ad - 328 Four Seasons At Mirage Homeowners Association, Inc. Administrative Resolution No. 3-2021

RELATING TO A SYSTEM OF FINES AND PENALTIES WHEREAS, it is the intent of the Board of Trustees (“Board”) of the Four Seasons at Mirage Homeowners Associa- tion, Inc. (“the Association”) to establish a system of fines and penalties; and WHEREAS, the Amended Bylaws, the Amended Declaration of Covenants and Restrictions, Association Resolutions and/or the Rules and Regulations of the Association (collectively “the Governing Documents”) empower the Board to: (a) make, approve and amend reasonable rules and regulations for the Association applicable to all property including Lots and Homes and (b) enforce, following adequate written notice, the provisions of the Governing Documents by imposing fines, liens, restrictions, and legal actions on the use of common properties. WHEREAS, the Governing Documents empower the Board to: (a) establish rules concerning Homeowner, Resident, Tenant, and Guest use of the Association’s amenities provided Homeowner priority is maintained and (b) suspend the rights of any Homeowner, Resident, Tenant, or Guest to enjoy the Common Properties and facilities for any period during which any fines/penalties are outstanding for an infraction of any rules or regulations duly adopted by theAssociation. NOW, THEREFORE, BE IT RESOLVED the following Resolution be adopted to set forth the following procedure for a system of fines and penalties: I. DUE PROCESS Homeowners are bound to adhere to any and all Association rules and regulations duly adopted by the Association, as outlined in the Governing Documents. Non-compliance with Association rules will be processed in accordance with the attached flow chart. A Homeowner may receive a notice by phone for routine non-continuing first-time violations reported to Management. A Homeowner may be given thirty (30) calendar days to correct a violation. A shorter notice to correct a condition affecting the health, safety or welfare of residents may be given to a Homeowner, Resident, Tenant or Guest. Prior to the Association undertaking any punitive or corrective action, a Homeowner shall be offered Alternative Dispute Resolution unless the violation concerns imminent harm to a person or property. The Association shall comply with its Due Process Resolution. An alleged violation that requires professional or outside contractor to correct the violation shall be granted an extension of original thirty (30) days upon receipt of written contract stating date violation will be corrected. Upon completion Management will be notified. In the event violation is not corrected, fine(s) will be imposed after due process requirements are met. A shorter notice of five (5) days will be issued to correct minimal/modest violation that does not require a professional or outside contractor. Upon completion Management will be notified. Prior to the Association undertaking any punitive or corrective action, a Homeowner shall be offered Alternative Dispute Resolution unless the violation concerns imminent harm to person(s) or propert(ies)y. The Association shall comply with its Due Process Resolution. II. VIOLATIONS/INFRACTIONS Violations/infractions of Association rules and regulations may subject the violator to fines no greater than $25 per day for each violation. If a violation has not been corrected after the maximum fine has been imposed on a Homeowner, the Association may do any or all of the following: • add a restriction; • suspend a Homeowner’s rights/privileges until a continuing violation is corrected; or • institute legal action and or file a lien on the property III. RECURRING VIOLATIONS Homeowners having recurring violations will be fined from day one of receipt of notice. Notice to the Homeowner regarding recurring violation(s) will be sent notification letter via registered mail, return receipt requested, and regular mail. IV. SUSPENSION Non-compliance with Association rules and regulations applicable to the Common Properties, by a Homeowner, resident, tenant, guest, or other person on the Property subject the violator to penalties which include, but are not limited to, suspensions of rights/privileges, and/or imposition of restrictions for a period of not greater than thirty (30) calendar days for a fist time violation. A written Non-compliance letter will be issued for an infraction of the rules. Fines and penalties imposed by the Association for identical viola- tions should be the same for all. VI. CONFLICT AND INVALIDITY A. The Board may determine to waive all or parts of the fines, penalties, liens and/or other restrictions provided the reasons for such waivers are documented. B. Notwithstanding any of the above, the Association may exercise all rights and remedies available to it in law, in equity and/or pursuant to the Governing Documents. Should any provisions hereof be determined to be invalid, the remaining provisions hereof shall remain in full force and effect. C. This Resolution replaces Resolution No. 3-2018. Any provision contained within any previously adopted reso- lution of the Association, which conflicts with any provisions set forth herein, shall be deemed void and the provision contained herein shall govern.

This month I’d like to talk a little about travel photography. I ran this column a few years ago, but, with COVID restrictions lifting, we’re starting to travel again, so I thought it was a good time to run it again. It’s great to bring back wonderful images of the trip; and a camera that is easy to carry, and takes quality images, is important. Carrying a bulky camera bag or heavy camera will not make your vacation more pleasurable. Photographing the buildings, scenery, and people is nice, but images that capture mood or culture are the best. It’s good to include yourself, family, and friends in some of the images, but photographing the local people in their environment will add culture and fl avor. I’ve included some of my Bermuda images. If you’re familiar with your camera, try some shots on aperture priority and shoot at F8 or F11 to add depth and sharpness. Make certain you don’t center your subjects and try to fi ll the frame. When you return home, you may want to print a coff ee table book of the trip. It’s a great way to show off your images. There are many online services that publish nice photo books. That’s it for this month. As always you can send me an email at [email protected]. These photos were taken in an area in Ocean City, been rewarding and fascinating. The attached photos are all N.J. where various birds come to nest and mate. I’ve been from the past few months. The photos are of an adult and fortunate to see many different birds that are not native to a juvenile Black-crowned Night heron, a Glossy ibis, and this area and which are interesting and beautiful. Watching a Great white egret feeding its chick. There’s many more them build nests, feed their young and engage in mating birds of different species that I have photographed but I displays while wearing their colorful breeding plumage has like the way these gave me such interesting poses.
