GPA/W/315/Add.3 Página 2 EUROPEAN UNION WTO AGREEMENT ON GOVERNMENT PROCUREMENT - EU'S COMMITMENTS RESULTING FROM THE "POLITICAL AGREEMENT" REACHED WITH ALL PARTIES ON 15 DECEMBER 2011 The EU's commitments reflected in the third revised offer are amended as follows: Annex 1 The following category is added: (d) for the goods services and service providers of the United States, Japan and the separate customs territory of Taiwan, Penghu, Kinmen and Matsu, procurement by the following central government contracting authorities of EU Member States provided that they are marked by a double asterisk For the sake of clarity, the EU attaches to this document the list of these entities which will be marked with a double asterisk in the EU's final commitments under Annex 1.1 Notes to Annex 1 Paragraph 2 is deleted and is replaced by the following: The provisions of Article XVIII shall not apply to suppliers and service providers of Japan, Korea and the USA in contesting the award of contracts to a supplier or service provider of Parties other than those mentioned, which are small or medium sized enterprises under the relevant provisions of EU law, until such time as the EU accepts that they no longer operate discriminatory measures in favour of certain domestic small and minority businesses. Annex 2 Notes to Annex 2 All paragraphs but paragraph 1 are deleted. They are replaced by the following: The provisions of Article XVIII shall not apply to suppliers and service providers of Japan, Korea and the USA in contesting the award of contracts to a supplier or service provider of Parties other than those mentioned, which are small or medium sized enterprises under the relevant provisions of EU law, until such time as the EU accepts that they no longer operate discriminatory measures in favour of certain domestic small and minority businesses. The provisions of Article XVIII shall not apply to Japan and Korea in contesting the award of contracts by entities listed under Annex 2 paragraph 2, until such time as the EU accepts that they have completed coverage of sub-central entities. 1 See page 4 of this document for this list of entities. General presentation of the judicial organisation and position of the administrative jurisdictional order In Greece there is a distinction between the administrative courts on the one hand and the civil and criminal courts on the other (Article 93 (1) of the Constitution). The organisation of the two jurisdictional orders follows the classic pyramidal form in this matter: at the top of the civil and criminal jurisdictions is the Court of Cassation; then the courts of appeal and the courts of first instance; finally, at the base of the pyramid, justice of peace. At the head of the administrative jurisdiction is the Council of State; then the administrative courts of appeal and the administrative tribunals of first instance. The third supreme court, the Court of Audits knows, sovereignly, certain specific administrative disputes (listed in Article 98 of the Constitution). Disputes of attribution are settled by a Special Supreme Court (Article 100 of the Constitution). 1.2. Key dates in the evolution of the administrative jurisdictional order and the control of administrative acts The creation of administrative tribunals was provided for in Greece as early as 1833. The Court of Audits was first established as an administrative body competent in certain administrative disputes submitted to it.

It emerged from the collapse of the Fourth Republic, replacing the former parliamen- tary republic with a semi-presidential, or dual-executive, system that split powers between a prime min- ister as head of government and a president as head of state. De Gaulle, who was the first president elected under the Fifth Republic in December 1958, believed in a strong head of state, which he de- scribed as embodying “l'esprit de la nation” (the spirit of the nation). The nation declares itself to be an "indivisible, secular, democratic, and social Republic". The constitu- tion provides for a separation of powers and proclaims France's "attachment to the Rights of Man and the principles of national sovereignty as defined by the Declaration of 1789." The Fifth Republic is France's third-longest political regime, after the hereditary and feudal monarchies of the Ancien Régime (15th century – 1792) and the parliamentary Third Republic (1879–1940). Executive branch Executive power is exercised by the President of the Republic and the Government. The Government consists of the Prime Minister and ministers. The Prime Minister is appointed by the President, and is responsible to Parliament.

Long-standing initiatives to strengthen judicial independence, in particular by reinforcing the competences of the High Council for the Judiciary, have not advanced towards adoption, which would require a qualified majority of the votes cast by both chambers of Parliament. The resources devoted to the justice system received a significant increase. Projects aimed at achieving full digitalisation of the criminal procedure and some aspects of the civil procedure continue to advance.

The sun shone; a gusty, warm breeze blew. People were out shopping or strolling along Gediminas Prospect, Vilnius' central boulevard. Life looked normal. It was, however,-far from that. It was on this balmy spring day that Mikhail Gorbachev delivered his most stinging written rebuke yet to the Lithuanian leadership. Almost three weeks to the day after the Lithuanians declared independence, Gorbachev warned of "grave consequences" if the Lithuanian parliament refused to revoke all the laws, declarations, resolutions and appeals that it had passed in the interim. Gorbachev's primary target, of course, was the declaration of independence itself, or as the Lithuanians call it, the "reestablishment" of the independent statehood of Lithuania. The Lithuanians have been calling for negotiations with Moscow ever since they passed this act on March ii. Gorbachev now stipulated he would sit down at the negotiating table only if the Lithuanians [evoked it. "The current Lithuanian leadership is not listening to the voice of reason, Gorbachev' s ultimatum to the Lithuanian Parliament began. It was totally ignoring the decisions of the extraordinary third session of the Soviet People's Congress held in mid-March (which condemned all the Lithuanian moves) and was "carrying out actions which conflict with the Constitution of the Soviet Union, and which, in the view of the entire Union, are openly provocational and insulting."
