Election Division Presidential Electors FAQ Q1: How many presidential electors does Indiana have? What determines this number? Indiana currently has 11 presidential electors. Article 2, Section 1, Clause 2 of the Constitution of the United States provides that each state shall appoint a number of electors equal to the number of Senators or Representatives to which the state is entitled in Congress. Since Indiana has currently has 9 U.S. Representatives and 2 U.S. Senators, the state is entitled to 11 electors. Q2: What are the requirements to serve as a presidential elector in Indiana? The requirements are set forth in the Constitution of the United States. Article 2, Section 1, Clause 2 provides that "no Senator or Representative, or person holding an Office of Trust or Profit under the United States, shall be appointed an Elector." Section 3 of the Fourteenth Amendment also states that "No person shall be... elector of President or Vice-President... who, having previously taken an oath... to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. Congress may be a vote of two-thirds of each House, remove such disability." These requirements are included in state law at Indiana Code 3-8-1-6(b). We are a young nation and nothing can be taken for granted. If our institutions are maintained in their integrity, and if change shall mean improvement, it will be because the intelligent and the worthy constantly generate the motive power which, distributed over a thousand lines of communication, develops that appreciation of the standards of decency and justice which we have delighted to call the common sense of the American people.’ Hughes in 1909 ‘Our institutions were not designed to bring about uniformity of opinion; if they had been, we might well abandon hope.’ Hughes in 1925 ‘While what I am about to say would ordinarily be held in confidence, I feel that I am justified in revealing it in defence of the Court’s integrity.’ Hughes in the 1940s In early 1927, ten years before his intervention against the court-packing plan, Charles Evans Hughes, former Governor of New York, former Republican presidential candidate, former Secretary of State, and most significantly, former Associate Justice of the Supreme Court, delivered a series 18 history in the making vol. 3 no. 2 of lectures at his alma mater, Columbia University, on the subject of the Supreme Court.1 These lectures were published the following year as The Supreme Court: Its Foundation, Methods and Achievements (New York: Columbia University Press, 1928). -

Anyone interested in collecting a bookshelf of serious reading on the various Chief Justices of the United States is struck at the outset by the relative paucity of materials available. Among the studies of the Chief Justices of the twentieth century there is King's Melville Weston, Fuller,' which, while not definitive, is reliable and adequate enough to have merited reprinting in the excellent paperback series being edited by Professor Philip Kurland of the University of Chicago. -

BALKIN* John Marshall’s greatness rests on a relatively small number of Supreme Court opinions, of which the most famous are Marbury v. Madison,1 McCulloch v. Maryland,2 and Gibbons v. Ogden.3 Beyond these are a number of less famous but also important cases, including his opinions in the Native American cases,4 Fletcher v. Peck,5 and Dartmouth College v. Woodward.6 What makes Marshall a great Justice? One feature is certainly his institutional role in making the U.S. Supreme Court much more important to American politics than it had been previously. That is a function, however, of the sorts of cases that were brought before the Court, and of the opinions he chose to write. Further reproduction prohibited without permission. ABSTRACT This dissertation examines the U.S. wartime presidential campaign of 1944. In 1944, the United States was at war with the Axis Powers of World War II, and Democrat Franklin D. Roosevelt, already serving an unprecedented third term as President of the United States, was seeking a fourth. Roosevelt was a very able politician and-combined with his successful performance as wartime commander-in-chief-- waged an effective, and ultimately successful, reelection campaign. Republicans, meanwhile, rallied behind New York Governor Thomas E. Dewey. Dewey emerged as leader of the GOP at a critical time. Since the coming of the Great Depression -for which Republicans were blamed-the party had suffered a series of political setbacks. Republicans were demoralized, and by the early 1940s, divided into two general national factions: Robert Taft conservatives and Wendell WiIlkie "liberals." Believing his party's chances of victory over the skilled and wily commander-in-chiefto be slim, Dewey nevertheless committed himself to wage a competent and centrist campaign, to hold the Republican Party together, and to transform it into a relevant alternative within the postwar New Deal political order. -

LASH* ALICIA HARRSON** In 1799, the Federalist minority of the Virginia House of Delegates produced an extended defense of the Alien and Sedition Acts. This Minority Report responded to Madison's famous Virginia Resolutions and efforts by Virginia Republicans to tar the Adams Administration with having exceeded its powers under the federal Constitution. Originally attributed to John Marshall by biographerAlbert Beveridge, recent biographies of Marshall have omitted the episode or rejected Beveridge's claim and the current editors of the Papers of John Marshall omitted the Minority Report from their multi-volume collection of Marshall's work. What was once an assumed (if controversial) episode in Marshall's career has disappeared from otherwise exhaustive accounts of his life and work. As in Philip K. Dick's story, Minority Report, an alternate view of events has been unceremoniously erasedfrom the official record. The authors of this Article challenge the decision to remove Marshall's name from the Minority Report. Marshall was the only person named at the time as the probable author, and Marshallhad both reason and opportunity to draft the Address. The arguments of the Report not only track Marshall's views on the Constitution, they utilize constitutional arguments that were * Professor of Law and W. DEFINING THE OFFICE: JOHN MARSHALL AS CHIEF JUSTICE † CHARLES F. HOBSON Credit for making the United States Supreme Court a significant player in the American scheme of government has been attributed to the masterful leadership of John Marshall, Chief Justice of the United States from 1801 to 1835. By the latter year, the Supreme Court had acquired a kind of parity with Congress and the Executive that it did not possess in 1801. Central to this development was the Court’s ap- propriation of the Constitution as its special preserve. Marshall and his brethren built up the Court’s institutional strength by successfully asserting a claim to expound the Constitution and apply it as law in the ordinary course of adjudication. Although the Chief Justice’s con- tribution to this enterprise far exceeded his proportional share as a single Justice, scholarship has long since exploded the myth of a he- roic Marshall who dominated the Supreme Court by the sheer force of his individual genius and will. Such a myth ignores the historical real- ity that Marshall’s success as Chief Justice resulted from the interplay between his exceptional leadership abilities and the peculiar circum- stances of time and place that allowed those abilities to flourish and have effect. “A great man,” Oliver Wendell Holmes famously said, “represents a great ganglion in the nerves of society, or, to vary the figure, a strategic point in the campaign of history, and part of his greatness consists in his being there.”1 Marshall, in short, was the right man in the right place at the right time. -

Madame Secretary: Old Wine in a New Bottle December 11, 2008 by Dr. G. Terry Madonna and Dr. Michael Young Why did she do it? Why did Hillary Clinton agree to become secretary of state in an Obama administration? Many believe it effectively ends any presidential aspirations she may have, locks her into a thankless bureaucratic role, and ultimately shunts her toward obscurity in an administration likely to focus on domestic issues and the economy. Equally important, it forces her to give up an independent political voice as a high profile U.S. Senator and tethers her to Obama’s fate and fortune. Has she exchanged the role of presidential comer for the role of political goner? This perhaps harsh view is held by many political watchers shocked at Hillary’s decision to join the Obama cabinet. They believe she is preparing to totter off the national political stage at the end of four years or so and enter a well-earned retirement along with her already “well-retired husband.” Former secretaries of state often carry illustrious names with them into retirement. In the modern era these have included names like Kissinger, Dulles, and Marshall but almost never do they entertain presidential candidacies. Even the hard driven William Jennings Bryan, three-time nominee of his party, never tested national politics again after serving as Wilson’s secretary of state. More recently the only ex-secretary of state to try presidential politics was Alexander Haig, who ran a short, failed campaign in 1988. Former secretaries of state have accomplished many things, but none of them in modern times has included a successful presidential nomination.
