On November 12, 1976, private respondent ordered from Eli Lilly. Inc. of Puerto Rico through its agent in the Philippines, Elanco Products, 600,000 empty gelatin capsules for the manufacture of his pharmaceutical products. The capsules were placed in six (6) drums of 100,000 capsules each valued at US $1,668.71. The 600,000 empty gelatin capsules in six drums were already shipped on board MV "Anders Maerskline" for shipment to the Philippines via Oakland, California. Shipper Eli Lilly, Inc. specified the date of arrival to be April 3, 1977. Said cargo of capsules were mishipped and diverted to Richmond, Virginia, USA and then transported back Oakland, Califorilia. The goods finally arrived in the Philippines on June 10, 1977 or after two (2) months from the date specified in the memorandum. As a consequence, private respondent as consignee refused to take delivery of the goods on account of its failure to arrive on time. Private respondent alleging gross negligence and undue delay in the delivery of the goods, filed an action before the trial for rescission of contract with damages against petitioner and Eli Lilly, Inc. as defendants. Denying that it committed breach of contract, petitioner alleged in its that answer that the subject shipment was transported in accordance with the provisions of the covering bill of lading and that its liability under the law on transportation of good attaches only in case of loss, destruction or deterioration of the goods as provided for in Article 1734 of Civil Code.

    Transport and Communications Bulletin for Asia and the Pacific No. 82, 2013 BATTLING CONGESTION IN MANILA: THE EDSA PROBLEM Yves Boquet ABSTRACT The urban density of Manila, the capital of the Philippines, is one the highest of the world and the rate of motorization far exceeds the street capacity to handle traffic. The setting of the city between Manila Bay to the West and Laguna de Bay to the South limits the opportunities to spread traffic from the south on many axes of circulation. Built in the 1940’s, the circumferential highway EDSA, named after historian Epifanio de los Santos, seems permanently clogged by traffic, even if the newer C-5 beltway tries to provide some relief. Among the causes of EDSA perennial difficulties, one of the major factors is the concentration of major shopping malls and business districts alongside its course. A second major problem is the high number of bus terminals, particularly in the Cubao area, which provide interregional service from the capital area but add to the volume of traffic. While authorities have banned jeepneys and trisikel from using most of EDSA, this has meant that there is a concentration of these vehicles on side streets, blocking the smooth exit of cars. The current paper explores some of the policy options which may be considered to tackle congestion on EDSA . INTRODUCTION Manila1 is one of the Asian megacities suffering from the many ills of excessive street traffic. In the last three decades, these cities have experienced an extraordinary increase in the number of vehicles plying their streets, while at the same time they have sprawled into adjacent areas forming vast megalopolises, with their skyline pushed upwards with the construction of many high-rises.

Carmella Coz, Paul Jason Flores, Kim Louie Hernandez, Alyssa Jean Portus* College of Engineering, University of the Philippines Diliman, Quezon City 1101, Philippines Abstract The Philippine Jeepney is one of the most popular, the most accessible and cheapest medium of public transportation in the country. During their driving period, an average of 10 hours a day, the Filipino jeepney drivers are exposed to sustained awkward postures. This research aims to evaluate the drivers’ workspace and driving conditions in relation to their anthropometric measurements and their workspace dimensions in order to determine the sources of awkward postures.A comprehensive survey among jeepney drivers inside the UP Diliman campus was conducted to identify the discomforts experienced by the drivers. In addition, a workspace evaluation in comparison with the drivers’ anthropometric measurement was also administered to seek out discrepancies that accounts for the discomforts felt. Results reveal that jeepney drivers’ working conditions pose danger to their health and safety. For instance, there is an insufficient distance between the steering wheel and driver’s seat causing restraint to the drivers’ mobility. The limited height of the windshield also blocks the driver’s line of sight keeping the drivers leaning forward when looking for traffic signs. Recommendations were made to improve the working conditions of the Filipino jeepney drivers. © 2015 PublishedThe Authors.

MONTEGRANDE / Philippine Daily Inquirer) MANILA, Philippines — The Land Transportation Franchising and Regulatory Board (LTFRB) plans to offer more routes “every week or every other week” for all modes of transport in Metro Manila depending on commuter demand. Zona Tamayo, LTFRB-National Capital Region director, said on Wednesday this was part of the agency’s “partial, calibrated and gradual approach” to reopening public transport. The more open approach to mobility was announced after the House committee on Metro Manila development asked both the LTFRB and the Department of Transportation to hike the number of public utility vehicles (PUVs) in the streets to up to 30 percent, and then by 10 percent every week. “At the moment, only 10 percent of all public transport are allowed to resume operations but the directive from the different agencies and local government units is to increase transport in different areas,” Tamayo said. So far, around 212 routes for all modes of public transport, including buses, UV Express vans and jeepneys, have been opened since the Inter-Agency Task Force for the Management of Emerging Infectious Diseases eased quarantine restrictions in the metropolis.

The development of the public transportation network is crucial in tackling these problems. In addition, investment in infrastructure development is essential to realize a sustainable economic growth. Metro Manila, in particular, requires a transportation policy to facilitate a modal shift from private cars to public transportation by developing and integrating transportation networks and strengthening linkages between transportation modes. It is within this context that the Government of Japan has provided technical assistance to the Philippines’ Department of Transportation and Communications (DOTC) and other related agencies through the Japan International Cooperation Agency (JICA) in conducting a capacity development project entitled “The Project for Capacity Development on Transportation Planning and Database Management in the Republic of the Philippines.” MUCEP, as the project is known (short for MMUTIS Update and Capacity Enhancement Project), has been carried out for more than four years, starting on 27 September 2011 and completing on 30 November 2015. The overall project goal of MUCEP is to enable the DOTC to prepare a public transportation plan for Metro Manila for strategic corridors by strengthening their capacity in transportation database management and public transportation network planning.

However, the adoption of electric vehicles (EVs) encounters varying challenges ranging from financing issues, government policies, and public acceptance. Using the Philippines as a case, this research applies political, economic, social, technological, legal, and environmental (PESTLE) analysis to determine how different drivers affect the adoption of EVs in the public transport system from various transport stakeholders’ vantage points. Survey results identified economic and technological factors as the main barriers to the adoption of electric public transport. This includes high investment and operational costs, lack of charging infrastructure, issues in driving range and use in different terrains, and the availability of EV parts and repair stations. On the other hand, the main enabler is the significant public support for the modernization of the public transport system through EVs, backed up by policy and legal drivers.
