Media Mergers 2003 Media Mergers 2003 The OECD Competition Committee debated media mergers in May 2003. This document includes an executive summary and the documents from the meeting: an analytical note by Mr. Gary Hewitt for the OECD, written submissions from Australia, Austria, Brazil, Canada, Czech Republic, Denmark, the European Commission, Finland, Germany, Ireland, Israel, Japan, Mexico, Spain, Chinese Taipei, the United Kingdom, the United States, as well as an aide-memoire of the discussion. Reviewing media mergers may be more complicated than reviewing other mergers because of the huge variety of possible media content and the two-sided market aspect of many media, i.e. those earning advertising revenue. A wide variety of content means that market definition is rendered more complex. The two-sided market characteristic has important and sometimes far from obvious impacts on how mergers affect economic efficiency, media plurality and content diversity. Vertical integration can produce real efficiencies in media markets notably when it eliminates a double-marginalisation problem but it can sometimes create competition problems as far as access to content and final delivery to the consumer are concerned. Adequate trade off between economic welfare and non-economic effects on social welfare, e.g. on pluralism, which are two separate goals, are difficult to make in reviewing media mergers. Although competition authorities tend to protect pluralism, most often they are reluctant to include pluralism considerations in merger reviews as they want to preserve their reputation for objectivity and evenhanded. Behavioral remedies which are more frequently applied than divestiture impose high enforcement costs on competition authorities. Bok- og forlagsbransje i EU-land virker innenfor ulike økonomiske og regulatoriske virkemidler og rammebetingelser. Som tillegg til en hovedundersøkelse om virkemidler for å fremme norsk skjønn- og faglitteratur skal det gjennomføres en egen kartlegging av rammebetingelser for bokbransjen i EU. Utredningen skal: a) kartlegge virkemidler i sentrale EU-land, for eksempel Tyskland, Frankrike, Storbritannia, Nederland, Spania, Sverige og Danmark. Også Sveits bør inngå i kartleggingen. b) gi en beskrivelse av disse virkemidlene mht. innhold, virkeområde, form etc. c) vurdere om elementer ved de kartlagte virkemidlene i EU-land kan ha overføringsverdi til norske forhold d) spesielt se på virkemidler som har som mål å fremme bredde i skjønnlitteratur, og et litteraturtilbud på eget lands språk – også i faglitteraturen. e) KD er ansvarlig for gjennomføringen av de delene av utredningen som omhandler fagbøker. KUD er ansvarlig for gjennomføringen av de delene som omhandler skjønnlitteratur. De to delene håndteres som to separate oppdrag, men koordineres med hensyn til utforming og gjennomføring. Utredningen skal gjennomføres i samsvar med utredningsinstruksen og innen 15. februar 2012. 3 Overordnet sammendrag 1. Denne studien omfatter bokbransjen i 15 europeiske land. 9 av disse har boklover med fastprisbestemmelser og 6 har friprissystemer. Generelt er det kontinentale Europa regulert med boklover. Friprislandene er Sverige og Finland, som har hatt fripris fra henholdsvis 1970 og 1971, Belgia fra 1981, Storbritannia fra 1995 og Danmark siden 2011.

    05-Sadler.qxd 2/3/2005 12:47 PM Page 101 5 MEDIA OWNERSHIP RULES It is the purpose of this Act, among other things, to maintain control of the United States over all the channels of interstate and foreign radio transmission, and to provide for the use of such channels, but not the ownership thereof, by persons for limited periods of time, under licenses granted by Federal author- ity, and no such license shall be construed to create any right, beyond the terms, conditions, and periods of the license. —Section 301, Communications Act of 1934 he Communications Act of 1934 reestablished the point that the public airwaves were “scarce.” They were considered a limited and precious resource and T therefore would be subject to government rules and regulations. As the Supreme Court would state in 1943,“The radio spectrum simply is not large enough to accommodate everybody. There is a fixed natural limitation upon the number of stations that can operate without interfering with one another.”1 In reality, the airwaves are infinite, but the govern- ment has made a limited number of positions available for use. In the 1930s, the broadcast industry grew steadily, and the FCC had to grapple with the issue of broadcast station ownership. The FCC felt that a diversity of viewpoints on the airwaves served the public interest and was best achieved through diversity in station ownership. Therefore, to prevent individuals or companies from controlling too many broadcast stations in one area or across the country, the FCC eventually instituted ownership rules. These rules limit how many broadcast stations a person can own in a single market or nationwide.

Peter Vallone, Jr. New York City Council Investigation Division EXECUTIVE SUMMARY New York City faces a “brain drain” in our City’s schools; a staffing crisis looms on the horizon as New York City public school teachers retire or leave the system at alarming rates. A report by the New York City Council Investigation Division (CID) shows that over 70% of the most experienced NYC public school teachers are likely to retire within the next two years, while more than 25% of mid-career teachers and nearly 30% of newer teachers say it is likely that they will leave the system within the next three years—potentially creating as many as 30,000 vacancies in the City’s classrooms in that time. There are currently over 80,000 teachers in New York City’s public school system.i In NYC, the two-year attrition rate for teachers is 25%, with 18% of teachers leaving in the first year—while the national rate is only ten percent.ii To find out how many teachers are thinking of leaving the school system and possible reasons why, CID investigators, with the assistance of UFT staff members, conducted a telephone survey of 2,781 teachers currently employed by the DOE. Respondents, who were randomly selected, were called during the weeks of April 26 and May 3, 2004.

E-mail: [email protected] Resumo O presente artigo analisa as narrativas sobre a inserção da MTV no Brasil, relacionando com o processo de abertura política no país. Partindo de algo já formatado, a operação brasileira trazia diferenças profundas, que repousavam na sua transmissão e no contexto de inserção, com uma série de acontecimentos que estruturaram a narrativa de abertura política, social e cultural. Coloco como marco central a promulgação da Constituição Cidadã, em 1988, por compreendê-la enquanto fator crucial de um processo de redemocratização, reverberando na radiodifusão no país, consolidando clima de liberdade, protagonismo e renovação. Com isso, o contexto de entrada da MTV no país está intimamente ligado com as reverberações da promulgação, em que as expectativas sobre o futuro estavam na ordem do dia. As fontes trabalhadas são matérias do jornal Folha de São Paulo, entre 1985 e 1990, em diferentes cadernos e colunas e que tiveram como foco as narrativas sobre a MTV. Portanto, o início das atividades desta emissora em solo brasileiro esteve associado ao desenvolvimento de narrativas que aventavam a ideia de liberdade, mediante conteúdo musical na programação, voltada ao público jovem.     International Journal of Communication 13(2019), 1167–1185 1932–8036/20190005 The Children Are Watching: A History of Age-Rating Television in Brazil LIAM GREALY1 CATHERINE DRISCOLL The University of Sydney, Australia ANDREA LIMBERTO The National Service for Commercial Education and University of São Paulo, Brazil Histories of Brazilian media regulation typically emphasize a major transformation with the passing of the federal constitution in 1988, contrasting censorship during the military period of 1964‒1985 with age rating, or “indicative classification,” thereafter. Contemporary conflicts among child advocates, television broadcasters, and the state as monitor of the industry’s self-regulation are grounded in a much longer history of age rating in popular media. Drawing on an examination of files from Brazil’s Ministry of Justice and interviews with current examiners, this article provides a history of age ratings for television in Brazil and of the processes by which classification decisions are made. We argue that the desire to limit young people’s access to television through age ratings has had significant ramifications in Brazil, evident in the formation of legal regimes, reform of institutional practices, and even the revision of time zones. Keywords: media classification, age rating, youth, minority, time zones, legal reform, Brazilian television, telenovelas The passing of Brazil’s federal constitution in 1988 was a central achievement in the nation’s transition from a prolonged era of military government to renewed democracy. Regarding media regulation, the constitution is usually understood as a shift from state-led censorship characterized by inconsistency, opaque decision making, and restrictions on political criticism to protected freedom of expression with media subjected to a system of differentiated age-based classifications.
