Let all parties concerned attend before Their Lordship the Hon'ble Justice

Shri. S. S. Khemkar and Hon'ble Justice Shri. M. S. Karnik on the day of __ 2018 at 11:00 A. M. or soon thereafter for hearing an application on behalf of the Applicant in the above Petition. The above named Applicant prays:-

(a) That the directions of this Hon'ble Court to hold a general Body

meeting of the members of the Respondent No.1 Association on or

before 15th May 2018 and to complete the entire process including

the election to the New Managing Committee by 30tl1 June, 2018 in

terms of amended para No.6 of the order dated 6tl1 April, 2018

passed in the above Petition be kept in abeyance till such time as this

Hon'ble Court may deem fit and proper.

(b) That this Hon'ble Court may direct that the above Petition to be

placed on board for appropriate directions on a date after the Hon'ble finalises the constitution of

Respondent No.6.

(c) That pending the hearing and the final disposal of the above Notice

of Motion this Hon'ble Court be pleased to keep in abeyance the

directions of this Hon'ble Court to hold a general Body meeting of

the Respondent No.1 association on or before ISth May 2018 and to

complete the entire process including the election to the New

Managing Committee by 30th June, 2018 in terms of amended para

No.6 of the order dated 6th April, 2018 passed in the above Petition.

(d) Interim and ad interim orders in terms of prayer clause (a) to (c)

above.

I, Chandrakant S. Naik, Adult of Mumbai, Indian Inhabitant, the

Chief executive Officer of the Respondent No.1 abovenamed having my office at Wankhede Stadium, "D" Road, Churchgate, Mumbai 400 020, do hereby solemnly'affirm and state as under:- .'" ,"

1. I say that I am the Chief Executive officer of Mumbai Cricket

Association being the Respondent No.1 abovenamed. I am conversant with the facts of the case and duly authorised by the Committee of administrators comprising of (1) Mr. Justice H. L. Gokhale, former Judge of the Hon'ble Supreme Court of India (Chairman) and Mr. Justice V.M.

Kanade, former judge of the (member) appointed by this Hon'ble Court vide its order dated 6th April, 2018 passed in the above

petition to file this affidavit. I say that the brief facts relating to filing of this r " notice of Motion are as under:

2. I say that vide order dated 6th April, 2018 this Hon'ble Court was

pleased to appoint a Committee of Administrators (Hereinafter referred to

as "the Committee of Administrators") comprising of (1) Mr. Justice H. L.

Gokhale, former Judge of the Hon'ble Supreme Court ofIndia (Chairman)

and Mr. Justice V.M. Kanade, former judge of the Bombay High court

(member) for the purpose of ensuring that the Mumbai Cricket Association

implements all the directions contained in the Principal Judgment as well as

the steps set out in the timelines issued by the Hon'ble Justice Lodha

Committee pursuant thereto.

3. I say that relevant clauses of the said order dated 6th April, 2018

concerning this notice of motion are reproduced herein below and read as

under:

the proposed new constitution and/or proposed amendments to

the existing constitution of the Mumbai Cricket Association

which is to be placed before the General body of the Mumbai

Cricket Association is in conformity with the recommendations

of the Hon'ble Justice Lodha Committee as modified and

accepted by the Hon'ble Supreme court vide the Principal

Judgement in its letter and spirit. The Committee of

Administrators may, if it considers necessary, postpone the

meeting of the General Body of the Mumbai Cricket Association

currently scheduled on 16th April, 2018. However, the Committee

of Administrators shall endeavor to hold such meeting by 15th

May, 2018 and complete the entire process including the election

to the New Managing Committee by 30th June, 2018.

7. The" General Body meeting for the purpose of voting on the

proposed new constitution and/or proposed amendments to the

- ~ existing constitution of the Mumbai Cricket Association shall be .~V.l~-1I' conducted under the supervision of the Committee of ~!.If- J?;99 O~"U6a

to time to in the course of discharging its functions."

4. I say that in terms of amended para No.6 of the said order dated 6th

April, 2018, the Committee of Administrators was required to

endeavor to hold General body meeting of the members of the

Respondent no.l to amend the constitution by 15th May, 2018 and

complete the entire process including the election to the New

Managing Committee by 30th June, 2018.

5. I say that the Committee of Administrators took charge of the

administration of respondent No.1 association on 1/14/2018 and had

thereafter planned to draft the constitution of Respondent No.1 and

to hold the Special General body meeting of the Association to

consider the amended constitution as per the Lodha committee report

on or before 15/5/2018 so that the electoral process could be

completed by 30/6/2018 in accordance with the said order dated 6th

April, 2018 a copy whereof is annexed as exhibit "A" hereto.

6. I say that a period of about 45 days would be normally required

after amending the constitution of the Respondent No. lAssociation

to comply with the electoral process.

7. I say that on 2/5/2018 the Committee of Administrators has come

across a newspaper report published in the daily issue of the

newspaper "Times of India" circulated in Mumbai which has

inter-alia reported as under:

"A bench led by the cn Dipak Misra bench said it would

finalise the BCCI constitution by May 7 and state association

could amend their constitutions to bring it in sync with the

BCCrs. Thereafter, state association could hold elections to take

control of their affairs through elected bodies, the bench said."

I say that it is learnt that the said case before the Hon 'ble Supreme

Court ofIndia is adjourned to 11th May 2018 and hence information

about finalization of the constitution of BCCI i.e. the Respondent

No.6 herein can be known only on 11th May, 2018 or thereafter.

8. I say that in view of the said news paper report dated 2/5/2018 the

Respondent No.1 Association would be able to effectively amend its

constitution and bring the same in sync with the BCCI's constitution

only after the Hon'ble Supreme Court of India finalises the BCCI

constitution on i h May, 2018. I say that the Committee of

Administrators will also require additional time to ascertain changes

if any required to be made to the draft constitution of the Respondent

No.1 Association in order to bring it in sync with the finalized

constitution of BCCI and to thereafter convene a Special General

body meeting to get the constitution amended accordingly and also

to complete the entire process including the election to the New

I say that in view of the aforesaid, it would not be possible to hold a

special general Body meeting of the Respondent No.1 association on

or before 15 th May 2018 and or to complete the entire process

including the election to the New Managing Committee by 30th June,

2018 in terms of amended para NO.6 of the said order dated 6th

April, 2018 passed in the above Petition.

1O. I say that the Committee of Administrators has in its meeting held on

2/5/2018 considered the said newspaper report dated 1815/2018 and

inter-alia decided that appropriate application be made to this

Hon'ble court pointing out the said development so that this Hon'ble

Court would be in the know thereof and may pass appropriate --t;y lAc" directions. Hereto annexed and marked as Exhibit "C" is a copy of minutes of the Committee of Administrators of Respondent No.1

dated 2/5/2018.

11. I say that in the circumstances it would be necessary and in the

interest of justice that the directions of this Hon'ble <;:ourt to hold a

general Body meeting of the members of the Respondent No.1

association on or before IStl' May 2018 and to complete the entire

process including the election to the New Managing Committee by

30th June, 2018 in terms of amended para No.6 of the said order

dated 6th April, 2018 be kept in abeyance till such time as this

Hon'ble Court may deem fit and proper.

12. I say that in the circumstances it would also be necessary and in the

interest of justice that this Hon'ble Court may direct that the above

Petition to be placed on board for appropriate directions on a date

after the Hon'ble Supreme Court ofIndia finalises the constitution of

Respondent No.6.

13. I say that in these circumstances and pending the hearing and the

final disposal of the above notice of motion this Hon'ble Court be

pleased to keep in abeyance the directions of this Hon 'ble Court to

New Delhi: The arrangement of former judges presiding over the affairs of state cricket associations is likely to come to an end shortly, with the Supreme Court on Tues­ day indicating that cricket bodies will be al­ lowed to hold elections soon. A bench led by CJr Dipak Misra bench said it would finalise the BCCr constitution by May 7 and state associations could amend 'j their constitutions to bring it in sync with the BCCI's. Minutes ofthe Committee of Administrators of Mumbai Cricket Association

1. It is reported that in the hearing of the matter concerning BCeI in Hon'ble Supreme Court, which took place yesterday, i.e., 115/2018, the Hon'ble Supreme Court has sought suggestions from the member associations on BeCI Constitution. These suggestions are supposed to be made to amicus curie Shri Gopal Subramanium appointed by the Apex COUli. These suggestions are to be received by 7/512018 and he is supposed to make a report on proposed constitution of BCCI. The further hearing is presently fixed on 1115/2018. The court has in the meanwhile directed the members associations not to rush to hold elections on the basis of self-amended constitution till the cOUli finalises BCCI Constitution. The Court has also asked the member associations to synchronise their constitution with Bee!.

2. The Administrators appointed by Bombay High Court had in the meanwhile planned to draft the constitution and to hold the meeting to consider the amended constitution as per the Lodha COlmnittee report on or before 15/512018 so that the electoral process could be completed by 30/6/2018. This was in reference to amended para 6 of the order of Division Bench dated 614/2018 in O.S.W.P.(L) no. 752 of2018. The Administrators are however now of the view that in view of tillS development it may not be proper to call a ~~~~~eting on or before 15/5/2018 to consider any such constitution and to hold $~~~r'\'on on or before 30/6/2018.
