AGREEMENT ON IMPORT LICENSING PROCEDURES

NOTIFICATION UNDER ARTICLE 5.1-5.4 OF THE AGREEMENT1

PHILIPPINES

The following notification, dated 3 November 2016 is being circulated at the request of the delegation of the Philippines.

1. (a) Title / number / date of the law or regulation establishing / changing the import licensing procedure: • Republic Act No. 10591 dated 29 May 2013 and its IRR dated December 2013 – An Act Providing for a Comprehensive Law on Firearms and Ammunition and Providing Penalties for Violations Thereof, otherwise known as the “Comprehensive Firearms and Ammunition Regulation Act”. • R.A. No. 9516 - (An Act Further Amending the Provisions of P. D. No. 1866, as Amended, Entitled Codifying the Laws on Illegal/Unlawful Possession, Manufacture, Dealing in, Acquisition or Disposition of Firearms, Ammunition or Explosives or Instruments Used in the Manufacture of Firearms, Ammunition or Explosives, and Imposing Stiffer Penalties for Certain Violations thereof and for Other Relevant Purposes) dated 22 December 2008. • Implementing Rules and Regulations on Controlled Chemicals pursuant to Section 4-C to 4-F of PD 1866 as Amended by RA No. 9516 dated June 9, 2016 • Presidential Decree No. 1866 dated June 29, 1983 – Codifying the Laws on Illegal/Unlawful Possession, Manufacture, Dealing In, Acquisition or Disposition of Firearms, Ammunition or Explosives, and Imposing Stiffer Penalties for Certain Violations Thereof and for Relevant Purposes. • Republic Act 8294 dated June 6, 1997 – An Act Further Amending the Provisions of Presidential Decree No. 1866, as Amended, entitled “Codifying the Laws on Illegal/Unlawful Possession, Manufacture, Dealing in, Acquisition or Disposition, of Firearms, ammunition or Explosives, and Imposing Stiffer Penalties for Certain Violations Thereof and for Relevant Purposes. • Executive Order No. 522 (Prescribing Rules and Regulations for the Control and Supervision of the Importation, Sale and Possession of Chemical Used as Ingredients in the Manufacture of Explosives and for Other Purposes) dated 26 June 1992. (b) If the notified measure refers to a change in an already notified import licensing procedure, please indicate the document symbol of the notification to which change(s) has(ve) been introduced. (In this case please also indicate in Section 3, below, the nature of the changes (i.e. inclusion or exclusion of some goods and a list thereof; contact point for information and/or administrative body(ies) for submission of applications, etc.)):

2. Abbreviations should be avoided. In the case of a long list of products, please attach the list as an Annex in Microsoft Word or compatible software. Please do not use PDF, or photocopies.) i. Chemical and accessories refer to chlorates, , nitric acid and such other chemicals and accessories that can be used for the manufacture of explosives and explosive ingredients; xiii. Mineral or chemical fertilizers, nitrogenous; xiv. Mineral or chemical fertilizers containing two or three of the fertilizing elements nitrogen, phosphorous and potassium; other fertilizers; goods of Chapter 31 of the AHTN in tablets or similar forms or in packages of a gross weight not exceeding 10 kg.; xv. Propellant powder; prepared explosives other than propellant powder; safety fuses; detonating fuses; percussion or detonating caps; igniters; electronic detonators; fireworks, signalling flares, rain rockets, fog signals and other pyrotechnic articles; matches other than pyrotechnic articles.

All business entities who intend to engage in the exportation or importation of the commodities are required to secure the appropriate license first, either license to deal or manufacture before they may be allowed to apply for an export or import permit.

In addition, aside from the completeness of the requirements for the export or import permit, an evaluation or risk assessment is being conducted prior to endorsement for approval.

(h) Expected duration of the licensing procedure if this can be estimated with some probability, and if not, reason why this information cannot be provided • 24 days period is the normal processing time for the approval of application for import and export of No. 2(a) i to ix above. • 3 days is the processing time for application of export of not more than 5 per type of firearm or not exceeding 10,000 rounds intended for sample, test and evaluation, demonstration or trade exhibit.

3. Other relevant data or information: (i.e. complete title and data concerning the legislation, inclusion or exclusion of certain products from the import licensing regime and list thereof; changes related to the administrative body(ies) for submission of applications, etc.) All goods listed in No. 2(a), i to xv, requires the issuance of appropriate License or Permit to the Firearms and Explosives Office, Civil Security Group, prior to actual import, export or usage.
