Call to Order: The Vice Chair called the meeting to order at 8:31 a.m. at which time quorum was established.

The Vice Chair announced that the Chair was running late so we will defer his report until he arrives and asked the audience to introduce themselves.

Upon a motion by Ms. Daub, seconded by Ms. Stone Murai, it was voted on and unanimously carried to approve/accept the recommendations from the Education Committee’s October 3, 2019 meeting.

Executive Officer’s Conferences/Seminars/Meetings Report: Boards and Commissions Member Orientation, October 11, 2019, 8:30 – 12:00, State Capitol Auditorium Ms. Oliveira gave a brief report on her attendance at the orientation stating that it was very informative and well worth the ½ day.

2019 Renewal – Status Report

Continuing Competency The EO reported that a total of 1, 221 audit letters were mailed out on October 31, 2019 (Halloween) that breaks down as follows:

• 51 – APRNs • 82 – LPNs • 1,088- RNs

She reported that the Board’s office is receiving quite a lot of phone calls from nurses who received the audit letter asking if they can submit copies of their completion certificates, unofficial transcripts that indicates at least 2 semester credit hours, etc.

She also stated that the nurses have sixty (60) days to respond to the audit request. A list of nurses who were selected for the audit, is now posted on the Board’s web page.

Finally, she expressed her concerns with the number of audit letters that are being returned by the post office indicating a “new” address for the nurse. She stated that another letter will go out to these nurses that will also include language that states it is a violation of the licensing laws for failure to notify the Board of a change of address.

Criminal History Background Check The EO reported that a total of 8,391 nurses licensed prior to July 1, 2017 were randomly selected to be fingerprinted for the 2019 renewal and that 3,061 notified us via their MyPVL account that they went to get fingerprinted, 3,491 nurses on the list renewed but did not notify us that they went to get fingerprinted and 1,857 did not renew.

She stated that should any of the nurses selected for fingerprinting try to restore their license, they will be subject to complete the fingerprint requirement before their license can be restored.

Chair’s Report: 2019 NCSBN Leadership & Public Policy Conference, October 2-4, 2019, Atlanta, GA – Report on Attendance The Chair provided a written report on the conference and gave a brief verbal report.

Approval of the Previous Minutes – October 3, 2019 The Chair called for a motion in regard to the minutes.

Upon a motion by Ms. Oliveira, seconded by Ms. Stone Murai, it was voted on and unanimously carried to approve the minutes as circulated.

Executive Officer’s 2020 Legislation Report: APRNs Performing Aspiration Abortions The EO reported that she had a phone call with Planned Parenthood who wanted the Board’s position on HB 1434, also introduced in 2019, but was not scheduled for hearing.

She did a comparison sheet for the Board to see how HB 1434 and SB 415 compares since testimony was submitted on behalf of the Board recommending the following language be inserted into SB 415:

"§457- Advanced practice registered nurses; abortions by medication or aspiration. Notwithstanding any other law to the contrary, an advanced practice registered nurse may perform an abortion by medication or aspiration in the first trimester of pregnancy, so long as the nurse: (a) Has prescriptive authority; (b) Practices within the nurse’s practice specialty; (c) Completes a Board-approved Board of Nursing Minutes of November 7, 2019 Meeting Page 4

specified training program that includes a clinical component; and (d) Has a valid, unrevoked, and unsuspended license obtained in accordance with this chapter.”

The Board also previously determined, and which was verified by the Hawaii Medical Board that APRNs, practicing within their practice specialty, were allowed to perform abortions by medication.

The Board will wait to see a bill before taking a position.

Nurse Licensure Compact The EO reported that there is a possibility that the NLC bill may be resurrected for the 2020 Legislative session.

She reported that for the 2019 Legislative session, the Board’s testimony on the NLC bill expressed the following concerns:

• Inconsistent renewal requirements. For example, the Board requires mandatory continued competency to renew a license. Many NLC participating states do not have this same requirement. • It is unclear whether the Board may take disciplinary action against a multistate licensed nurse, as that nurse would not hold a license issued by the Board. • A multistate licensed nurse does not have to apply for or notify the Board that the nurse is practicing in this state. Thus, the Board is unclear how this will impact Hawaii’s nursing workforce needs. The Board and the Hawaii State Center for Nursing work collaboratively to address the nursing workforce to meet the needs of Hawaii residents. • It is unclear what the fiscal impact will be on the Board and the Department of Commerce and Consumer Affairs. Some states that have enacted the NLC have had to increase their license fees to compensate for their loss of revenue. The Board would like to ensure that its current licensees are not negatively impacted by a possible increase in fees to join the NLC.

The bill was amended to establish a task force to investigate the feasibility of joining and identify issues that may arise if the State joins the multistate NLC, however, the bill was not scheduled for hearing when it crossed over to the Senate.

The Board will wait to see if this legislation is resurrected.

Legislative Updates The Board noted the following bills introduced or new laws enacted in other states:

• 9/27/2019 Introduced PA H 1888 SUMMARY: Authorizes the Commonwealth to join the Nurse Licensure Compact.

• 10/11/2019 Enacted CA A 241 SUMMARY: Requires the Board of Registered Nursing and the Physician Assistant Board to adopt regulations requiring the curriculum for continuing education to include specified instruction in the understanding of implicit bias in treatment.

• 10/18/2019 Introduced PA H 1923 SUMMARY: Amends the Professional Nursing Law by authorizing the Board of Nursing to permanently revoke a license of a professional nurse for the theft of a controlled substance.

MedPage Today Article “Nursing Boards Failing at NP Oversight?” The article referred to a specific case of an FNP practicing in Texas who allegedly prescribed an excess amount of testosterone and thyroid medications. The article alleges that two patients of the this FNP had died. The article looked at how long it took the Texas Board to take action against the FNP. Ultimately, the article examined whether state boards of nursing can provide proper regulation and oversight to ensure patient safety with the rapid growth and increasing scope of practice of nurse practitioners.

Scope of Practice

CRNA Working With Dentists – Can CRNA Update Pediatric Patient’s History and Physical? The Board discussed the following email inquiry:

“I am a CRNA working at Kona Community Hospital and would appreciate your assistance in clarification of regulations. We do pediatric dentistry here with the patient's primary physician seeing them a week before their dental procedure for a physical exam. On the day of the procedure, the H & P needs to be updated. Are CRNA's, as the main anesthesia providers at this facility, allowed to update the H&P? Need clarification for Hawaii CRNA's working with dentists at inpatient and outpatient facilities.” Board of Nursing Minutes of November 7, 2019 Meeting Page 6

The Chair stated that the CRNA should do an assessment and referred to HAR §16-89-81 (c) The scope of practice for each of the four areas of clinical practice specialties shall be in accordance with nationally recognized standards of practice which are consistent with the following: (2) Certified registered nurse anesthetist scope of practice: (A) Be responsible for performing and documenting total anesthesia care of patient including, but not limited to, pre-anesthetic preparation and evaluation, requesting consultations and diagnostic studies, obtaining informed consent for anesthesia, and selection and administration of anesthetic agents or other agents administered in the management of anesthetic care, anesthesia induction, maintenance, emergence, and post anesthesia care;

The Board also referred to the following section in regards to the facility’s policies and procedures:

§457-1.5 Practice of nursing. (a) Nursing is a scientific process founded on a body of professional knowledge. It is learned profession based on an understanding of the human condition across the lifespan of a client and the relationship of a client with others and within the environment. It is also an art dedicated to caring for others. The practice of nursing means assisting clients in attaining or maintaining optimal health, implementing a strategy of care to accomplish defined goals within the context of a client-centered health care plan, and evaluating responses to nursing care and treatment. Nursing is a dynamic discipline that is continually evolving to include more sophisticated knowledge, technologies, and client care activities. Nursing applies evidence-based practice to promote optimal client outcomes. (b) The scope of nursing practices established in this chapter and by the rules of the board shall serve as general guidelines and are not intended to address the appropriateness of the use of specific procedures in any particular work setting or to grant permission to implement specific procedures in any particular work setting.

And also referred to the following section in regards to an advance assessment:

§457-2.7 Advanced practice registered nurse. (a) Practice as an advanced practice registered nurse means the scope of nursing in a category approved by the board, regardless of compensation or personal profit, and includes the registered nurse scope of practice. The scope of an advanced practice registered nurse includes but is not limited to advanced assessment and the diagnosis, prescription, selection, and administration of therapeutic measures including over the counter drugs, legend drugs, and controlled substances within the advanced practice registered nurse's role and specialty-appropriate education and certification.

(b) The advanced practice registered nurse's scope of practice supersedes the registered nurse's scope of practice. Advanced practice registered nurses shall practice within standards established or recognized by the board and be guided by the scope of practice authorized by this chapter, the rules of the board, and nursing standards established or recognized by the board including but not limited to: (1) The National Council of State Boards of Nursing Model Nursing Practice Act, Article II, Scope of Nursing Practice, Section 4; and (2) The National Council of State Boards of Nursing Model Nursing Administrative Rules, Chapter Two, Standards of Nursing Practice, Section 2.4.1; provided that NCSBN shall have no legal authority over the board and shall have no legal authority or powers of oversight of the board in the exercise of its powers and duties authorized by law. (c) An advanced practice registered nurse shall comply with the requirements of this chapter; recognized limits of the advanced practice registered nurse's knowledge and experience and planning for the management of situations that exceed the scope of authorized practice; and consult with or refer clients to other health care providers, as appropriate.

It was the consensus of the Board that a CRNA’s scope of practice does include an assessment of the patient that would cover an update on the patient’s history and physical.

Hawaii State Center Ms. Reichhardt reported on the following: for Nursing: • The HSCFN has received ANCC accreditation to be a CE provider; • The Leadership in Action Workshop is November 14-15; • As of right now the Center does not have any Legislative initiatives; • The Workforce Supply report is scheduled to be released early December; • They received a Governor Proclamation naming November 10-16, 2019 as Nurse Practitioner Week

Hawaii-American No report. Nurses Association:

Hawaii Association of Mr. Kuo reported on the following: Professional Nurses: • HAPN’s renewed focus is on APRN and advanced degree nursing. They would like to network their members. A strong need for people to learn about business practices, networking with one another and being able to refer to one another. • HAPN spear headed the Medical Director Bill which they will be working with the Department of Health in creating the language.

• HAPN joined the ENP network, which is a national network that allows individual organizations to have a presence yet be networked together. The ENP network allows HAPN to significantly improve membership engagement which in turn yields better turnouts at their events. In addition, they provide support to preceptors and preceptees so they can link up with one another. Lastly, the website includes job openings and postings. • J.P. Moses will be the next president for HAPN.

Chapter 91, HRS - At 9:33 a.m., the Chair called for a recess of the meeting to discuss and Adjudicatory Matters: deliberate on the following adjudicatory matter:

Following the Board’s review, deliberation, and decision in these matters, pursuant to Chapter 91, HRS, the Chair announced that the Board was reconvening its scheduled meeting at 9:41 a.m.

Executive Session: At 9:41 a.m., upon a motion by the Vice Chair, seconded by Ms. Kodama, it was voted on and unanimously carried to move into Executive Session in accordance with HRS, 92-5(a) (1), “To consult with the board’s attorney on questions and issues pertaining to the board’s powers, duties, privileges, immunities, and liabilities”.
