on the Traffic in Opium and other Dangerous Drugs.

The Secretary-General has the honour to circulate the attached report for the information of the States Members and non-Members of the League, and the Advisory Committee on Traffic in Opium and other

A. GENERAL,

1. Supreme Decree of December 6th, 1929 determining the functions of the General Directorate of Public Health and of

the Customs Administration in regard to the importation, registra­

tion and sale of and permits for the products referred to in

the Supreme Decrees of May 19th, 1928 and September 21st, 1929.

Supreme Ordinance concerning the protection of national pharmaceutical products.

2. Regulation of imports and exports.. (a) Exports. No drugs are exported, as none are

manufactured in Bolivia.

(b) Imports. Applications for permits tc import drugs must be made to the General Directorate of Public Health

on stamped paper of 1 Bolivian peso, the name and quantity of

the product, place of import and name of the importer being

given. If the importation of the drugs is authorise^ the

National Bax Collecting Agency is informed and the latter instruct

the Customs Offices to allow the products in question to be

Any person dealing in drugs must be a qualified chemist duly authorised by the Ministry of Education; permits to import the narcotics required will be granted by the General Directorate of Public Health on presentation of the balance of the importer’s stock of drugs in hand at the time, to enable the total stocks to be accurately checked.

Sale of Drugs.

Wholesalers may only sell drugs to pharmacists, or managers of pharmacies duly authorised by the General Directorate of Public Health by a special permit in each case; to scientific establishments against a request in writing from the director of the establishment, and subject to the previous authorisation of the General Directorate of Public Health, or to druggists re­ gistered with the Ministry of Education as importers or dealers.

Pharmacists may not sell to the public any drugs classified under the heading ’’Imports” or pharmacuetical preparations made from those products without a prescription from a qualified medical practitioner, stating in legible characters the full name and address of the doctor and of the patient. These prescriptions must be entered in full in a special book to be kept by pharmacies.

Importers or dealers in drugs must send a quarterly

-eport to the General Directorate of Public Health, giving full particulars of the class and quantities of alkaloids sold, and mentioning the pharmacies or establishments to which these products were sold. Pharmacists must also send a quarterly statement of their sales, mentioning the class and quantity of drugs sold and the number of prescriptions made up.

DISTRIBUTION AKD USE OF DRUGS.

PENALTIES: Any person dealing In drugs or importing, exporting, keeping in stock, preparing, buying, selling or supplying these products in any other manner, even free of charge, without a previous authorisation, will be sentenced to a term of rigorous imprisonment (prision correccional) varying from six months to one year, and to a fine of not less than Bs.3,000 or more than

Es.5,000. A similar penalty will be imposed on chemists supplying drugs to the public without a medical prescription, or in a larger quantity than that specified in the prescription, and on persons who endeavour to obtain drugs by means of false or cancelled prescriptions or prescriptions which have already been made up. Druggists, pharmacists, hospitals and in general any persons authorised to import, stock, export and sell drugs who fails to keep a register will be required to pay a minimum fine of 3s.1 ,000. Pharmacists repeating a prescription without the doctor's authorisation will be fined Bs.500. If the offender is a foreigner, the Law relating to Residence will be applied in addition to these penalties.

It is necessary to determine the functions of the

General Directorate of Public Health and of the Customs Adminis­ tration in regard to the registration and sale of and permits to import the pharmaceutical specialities or patent medicines referred to in the Supreme Decrees of 11ay 15th, 1928, April 25th and September 21st of this year:

HEREBY DECREES: Article 1. The General Directorate of Public Health attached to the Ministry of the Interior shall be responsible for the registration of narcotics arid proprietary remedies or patent medicines and for the issue of import permits in respect thereof, entrusted to the General Directorate of Customs by the

Decree and Regulations of May 19th, 15 28 and the Supreme Decree of April 25th last.

article 2. The General Directorate of Public Health shall notify the management of the national Tax Collecting Agency in writing, for purposes of Customs clearance, of the registra­ tion of or permission to import any narcotics, pharmaceutical specialities or patent medicines.

Article 5. The Eational Tax Collecting Agency shall s - -id to the General Directorate of Public Health xull pax'ticu— larg of all pharmaceutical specialities or patent medicines - 13 - registered, by the General Directorate of Customs or the

IT?.tional Tax Collecting Agency, for insertion in the general register.

Article 4. applications for permits to import narcotics and drugs containing the alkaloids specified in the Decree and Regulations of Hay 15th, 1528 must be made to the General Directorate of Public Health.

The Bolivian Customs and post offices authorised to inspect goods and assess their value shall not allow narcotics and drugs containing the alkaloids specified in the Decree and Regulations of May 15th, 1528 to be cleared unless the documents are accompanied by the respective import permits ; neither shall they allow the clearance of pharmaceuti­ cal specialities or patent medicines which have not been registered by the General Directorate of Public Health.

May 19th, 1528 which are imported without the relevant permit shall be seized and the offenders dealt with in accordance with the provisions of the Customs laws.

Article 7. a 11 the other provisions laid down in the Regulations of May 15th, 1528 and the Supreme Decrees of April 25th and September 21st of this year, shall remain in force and the General Directorate of Public Health shall be responsible for their application.

SUPREME ORDINANCE CONCERNING THE PROTECTION

OF NATIONAL PHARMACEUTICAL PRODUCTS.

Ministry of Education - - La Paz, May 17th, 1930.

In view of the necessity of protecting howe industries and whereas certain pharmaceutical products, drugs and narcotics of similar quality to those imported from abroad are now produced in Bolivia

IT IS HEREBY DECREED THAT: The Customs duties on the following products intended for injection shall be increased by fifty per cent (50$): strychnine sulphate with spartein, strychnine sulphate, spartein (sulphate), sodium (citrate), quinine hydrochloride 2f0, adrenalin, gomenolated oil, strychnine nucleinate (neonofnol), anhenal, hydrochloride of apomorphine, atropin, sodium nucleinate, camphorated oil, imidosuccinic mercury, novocain hydrochloride, hydrochloride of diaminomethyl acridine (hypo- flavine), cyanide of mercury, Bonjean1s ergotine, morphine, opium for injection purposes, caffeine, hydrated oxide of bismuth, bismuthous iodide of quinine, citro-oismuth, apomor­ phine, sodium nucleinate 50$ (protein-therapy).
