    Turning Medals into Metal: Evaluating the Court of Arbitration of Sport as an International Tribunal Daniel H. Yi Yale Law School May 2006 Abstract The history of transnational adjudication is littered with failure and disappointment. War crimes tribunals have often become farces, the ICC has exacerbated armed conflicts, and even the venerable ICJ has endured humiliating failures. This piece makes a compelling case for why one international tribunal, the Court of Arbitration for Sport (“CAS”), has managed to flourish in the otherwise depressing landscape of transnational adjudication. Specifically, the article makes a novel argument for 1) why parties are drawn to the CAS, and 2) how the CAS’ speech acts manage to have force. Reviewer Information I am currently a third-year student at Yale Law School. Prior to law school, I spent a year as a Fulbright scholar studying the distance running phenomenon in Kenya. I have also worked extensively with the U.S. Association for Track & Field (“USATF”), and was heavily involved in USATF’s legal response to the “BALCO” scandal of 2004.     Tomi Mertanen Voima ja kunnia. Suomen ja Saksan voimistelumaaottelut 1935–1940 (ref.) Suomen ja kansallissosialistiseksi vuonna 1933 muuttuneen Saksan po- liittiset suhteet kärsivät monista ongelmista 1930-luvulla. Suomalaiset suhtautuivat kansallissosialismiin vaihtelevasti ja kansalaisten mielipi- teet Hitlerin Saksaa kohtaan pysyivät jakautuneina koko 1930-luvun ajan. Vaikka maiden poliittiset suhteet eivät olleet parhaat mahdolliset, toimivat kulttuurisuhteet sitäkin paremmin. Kiinnostus suomalaista kulttuuria ja sivistystä kohtaan oli Saksassa suuri ja useilla eri taiteena- loilla saatiin aikaan toimivat suhteet maiden välillä. Kiinteimmäksi vaihto kehittyi kirjallisuudessa ja musiikissa. Innostus Suomea kohtaan ei kuitenkaan rajoittunut ainoastaan kulttuuriin vaan tiiviit yhteydet muodostettiin myös urheilun saralla. Tässä artikkelissa tarkastellaan Suomen ja Saksan välisiä 1930–1940-lu- vulla käytyjä voimistelumaaotteluita. Voimistelussa kontaktit muodos- tuivat säännöllisiksi ja ne varmistettiin erillisellä sopimuksella. Maaot- teluita oli määrä käydä vuosittain – vuoron perään molemmissa maissa. Urheiluvaihdon merkityksestä kertoo se, että suomalaislehdet seurasivat tiiviisti voimistelujoukkueiden edesottamuksia ja tulokset uutisoitiin 85 näyttävästi etusivulla. Maaotteluita käsitellään tässä sekä poliittisina että nationalistisina tapahtumina. The 1964 Summer Olympics, officially known as the Games of the XVIII Olympiad ( Dai J ūhachi-kai Orinpikku Ky ōgi Taikai ), were held in Tokyo , Japan , from October 10 to 24, 1964. Tokyo had been awarded the organization of the 1940 Summer Olympics , but this honor was subsequently passed to Helsinki because of Japan's invasion of China , before ultimately being canceled because of World War II . The 1964 Summer Games were the first Olym- pics held in Asia, and the first time South Africa was barred from taking part due to its apartheid system in sports. (South Africa was, however, allowed to compete at the 1964 Summer Paral- ympics , also held in Tokyo, where it made its Paralympic Games debut .) Tokyo was chosen as the host city during the 55th IOC Session in West Germany, on May 26, 1959. These games were also the first to be telecast internationally without the need for tapes to be flown overseas, as they had been for the 1960 Olympics four years earlier. The games were The 1964 Olympics were also the last to use a telecast to the United States using Syncom 3, the traditional cinder track for the track events. PUBLISHED BY WILHELM LIMPERT, BERLIN, S.W. 68 The Dietrich Eckart Open-Air Theatre provided an ideal site for the gymnastic competitions. Gymnastics When the preliminary work for the gymnastic contests was begun in 1933, the circumstance arose that the body concerned, the German Gymnastic Association, did not belong to the International Gymnastic Federation. Individual German gymnasts had competed in earlier Olympic Games, but there had been no official participation of the German Gymnastic Association. Now, in the few years between 1933 and 1936, it was necessary to establish a union with the nations represented in the International Gymnastic Federation. The Gymnastic World Championship contests, held in Budapest in 1934, offered the first opportunity to establish this contact. On the occasion of these contests, Germany, that is, the German Gymnastic Association, was admitted into the International Gymnastic Federation. On this occasion, the German men gymnasts for the first time participated as a group 837 in an international contest, competing against 12 nations. The Olympic Games offered the German women gymnasts their first opportunity to test their ability in an international contest. The problem of the manner in which the gymnastic contests should be carried out was studied in great detail by the Organizing Committee. When it was certain that the Dietrich Eckart Theatre would be constructed, the problem of a suitable contest site was solved. It was then possible to begin the purely technical part of the preparations-the provision of the apparatus, the publication of the exercises, etc.
