RECOMMENDATION:

That:

SUMMARY

Council is in receipt of a Development Application which proposes to subdivide a portion of a redundant laneway at the rear of 58 Lime Street, Cabramatta West to create one (1) residue allotment numbered 100 for Title Issue and Road Closure under the Roads Act, 1993.

The following figure depicts the part of lane behind Lime Street subject to the Road Closure and Title Issue under the Roads Act, 1993.

Council resolved in March 2015 to proceed with the Application to formally close the laneway at the rear of No. 58 Lime Street, Cabramatta West (refer to Attachment F) and approval in principle has been received from the NSW Department of Primary Industries – Land, to permit the closure of the road.

It was also resolved to classify the residue allotment as operational land and then sell the redundant part laneway to the owners of No. 58 Lime Street, Cabramatta West, in line with the superseded Policy for the disposal of surplus roads, laneways and pedestrian pathways as outlined in the previous report, Item No. 45, Ordinary Council meeting, 24 March 2015.

Once the subdivision is registered and the redundant laneway portion is closed and the Title issued the matter will then be processed by Council’s Property Branch. Services Committee CSC140217_32 Page 8 Section A - Planning

The site is zoned R2 Low Density Residential under Fairfield Local Environmental Plan 2013. The Application for the purpose of “subdivision” is permissible subject to consent by Council.

In accordance with Fairfield City-Wide Development Control Plan 2013, the Application was notified via written notification to adjoining and affected residents for a period of 21 days from 1 December 2016 to 22 December 2016. Council received no written submissions objecting to the proposal.

The Application proposes to subdivide the laneway in the following manner:

The minimum lot size under Fairfield LEP 2013 for subdivisions located within an R2 – Low Residential zone is 450m2. The proposal shall create an allotment with a site area of 69.72m2, which proposes a variation of 84.51% to the minimum lot size development standard.

In accordance with the Department of Planning’s Planning Circular PS 08-014 issued 14 November 2008, all development applications proposing a variation greater than 10% from a development standard shall be determined by full Council rather than the General Manager or a delegated staff member. As such this report is prepared for Council’s determination.

Pursuant to Clause 4.6 Exceptions to Development Standards Subclauses 3 and 4, Council can grant development consent that contravenes a development standard if the Consent Authority is satisfied that compliance with the standard is unreasonable and unnecessary in the circumstances and that the proposed development will be in the public interest.

The Applicant has submitted a written application justifying the minimum lot size variation of 84.51% pursuant to Clause 4.6 Exceptions to Development Standards, justifying that there are sufficient environmental planning grounds to justify the contravention and that the underlying objective or purpose of the standard is not relevant to the development and therefore compliance is unnecessary.

It is considered that the non-compliance with the development standard does not raise any significant matters with respect to State or Regional Planning and no public benefit is obtained by adhering to the relevant planning controls. The variation pursuant to Clause 4.6 of the Fairfield LEP 2013 is therefore considered acceptable in the circumstances.

Additionally, similar approvals will not undermine the objectives of the 450m2 development standard including planning objectives for the locality, as these lots will be restricted to residue lots with further development limited to consolidation with their corresponding adjoining property, No. 58 Lime Street, Cabramatta West, Lots 69 and 70, Section 2, DP 1553 including Lot 1, DP 193521.

Effectively the proposed subdivision will allow the 1 portion of redundant laneway to be sold by Council to the adjoining property.

Based on the assessment of the Application, including the consideration of Clause 4.6 of Fairfield LEP 2013, and other provisions of Section 79(C) of the Environmental Planning and Assessment Act, 1979, it is considered that the proposal is satisfactory and is unlikely to detrimentally impact the environment or the amenity of nearby residents, is suitable for the site, and is in the interest of the public.

Accordingly, the Application is recommended for approval subject to Conditions of Consent outlined in Attachment E of this report.

THE ASSESSMENT OF THE APPLICATION

BACKGROUND

The immediate area consists of narrow residential allotments and rear laneways, created by subdivisions in the early 20th century (early 1900’s). The rear laneways were created as a way of adequately servicing the removal of night waste from these properties prior to the availability of a piped sewerage system.

Following the availability of the piped sewerage system, the need for these rear laneways has become redundant. Subsequently over the past few years, Council has subdivided and sold off a number of these parcels of the laneways to adjoining property owners.

Council resolved in March 2015 to proceed with the Application to formally close part of the redundant laneway at the rear of No. 58 Lime Street, Cabramatta West. It was also resolved to classify the residue allotment as operational land and then sell the part redundant laneway to the adjoining property. The owners of No. 58 Lime Street approached Council to make an application to formally close the road at the rear of their property. All costs associated with the road closure and including the price of land shall be borne by the Purchaser.

SITE DESCRIPTION AND LOCALITY

The land is known as a laneway and is owned by Fairfield City Council. Under Section 38 (2b) of the Roads Act 1993 the laneway will vest in Council upon closure as maintenance on the laneway have taken place.

The proposed allotment 100 is located at the rear of No. 58 Lime Street, Cabramatta West. The subject Lot is regular in shape, as seen in the Subdivision Plan Attachment B.

THE APPLICATION

The Development Application proposes a subdivision of a portion of redundant laneway at the rear of No. 58 Lime Street, Cabramatta West, for Title Issue and Road Closure under the Roads Act, 1993.

The eventual intent of the proposed subdivision is to allow the redundant laneway portion to be sold by Council to adjoining residential property No. 58 Lime Street, Cabramatta West.

The Development Application proposes the 1 allotment as follows:

COMPLIANCE WITH RELEVANT STATUTORY REQUIREMENTS

1. Fairfield Local Environmental Plan (LEP), 2013

The subject site is zoned R2 Low Density Residential as stipulated within the Fairfield LEP 2013. The Development Application proposes a subdivision to create 1allotment.

The proposed subdivision provides for 1 allotment with an area as follows:

Proposed Lot 100 = 69.72 m2

The proposed development therefore does not comply with the required minimum lot size requirement of 450m2 as stipulated within Clause 4.1 Minimum subdivision lot size of Fairfield LEP 2013.

The Application was publicly notified via written notification to adjoining and affected residents for a period of 21 days from 1 December 2016 to 22 December 2016. Council received no written submissions objecting to the proposal.

CONCLUSION

In conclusion, the following is noted:

1. The Application proposes a subdivision of a portion of a redundant laneway to the rear of, narrow allotments 69 and 70, Section 2, DP 1553 and Lot 1 DP 193521, collectively known as No. 58 Lime Street, Cabramatta West for Title Issue and Road Closure under the Roads Act, 1993.

2. The subject site is zoned R2 Low Density Residential as stipulated in Fairfield Local Environmental Plan (LEP) 2013 and the proposed development is permissible within the R2 Low Density Residential zone subject to Council consent.

4. In accordance with the Fairfield City – Wide Development Control Plan 2013, the Application was notified to adjoining and affected owners and occupiers for a period of 21 days. Council received no written submissions objecting to the proposal.

5. The Applicant has formally lodged a written application justifying the lot size variation pursuant to Clause 4.6 Exceptions to development standards under the Fairfield LEP 2013. The variation is considered to be satisfactory in the circumstances of the case.

6. The proposed development has been assessed and considered having regard to the matters for consideration under Section 79C of the Environmental Planning & Assessment Act 1979.

Accordingly, it is recommended that the Development Application No. 757.1/2016 be approved subject to the Conditions outlined in Attachment E to this report.

Council resolved in October 2015 to proceed with the Application to formally close the laneway at the rear of 34 Lord Street, (See Attachment F) and approval in principle has been received from the NSW Department of Primary Industries – Land, to permit the closure of the road.

It was recommended that Council consent to lodge an Application to formally close the surplus public road adjoining 34 Lord Street, Cabramatta West. Upon closure of the road it was recommended that Council sell the land to the owner of 34 Lord Street, Cabramatta West in line with the current Policy for the disposal of surplus roads, laneways and pedestrian pathways as outlined in the previous report, Item No. 261, Ordinary Council meeting, dated 27 October 2015.

Once the subdivision is registered and the redundant laneway portion is closed and the Title issued the matter will then be processed by Council’s Property Branch.

Effectively the proposed subdivision will allow the 1 portion of redundant laneway to be sold by Council to the adjoining property.

Based on the assessment of the Application, including the consideration of Clause 4.6 of Fairfield LEP 2013, and other provisions of Section 79(C) of the Environmental Planning and Assessment Act, 1979, it is considered that the proposal is satisfactory and is unlikely to detrimentally impact the environment or the amenity of nearby residents, is suitable for the site, and is in the interest of the public.

Accordingly, the Application is recommended for approval subject to Conditions of Consent outlined in Attachment E of this report.

THE ASSESSMENT OF THE APPLICATION

BACKGROUND

The immediate area consists of narrow residential allotments and laneways, created by subdivisions in the early 20th century (early 1900’s). The laneways were created as a way of adequately servicing the removal of night waste from these properties prior to the availability of a piped sewerage system.

Following the availability of the piped sewerage system, the need for these rear laneways has become redundant. Subsequently over the past few years, Council has subdivided and sold off a number of these parcels of the laneways to adjoining property owners.

Council resolved in October 2015 to proceed with the Application to formally close part of the redundant laneway at the rear of 34 Lord Street, Cabramatta West. It was also resolved to classify the residue allotment as operational land and then sell the part redundant laneway to the adjoining property. The owners of 34 Lord Street approached Council to make an Application to formally close the road at the rear of their property. All costs associated with the road closure and including the price of land shall be borne by the Purchaser.

SITE DESCRIPTION AND LOCALITY

The land is known as a laneway and is owned by Fairfield City Council. Under Section 38 (2b) of the Roads Act 1993 the laneway will vest in Council upon closure as maintenance on the laneway have taken place.

The proposed allotment 100 is located at the rear of No. 34 Lord Street, Cabramatta West. The subject Lot is regular in shape, as seen in the Subdivision Plan Attachment B.

THE APPLICATION

The Development Application proposes a subdivision of a portion of redundant laneway at the rear of No. 34 Lord Street, Cabramatta West, for Title Issue and Road Closure under the Roads Act, 1993. The eventual intent of the proposed subdivision is to allow the redundant laneway portion to be sold by Council to adjoining residential property No. 34 Lord Street, Cabramatta West.

COMPLIANCE WITH RELEVANT STATUTORY REQUIREMENTS

1. Fairfield Local Environmental Plan (LEP), 2013

The subject site is zoned R2 Low Density Residential as stipulated within the Fairfield LEP 2013. The Development Application proposes a subdivision to create 1 allotment.

The proposed subdivision provides for 1 allotment with an area as follows:

Proposed Lot 100 = 46.48 m2

The proposed development therefore does not comply with the required minimum lot size requirement of 450m2 as stipulated within Clause 4.1 Minimum subdivision lot size of Fairfield LEP 2013.

SUMMARY

Council is in receipt of a Development Application which proposes to subdivide the redundant laneways between No. 4 and 5 Helen Street, Smithfield and No. 6 and 8 Mala Street, Smithfield to create 2 residue allotments numbered 101 and 102 for Title Issue and Road Closure under the Roads Act, 1993.

The following figure depicts the laneways on Helen Street and Mala Street subject to the Road Closure and Title Issue under the Roads Act, 1993.

The 2 laneways proposed to be closed both currently serve as public access to Council’s land known as 117A Wetherill Street, Smithfield, Lot 15, DP 27962. On 11 December 2012 Council resolved to proceed with the lodgement of a Development Application to subdivide No. 117A Wetherill Street, Smithfield into residential allotments. A subdivision application No. 633.1/2016 to create 13 new allotments and a new road is currently being assessed.

As a result of the proposed redevelopment of 117A Wetherill Street, the laneways adjoining the property are considered surplus to Council’s requirements.

It was also resolved to classify the residue allotments as operational land; the future sale process of the redundant laneways will be carried out by Council’s Asset Management Division.

The site is zoned R2 Low Density Residential under Fairfield Local Environmental Plan 2013. The Application for the purpose of “subdivision” is permissible subject to consent by Council.

In accordance with Fairfield City-Wide Development Control Plan 2013, the Application was notified via written notification to adjoining and affected residents for a period of 21 days from 1 December 2016 to 22 December 2016. Council received no written submissions objecting to the proposal.

CONCLUSION

1. Mrs J and Mr R England are the registered proprietors of 277 Polding Street Fairfield West being Lot 4 and Deposited Plan 259477.

2. The Property is subject to a Restriction as to User created upon the registration of the DP 259477 which denies access from the property across the boundary of Smithfield Road.

3. Fairfield City Council (FCC) is nominated as the authority empowered to release, vary or modify the Restriction as to User.

4. In July 2005, FCC approved an application for the construction of a vehicular crossing from the Property to Smithfield Road.

In September 2016, Council under delegation approved Development Application No. 182.1/2016 proposing a Torrens Title Subdivision of 4 Existing Allotments to create 2 larger Non-Urban Residential Lots (Refer to Attachment C – Approved Subdivision Plan). In order to enable the issue of the subdivision Certificate, an existing Restriction on Use on both existing redundant road allotments must be varied, to permit further development.

The existing residential allotments 11 and 12, DP 1071614 are zoned RU4 Primary Production Small Lots under Fairfield Local Environmental Plan 2013 and are owned by Mr & Mrs Dutt and Mrs M Panuccio, respectively. The owners are the current prospective buyers for the redundant road portions lots 4 & 5 DP 1086205.

The redundant road portions were created for Title Issue and Road Closure under the Roads Act 1993 and covered by Subdivision Certificate No. 8599 dated 25 May 2005 (Refer to Attachment D – Deposited Plan creating road portion lots). As Barbaro Lane was unformed under Section 38(2)(b) Roads Act 1993, the road portions were vested in the Crown on closing.

It was Council’s intention that the subdivision layout creating the subject road portions would facilitate the consolidation of the road portions with the relevant adjoining properties, known as Lot 1 DP 184097 or Lot A, DP 410302, as seen in Attachment D.

A subsequent subdivision of Lot 1, DP 184097 created 2 new residential allotments, now known as lot 11 and Lot 12 of DP 1071614 (the prospective buyers) thereby necessitating the need to vary the wording of the imposed Restriction on Use to update the new allotments and enable the consolidation and further development to the newly formed allotments.

SUMMARY

The Property and Community Facilities Branch of the Asset Management Division manages Council owned properties including leased/licenced sportsfields and community centres, the Dutton Plaza Retail Centre and multi-deck car parks. The Branch also undertakes for Council, real estate functions to buy, sell, lease land, grant easements and road closures.

Purpose

This report provides an update with reference to Councils Operational Plan and highlights the activities that have been undertaken within the last quarter ie. October - December 2016.

Update for Current Property Transactions

1. Sale of Land to Western Sydney Parkland Trust

At its Ordinary Meeting dated 22 November 2016 Council resolved to sell Lot 200 DP 1220359 to the Western Sydney Parkland Trust. Council has subsequently been advised that the purchaser of the land will be the Minister Administering the Environmental Planning and Assessment Act 1979. All other terms of the sale and conditions will remain the same.

It is common for land with the to be owned by another state government agency. It is recommended that Council accept the changes to the nominated purchaser for Lot 200 DP 1220359 and update their resolution to reflect this administrative update.

2. Lease of Shop 2, 40 Harris Street, Fairfield

At its Ordinary Meeting dated 6 December 2016 Council resolved to lease Shop 2, 40 Harris Street, Fairfield to the Think + Do Tank Foundation Limited. One of the lease terms resolved by Council was a lease commencement date of 1 February 2017. The Think + Do Tank Foundation has requested that the lease commencement date be delayed by around one month and that all other lease terms remain as previously resolved. This will allow the Foundation to complete their development approval process.

The Think + Do Tank Foundation is a not for profit organisation that intends to provide multi-lingual literacy and support services to the community. It is recommended that Council acknowledge this request for a delayed lease commencement date and so remove the lease commencement date specified from the terms and conditions previously resolved.

Dutton Plaza

Dutton Plaza is now open to the public and is enjoying excellent patronage from local shoppers and tourists. The new shops are attractive and shop owners are reporting good patronage through their stores. The public toilets are well used and the upgraded facilities are receiving good feedback from shoppers and business owners.

Car park patronage is high and has reached capacity during peak shopping times on weekends. The new car park exits and entry are operating efficiently and the lifts from the shopping centre to the car park are heavily utilised.

New shops such as a Japanese Restaurant and a Butcher are commencing their shop fitout works now and will be ready to trade to the public in a few weeks.

Licence Agreement – St Johns Park Cottage, 41 Canberra Street, St Johns Park

Council in July 2016 undertook an Expression of Interest (EOI) process where The Junction Works were the successful and only applicant for a Licence Agreement for the use of the St Johns Park Cottage. In line with this commitment The Junction Works are working with Council to submit a Development Application to construct a demountable facility on this site.

Deed of Agreement – Transport for NSW – Construction of Canley Vale Exeloo

The Deed of Agreement and transfer of funds from Transport for NSW to Fairfield City Council has been finalised. This enables Council to complete the works associated with the construction of the Multi-Deck Car Park by Transport for NSW. Works will be scheduled aiming for completion in the 2016/2017 financial year.

The new retail centre only opened on 14 December 2016 and therefore any changes to these results may not be realised until the next quarter. 5) Council figures indicate 34% of visitors paid for parking in Quarter 2 (2016/2017) at Nelson Street. 6) Council figures indicate 22% of visitors paid for parking in Quarter 2 (2016/2017) at Downey Lane.

Surveillance

Malicious damage incidents, although decreasing, continue to occur at Council’s multi- storey car parks. The events tend to happen after 10.00pm, particularly on Friday, Saturday and Sunday nights. A procedure for allowing automatic passage (at the Nelson Street Carpark) has continued. When a vehicle approaches within range of a sensor between 11.00pm and 6.00am daily the gates automatically open. This has been a collaborative approach with the owners of the local function centres whose patrons frequently utilise the site.

Council’s Property Department and Environmental Standards Division have created a procedure to proactively follow up and address these issues, including the recent increase of non-car park equipment vandalism issues (Fisher St and Downey Lane lifts). CCTV footage will be safely stored for future reference.

SUMMARY

MULTICULTURAL

Humanitarian and Refugee Settlement to Fairfield City

Between 1 January 2016 until 4 January 2017 4,712 refugee and humanitarian entrants settled in Fairfield City. This represents approximately 50% of the NSW total intake and 20% of the national total. This figure does not include individuals who have chosen Fairfield City as a secondary settlement location after their initial settlement area. In an average calendar year, approximately 900-1,000 individuals settle in Fairfield indicating a 500 percent increase in 2016 on the number of people settled in previous years.

Council staff have been working to collect data so local service providers, community organisations and Council have a better understanding of people who are settling in Fairfield. The data will contain a more descriptive account detailing age, gender, English language proficiency, educational attainment, previous occupation among other information. This should enable direct service providers to deliver a more tailored and effective service when working with our newest residents. Council has been preparing information and data in relation to the increased intake in response to media requests.

Settlement Resource Issues for Fairfield LGA

Council has made representation to the Federal and State Government highlighting the need for more timely and accurate data relating to settlement numbers and requesting additional resources for Fairfield LGA due to the influx of new arrivals. Correspondence was sent to Professor Peter Shergold, Coordinator General for Refugee Resettlement in NSW, The Hon. Peter Dutton, MP, Minister for Immigration & Border Protection, and other relevant Ministers. A meeting is scheduled with Professor Peter Shergold to discuss Council’s representations.

International Women’s Day

Council has been approached by the Women’s Committee of the Iraqi Australian University Graduates Forum (IAUGF) for support with their International Women’s Day event. The annual celebration that primarily attracts Iraqi women from all faiths and cultural backgrounds also honours and recognises the contributions made by women over the previous year. The IAUGF have asked Council for $1,500.00 to sponsor their event.

RECYCLING BIKE PROJECT

During December 2016 and January 2017, the volunteers from the Western Sydney Cycling Network (WSCN) received 47 used bicycles, recycled 52 used bicycles and 37 bikes were loaned out to the community. The bike clearance days leading up to Christmas helped increase the loans of bikes to the community. Volunteers contributed 400 hours of time supporting the social needs of many residents, building knowledge for new volunteers and recycling of used bikes. The WSCN coordinated 31 community rides for 411 people and organised a social night ride for Christmas with decorated bikes.

The partnership with Community First Step, ‘Ride for Life – a Youth Initiative’ has been finalised with positive outcomes. Thirteen young people aged between 13 and 18 participated to learn about bike maintenance, rider safety and how to navigate across the city using local shared pathways to locations such as TAFE, high schools and youth facilities. The group was provided with maps illustrating the shared pathways, points of interest and information about rules for cycling safely. One young person commented on the survey “we learned how to have fun and be safe while riding a bike”.

CHILD and FAMILY

The Department of Family and Community Services has verbally advised that they will negotiate a new Program Level Agreement for the Families NSW Facilitation Project for the period commencing July 2017. Along with other Targeted Earlier Intervention Programs, the project is subject to the reform process and the PLA for the 12 months from July 2017 may reflect the transition period until the reform process is finalised.

The NSW Department of Education has advised that the Families Together program, which provides free parenting sessions to local families, will be funded until December 2017. The Department of Education will review this, and other early childhood programs, over the coming months to determine whether funding will be continued.

AGED AND DISABILITY

Disability Inclusion Action Plan (DIAP)

The NSW Disability Inclusion Act 2014 requires all local government authorities to adopt a Disability Inclusion Action Plan (DIAP) by July 2017. The Disability Inclusion Act 2014 defines disability as: ‘The long-term physical, mental, intellectual or sensory impairment which in interaction with various barriers may hinder the full and effective participation in society on an equal basis with others.’ The objective of the legislation and the DIAP is to ensure all people can use Council services, information and facilities. Council will be consulting with the community on the development of the DIAP in the coming months.

DisAbility Rocks - International Day of People with Disability Event

More than 80 people with a disability, carers and friends of all ages, including school children, young people, adults and older people with disabilities enjoyed a great day of celebration at Prairiewood Community Hall. The event aims at including a therapeutic program to make people positive and celebrate the achievements and abilities of participants. The event included dancing and a laughter workshop, a barbeque lunch and lucky door prizes. Fairfield City Council organised the event in partnership with The Parks Community Network with participation from disability services and a local special school.

Disability Access Improvement Project

All facilities are required to facilitate access by all members of the community, regardless of ability. Council’s Disability Access Improvement Project retrofits community facilities that are not currently compliant with disability access requirements. The universal disabled facilities are being upgraded at Community Hall and a laundry is being converted into a disabled toilet at Greenfield Park Family Day Care Centre to prepare for NDIS clients. Work on these upgrades is scheduled to commence in February 2017.

International Day of People with Disability and Carers

This event sought to bring people with disabilities and carers together to celebrate and encourage carers to mentor their loved ones to celebrate their abilities and sense of fun. Participants were encouraged to dress up in their favourite costumes, take selfies and group photos with props provided to encourage a celebratory mood.

Fairfield City Council organised the event in partnership with Uniting Recovery. More than 200 carers and the people with a disability participated on the day.

Senior’s Week

Fairfield Council has received $5,000.00 from the NSW Seniors Festival Grants Program to hold the 2017 Fairfield Seniors Week Event to be held in March 2017.

CAPACITY BUILDING AND COMMUNITY IMPACT

“THRIVE! Don’t just survive”

“Thrive! Don’t just survive” was a forum held by Council to increase the capacity of the community services in Fairfield to be successful within a highly fluid and contestable funding environment. A hundred percent of attendees stated that their organisation’s practice will improve as a result of THRIVE! A survey held post event showed that 100% of respondents said they had:-

Neighbour Day Celebration in March 2017

Neighbour Day aims to encourage neighbours to get to know each other and to build resilient communities. Resilience and neighbourhood connectedness is an indicator of community strength and inclusion. People feel safer in neighbourhoods where they know each other and feel supported. In 2017, Neighbour Day will be held between Saturday 18 March and Sunday 26 March 2017. Council sought expressions of interest from community organisations to deliver locally based Neighbour Day events or activities. Community First Step in Fairfield and Cabramatta Police in partnership with Local Neighbourhood Watch Group from Fairfield LGA have been identified for support from Council.

COMMUNITY SAFETY AND CRIME PREVENTION

Domestic and Family Violence

The 16 Days of Action to Eliminate Violence Against Women and White Ribbon Day campaigns 2016 were held in November and December 2016. Domestic Violence has been identified as a significant issue impacting the safety of our local community. The campaign coordinated by Council supported projects that provided information, education and increased awareness. Fairfield City Council partnered with 10 organisations to deliver this year’s campaign. Events held during the campaign were:

 Cabramatta Police ‘Police and Community White Ribbon Walk’  CORE Community Services ‘Strengthening community awareness and exploring local partnership for action against family and domestic violence’ – Inaugural conference.  Youth Off the Streets ‘Fairfield White Ribbon Day Soccer Tournament’.  Fairfield Police White Ribbon Day BBQ & Prize winning presentation for the DV Resource artwork.  St George Community Housing (SGCH) Newleaf ‘Pledge to Stop Violence Against Women – workshops with students at Bonnyrigg High School.  Khmer Community ‘Family Harmony- Khmer Community’ community education sessions with a focus on legal information and available services.  The NSW Spanish and Latin American Association for Social Assistance (SLASA) ‘How do we cope with DV in a multicultural society?’ – a forum.  Samoa Victim Support Group Sydney Inc ‘Promoting Healthy Relationships to the Samoan Church Community’ SVSG - a forum for Church leaders.  Community First Step ‘Fairfield Youth Unite for White Ribbon Day’ a one day themed sporting/competition event between local youth and Fairfield Police.  The Immigrant & Refugee Women’s Network - a community event to raise awareness and knowledge of the prevention strategies available.

Community Safety Grants

The NSW Department of Justice is offering grants up to $250,000.00 to promote community safety. It is proposed that Council apply for funding to address issues relating to safety and the perception of safety. Council is nearing completion of a 4 year roll out of some 100 new CCTV cameras in the public domain. Funding will be sought to enhance the CCTV program in a Council car park that has been identified as a crime and anti-social behaviour hot spot; implement a program leveraging the investment of the past 4 years of CCTV as a deterrent, through an education and awareness campaign as well as signage; and development of a diversionary program to prevent escalation of anti-social behaviour and criminal engagement by young people.

YOUTH

Bring It On! Festival

Currently applications for volunteers are being accepted until 6 March 2017. Meetings with the youth sector have taken place, identifying new and innovative ideas for the event. Macquarie University will provide an interactive robotics display and Western Sydney University will provide an interactive activity from the medicine, science and school of nursing faculties. These displays offer a way to engage with young people about career planning. A sound line up of entertainment including In Stereo and Mash’d N Kutcher has been confirmed with skating, racing simulators and sporting activities. Sponsorship is resource intensive with a total of $8,500.00 confirmed.

Fairfield Youth and Community Centre - ‘Youth Hours’ Report

There continues to be a high level of attendance at the Youth Hours sessions at the Fairfield Youth and Community Centre each Monday to Thursday between 3pm and 6pm. Council licenses the facility at a reduced cost to Community First Step who provide all staff, activities and brokers other youth providers to support the young people attending. The drop in service welcomes all young people and provides information and referral to specialist services as required by each young person. This may include liaison with legal services, housing, advice on relationships and support for education and training.

ARTS AND CULTURE

FAIRFIELD MUSEUM AND GALLERY

Fairfield Museum and Gallery are actively seeking external funding to support and develop the program of cultural activities and facilities available to the community and to support artists. The following grant programs are currently available and it is intended that the FMG will submit applications as outlined:

 Celebration Grants with Multicultural NSW for the Living Cultures Festival which celebrates Harmony Day. This celebration is part of the annual program and it is intended to apply for the maximum of $5,000.00 to supplement current funds.

 Catalyst – Australian Arts and Culture Fund. It is proposed that Fairfield City Museum and Gallery auspice an application on behalf of the Health and Arts Reference Group. Council is represented on this group by the Director of the FMG. Application will be made for funds to conduct a training program for artists who want to work in the sector of Community Arts and Health. There is a maximum of $500,000.00 available for an individual project.

 Western Sydney Making Spaces Initiative - up to $60,000.00 is available through Arts NSW. The Western Sydney Making Spaces Initiative is designed to encourage property owners or managers to offer new or unused spaces for making and programming art works in 2017/18 and 2018/19.

 Arts & Culture Infrastructure Grants 2016-17, Justice, Liquor and Gaming NSW, (Clubs Grant) - Funding, up to $300,000.00 is available for the construction, alteration, renovation and fit-out of arts and cultural facilities. The Museum and Gallery intends to apply for the renovation of the Museum and the Stein Gallery.

ABORIGINAL

Council staff have met with key primary schools and high schools and community groups across Fairfield City to discuss a program of events for NAIDOC Week 2017. Expressions of Interest will be sought from the community to hold events which celebrate and promote appreciation and understanding of Aboriginal culture in Fairfield City.

The Strong Fathers Strong Families project aims to strengthen the role of Aboriginal and Torres Strait Islander fathers in their families. South West Sydney Local Health District is considering establishing the program in the Fairfield LGA. Several Darug men and community members have called for a local program.

HEALTH

Health Partnership

Council has a strategic partnership with the South West Sydney Local Health District (SWSLHD). At the Health Partnership Executive meeting on 29 November 2016, SWSLHD and Fairfield Council agreed to develop a further 3 year partnership with a Memorandum of Understanding (MOU) 2017 – 2020. An evaluation of the current Health Partnership is in progress and will be used to inform the new MOU and 3 year work plan for 2017 – 2020.

Healthy Food Guidelines

The Health Partnership outlines work to create Healthy Environments. This is in alignment with the Fairfield City Plan’s goal to create a healthy and active community that includes education and access to good nutrition for health and wellbeing. ‘Healthy Catering Guidelines’ have been developed in consultation with staff, analysis and research of successful similar policies in similar organisations.

Make Healthy Normal

Make Healthy Normal is a NSW Government campaign to help people make simple, healthy food and activity changes. Council is working with NSW Health to trial signage promoting physical activity and water consumption in Endeavour Reserve and Fairfield Adventure Parks to promote physical activity. NSW Health will provide the signage that will be in place for 3 – 6 months. The SWSLHD Health Promotion team will undertake an evaluation/observational study to establish community effectiveness. Signage will complement the key messages of the Make Healthy Normal campaign – ‘sit less and move more’ and ‘be active every day’.

Gyms in Parks

The aim of the Gyms in Parks program is to encourage residents to increase their level of physical activity, build social connections and utilise the fitness equipment installed by Council at various parks. This activity seeks to improve the health outcomes of participants and build community cohesiveness. The program for 2017 will be commencing on Tuesday 14 February 2017 and will run every Tuesday and Thursday morning until 30 March 2017. The location will be Vine Street Fairfield, next to the Adventure Park.

DRUGS AND ALCOHOL

Additional Electronic Gaming Machines – Notification of Intention to Apply

Fairfield Hotel has notified Council that they intend to apply for additional poker machines (EGMs). Council has provided a copy of the Gambling Policy and discussed areas of community need. Fairfield LGA currently has approximately 4% of all poker machines in NSW.

Liquor Licensing

Legislative Changes

From 16 January 2017 licensees who hold either an on-premises or hotel general bar licence can apply to convert their licence to a small bar licence, free of charge.

From 31 January 2017 applicants seeking to serve liquor in restaurants and cafes under standard trading hours and conditions will be eligible to obtain an interim restaurant authorisation. An interim restaurant authorisation allows applicants seeking an on- premises liquor licence for a restaurant to begin serving liquor as soon as they have lodged a liquor licence application online. To qualify for this, applicants must meet certain requirements including planning approval to use the premises as a restaurant or café, with the local council and community informed of the intention to serve alcohol as part of the public exhibition process.

Liquor License Applications

There are 4 categories of liquor licence applications. The NSW Liquor and Gaming Authority (The Authority) is the consent authority, however, approval can only be given if development consent for the use of the premises does not prohibit the service, supply or consumption of alcohol. The Authority recommends that all Councils develop policies in relation to alcohol. To date, Fairfield City Council has only adopted the Sale and/or Supply of Alcohol in Council Owned Parks and Sportsfields Policy.

In December and January, 8 applications were lodged with Liquor and Gaming NSW. One application is for extended hours of trading by a hotel in Fairfield, one application is for a new on premise license for a café, three seek changes to boundaries and conditions relating to one premise and three applications relate to the transfer of the liquor license to a new licensee. Council is not required to comment on these applications as they relate to individuals, not premises.

Smithfield Baptist Church, Smithfield Public School and the Sydney Refugee Team Charity

Written representation has been received from Minister Chris Athavle of Smithfield Baptist Church and Smithfield Public School seeking financial assistance towards the purchase of food for refugee families enrolled at Smithfield Public School and who live in the vicinity of the Smithfield area.

The Church and school have identified refugee families that require assistance in obtaining the basics for daily living. A contribution from Council will go towards the purchase of food supplies eg. rice, oil, bread, milk and fruit from the Food Bank, making most of these families self-sufficient by the end of the year.

Smithfield Baptist Church and Smithfield Public School meet the primary eligibility requirements of the Community Volunteer Fund of a new community program. A donation of $1,000.00 would be appropriate.

Iraqi Cultural Festival

Written representation has been received from the Iraqi Australian University Graduates Forum (IAUGF) requesting financial assistance towards their 2017 Cultural Festival being held from May to July 2017.

The IAUGF is a non-profit organisation with a majority of their activities held within the Fairfield LGA.

The purpose of the Festival is to bring together the Iraqi community through art and cultural activities to promote social cohesion and mutual understanding among different Iraqi ethnic and religious groups. There are a variety of activities to cater for all ages and community members, with a majority of events to be held at the Fairfield Museum & Gallery.

Under the Telecommunications Act 1997, Carriers such as Optus have the right to install and operate telecommunication facilities on private land. These carriers often seek Council’s consent to place the telecommunication facilities on public spaces such as parks in order to minimise the impact of the facility on nearby residents. As owners of the land Council is entitled to seek compensation.

This report seeks approval to enter into a Deed with Optus Mobile Pty Ltd (Optus) for a proposed telecommunication facility within Parkes Reserve, Canley Vale.

DISCUSSION

Commercial Terms

It is recommended that Council agree to enter into a Deed with Optus on the following commercial terms:

Whilst the location of the installation on Councils current floodlight pole is not considered ideal, Optus have advised that this location meets its communication requirements and that no alternative site is appropriate. For this reason it has been stipulated that Optus provide a maintenance switch to enable Council to service its floodlight globes in a timelier manner than is currently experienced when a telecommunications carrier co-locates on a Council owned asset.

Public Notification and Assessment

The proposal has been notified to the surrounding residents for 14 days as part of the Development Application. The regular hirers of the sports field were also contacted and given an opportunity to comment on the proposed telecommunication installation. None of the sports groups responded to Council with an objection to the proposed installation. Some residents provided comments to Council and these comments were considered as part of the Development Approval process.

The Telecommunications Act 1997 allows Carriers to install infrastructure on public land and does not require any public notification.

Council received submissions from the public regarding the proposed telecommunications tower that expressed concerns regarding the visual amenity of the tower. The proposed tower will be located behind trees growing on the boundary of the site, with these trees being over 20 metres in height. These trees will provide significant screening of the tower for the surrounding residential properties and so the visual impact of the proposed development will be minimised.

Additionally, the proposed tower is located towards the centre of the site and the park is not bounded by residential development on all sides. This further reduces the visual impact on the surrounding area.

Approval for this structure has been granted under DA 559.1/2016.

Location

CONCLUSION

It is recommended that Council complete the Deed with Optus Mobile Pty Limited for the occupation of this site. The installation of this site is important for the ongoing provision of telecommunication services to nearby residents and it will provide an ongoing income stream for Council.

2017 Annual Conference

Correspondence has been received from ALGWA NSW advising that the Annual Conference will be held from Thursday 4 to Saturday 6 May 2017 at Penrith Panthers Conference Centre.

Each year this conference attracts over 150 councillors, local government leaders and professionals from across NSW. The conference provides an opportunity for delegates to exchange ideas, network, debate and engage in cross-council collaboration on issues affecting women in local government.

At the time of compiling this report, no Program or registration costs were available.

The Director Corporate Governance, Amanda Spalding is a member of the ALGWA NSW and has been nominated as the staff representative to attend the Conference. The purpose of this report is to request Councillor nominations.

Accommodation

As the conference venue is within the Sydney metropolitan area, there are no accommodation costs associated with this conference.

Travel

A council vehicle can be arranged for those Councillors attending the Conference. Alternatively, travel expenses can be reimbursed in accordance with Council’s Councillors’ Fees, Expenses & Facilities Policy.

SUMMARY

The Financial Hardship Policy deals with ratepayers who are experiencing genuine financial hardship with the payment of their rates and charges. It is designed to assist those ratepayers in meeting their commitments. The policy generally applies to pensioners and other ratepayers that are eligible for Centrelink benefits. The policy fulfils the statutory requirements under the Local Government Act 1993 with its ability to provide financial hardship limited by that Act. While up to 2% of ratepayers enter into repayment plans with Council very little use is made of the other financial hardship options.

In December 2015, the NSW Government announced it would abolish the insurance – based Emergency Services Levy (ESL) and replace the revenue it generates with an Emergency Services Property Levy (ESPL) from 1 July 2017.

The ESPL will be an additional tax to pay for marginal members of the community who in the past may not have been able to afford property insurance. The ESPL will be shown separately on the rates notice as The Government Emergency Services Property Levy.

As these proposed changes are implemented and the impacts are understood, future amendments to this policy may become necessary that are not able to be properly assessed and included at this time.

As part of the review process Council’s Financial Hardship Policy is now provided to Council for adoption.

Council adopted the Policy on 11 February 2014 with a further review to be undertaken in February 2017 or earlier if the policy was affected by a change in legislation.

That further review has now been undertaken. As a result of the review, no changes are recommended with the only alteration to the current policy being a new review date of February 2021.

Asset Management Division

The Property Development Fund (PDF) is administered within Councils Asset Management Division. The service provides Council with a self-funded Property Development Fund (investment portfolio) for the purpose of generating additional revenue through entrepreneurial real estate activities and re-investing funds back into the community.

Purpose

This report provides a brief update about the progress of property development projects currently associated with the Property Development Fund (PDF).

Subdivision of 45-49 Diamond Crescent, Bonnyrigg There is 1 lot remaining for sale and it is being marketed by a local agent. It is anticipated to be sold prior to 2016/17 financial year, which will complete this project.

Subdivision of 117a Wetherill Street, Wetherill Park The Development Application (DA) is currently under assessment. Council’s Development Planning unit has requested further contamination testing to be carried out onsite in order to complete the assessment.

This testing is currently being contracted and is expected to be completed by end March 2017.

Subdivision of 65 The Avenue, Canley Vale It was previously reported to Council that the sewer carrier dissecting part of the subject property would result in the loss of 3-4 of the potential lots. Discussions are currently being held with the current tenant of the building to inform commercial options for the site.

A report advising Council of the highest and best use for the subject site will be submitted to the April 2017 Council meeting.

Dutton Plaza Cabramatta Refer to the Dutton Plaza – Leasing and Tenancy update within this Services Committee agenda as well as information provided in relation to the construction of the building provided in the Major Projects Divisional report.

Future Property Development Fund (PDF) Project Proposals Investigations are ongoing to identify the next development opportunities for the consideration of Council. The projects that are presented will be capable of generating additional revenue to Council.

Construction Project Highlights

Terone Park – Proposed Installation of Floodlights and new pole (new asset)

To meet increasing demand for training facilities, Terone Park will be receiving an additional 20m steel pole with 2 floodlights. This responds to an identified need to provide adequate lighting for night training on the mini soccer fields located east of the amenity building.

The new light will be coordinated to turn on and off the same time as the existing lights and will enable Council to add this sportsfield to its inventory of sportsfields for hire.

Proposed installation date will be late January to early February 2017.

St Johns Park & Emerson Tennis Centres

Upgrade work at St Johns Park Tennis Courts has commenced with the re-surfacing of all 4 courts completed.

The hirers have provided positive feedback to Council that they are very happy with the courts. Council still has to complete minor works associated with the fence and seating which will be completed during February 2017. Installation of Exercise Equipment and connecting paths is anticipated to be completed in quarter 4.

Upgrade work is also continuing at Emerson Tennis Courts where Court One has been reconfigured into a Futsal Court. The external fences and gates have been re-enforced and the court marked out for Futsal.

The upgraded work is to be completed by installation of a large art-work which is designed to give users an impression of playing within a grandstand of fans.

Bookings for this exciting new facility will commence early in 2017.

Powhatan Park

Due to a fire at the Powhatan Park on 10 July 2016 the building work to renew the amenities building moved forward in the 2016/17 schedule. As this work commenced earlier than anticipated the work is now at practical completion and is expected to be finalised and handed over early 2017.

The winter hirers AC United have advised Council Officers that they are delighted with the work completed to date.

Other Sportsfields Upgrades

Programmed renewal work to the amenities building at Adams Park and Endeavour Sports Park (middle building) is progressing. Renewal work for upgrades to the kitchens at Knight Park 1, 3 & 5 has been completed.

Sportsfield Utilisation

Sportsfield Applications for the 2017/2018 Winter Season have been received with the Allocations Panel scheduled for 17 February 2017. Council always strives to accommodate all requests for sportsfields.

Sports and Recreation Advisory Group

The next meeting of Council’s Sports and Recreation Group is on Monday 13 February 2017, with representatives from netball, rugby league, soccer, baseball, cycling, basketball, and the NSW Office of Sport invited.

Items scheduled for discussion at the meeting include promotion of Councils 2017/2018 Operational Plan for sports facilities, input to Council’s submission to the South West Sydney District Plan and information about Sports Community’s Club Spot which is an online resource for sports club committees.

Western Sydney Academy of Sport – Councillor Representation

Following the nomination at the 26 September 2016 meeting of Council of Councillor Azzo, Councillor Khoshaba, Councillor Molluso and Council Saliba to represent Fairfield City Council on the Western Sydney Academy of Sport (WSAS) Forum, Councillor’s had an opportunity to express and interest in being on the WSAS Board of Directors.

Councillor Molluso has indicated interest in this role. Appointments of 3 Local Government representatives to the WSAS Board of Directors are made from the WSAS Forum, and are for a minimum period of 12 months with the possibility of renewal / extension based on re- nomination.

Sport NSW Membership

Council has undertaken Local Government Membership with Sport NSW, which is a peak body for sport in the state. Sport NSW exists to promote, strengthen and advocate for the sport sector so that more people and communities in NSW enjoy the significant benefits sport and active recreation provides.

Through this membership, Council and Sport NSW can work together and better support the local sport and recreation sector through participation initiatives, offering community education sessions and workshops, community strategic planning processes and advocating for improved sporting outcomes. An example of this work may be the promotion of more participation by women in organised local sport.

Joint Use Partnerships

Council has been approached by the NSW State Government Department of Education and Communities to promote a new initiative known as Joint Use Partnerships which is a planning mechanism for local government and the NSW Department of Education to work together on the delivery of capital works where there might be increased benefits to the community by working together on infrastructure projects.

The Department of Education has not advised any time limits to this opportunity. The process requires that Council identify proposed capital work projects that might align with Department of Education interests. Projects may include sportsfields, arts centres and community halls and be works proposed on either NSW State Government land or that under the control of Council.

Progression of projects requires both parties to enter into a Memorandum of Understanding, followed by the development of a project brief which then requires a legal agreement on the roles and responsibilities of each party. Council Officers will continue to review projects to identify if any opportunities arise that might deliver better community outcomes through a joint partnership with the Department of Education.

Public Toilets

Fairfield City Council provides a range of public toilet facilities for community use. This includes public toilets that are open 24/7 which are available at 8 parks, disabled toilets accessible through the Master Locksmith Access Key (MLAK) system available at a range of sporting grounds and automated public toilets in the Town Centres.

The table below provides a month snapshot of the use and maintenance of the automated (Exeloo) public toilets available in Town Centres and including the addition of the multi- deck Car Parks at Nelson Street and Downey Lane in the Fairfield Town Centre and at Fisher Street in the Cabramatta Town Centre. Councils Exeloos’ continue to provide a high quality service and are extremely well utilised at each site.

Graffiti Prevention and Removal

Since August 2010, Fairfield Council has been collecting data about graffiti crime in the Fairfield Local Government Area (LGA).

The information that is captured is logged through the Australian Graffiti Register website and made available to the NSW Police through their Local Area Command. The main type of graffiti captured continues to be “tags” with the majority of vandalism identified on Council’s assets such as park amenities /sports fields and on park signs. All graffiti captured on the Australian Graffiti Register can be monitored to enable Police to identify hot spots for tagging for the prosecution of offenders. The majority of graffiti identified on private property remains on adjoining fences with Council open spaces/reserves.

The information in the table above shows all graffiti removal from the date Fairfield City Council first adopted the Australian Graffiti Register as part of a graffiti capture system.

The table shows that Fairfield, Canley Vale and Bonnyrigg are the highest graffiti reported suburbs in the last 7 years.

Juvenile Justice

Juvenile Justice has continued to provide a “paint over” service to more than 1140 sites across Fairfield City and they advise that they continue to task Juvenile Offenders to this service. Juvenile Justice has been continuing to paint over a significant amount of graffiti that has re-occurred along the cycleway between Canley Vale, Fairfield West and recently at the Downey Lane Multi-storey Car Park in the Fairfield Town Centre.

The Fairfield City Plan 2010-2020, has as a key element to “protect and enhance our natural environment”. Under the Local Government Act, Council has a significant responsibility for the planting of trees on public land and to preserve trees on both public and private property.

SUMMARY

Open Libraries Update

At the Outcomes Committee Meeting of 12 May 2015, Council endorsed the “Fairfield City Open Libraries” Program via the adoption of the following:

1. Council adopt a 12 month trial at the Whitlam Library of extended opening hours as recommended in the report. 2. Council adopt from July 2015 the Library opening hours outlined in Attachment B of the report, ‘Recommended Trial Opening Times and Hours’, to more efficiently align library services with residents’ usage, requirements, preference and convenience. 3. Council delegate authority for the City Manager to vary opening times and lunchtime closures plus or minus up to 2 hours based on customer demand. 4. Council introduce free Wi-Fi and free use of computer facilities into all Council libraries. 5. Council endorse the Library Modernisation Program as outlined in the report.

Council Customer Service Council customer service is provided through the Whitlam Library, the Bonnyrigg Library and the Wetherill Park Library. This service will be extended to the Fairfield Library early in 2017.

Library Café at the Whitlam Library The Construction Certificate to allow a café to be constructed at the entrance to the Whitlam Library has been approved. Work is expected to be completed in February/March 2017. Expressions of interest to operate the café have been sought.

Whitlam Library Refurbishment The refurbishment works of the ground floor of the Whitlam Library has virtually been completed. Customers have responded enthusiastically to the vastly improved facilities and services now available.

Extended Opening of the Whitlam Library A Section 96 Application has been submitted together with a statement of environmental effects to allow a 12 month trial at the Whitlam Library of extended opening hours. A Plan of Management for extended opening has been prepared by the Library, with procedures for extended opening currently being documented. Initially the Library will extend opening during weekdays until 10pm, with the option of extending to 12 midnight based upon the level of demand. A security concierge service will be present during extended opening times. It is anticipated that the trial will begin in April/May pending the outcome of the Section 96 Application.

Sydney Writer’s Festival

The Library participated in the Sydney Writer’s festival in November with a very successful event held on 17 November. The Library had the pleasure of hosting authors Jacqueline Harvey, Mulga (Joel Moore), Ronojoy Ghosh and Cheryl Orsini. A total of 155 students attended with 12 teachers/parents also attending from a number of Fairfield City’s schools: Sacred Heart, St Johns Park, Harrington Street, Bonnyrigg Public and Fairfield West. Each author conducted a talk and a workshop, sharing with the audience their journey to becoming published authors/illustrators. They also read snippets from their works, as well as providing students with tips on how to come up with ideas/inspiration for writing. Each session ended with a question and answer session.

Mayor’s Summer Holiday Program

On 17 November, at the culmination of the Sydney Writers Festival events, the Mayor successfully launched the Mayor’s Summer Holiday Program with the students of Fairfield City. The teachers present were all given a Mayor’s Summer Holiday Program kit and information package. All teachers were very supportive of the program and endorsed their support to promote the program with all their students.

Smart Bar

The Library’s innovative Smart Bar service is now available through all libraries. The Smart Bar provides a one-on-one digital consultancy service to educate customers in the use of the Library’s digital resources with their mobile devices. This service has proved to be highly popular with the Library’s customers and is fulfilling a real need within the community.

New Exhibition

In April the Library will be exhibiting a new exhibition at the Whitlam Library Cabramatta, titled Journeys in Fairfield. The exhibition will feature images from and stories about the Cabramatta and Villawood Hostels which were operational between from the 1950s to the 1980s.

This report outlines the progress made on Catchment Planning Branch projects and programs for the 6 month period ending December 2016, including multi-year and carry forward projects.

Flood Mitigation Program

During November 2016, Council was notified of grant funding under the NSW Government’s Floodplain Management Program:  Smithfield West Floodplain Risk Management Study and Plan  Cabravale Overland Flood Study  Prairiewood Detention Basin Upgrade Feasibility Study and Detailed Design These projects have now commenced with consultant’s briefs in preparation, with a view to engaging consultants to undertake the work, by April 2017.

Gregorace Pl Floodway Construction The preferred contractor has been determined for the Gregorace Place Floodway Construction project. If the quarterly budget revision is approved, construction can commence shortly.

Three Tributaries Flood Detention Basin Upgrade Design Concept designs for the Fairfield Golf Course and Powhatan Reserve Flood Detention Basin Upgrades are continuing. Initial modelling and concept design has shown that a considerable amount of armouring of the embankments would be required to meet current NSW Dams Safety Committee (DSC) guidelines. Negotiations are underway with the DSC to determine a more reasonable requirement for the detention basins.

Prospect Creek Floodway Rectification Design The preferred consultant has been determined for the design of the Prospect Creek Floodway Rectification project. If the quarterly budget revision is approved by Council, the project can commence shortly.

Update to Stormwater Drainage Policy The update to Council’s Stormwater Drainage Policy is nearing the final stages. A consultant has been engaged to undertake a peer review of the document and any comments will be considered for incorporation in the draft document. A briefing to Council will be undertaken in March 2017.

Existing Stormwater Improvement Program

2015/16 Minor Stormwater Works Construction of all the 2015/16 Minor Stormwater Works is complete.

One of these projects is at Water Street, Cabramatta West, where the existing butterfly grated pit would often become blocked with rubbish and stormwater would pond within the properties at numbers 40 and 42. A new lintel, with greater capacity, and pipe was installed between the properties to direct the flow into the existing pit.

Horsley Park Stormwater Drainage Design The design of the Horsley Park Stormwater Drainage project is almost complete. The cost estimate for construction of the design is approximately $1.5 million, and it can be staged over a period time. Construction has not been included in the 2017/18 Operational Plan, however it will be considered in the mix of unfunded projects for prioritisation and potential inclusion in a future program.

Prospect Creek Bank Stabilisation The Prospect Creek Bank Stabilisation works near Bromley Street, Cabramatta have been slightly delayed due to the presence of asbestos. The asbestos has now been removed from the site. Spreading topsoil, mulching and planting is planned for early 2017, when the weather cools slightly.

Rosford Reserve Detention Basin Outlet Remediation The Rosford Reserve Detention Basin Outlet Remediation is continuing, however the fee proposals received from contractors are above Council’s budget. If the quarterly budget revision is approved by Council, construction can commence shortly.

Wilson Road Reserve Creek Restoration Design The design of the Wilson Creek Restoration project has been delayed which means construction cannot commence this financial year. A budget revision has been requested of Council to move the funds for construction into 2017/18.

Stormwater Levy Program

Orphan School Creek Rehabilitation Works - Avoca Road to Cumberland Highway Civil works on the Orphan School Creek Rehabilitation Works - Avoca Road to Cumberland Highway is complete. Some minor erosion occurred after a rainfall event which will be rectified, along with some additional planting.

Construction of 2 Gross Pollutant Traps Construction of the Gross Pollutant Trap (GPT) at Chifley Street, Smithfield is complete and at Burdett Street Canley Vale is continuing. It is expected that this GPT will be completed within the coming month.

Cabramatta Creek Bank Stabilisation The design for the Cabramatta Creek Bank Stabilisation is complete and we have now entered into negotiations with the Holiday Inn to do work on their land and their contribution to the cost of the works.

Green Valley Creek Rehabilitation Design Negotiations with 2 possible consultants to undertake the Green Valley Creek Rehabilitation Design is underway with a view to engaging the preferred consultant shortly.

Smithfield Catchment Management Plan Council staff have reviewed the preliminary draft Smithfield Catchment Management Plan and provided comments back to the consultant. The draft report is expected to be issued by the consultant in the next few weeks, when we will seek Council support to publicly exhibit the draft report prior to adoption by Council.

CONCLUSION

The Catchment Planning Branch has been working on a number of different projects in 2016/17 and the projects are at varying stages of their project life. The projects continue to be advanced and will be reported to Council accordingly.
