I. Introduction

1. The Government of Lao People’s Democratic Republic (GoL) is implementing the GMS East-west Economic Corridor Agriculture Infrastructure Sector Project (EWEC-AISP) in the provinces of and . The Asian Development Bank (ADB) is supporting the project through Loan 3024-Lao (SF).1 The EWEC-AISP aims to regenerate and upgrade existing but underdeveloped and outdated agriculture infrastructure facilities that include pumping stations, weirs, canals, control structures, farm access roads and bridges. The Ministry of Agriculture and Forestry (MAF) is the executing agency (EA), assisted by the Department of Irrigation (DOI) that put up a National Project Management Office (NPMO) in Vientiane. The provincial governments of Savannakhet and Salavan are the implementing agencies (IAs), each assisted by a Provincial Project Management Office (PPMO). The District Coordination Office (DCO) at the District Agriculture and Forestry Office (DAFO) of each participating district provides support to the PPMO. The EWEC-AISP is being implemented in 3 phases, with 3 subprojects in Phase 1 (commenced in 2016) and 12 subprojects in Phase 2 (with 6 subprojects commencing in 2017-2018). Phase 3 has not yet started and 10 subprojects are being considered for inclusion.

2. This due diligence review (DDR) report covers the 3 subprojects in Phase 1 that were completed in 2017. The report will (1) look into the scope of project impacts, (2) check on how land acquisition was planned and executed, and (3) suggest actions that need to be undertaken to correct any outstanding social issues. It is hoped that lessons could be drawn from the findings of this report that would help project authorities improve resettlement planning and implementation in subsequent subprojects of the AISP. II. Description of the Subprojects

3. The Bungxe Subproject, located in Xayabouli District of , involved the rehabilitation and improvement of the Bungxe pump irrigation system and farm access roads. Rehabilitated or constructed under the subproject were 1 pump station; 2 main irrigation canals (3,703 m long); 7 secondary irrigation canals (8,033 m); 11 tertiary irrigation canals (5,857 m); 4 main drains (5,776 m); 227 ancillary structures (including farm turnouts, divisions, road crossings, culverts, flumes, side spillways, and end structures); and 3 farm roads (5,060 m). The subproject was envisaged to increase the area of dry weather irrigated farms to about 230 ha.

4. The Phanomxay Subproject, located in Phalanxay District of Savannakhet Province, involved the rehabilitation and improvement of the Phanomxay pump irrigation system and farm access roads. Rehabilitated or constructed under the subproject were 1 pump station; 2 main irrigation canals (2,720 m long); 6 secondary irrigation canals (4,260 m); 3 tertiary irrigation canals (645 m); 1 main drain (3,000 m); 85 ancillary structures (including farm turnouts, divisions, road crossings, culverts, flumes, side spillways, and end structures); and 3 farm roads (3,050 m). The subproject was envisaged to increase the area of dry weather irrigated farms to 270 ha. Figure I-1: Project Location Map

Bungxe Phanomxay

Vapy Neua

5. The Vapy Neua Subproject, located in Vapy District of , involved the rehabilitation and improvement of the Vapy Neua pump irrigation system and farm access roads. Rehabilitated or constructed under the subproject were 1 pump station; 1 main irrigation canal

(2,550 m); 8 secondary irrigation canals (6,675 m); 2 tertiary irrigation canals (1,225 m); 2 main drains (2,600 m); 114 ancillary structures (including farm turnouts, divisions, road crossings, culverts, flumes, side spillways, and end structures); and 1 farm road (3,260 m). The subproject was envisaged to increase the area of dry weather irrigated farms to 270 ha.

III. Land Acquisition per the LACRs

6. The Department of Irrigation (DOI) in March 2016 submitted to ADB for concurrence a land acquisition and compensation report (LACR) each for subprojects Bungxe, Phanomxay, and Vapy Neau. Just like a standard resettlement plan (RP), the LACR provided a thorough description of the subproject and included information on (1) the types and quantities of affected assets based on the results of the detailed measurement survey (DMS), (2) the socioeconomic situation of the community and of the affected households (AHs), (3) project principles and entitlements, (4) public consultations held, (5) the grievance redress process, and (6) the budget for implementing land acquisition and resettlement (LAR). A statement at the conclusion of each LACR declares, however, that not a single LAK was needed on compensation for lost assets; the AHs had signed voluntary donation forms in lieu of remuneration for their losses even before the LACRs were written. (See Appendix 1 for sample voluntary donation forms and supporting documents signed by the AHs).

7. In fact, voluntary donation forms were signed by the AHs either before or around the time of the conduct of the DMS. The AHs at the Bungxe Subproject signed voluntary donation forms in July and August 2015 (see para 97 of the Bungxe LACR); the DMS for the subproject was carried out on 21 July to 2 August 2015 (para of the LACR). In Phanomxay Subproject, AHs signed voluntary donation forms in July and August 2015 (para 97 of the Phanomxay LACR) ahead of the 23 September to 6 October 2015 DMS (para 34 of the LACR) for the subproject. In Vapy Neau Subproject, the AHs signed voluntary donation in June and July 2015; the DMS was carried out on 21-30 June 2015 (see para 34 of Vapy Neau LACR).

A. Bungxe Subproject

8. The DMS conducted on 21 July to 2 August 2015 identified the following adverse social impacts of the Bungxe Subproject: (a) acquisition of 0.9251 ha of private productive landholdings of 14 AHs, including forestland, paddy fields and orchards (garden land); (b) acquisition of 0.1860 ha of village forestland; and (c) acquisition of 68 private trees belonging to 11 AHs, in addition to 10 village trees. The total compensation due to the AHs for their lost assets was calculated at 78,546,000 LAK. The AHs executed a deed of voluntary donation in place of cash compensation for their lost assets in July and August 2015.

9. There were 6 vulnerable AHs, 4 women headed and 2 headed by the elderly. None of the AHs was poor. There were a total of 14 AHs, made up of 97 household members or the equivalent of an average household size of 6.9. (See Appendix 2 and Appendix 3 for the master list of the AHs and for details of their land losses). B. Phanomxay Subproject

10. The DMS on 23 September to 6 October 2015 identified the following assets that the Phanomxay Subproject would acquire: (a) 5.358 ha of private productive landholdings belonging to 74 AHs, including paddy fields and fishponds; (b) 0.1284 ha of drainage land of the village; (c) 0.05 ha of residential land of 20 AHs; (d) secondary structures, such as wooden fences, animal pen, and wooden kitchens; and, (e) 142 private trees belonging to 34 AHs. The total compensation due to the AHs for their lost assets was calculated at 813,100,100 LAK. The AHs in July and August 2015 executed a deed of voluntary donation in place of cash compensation for their affected landholdings, fences, animal pen, and trees. Similarly, the AH with an affected rice bin (12 m2 floor area) and 2 AHs that each lost a kitchen (8.8 m2 and 8.5 m2, respectively) agreed with the DCO and PPMO that the subproject would, at no cost to the affected households, dismantle and rebuild their structures on the same plots of the AHs but outside the subproject right-of-way (ROW).

11. There were 22 women AH heads, 2 of whom were elderly. Also, 19 of the male AH heads were elderly. There were a total of 93 AHs, made up of 639 household members or the equivalent of an average household size of 6.9. (See Appendix 4 and Appendix 5 for the master list of the AHs and for details of their land losses). C. Vapy Neau Subproject

12. The DMS conducted on 21-30 June 2015 identified the following assets that the Vapy Neau Subproject would acquire: (a) 6.17 ha of private productive landholdings of 102 AHs, including paddy fields and fishponds; (b) 0.2324 ha of communal land of Vapy Village; (c) 0.0601 ha of residential land of 4 AHs; (d) secondary structures, such as wooden fences, farm huts, farm implement shelter, and a rice bin; and, (e) 206 trees belonging to 43 AHs. The total compensation due to the AHs for their lost assets was estimated at 983,552,991 LAK. The AHs in June-July 2015 executed a deed of voluntary donation in place of cash compensation for their affected

landholdings, fences, animal pen, and trees. AHs with affected secondary structures, such as fences and farm huts, were promised that the subproject would have the structures relocated outside the subproject ROW at no cost to them.

13. There were 13 women AH heads, 5 of whom were elderly. Also, 16 of the male AH heads were elderly, 2 of who had physical disabilities. There were a total of 93 AHs, made up of 633 household members or the equivalent of an average household size of 6. (See Appendix 6 and Appendix 7 for the master list of the AHs and for details of their land losses). IV. Site Visits

14. The DDR mission in September 2019 visited the 3 subprojects and met with officers of the villages and water users’ groups (WUGs). A handful of AHs were present in the meetings. Personnel from the PPMO and DCO accompanied the DDR mission.

A. Bungxe Subproject

15. Highlights of the 23 September 2019 visit of the DDR mission in Bungxe Subproject are provided below. a. Construction works in the subproject started in April 2016 and were completed 18 months later in October 2017. b. The WUG and AHs complained that, while the rehabilitated system was generally doing well, there were issues that project authorities had to address, such as (i) water overflows at 4 locations of the main canal; (ii) some canal crossings are so steep that mechanized farm implements could not cross over them; (iii) erosion at the river bank is evident at the site of the systems’ head works; and, (iv) canal water gates and those of farm ditches have expanded and are difficult to operate because they are made of wooden planks.

c. The WUG and AHs complained that the contractor of the head works has yet to completely pay the salaries of laborers hired from the village, notwithstanding that the contractor has already demobilized. d. Participants in the DDR mission’s meeting (see Appendix 8 for the registry of participants and some photos) confirmed that public consultations were held prior and after the DMS. They also confirmed that nobody objected to donating their affected assets in lieu of compensation. However, they recalled that the discussions in the public meetings focused more on the subject of donation; meaning, the entire project policy might not have been discussed with them. The participants could not also agree on whether or not copies of the project information brochure (PIB) were given to the village officials, let alone individual AHs. e. Personnel from the NPMO, PPMO, and DCO carried out the DMS. Officials from the village and WUG were also present during the DMS. Occasionally, members of the AHs were present during the survey. f. Complaints were not recorded, but any complaint that cropped up was reportedly resolved at the village level. g. The land records of the AHs have not yet been amended. The AHs continue to pay tax for the portion of their landholdings that the subproject has already acquired.

B. Phanomxay Subproject

16. Highlights of the 23 September 2019 visit of the DDR mission in Phanomxay Subproject are provided below (see Appendix 9 for the registry of participants and some photos). a. Construction works in the subproject were completed 2 years ago; works lasted for 18 months. There were 2 civil works contractors, one did the headwork, the other the irrigation canals and the village road. b. Construction of the canals and headwork resulted in land take, while construction of the village road resulted in the acquisition of trees and secondary structures. The AHs agreed to donate their losses in lieu of compensation because they wanted the irrigation system improved and they wanted an all-weather village road.

c. However, the scheme has not yet been formally handed over to the village WUG because of outstanding issues, such as: (i) connection to the national power grid is still temporary; (ii) secondary canals and tertiary canals are leaking, causing flooding of paddies and erosion of service roads; and, (iii) work sites of contractors have not yet been restored to pre-project condition. d. Villagers prefer trapezoidal canals than the box-type canals that were constructed by the subproject even if this would have resulted in more land acquisition. e. Villagers prefer the water pump to be on a barge rather than being anchored permanently at the riverbank. f. Contractor of the headwork owes villagers 24.6 million LAK in unpaid workers’ salaries and construction materials. g. Both contractors still have claims with the AISP. h. Personnel from the NPMO, PPMO, and DCO did the DMS without the participation of the AHs. i. The AHs were not provided a copy of their signed voluntary donation forms and the results of the DMS of their affected assets. j. Copies of the PIB were provided to village officials and to the WUG, but not to the AHs. However, participants in the DDR mission meeting remember project authorities discussing the project resettlement policy in public consultations. k. Complaints were not recorded, but any complaint that cropped up was reportedly resolved at the village level. l. The land records of the AHs have not yet been amended. The AHs continue to pay tax for the portion of their landholdings that the subproject has already acquired.

C. Vapy Neau Subproject

17. Highlights of the 25 September 2019 visit of the DDR mission in Vapy Neau Subproject are provided below (see Appendix 10 for the registry of participants and some photos).

a. Construction works in the subproject were completed 2 years ago; works lasted for 18 months beginning in June 2016. Only 1 contractor was engaged for the subproject. b. The irrigation system had been in use the past 2 dry seasons before the September 2019 flood. c. The rehabilitated system was extensively damaged when the Xedon River overflowed its banks on 2-4 September 2019. The irrigation pump on a barge was almost swept away by strong currents and the power transformer was submerged in the flood. An inverted siphon of the main canal that crosses the national highway was destroyed. More than a thousand ha of rice paddies were heavily damaged, and tons of standing rice crops destroyed. Almost 200 water wells were impacted making household water scarce in the village. d. Immediate repairs need to be carried for the residents to be able to plant this coming dry season. e. The WUG and AH complained that the contractor owes villagers more than 100 million LAK in unpaid salaries and construction materials. This was the same contractor engaged in the 2 other subprojects.

f. Personnel from the NPMO, PPMO, and DCO did the DMS without the participation of the AHs. g. AHs signed voluntary donation forms in lieu of compensation; however, the AHs were not provided copies of the signed voluntary donation forms and the DMS of their affected assets. h. Public consultations were held and the project resettlement policy discussed. However, copies of the PIB were not provided to each AH. i. No translated copy of the LACR was posted at the village office. j. Complaints were not recorded, but any complaint that cropped up was reportedly resolved at the village level. k. The land records of the AHs have not yet been amended. The AHs continue to pay tax for the portion of their landholdings that the subproject has already acquired.

V. Analysis and Discussion

18. The LACRs were not resettlement planning documents. Land acquisition was carried out either before or around the time of the conduct of the DMS. Resettlement specialists of the loan implementation consultants (LIC) that prepared the land acquisition and compensation reports seemed to be unaware of this fact. A statement in the Bungxe LACR (see para 98) makes this evident, thus “the final updated LACR concerns the resettlement planning report that had already been concurred by ADB as part of the feasibility study during the PPTA stage.” The feasibility study (FS) stage document referred to was the 2013 resettlement plan prepared for each subproject that also had the title Land Acquisition and Compensation Report, contrary to the norm.

19. Notwithstanding the wrong choice of title, the 2013 LACRs were resettlement plans (RPs). Each LACR included (1) a preliminary identification and assessment of project impacts based on the concept (preliminary) engineering design, (2) socioeconomic information on the AHs, (3) a discussion of project principles and entitlements, (4) a narrative on consultations held, (5) a description of the grievance redress process, (6) an indicative budget for implementing land acquisition and resettlement, (7) a discussion of institutional arrangements in resettlement planning and implementation, and (8) a discussion of monitoring and evaluation requirements.

20. The 2016 LACRs did provide an updated information on project impacts based on the DMS per the approved detailed engineering design, including (1) socioeconomic information of the AHs; (2) a short description of consultations held at the villages to discuss the DMS process and, subsequently, to present the results of the impacts survey; (3) a copy of sections of the 2013 LARCs, such as project principles and entitlements, the grievance redress process, institutional arrangements, and monitoring; and (4) the replacement costs of affected assets. However, the 2016 LARCs reported that even at the time of the DMS, the AHs indicated their willingness to donate their affected assets in lieu of compensation, echoing the same statement in the 2013 feasibility study stage LARCs, thus “the contacted land owners indicated their willingness to donate land to the subproject as they expect benefits from its implementation.” Therefore, the 2016 LARCs reported a zero budget requirement to implement land acquisition because AHs had relinquished their affected assets in favor of the project even before the LARCs could be written.

standard”.

21. On a related social safeguard matter, this DDR report notes that none of the AHs received cash assistance for vulnerability. There is no problem with this per se, since the LACRs declared that all AHs in the 3 subprojects were middle-income households (i.e., none was poor or rich). However, to help readers understand why no cash allowance was to any vulnerable AH, the LACRs should have added a short explanation that the project resettlement framework (RF) only requires the granting of a cash assistance of 50,000 LAK for 90 days to poor AHs that are concurrently headed by the elderly, women, disabled, and a member of an ethnic minority group.

22. The foregoing discussions reveal weaknesses regarding the manner by which land acquisition was planned and implemented in the 3 subprojects.

23. Relatedly, the 2016 updated LACRs could not be considered as resettlement planning documents. The 2016 LACRs contained updates on project impacts per the DMS in addition to the actual implementation of land acquisition. In other words, the 2016 LACRs were more of land acquisition completion reports than resettlement planning documents.

24. This DDR report does not disagree with AHs donating their affected assets to the project in lieu of compensation. This is allowed by the project RF. However, it is difficult to imagine that AHs could make an informed decision on voluntary donation during or shortly after the DMS, let alone in the presence of provincial, district, and village officials. The AHs should have been provided sufficient time to mull over their options on compensation, following confirmation of what they were losing to the project.

25. The following are additional findings of the DDR that illustrate weaknesses in resettlement implementation: a. Land records of AHs have not yet been amended and that AHs continue to pay tax the past years for portions of their landholdings that they already donated to the subprojects is not fair. b. None of the AHs was provided a copy of the DMS of its affected assets and the signed voluntary donation form. This is a weakness in transparency and documentation. c. None of the AHs was provided a copy of the PIB. Summary versions of the LACRs in Lao were not posted in the villages or at relevant offices of the districts and provinces. d. Complaints of AHs and residents, reportedly resolved at the village level, were never documented, let alone systematically monitored and tracked at the NPMO level. e. NPMO has no readily available digital copies of the results of the DMS and socioeconomic survey (SES) conducted in the 3 subprojects. 26. In light of the aforementioned, one can only conclude that project resettlement specialists failed to adequately provide guidance to the executing agency. Likewise, they did not exercise vigilance in ensuring that land acquisition and resettlement were planned and implemented according to the project resettlement policy.

VI. Lesson Learned and Follow-up Actions Required

27. Lessons that can be drawn from Phase 1 of the AISP concern proper planning and implementation of land acquisition and resettlement. They are as follows: a. There are no cutting corners in planning and implementing resettlement. A resettlement plan has to be approved first before it can be implemented. b. Voluntary donation can be discussed during public consultations and similar forums, but the decision on relinquishing one’s property in lieu of compensation should be made privately by each AH after giving the household ample time to consider its options. c. Proper documentation and a functioning data retrieval system are indispensible in resettlement planning and implementation. d. Providing AHs copies of the results of their DMS, voluntary donation forms signed, and the PIB, not to mention the posting of resettlement documents at village offices, add meaning to the public consultation and participation process.

VII. Conclusion

28. This DDR report endeavored to piece together key events that transpired in connection with the planning and execution of land acquisition and resettlement in the 3 subprojects of AISP Phase 1. Lessons could be drawn from these events, one of which concerns the systematic application of protocols in resettlement planning and implementation. Public participation and consultation in various ways, including tracking of complaints until their resolution, should be carried on a continuing basis until project completion. AHs should be provided ample time to decide on whether or not they will donate their losses in lieu of compensation, and the AHs should sign voluntary donation forms in the privacy of their homes. Likewise, a functioning documentation and data retrieval system is invaluable in managing involuntary resettlement.

29. To help put to closure land acquisition and resettlement in Phase 1, project authorities (NPMO, PPMO, and DCO) are enjoined to implement the following corrective actions: a. Amend the land records of AHs that are in the custody of the village chiefs. The amendment will clearly put on record the remaining landholdings of the AHs for which they have to pay tax. b. Return to the AHs the amounts paid in tax for plots that have already been donated to the subprojects. The mode of reimbursement should be agreed mutually by project authorities and the AHs. c. Provide each AH a copy of the voluntary donation forms they signed that include information on what they lost and the value of what they donated to the project. d. Consistent with the project resettlement policy, a post resettlement implementation evaluation should be carried out by the social safeguard external monitor to determine whether the AHs have been able to re-establish their pre-project standards of living. Those found to be living below the poverty line should be paid retroactively the replacement costs of their lost assets, calculated at the time the AHs signed voluntary land donations.
