December 1, 1998 SPECIAL MEETING OF THE COUNCIL OF THE PARISH OF ASCENSION, DONALDSONVILLE, LOUISIANA DECEMBER 1, 1998 The Council of the Parish of Ascension met this day in Special Session in the Council Meeting Room, Courthouse East, Gonzales, Louisiana, 6:00 p.m., with Chairman Thomas Pearce presiding. The following members were present: Joseph Pierre Dudley Brown Milton Vicknair Jerry Savoy Thomas Pearce Todd Lambert Jeffrey Poche Darnell Martinez The following members were absent: Alvin Thomas Marvin Braud Gilbert Buratt Council Jeffrey Poche offered the prayer and led the pledge to the flag by all present. Parish President Tommy Martinez was not present. Chairman Thomas Pearce stated the purpose of the special meeting of the Council was consideration to adopt the Ascension Parish Land Use Plan and Development Code (Zoning Ordinance) and at that time opened the floor to the Council for discussion of said ordinance. Councilman Jeffrey Poche stated to the Council the changes before them were proposed at the special meeting on November 3, 1998. Moved by Jeffrey Poche, seconded by Todd Lambert and unanimously adopted, to recommend the following change to the Ascension Parish Land Use Plan (Page 17): Section 3.0 Land Use Definitions To pursue these principles, the Land Use Plan uses the following set of land use concepts. High Intensity Commercial and Residential Development Definition--This district includes residential development of not more than eight units per acre and commercial developments of a minimum lot of 43,560 square feet and commercial developments on a minimum lot of 16,000 square feet. Moved by Jeffrey Poche, seconded by Todd Lambert and unanimously adopted, to recommend the following change to the Ascension Parish Land Use Plan (Page 18): High Intensity Residential District Definition--This district allows residential densities of eight dwelling units per acre and commercial development of 1,500 square feet on a minimum lot of 10,000 square feet. Councilman Joseph Pierre recognized Ms. Theresa Robert, who addressed the Council in regard to a zoning request for a parcel of property owned by Robert Properties Inc. Moved by Joseph Pierre, seconded by Todd Lambert and unanimously adopted, to recommend zoning Commercial a parcel of property owned by Robert Properties, Inc. and The Cabin Restaurant located at Louisiana Highway 44 and Louisiana Highway 22. Moved by Joseph Pierre, seconded by Milton Vicknair and unanimously adopted, to recommend zoning Conservation, the M. P. Evans Property located from Interstate 10 to the Brittany Tower Road on the southeast side of Louisiana Highway 44 extending to Loosemore Road. Legal Advisor Ricky Babin stated to the Council the proposed changes to the Ascension Parish Zoning Map in accordance with Section XX-204, a sub-section of the ordinance, the map is to be a part of the adopted ordinance. Any recommended changes to the original Zoning Map as presented by the Planning Commission must be made prior to adoption. GSA, Inc. Engineer Mark Debosier presented each Councilman with a revised map of his respective district designating their requested changes. Chairman Thomas Pearce read aloud to the Council a resolution of support from the Ascension Chamber of Commerce as adopted by the Board of Directors of the Chamber on October 1, 1998. Councilman Joseph Pierre recognized Mr. John Lemman whom addressed the Council in reference to the proposed Zoning Ordinance. Moved by Jeffrey Poche, seconded by Dudley Brown and unanimously adopted, the text of the Ascension Parish Land Use Plan and Development Code to include the recommended amendments as approved by the Ascension Parish Council. Moved by Jeffrey Poche, seconded by Dudley Brown and unanimously adopted, the Ascension Parish Land Use Plan and Development Code Map to include all modifications as presented by the Ascension Parish Council on December 1, 1998. Moved by Jeffrey Poche, seconded by Dudley Brown and unanimously adopted, all literature and all Parish Codes as recommended by the Ascension Parish Council on December 1, 1998. Moved by Jeffrey Poche, seconded by Todd Lambert and unanimously adopted, to establish the effective date and implementation of the Zoning Ordinance, as adopted by the Ascension Parish Council on December 1, 1998, to be six months from date of adoption; effective date to be June 1, 1999. Moved by Jerry Savoy, seconded by Jeffrey Poche and unanimously adopted, to authorize Legal Advisory Ricky Babin to move forward with formulation of an ordinance in respect to placing a moratorium on the construction of communications towers in Ascension Parish. Councilman Jeffrey Poche thanked the Ascension Parish Planning Commission and Parish President Tommy Martinez and his staff for their tireless efforts in preparation for adoption of the Ascension Parish Land Use Plan and Development Code Ordinance. Chairman Thomas Pearce paid special tribute to Mr. Harvey Kling, Chairman of the Planning Commission, for his many years of service to Ascension Parish and for his leadership role in the zoning ordinance process. There being no further business to come before the Council of the Parish of Ascension, Louisiana, upon motion duly made, seconded and carried the Special Meeting adjourned at 7:25 p.m. _________ __________ CHAIRMAN SECRETARY .
