Introduction 1. Legal background As per EU Roaming Regulation III. effective from 1st July 2012, Mobile Network Operators must offer Wholesale Direct Access and Resale Access for Access Seekers on the territory of the EU/EEA countries for mobile roaming- • voice calls, • SMSs, and • data services made within EU member states. The provision of these services to other directions outside the area of the EU/EEA countries or other types of wholesale services are not covered by the roaming regulation, but can be subject to commercial negotiations. This document is to define a Reference Offer for Wholesale Direct Access and Resale Access. This document contains reference to GSMA standards used generally in roaming agreements. Points of the Reference Offer takes into consideration the BEREC Guideline of BoR (12) 107. Since the BEREC Guideline contains recommendations to MNO-s on how to implement the roaming regulation its points are legally not binding. This Reference Offer is subject to the Hungarian Law and is effective from the 1 st of January 2013. 2. Structure of the Reference Offer: This Reference Offer consists of the main Points and the Annexes as outlined in the content, these are inseparable parts of the Reference Offer. 3. Definitions Notions, abbreviations and acronyms used in this Reference offer are listed in point 1. (‘Definitions’) 3 Wholesale Roaming Access – Reference offer Vodafone Hungary Telecommunication Ltd. 1. Definitions - “Agreement” shall mean the Wholesale Roaming Access Agreement together with its Annexes - “Applicable law” – Hungarian National Law - “Direct Access” means that the Access Seeker contracts directly with a foreign visited network for the purpose of allowing roaming customers to access the roaming services of the retail provider. - “Direct Wholesale Access Seeker” as defined by the EU Roaming Regulation III. - “GSM Association” (GSMA) - the association of mobile operators and related companies devoted to supporting the standardising and deployment, also represents the interests of mobile operators worldwide - “GSM Association Permanent Reference Documents” (PRDs) – standards for mobile communication laid down by GSMA for roaming - “International Roaming” (IR) means the services in respect of which access is granted by Roaming Customer of Party B through A’s PMN - “MNO” – Mobile Network Operator - “NDA” – Non-Disclosure Agreement - “Public Mobile Network” (PMN) a network that complies with the definitions of a GSM network defined by the GSMA relevant documentation (AA.16) - “Roaming provider” the MNO who offers its roaming services to the Access Seeker - “Services” means the services specified by the Agreement - “VRS” means Vodafone Roaming Services, a HUB provider of Vodafone Companies - “Vodafone Participation company” : company owned by Vodafone Group Plc, in this case Vodafone Hungary Telecommunications Ltd. (Vodafone Hungary) - “Roaming Regulation III.”: EU Regulation N. 531/2012 of the European Parliament and of the Council of 13 June 2012 on roaming on public mobile communications within networks within the Union - “MNO” is a network operator that owns a licensed radio spectrum and owns the whole core network of providing telephone services to the end-customer. They are likely to lease part of their radio spectrum to other parties for telecom operations. - “MVNO heavy/light” is a network enabler that does provide (mobile) phone services but does not own a licensed radio spectrum nor does it necessarily has the entire infrastructure required to provide these services. However, they do have a direct customer relationship with the end user. “Heavy” MVNO’s do own a large part of the network infrastructure (e.g. HLR/MSC, Switching, Billing platforms) and primarily rely on the MNO for renting the radio spectrum by means of purchasing wholesale “minutes”. “Light” MVNOs have direct customer relationship but rely on MNOs to provide large part of infrastructure – their own infrastructure mainly includes retail billing. 4 Wholesale Roaming Access – Reference offer Vodafone Hungary Telecommunication Ltd. 2. Who can be a wholesale access seeker? Reference offer can only be requested by Access Seeker, who will serve EU roaming customers with EU numbering resources assigned to the mobile service. 2.1 Direct Access Vodafone Hungary sets the below requirements for Access Seekers to be able to provide roaming services as per the EU Roaming Regulation III. 2.1.1 Access Seekers must have their own and unique: - MCC-MNC range (IMSI range) - NDC range - PMN code - Basic GSM infrastructure - IN - SIM cards 2.1.2 Access Seekers must meet the standards set out by the GSMA in its PRDs: - BA.01 - BA.04 - BA.08 - BA.11 - BA.20 - BA.27 - BA.30 - BA.36 - BA.38 - BA.47 - BA.61 - TD.32 - TD.35 - TD.57 The above mentioned documents can be downloaded from the official site of the GSMA at: BA documents: https://infocentre2.gsma.com/od/Pages/default.aspx?r=documentprefix%3D%22string%3B%23BA% 22 TD documents: https://infocentre2.gsma.com/od/Pages/default.aspx?r=documentprefix%3D%22string%3B%23TD% 22 2.1.3 Access Seeker must be able to handle - TAP files - NRTRDE files as per relevant GSMA standards and PRDs. 2.1.4 Access Seeker must have a Data Clearing service for TAP file validation or any other equipment with which the Access Seeker is able to complete the TAP validation. 5 Wholesale Roaming Access – Reference offer Vodafone Hungary Telecommunication Ltd. 3. Direct Wholesale Access Agreement The Direct Wholesale Access Agreement and its terms and conditions are to be negotiated case by case and a draft version is to be provided after signing the NDA. A draft contract shall be made available to the Access Seeker for signature within 1 month of the access request. Vodafone Hungary requests the direct wholesale access service
