5. FINANCE. a) To note cheques signed between Meetings (Appendix A) b) To note receipts (Appendix B). c) To note outcome of application for a debit card to be used by the Clerk for internet purchases. d) To note that as requested an account of the CIL receipts as at 31st. March 2020 was sent to the City Council. It stated that as at 31 March 2020 East Hanningfield Parish Council was holding £2,861.01 in S106 receipts and £272.57 in CIL receipts, making a total of £3133.58. Of the S106 monies, £800 was allocated to works to the football pitch and £571.78 to extending the sports wall at the playing field. Since then, £255 has been spent on football pitch levelling. e) To adopt the new NALC Model financial Regulations, as sent out on 19th. May. f) To review the Risk Assessment to ascertain whether it is fit for purpose. g) Payments to be authorised, and receipts noted.

Chelmsford [Determination as to whether the prior approval is required for the proposed change of use from agricultural buildings to 2 dwellings (Class C3). ] c. To note that City Council has published its updated Statement of Community Involvement for consultation. The consultation runs for four weeks from 10.00 am on Tuesday 21 July until 4.00pm on Tuesday 18 August 2020, and to consider a response.

7. HIGHWAY SAFETY MATTERS To note report of fact finding along the Common was been postponed from the February Meeting.

8. HFC/PC LIAISON To receive the report from the Treasurer. Report to follow.

9. CATHERINE CLOSE PLAY AREA To note the findings of the annual RoSPA report and action recommended (Appendix D). To note the statement with regard to the continue closure of the play areas in the village (Appendix E).

10. TYE MATTERS To receive report of any Tye matters including condition of willow by the bus shelter and storm damage to bus shelter. Following discussions with the tree officer, PC applied to carry out works on the willows as follows: 2x weeping willows - cut back on a 3-5 year cycle, depending on growth, to prevent possible subsidence to the neighbouring property and to keep the growth clear of the nearby overhead cables. Tree A, (the tree to the south) following storm damage is unbalanced and needs to be pollarded at about 3-4m above ground level, so that it can grow back evenly. Tree B, (the tree to the north) thin back by 30-35% of branches (to previous pruning points) and cut back 1m from overhead cables. A new map has been fitted into the Footpaths noticeboard.

11. NEIGHBOURHOOD WATCH & COMMUNITY SPEEDWATCH To note recent crime incidents & Neighbourhood Watch meeting dates: Report to follow.

12. DATES FOR NOTE To note the Easter Play in the Park was cancelled. Summer Play in the Park is booked for 11th & 25th August, morning and afternoon, with an inflatable assault course all day on 11th.

APPENDIX C RESPONSES SENT TO PLANNING APPLICATIONS

19/01084/FUL Land East Of The Pumping Station Old Church Road East Hanningfield Chelmsford [Construction of new dwelling, barn and 2 stables.] The Parish Council objects to the proposed development of this site in the Open Countryside outside the Defined Settlement Boundary, and has seen no justification for the granting of this application in contravention of policy. In addition the Parish Council notes that the land has been contaminated in recent years due to overflow at the pumping station which coincided with flooding. The "dry" ditch shown in the Ecological Study has in recent years been overwhelmed by the surface water draining into it and has flooded the surrounding land and gardens. 20/00325/FUL Buildings North West Of 2 Little Claydons Cottages Old Southend Road Sandon [Demolition of existing outbuildings and open sided barn. Construction of new building for commercial cattery use. Creation of additional parking spaces]. East Hanningfield Parish Council has no objection to the proposed development on the understanding that every effort will be made to protect the roots of trees in the adjacent hedgerow, and that the tree to be removed will be replaced elsewhere on the site. 20/00447/FUL Little Claydons Old Southend Road Howe Green Chelmsford Essex CM2 7TB [ Rear single storey extension] No objection. 20/00535/FUL 6 Clinton Close East Hanningfield Chelmsford Essex [Single storey rear extension.] No objection. 20/00562/FUL 7 Road CM3 8AN [Formation of access.] Objection. It has been reported to the PC that work has already started at the site in contradiction of the statement on the application form. The existing vehicular access to this property was designed with site lines etc taking into account the traffic on this busy road. Without an explanation as to

why another access is needed for this property the Parish Council sees no justification for it and therefore objects to the proposal. 20/00610/FUL The Homestead, Southend Road, Common CM3 8ED Extension of existing garage/store and construction of new roof over. The Parish Council objects to the proposed development. Although it is accepted that the building would benefit from being tidied up, and the squaring off is a reasonable proposition, the 2m extension creates an over- large building which the Council finds unacceptable in this location in the greenbelt. The Council suggests that a building no higher than the present building and with a footprint no larger would be acceptable. Should the City Council be mindful to grant this application the Parish Council requests that a condition be applied prohibiting the use of the building for residential or overnight accommodation. 20/00602/FUL Lodge Farm,[Change of use to nursery] Objection. The location is unsuitable in that it would require parents delivering and collecting children to drive along a single-track road through a busy industrial estate and farmyard, where there are HGVs and farm vehicles moving about. The location is unsustainable as it is away from population centres, thus requiring all children to be driven to the site. As it stands the listed building is unsuitable for young children, and not amenable to conversion. The security of the garden has not been addressed. The Parish Council would wish to see the Ofsted report on the suitability of the premises before reconsidering this application for change of use. The Parish Council has been informed that there are plenty of vacancies at nearby preschools, which contradicts the assumption of need stated in the applicants’ business plan. Cllr. Draper declares an interest in the following application as his property shares the access on to Highfields Mead with the application site. 20/00622/FUL Highfields Farm Barn, Highfields Mead CM3 8AW [Proposed two storey side extension and alterations to dwelling. Proposed conversion of detached garage to gym/games room.] Objection. The site is outside the defined settlement boundary. The house was originally converted and then extended in sympathy with its original status as an Essex barn, the loss of the atrium and the addition of the side extension would divest the building of its historic character and appearance. The proposed increase in size of the living accommodation is disproportionate to the size of the original building. PC is concerned that the application should have included change of use from C3 to either C1 (hotels, guesthouses etc) or C4 (houses in multiple occupancy). Permission was granted for the garaging on the condition that it should not be used as a habitable space. No case has been made to justify its change in status.

No case has been made to justify the need for the extra bedrooms. The proposed increase in the number of bedrooms is likely to increase traffic to the site on the private single track access causing loss of amenity to neighbours who share the access. The proposed increase in the number of bedrooms and the reduction in parking space, by the conversion of the garage, would create parking problems and there is no space to park on the track outside the property, which is also a PRW.

Cllr. Applegate declares an interest in the following application as he is a near neighbour of the site. 20/00675/FUL Spindlewood, 18 Bicknacre Road [Two storey rear extension. Obscured window to first floor]. The Parish Council has no objection to the proposed extension and creation of an obscured window.

20/00744/FLU & 20/00745/LBC The Folly Bistro [Demolish rear kitchen extension and single storey outbuildings, new porch to listed building and replace existing windows. Addition of new rear and side extension, minor interior alterations to the listed building, small single storey addition to external cold store, new single storey bin store, reorganise carpark landscaping and new signage, including relocating existing sign. ] The Parish Council notes the applicant's efforts to increase parking provision proportional to the number of covers since the previous application, but also notes that there is no disabled parking, which might have been expected at a family oriented facility. Any car being parked by or for a disabled person will require two of the marked spaces, reducing the provision. The Parish Council requests that should the City Council award planning permission a conditions be applied which require best effforts to be made to ensure that employees do not park at the Village Hall, or nearby streets etc.and to limit the number of covers in the Bakehouse to 60 and in the restaurant to 30.

20/00760/ADV The Folly Bistro The Tye CM3 8AA Front gable fascia sign. Resiting existing tall road signage No comment 20/00709/FUL Claydons Farm Bungalow, Back Lane CM3 8AJ [Proposed alterations and extensions to existing bungalow to create a new dwelling, including raising of the roof with front dormer and balcony. ] Objection. Proposed house is considerably and disproportionately larger than the existing bungalow. Its design and massing are unsympathetic to the surrounding open countryside and the nearby listed building. PC considers that the house should be confined to the footprint of the existing dwelling. PC also notes that a large brick gateway has been constructed to the adjoining field inappropriate to its agricultural status, and suggests it should be investigated by Planning Enforcement. 20/00757/CUPAQ Barns west of Claydons Farm Bungalow [Determination as to whether the prior approval of the local planning authority is required for the proposed change of use from an agricultural building to 5no. Dwellings (use class c3).] It is PC’s opinion that what is proposed is rebuild rather than conversion, due to the poor condition of the existing buildings, and that, therefore, this proposal should be the subject of a planning application and not considered as permitted development. Also, the applicant’s interpretation of what is permitted and what will be permitted, under new guidance, with regard to number and square meterage of conversions is over generous. PC believes

that the intention of the new rules will be to restrict such a development to three large conversions of 465 sqm or 5 small dwellings if none greater than 100sqm but not three large and two small dwellings. PC therefore urges the City Council to require this proposed development to be the subject of a planning application. 20/00846/FUL: Little Claydons Farm Old Southend Road Howe Green Chelmsford [Replacement of turkey rearing and production building to replace previous building destroyed by fire.] No comment. 20/01001/FUL Claydons Farm Bungalow, Back Lane East Hanningfield Chelmsford [Retrospective application for the installation of 6 No. lamp posts.] Objection. This site is the open countryside at some considerable distance from the defined settlement, so additions that urbanise it, such as street lighting and the recently constructed grand, unsympathetic gateway to a field, should be resisted. In addition, Back Lane is a Protected Lane whose rural character should be preserved and close to which such urbanisation is detrimental. This development is counter to efforts to reduce light pollution and the use of electricity.

APPENDIX E JOINT STATEMENT BY EAST HANNINGFIELD PARISH COUNCIL AND HANNA’S FIELD CHARITY REGARDING THE RE-OPENING OF PLAY AREAS

The Government announced on 23 June, playgrounds and outdoor gyms will be able to reopen from 4 July. However, the government public health guidelines are a considerable challenge to all operators of these facilities. Reopening whether straight away or after delay is therefore at the discretion of people responsible for each facility. The Council and Charity have to be aware of their duty of care to the users, the wider public, staff and volunteers and have decided to delay reopening.

This is because it is not practicable for the Council or Charity to meet the following Covid 19 precautions: • Provision of Supervision in play area • Arrange a booking system • Relocate equipment for social distancing • Clean equipment daily • Provide cleaning equipment • Create entrance and exits (both Hanna’s Field and Hanna's Hoppet play areas each have only one gate)

EHPC & HFC are aware that some authorities have opened their play areas by transferring responsibility for taking precautions and risk management to the users of the play area through signs but we know both play areas are used by unaccompanied children who cannot be expected to comply with social distancing and hand sanitising guidelines or rationally judge risk to themselves or others. They would also find it difficult to comply with such recommended rules as a specified maximum number of children in the play area, a time limit on equipment and no face touching.

The government is being lobbied by interested bodies about the impracticality of the latest guidelines. Once new guidelines have been issued HFC and EHPC will review the decision not to reopen yet, but, regrettably, for the time being both play areas have to remain closed for everyone’s safety.
