Circle of Knowledge Episode 2 – Matthew Wildcat Conor Kerr: Today on the Circle of Knowledge Podcast. Matthew Wildcat: I always really like speaking in Edmonton, because I always think of Edmonton as being one of the indigenous capitals of the world. It's easy to turn away from authority, but we actually need to dive into it and to define how we locate those forms of authority. But I prefer to talk about it in terms of responsibility, because what locating response does is it says, “okay yes there is going to be places where people make decisions and responsible for things, but then they're nested within that large web of relations and their acting based on those indigenous laws in order to do all this." Matt is a professor of political science at the University of Alberta and works on Indigenous governance structures. Today we're really going about wahkohtowin and his work with the Maskwacîs Education Schools Commission. We are going to start off with our interview with Matt Wildcat and Eliot Young. GREENWOOD SOURCE: OFFICE OF SPECIFIC CLAIMS & RESEARCH WINTERBURN, ALBERTA TAPE NUMBER: IH-221 DISK: TRANSCRIPT DISC 25A PAGES: 17 RESTRICTIONS: NONE SUMMARY OF ELDERS' INTERVIEWS TREATY 6 by Lynn Hickey Following is a summary of what the Treaty No. 6 elders have said in interviews about the nature of the treaty and the rights guaranteed to the Indian people by the treaty. Subjects discussed by the elders include mineral and other resource rights, hunting, fishing, and trapping rights, land and land surrenders, education and medicare, and economic development. In general, it would seem that most elders view the treaty as something which guarantees the Indian certain rights in exchange for permitting the white man the use of the land for farming, and perhaps timber for making houses, and grass for feeding animals. These are the only things that were requested by the treaty commissioners and the only things given up. In exchange for these, Indians received the right to pursue a livelihood in the traditional way, to live in particular areas unmolested, to be taught farming and be given agricultural implements and animals, to be provided with free education and medicare, and to receive such services on the reserve. The Treaty 6 elders, unlike the Treaty 7 elders, do not stress that the treaty was about establishing peace. Rather, the treaty was about land and permitting the white man to share in the use of that land whether the ideas is phrased as "selling" or "leasing" the land. -

Please post the following on your screen: Turtle Island Series – Daily Facts promoting Indigenous History, Culture & Contributions The Cree word for Edmonton is amiskwaciy-wâskahikan, means Beaver Hill House. The Niitsitapi and Nakota words for the region are kaghik-stak-etomo and chaba hei, respectively. Historically, the Beaver Hills region was important for the Tsuut’ina (Sarcee), Nehiyawak (Cree), Anishnaabe (Saulteaux), the Nakota Sioux, and the Niitsitapi (Blackfoot). Please share: The Edmonton region’s dense forests, open plains, rivers and lakes offered many resources for different Nations to rest and replenish their stores through hunting, gathering and fishing. The abundance of rich resources in the region made it an important place to rest during long voyages between the hills and the prairies, which happened each spring and fall. Activity in the region dates back to over 8,000 years ago. 200 Indigenous campsites and tool making sites have been found by archaeologists within the region. 2. Each First Nation has their own language, laws, traditions, customs and spiritual beliefs. Canada was named after the Algonquin word Kanata meaning settlement. Many First Nations can be heard referring to Canada as Turtle Island. This is in reference to the Creation Story of how the earth was formed on the turtle’s back. ERRATUM ERRATUM The article, “The Right to Be Heard: Representative Authority as a Requirement in Enforcing Métis Consultation” by Moira Lavoie, which appeared in volume 56 issue 4 of the Alberta Law Review, should be corrected as follows: On page 1213, in the first full paragraph under Part B, the fourth sentence incorrectly stated “the Supreme Court.” The sentence has been corrected to read: “Yet, unlike in those cases, the Court seems to have characterized the need for representative authority as a formal part of the legal test for triggering the duty to consult (the Haida test).” The version below was corrected on 18 June 2020. REPRESENTATIVE AUTHORITY AND MÉTIS CONSULTATION 1209 THE RIGHT TO BE HEARD: REPRESENTATIVE AUTHORITY AS A REQUIREMENT IN ENFORCING MÉTIS CONSULTATION MOIRA LAVOIE* The challenges that non-settlement Métis communities continue to face when attempting to enforce the duty to consult are reflected in the 2016 Alberta Court of Queen’s Bench Fort Chipewyan decision. In Fort Chipewyan, the Court appeared to require representative authority in order to trigger the duty to consult, effectively adding a new step to the Haida test for Aboriginal consultation. This creates a unique burden for non-settlement Métis communities in Alberta, in part because their governance systems are not statutorily recognized in Canadian statute. Nevertheless, a representative authority requirement, if interpreted purposively and in accordance with Indigenous principles of good governance, is justified by the Honour of the Crown. The Métis Nation of Ontario’s approach to consultation governance provides suggestions for governance reforms that could be undertaken by Alberta Métis to more effectively enforce the duty to consult. -
