Resolution No. R18-33 a Resolution of the Council of the City of Glendale, Maricopa County, Arizona, Expressing Support For RESOLUTION NO. R18-33 A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, EXPRESSING SUPPORT FOR THE ARIZONA SUPER BOWL HOST COMMITTEE’S BID TO HOST SUPER BOWL LVII AND OTHER OFFICIAL EVENTS IN 2023. WHEREAS, the National Football League (the “League”) owns, produces and controls the annual professional football championship game known as the “Super Bowl”; NFL Properties LLC (“NFLP” or, together with the League, the “NFL”) owns, produces and controls the “Super Bowl Experience”; and, along with other NFL Affiliates, including On Location Experiences (“OLE”) owns, produces and controls certain other events associated with the Super Bowl, including the Pro Bowl (“Official Events”); and WHEREAS, the City of Glendale, Arizona (the “City”) has within its jurisdiction facilities and premises, roads, thoroughfares and other areas and assets that may be used for the purposes of organizing, promoting, accommodating, staging, and otherwise conducting Super Bowl LVII and its related Official Events and activities; and WHEREAS, hosting the Super Bowl and its Official Events will generate goodwill, enhance the worldwide renown and prestige of the State of Arizona and City of Glendale, create temporary jobs and create substantial beneficial economic, tourism, and fiscal activity; and WHEREAS, the NFL has requested a declaration of support from the City of Glendale concerning its support for the Arizona Super Bowl Host Committee’s (the “Host Committee”) bid to host Super Bowl LVII and its related Official Events; and, concerning the performance of various general government services in connection with Super Bowl LVII and its Official Events; and WHEREAS, the Arizona Department of Public Safety is officially charged with the responsibility to provide public safety services inside the University of Phoenix Stadium and on parking lots controlled by the Arizona Sports and Tourism Authority (AZSTA) during events; and WHEREAS, the City of Glendale Police Department is officially charged with the responsibility to provide public safety services throughout the City’s jurisdiction; and WHEREAS, the University of Phoenix Stadium manager, as an agent of the AZSTA, is officially charged with the responsibility of provisioning emergency medical services inside the University of Phoenix Stadium and on the parking lots controlled by the AZSTA during events; and WHEREAS, the City of Glendale Fire Department is officially charged with the responsibility to provide fire and emergency medical services throughout the City’s jurisdiction; and WHEREAS, City of Glendale Resolution No. R17-100, authorizes the City Manager to execute any number of Form License Agreements for the non-exclusive, limited duration, temporary use of city-owned or controlled property upon a finding that it is in the city’s best interest to do so and would have the ability to execute said Form License Agreements in support of Super Bowl LVII or Official Events; and WHEREAS, Glendale City Code, Chapter 29.2 Special Events authorizes the City Manager to define a specified area surrounding a large special event within which commercial activity on a public facility shall be restricted in order to protect the health, safety, and welfare of event attendees and preclude deceptive business practices and would have the ability to execute an administrative regulation to temporarily restrict commercial activity near the event venue; and WHEREAS, in order to ensure the health, welfare, and safety of the public in conjunction with national and international events taking place in our jurisdiction, the City of Glendale routinely cooperates with the Department of Homeland Security and the Federal Aviation Administration (“FAA”) to enact appropriate temporary flight restrictions (“TFRs”) applicable to aircraft over and around the University of Phoenix Stadium in the city’s jurisdiction and to restrict the air space controlled by the general aviation tower at the Glendale Municipal Airport; and WHEREAS, as part of the formal bid of the State of Arizona to be designated as the site for Super Bowl LVII and its related Official Events and in anticipation of accommodating arriving Super Bowl visitors in Arizona, the City Council of the City of Glendale hereby expresses its support for Super Bowl LVII and its Official Events; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GLENDALE as follows: SECTION 1. That the City of Glendale welcomes Super Bowl LVII and its Official Events to its jurisdiction and to that end declares its full support of the efforts of the Host Committee to have Glendale, Arizona selected as the site for Super Bowl LVII. SECTION 2. That upon designation of the local region as the site for Super Bowl LVII and its Official Events, the City and its agencies, departments, and personnel are authorized consistent with the Recitals above, where applicable, and to the extent otherwise permitted by law to provide all governmental services (including, but not limited to, ambush marketing protections, permitting, facilitating the use of signage and street pole banners, providing a dedicated citywide liaison, traffic control operations, public safety support, emergency medical services, and emergency preparedness services, cooperation with the FAA for the implementation of TFR’s , working with private entities to provide high level service and access to the Glendale Municipal Airport and its assets, and use of certain City- controlled venues for Super Bowl LVII, Official Events and other NFL, OLE and Host Committee sanctioned activities) which are reasonably necessary for the success of Super Bowl LVII and Official Events held within its jurisdiction (recognizing the uniqueness and extraordinary scope of the Super Bowl LVII and the Official Events, such services are below, equal to, or beyond the normal level and range of governmental services usually provided for events held within the City), all at no cost, expense or liability to the NFL, OLE, the Host Committee, or the participating teams. SECTION 3. That the City and Host Committee will work in good faith to make available, provide for and coordinate the actual services generally described in Section 2 with the intent to insure the success of Super Bowl LVII and the Official Events. SECTION 4. That the City and Host Committee intend to negotiate a marketing agreement following the award of Super Bowl LVII to Arizona that will include both in-kind and monetary contributions subject to Council approval in exchange for mutually agreed upon benefits. SECTION 5. That the City Manager or designee and the City Clerk be authorized and directed to execute and deliver any and all documents necessary to effectuate said support on behalf of the City of Glendale.
