1 1. Project Description

a. Project number (State and Federal): P-91-446-09

b. Project Name: Illinois Route 31 (IL 31) at Miller Road

c. Location: Dundee Township, Kane County, Illinois

d. Project Termini: Along IL 31, the project limits are from just south of Commerce Parkway to 650 feet north of Miller Road. Along Miller Road, the study limits extend 175 feet west of IL 31.

e. Project Type: W&RS and Channelization. The scope of work includes widening and resurfacing IL 31 to provide a northbound left turn lane, a shared-use path on the west side of IL 31, and drainage improvements.

f. Project Length: 0.47 miles

g. NEPA Class of Action: Categorical Exclusion Group II.

h. Purpose and Need Summary: The purpose of the proposed action is to improve safety, capacity and operations at the IL 31 and Miller Road intersection. The lack of a northbound left turn lane at Miller Road results in stopped traffic in the through lane. Over 80 percent of crashes at this intersection are rear-end type, which is indicative of inadequate intersection channelization. The roadway ditch along the west side of IL 31, south of Miller Road, is inadequate and results in a drainage problem.

i. Project Status: The Illinois Department of Transportation (IDOT) is performing a preliminary engineering and environmental study (Phase I) and is anticipated to be completed by the end of 2014. Contract plan preparation and land acquisition (Phase II) and construction (Phase III) are included in IDOT’s FY 2015-2020 Proposed Multi-Modal Transportation Improvement Program. Current engineering efforts are targeted to enable a contract letting in the early portion of the current multi-year program contingent upon plan readiness, land acquisition, and funding availability through future annual legislative appropriations.

2. Section 4(f) Resources

b. Resource Name: Raceway Woods Forest Preserve and Brunner Family Forest Preserve

c. Official with Jurisdiction: Forest Preserve District of Kane County (FPDKC)

2 d. Description of role/significance in the Community:

Raceway Woods Forest Preserve: The site is located southwest of the IL 31 and Miller Road intersection and includes 122 acres of open space and recreational uses. The preserve’s name is from the Meadowdale International Raceway which previously occupied the property. The preserve was acquired in 2002 and carries an Illinois Department of Natural Resources easement. The preserve is part of a larger 366 acre complex situated in the middle of Dundee Township called "The Greater Raceway Woods". The Dundee Township Park District (DTPD) owns the western part of the Raceway Woods and FPDKC owns the natural areas in the eastern part. The preserve has been developed to provide active recreational opportunities and amenities including a parking lot, hiking, historic sites, picnic areas, shelters, biking, and horseback riding. The FPDKC manages the natural areas while the DTPD maintains the buffer parking, picnic and recreational areas. See Attachment B‐2 for an aerial map of the Raceway Woods Forest Preserve.

Brunner Family Forest Preserve: The site is located along the east side of the IL 31 and includes 741 acres of open space. The preserve was acquired in 2008 by the FPDKC and includes riverfront, wetlands, fens and woodlands. The preserve is currently undeveloped, but is planned to be developed and its size increased to over 1,000 acres to provide additional facilities such as multi-purpose trail, parking lot, restroom and shelter. As part of the mitigation for the project, Kane County Division of Transportation (KCDOT) is acquiring and transferring 10 acres of the preserve to the DTPD for the development of sports field complex. Access to the complex will be across from Miller Road. KCDOT also intends to acquire and transfer to IDOT the frontage of the DTPD parcel to 75 feet east of the IL 31 centerline. The frontage of the dedication extends approximately 957 feet along IL 31. See Attachment B‐3 for an aerial map of the Brunner Family Forest Preserve.

3. Description of intended Section 4(f) Resource Use

a. Type and Acres of Impact :

Raceway Woods Forest Preserve: 0.54 acre *

a. Fee Simple Acquisition: 0.10 acre for re-grading and maintenance of the roadside ditch.

b. Temporary Easement: 0.44 acre for grading along IL 31.

* The FPDKC requested the shared-use path along the west side of IL 31 between Commerce Parkway and Miller Road and will donate the additional 0.33 acre of temporary easement required for its construction.

Brunner Family Forest Preserve: 0.97 acre

a. Fee Simple Acquisition: 0.22 acre for reconstruction and maintenance of the roadway shoulder and concrete box culvert.

b. Temporary Easement: 0.75 acre for grading along IL 31 to meet existing ground.

3 b. Existing Function of Impacted Acres: The impacted areas are located adjacent to IL 31 and contain open space or trees and vegetation, and are located away from recreational uses and amenities. The resulting function of the impacted areas along IL 31 would be the same as its current use.

4. Description of Efforts to Avoid, Minimize, and Mitigate or Enhance Resource

a. Avoidance and minimization efforts made and benefits to resource: Roadway widening is required to construct the left turn lane and shared-use path. Shifting the alignment to avoid impacts could not be performed because the forest preserves are located along both sides of IL 31. To minimize tree removal within the heavily wooded Raceway Woods Forest Preserve and adjacent properties along the west side of IL 31, the roadway is proposed to be widened towards the open space along the east side of IL 31. To further minimize impacts within Raceway Woods Forest Preserve, the roadway ditch depth along the west side of IL 31 is proposed at only one foot, instead of three feet. The shoulders along both sides IL 31 are proposed as 8-feet wide in lieu of 10-feet. The project does not impact any areas that utilized conservation funding, such as OSLAD or LAWCON.

b. Commitments for mitigation or enhancement: At the request of the FPDKC, a shared-use path is proposed along the west side of IL 31 from Commerce Parkway to Miller Road to provide a connection for pedestrians and bicyclists between the Raceway Woods Forest Preserve and Brunner Family Forest Preserve. The FPDKC will provide the connection between the proposed shared-use path and the existing trail within Raceway Wood Forest Preserve. The FPDKC is constructing an internal trail parallel to the Fox River within Brunner Family Forest Preserve in 2014, and intends to construct a link from this trail to the IL 31 and Miller Road intersection. The FPDKC is applying for a permit with IDOT to provide a crossing with flashing lights along the south leg of the IL 31 and Miller Road intersection once the link is constructed.

The FPDKC will donate the additional temporary easement within Raceway Woods Forest Preserve to construct the shared-use path. Cost participation and long-term maintenance is required from FPDKC for the shared-use path. The local cost share is 20 percent of the construction cost plus a 15 percent engineering fee. The cost participation and maintenance requirements will be outlined in a Letter of Intent between IDOT and FPDKC at the end of the Phase I study. The agreement between the two parties will be prepared during Phase II.

5. Evidence of Opportunity for Public Review and Comment

a. Type of public availability: A newspaper ad will be posted in the Daily Herald on July 23, 2014 and August 6, 2014 to allow the public three weeks to review and comment on the Section 4(f) impacts (See attachment E). The comment period is from July 23, 2014 to August 13, 2014. The Section 4(f) documentation will be available for viewing during the three week period at IDOT (201 W. Center Court, Schaumburg, IL 60196), at FPDKC (1996 South Kirk Road, Suite 320, Geneva, IL

MEETING SUMMARY

Kane County Division of Transportation December 12, 2012

Kane County requested a meeting with IDOT to coordinate the required access needs for the new east leg of the IL 31 at Miller Road intersection. The following items were discussed:

1. As Section 4(f) mitigation for the Longmeadow Parkway project, Kane County Division of Transportation (KCDOT) is purchasing 10 to 20 acres of the Brunner Family Forest Preserve and dedicating it to Dundee Park District. A portion of that is being developed into a sports field complex which will have a new entrance along the east side of IL 31 across from Miller Road.

2. KCDOT is requesting a southbound to eastbound left turn into the complex. To facilitate this, KCDOT is securing a dedication along the east side of IL 31 for highway improvements. The dedication can be up to 75-feet measured from the IL 31 centerline. KCDOT has up to five acres to transmit to IDOT along IL 31 for this and future IL 31 projects. The dedication width shall be minimized for this project. KCDOT will provide IDOT copies of the dedication plats and intergovernmental agreement. KCDOT anticipates the dedication will be executed within a few months.

3. KCDOT provided conceptual drawings of the complex and information on the Longmeadow Parkway project. A traffic impact study has not been completed. The minimum design vehicle for the complex should be a bus.

4. IDOT suggested a northbound right turn lane be provided into the complex. KCDOT offered to cost participate if this is beyond the project’s budget.

5. The IL 31 at Miller Road project has an updated design approval date of May 31, 2013 and a 06CY14 letting. The project will use STP funds. The Longmeadow Parkway project has a design approval date in February 2013.

6. KCDOT does not foresee a need for an off-street shared-use path along IL 31 as part of this project.

7. The IL 31 at Miller project will also have Section 4(f) impacts along the west side of IL 31 within the Raceway Wood Forest Preserve. KCDOT offered to coordinate a meeting between IDOT and Kane County Forest Preserve District.

8. KCDOT will need to coordinate the new entrance with IDOT/Permits.

9. IDOT will provide KCDOT a preliminary plan in January 2013.

MEETING SUMMARY Kane County Division of Transportation and Forest Preserve District of Kane County September 6, 2013

The purpose of the meeting was to discuss impacts to Forest Preserve District of Kane County (FPDKC) properties and coordination with Kane County Division of Transportation (KDOT) resulting from the Longmeadow Parkway project. The following items were discussed:

1. The proposed improvement is anticipated to consist of widening and resurfacing IL 31 to provide left turn channelization onto Miller Road. The scope has been revised to provide left and right turn lanes into the new Brunner Family Forest Preserve/Dundee Township entrance.

2. Within the project limits, FPDKC’s Raceway Woods Forest Preserve (RWFP) and Brunner Family Forest Preserve (BFFP) exist along the west side and east side of IL 31, respectively.

3. There are drainage problems south of Miller Road along the west side of IL 31 due to a lack of a defined roadway ditch. A temporary easement (TE) is required along RWFP 300 feet beyond the roadway limits to establish a ditch to an existing culvert. The TE is needed to for grading the backslope and will require tree removal. IDOT is performing a tree evaluation for the projection. The ditch bottom will be within the existing right-of-way (ROW).

4. Within BFFP, the proposed ROW will be established at 75 feet to the east of the IL 31 centerline, which is the location where the Dundee Township facility will begin. The proposed limits of the new east leg of the IL 31 at Miller Road intersection shall be offset from the proposed ROW so a temporary easement is not required. KDOT will acquire the proposed ROW within BFFP and convey to IDOT in return for IDOT constructing new east leg and the left and right turn lanes into it.

5. OSLAD or LAWCON funds were not used for the FPDKC land needed for this improvement. OSLAD will be used to develop the Dundee Township facility.

6. As described, FPDKC does not foresee the proposed improvement as having adverse impacts to the preserves. The improvement of traffic operations along IL 31 will be a benefit to the preserves. The Section 4(f) impacts appear to be ‘temporary occupancy’, but IDOT will discuss with the Federal Highway Administration later this month. If agreed, IDOT will send a letter to the FPDKC requesting concurrence for no adverse impacts.

7. The FPDKC noted that the Village of Carpentersville is pursuing a traffic signal at IL 31 at Commerce Drive. Subsequent to the meeting, IDOT confirmed that a traffic signal at either Commerce Drive or Miller Road will require two lanes in each direction separated with a median along IL 31.

8. The existing field entrance to BFFP shall be removed. The new entrance across from Miller Road will provide access to the property.

9. The FPDKC would like to connect the two preserves. The preferred accommodations would include a shared-use path along the west side of IL 31 and a crossing at a signalized IL 31 and Miller Road intersection once IL 31 is widened to two lanes in each direction. In the interim, FPDKC could coordinate an unsignalized crossing with IDOT/Permits by contacting Tom Gallenbach at (847) 705-4130. Subsequent to the meeting, IDOT /Traffic noted crosswalk markings, a raised pedestrian median refuge, and flashing lights could be required and would be need to be installed by FPDKC upon completion of this improvement. The unsignalized crossing would be removed once the preferred accommodations were provided.

10. IDOT will add a Special Design and Construction Consideration to the Project Report to coordinate with the FPDKC on tree replacement types and locations.

11. The Phase I study is anticipated to be completed by the end of 2013. The target letting is in 2015.

This was the third presentation of this project. The last presentation was on January 16, 2013. The purpose of the meeting was to provide an update on the project and to present additional Section 4(f) impacts.

As Section 4(f) mitigation for the Longmeadow Parkway project, Kane County Division of Transportation (KDOT) is purchasing a portion of Brunner Family Forest Preserve east of the intersection to dedicate to the Dundee Township Park District for the sports complex. As part of the dedication to the Park District, KDOT will dedicate a 75’ right-of-way on the east side of IL 31 (measured from the IL 31 centerline) to IDOT for widening of IL 31. The purchase has not occurred and Section 4(f) documentation is required. Since the acquisition will be proposed right-of-way, the impacts will be considered de minimis.

On the west side of IL 31, back slope grading for the roadway ditch will require a Section 4(f) Temporary Occupancy letter for work within the Raceway Woods Forest Preserve. The ditch bottom will remain within the existing right-of-way. These impacts will be included in the de minimis documentation. An ESR addendum will be required to extend the ditch grading south to create a ditch that extends to the existing culvert approximately 300 feet south of the improvement limit.

A meeting was held with KDOT and Kane County Forest Preserve District (FPDKC) earlier this month and FPDKC concurs with the impacts and believes the project will be a benefit to the preserves.

An existing four-foot high by five-foot wide box culvert (SN 045-0266) is located south of the intersection and has a sufficiency rating of 22.4. The culvert is proposed to be replaced and will be extended to accommodate a future shared-use path along the west side of IL 31 that would connect the two forest preserves once the IL 31 at Miller Road intersection becomes signalized.

The purpose of this meeting was to introduce the project to the Village of Carpentersville (VoC) and the Dundee Township Park District (DTPD and discuss the impacts of the project to their respective properties and to the properties of the Forest Preserve District of Kane County (FPDKC).

1. The purpose of the project is to widen and resurface IL 31 to provide for a northbound left turn lane to Miller Road. A southbound left turn lane to the future DTPD sports complex and a northbound right turn lane to the sports complex is also proposed as requested by KCDOT.

Drainage improvements include a new storm sewer on the west side of IL 31 to convey offsite runoff to the existing culvert south of Commerce Drive. Another proposed storm sewer on the west side of IL 31 will convey the runoff from the Miller Road intersection to the culvert 320’ south of the intersection. Due to poor condition this culvert will be replaced. The east side of IL 31 will sheet flow offsite as it currently does.

2. DTPD stated that the sports complex will not be constructed until the intersection is signalized. A five-lane cross section along IL 31 is required to permit signal

installation at the IL 31/Miller Road and at IL 31/Commerce Drive. A permit will need to be obtained from IDOT for the new entrance. DTPD should contact Tom Gallenbach at (847) 705-4130 to initiate the process.

3. The local agencies expressed concern about the increased runoff from the improvements. IDOT agreed to manage the discharge from the drainage systems by the use of BMP’s. Detention may be provided if increase in flow rates would cause damage to the downstream properties.

4. Miller Road is under the jurisdiction of Dundee Township. The proposed improvements for Miller Road should be discussed with Larry Brash (847-428- 8092) of the Township.

5. FPDKC stated that the proposed 2.5:1 slopes within Raceway Woods Forest Preserve would be difficult to maintain and requested that slopes of 3:1 or flatter be explored realizing that the temporary easements as shown on the plans will need to be revised. GEC agreed to revise the design and share it with FPDKC. FPDKC will supply a detail of the bike path to assist with the design.

6. FPDKC requested that the ROW required for the ultimate five lane cross section be determined at this time so that future dedications will not be required when IL 31 is improved to five lanes.

7. The project is in the Phase I process and is expected to receive Design Approval in summer 2014. Letting is expected in the middle years of the Department’s FY 2014-2019 Multi-Modal Transportation Improvement Program. Phase III, construction, is expected to take one construction season.

8. The local agencies requested an electronic copy of the plans and LDS when available. Half-size plans were provided to VoC and DTPD.

This was the fourth presentation of this project. The last presentation was on September 18, 2014. The purpose of the meeting was to provide an update on the project and to present additional Section 4(f) impacts.

The project requires right-of-way and a temporary easement on the west side within the Raceway Woods Forest Preserve to construct a shared-use path and improve the existing roadside ditch. The project requires right-of-way, permanent and temporary easements on the east side of IL 31 within the Brunner Family Forest Preserve for roadway widening to add a northbound left turn lane at Miller Road, reconstruct an existing box culvert, and for grading to match existing conditions. Since these improvements appear to have minimal impacts and avoid recreational activities, the impacts can be considered de minimis. Documentation of the impacts shall be coordinated with the Forest Preserve District of Kane County (FPDKC) and public.

The FPDKC requested a shared-use path along the west side of IL 31from Commerce Parkway to Miller Road to provide a connection for pedestrians and bicyclists between the Raceway Woods Forest Preserve and Brunner Family Forest Preserve. A letter will be sent to the FPDKC for concurrence that they will cost participate and be responsible for the long term maintenance of the shared-use path. FPDKC will connect the shared-use path to the existing trail within Raceway Woods Forest Preserve. The FPDKC will also construct a crossing at the IL 31 and Miller Road intersection as a permit project.

As Section 4(f) mitigation for the Longmeadow Parkway project, Kane County Division of Transportation (KCDOT) is purchasing a portion of Brunner Family Forest Preserve east of the IL 31 and Miller Road intersection to dedicate to the Dundee Township Park District for a sports complex. As part of the dedication to the Park District, KDOT will dedicate right-of- way to 75-feet east of the IL 31 centerline for future widening. The purchase has not occurred yet. The right-of-way and easements necessary to construct the improvement are being shown on the plans until the dedication has occurred.

Because the project has Section 4(f) impacts, the processing is being changed from CE I to CE II. Design approval is anticipated by August 2014.

IDOT is seeking public comments on Section 4(f) impacts the IL 31 at Miller Road project will have on the Raceway Woods and Brunner Family Forest Preserves owned and operated by the Forest Preserve District of Kane County. Section 4(f) lands include publicly owned parks, recreational areas, wildlife and waterfowl refuges, or public and private historical sites. The project will impact the Raceway Woods Forest Preserve along the west side of IL 31 to improve the existing ditch and construct a shared-use path. The project will impact the Brunner Family Forest Preserve along the east side of IL 31 to widen the roadway to provide a northbound left turn lane. This is the first opportunity for the public to comment on the additional public land needed for this project. The Section 4(f) de miminis documentation is available for viewing at the following locations during normal business hours.
