3.6 ACCEPTANCE OF THE CERTIFICATIONS OF ELECTION FACTS FOR TRUSTEE AREAS 1, 2, 4, AND 6, AND THE OATH OF OFFICE CEREMONY - Recommendation: Following the Oath of Office ceremony, the Board recognize the returning Trustees and the outgoing President of the Board of Trustees. The Board accepted the certifications of the election facts from the Registrar of Voters and the Santa Clara County Recording Office for Trustee Areas 1, 2,4 and 6. The re-elected Board of Trustees members Robert Owens, Adrienne Grey, Karl Watanabe and Randi Kinman were administered the Oath of Office by Chancellor Davis.

Chancellor Davis said "On behalf of our entire community of educators, thank you for taking this important public service role. We know you will discharge it with honor, integrity, thoughtfulness and care. We're delighted to be your colleagues, and welcome back to the board." The District community welcomed them back to serve another term and expressed their gratitude for their continuous dedicated service to the WVMCCD and the students we serve.

3.7 ELECTION OF 2021 BOARD PRESIDENT - Recommendation: The Board of Trustees present nominations and elect a President for the 2021 calendar year. President Fish nominated Vice President Randi Kinman for Board President. No other nominations were made.

3.11 Presentations/Recognitions The Chancellor thanked Susan Fish for her service as the 2020 President of the Board of Trustees. President Fish is thoughtful, unflappable under pressure and has led the District Board through some uncertain times during this past year. Looking back through the year at the amazing work that's gone on in our campuses regarding social justice, addressing food insecurity, technology challenges, and working in collaboration to negotiate COVID-19. None of that would have been possible without exemplary support from our board and from our board leadership. The Chancellor displayed the gavel plaque expressing gratitude for President Fish's wise counsel and clear head while she served as 2020 President of our Board Of Trustees. Stephanie Kashima, Daniel Peck, Adrienne Grey, Anne Kepner and others expressed their gratitude for President Fish's leadership, friendship, guidance and support of higher education.

3.12 Oral Communication from the Public Jason L. Jones from ACCO Engineering expressed their displeasure in the District's public works bidding process for the Fine Arts Building Project, saying only two competitors use and can afford the required included in the bidding process, and he did not feel that the process was non-collusional.

One written communication to the Board from WVMCEA was received and will be shared with the Board of Trustees.

3.13 Report of the Audit and Budget Oversight Committee (ABOC) There was no report as ABOC does not meet until next week.

3.14 Report of the Legislative and Policy Oversight Committee (LPOC) LPOC members were joined by Ryan McElinney and Gerson Laiput-Sanchez from CCLC to provide an overview of current and pending release of legislation and advocacy. LPOC also discussed the new Ethnic Studies graduation requirements and set a goal to build relationships with new legislators. The next meeting will be January 13, 2021.

5.8 CONTRACT INCREASE TO ANDERSON BRULE ARCHITECTS FOR ARCHITECTURAL AND ENGINEERING SERVICES FOR THE LEARNING RESOURCE CENTER RENOVATION PROJECT AT WEST VALLEY COLLEGE - Recommendation: The Board of Trustees approve a contract increase in the amount of $195,000 with Anderson Brule Architects for architectural and engineering services for the Learning Resource Center Renovation project at West Valley College.

5.9 APPROVE CONTRACT WITH CONSOLIDATED ENGINEERING LABORATORIES FOR SPECIAL TESTING AND INSPECTION SERVICES - Recommendation: The Board of Trustees authorize the administration to enter into a contract with Consolidated Engineering Laboratories in the amount of $169,680.50 for special testing and inspection services for the Fine Arts Replacement project at West Valley College.

5.10 APPROVE CONTRACT WITH DSA SCHOOL INSPECTORS, INC. 10. Information Reports and Items for Future Board Consideration

10.1 Academic Senate Update (Aram Shepherd) (Gretchen Ehlers) MC Academic Senate President Shephard expressed his gratitude to President Fish for her leadership in 2020. He also thanked the members of the Curriculum Committee, Distance Education Committee and the Senators for their hard work and dedicated service in trying times. The Senate passed a resolution in support of hiring an Ethnic Studies FT Faculty member to lead a new Ethnic Studies Program. He also expressed his gratitude for his students who are struggling and thanked the community for supporting them in these uncertain times.

WVC Academic Senate President Ehlers also thanked Susan Fish for her service and Randi Kinman for stepping up to take Susan's place as President of the Board. OER grants are being given again this year to support development of free 010 online class textbooks and study materials. Ethnic Studies courses are in the development stage. Guided Pathways has created program maps so students know what courses to take to achieve their educational goals. She wished everyone a safe and relaxing holiday.

10.2 Classified Senate Update (Ana Lobato) (Kristal DeLaCruz) WVC Classified Senate President Lobato congratulated all the new hires, but she was especially excited to have Debra Griffith as the new Vice President of Student Services, having worked closely with her for years. The last Classified Senate meeting for the year is 12/9/2020, and they will have a special guest in Adrienne Grey, who will speak about the work they do in LPOC and also her role as President on CCLC's California Community College Trustees and their focus. Brenda Rogers will be advocating for the WVC Senate's support in adding one more classified representative to Chancellor Oakley's consultation council from the California Community College Classified Senate (4CS) The new representative would represent all classified professionals statewide. She thanked Brad Davis for creating a pipeline for classified professional development and wished everyone a happy holiday.

MC Classified Senate President DeLaCruz, thanked her Mission Buddies and Creating Spaces planning teams for their dedicated work this year. She also said that the caring campus team recently gave a presentation to the managers at Mission College on the Caring Campus Initiative. They have held their last senate meeting for the year, and wished everyone a happy winter holiday.

10.3 Student Senate Update (Maddy Mandarelli) (Alondra Martinez-Medina) On behalf for the WVC ASG Executive Board, President Mandarelli thanked the College Activities Board (CAB) for their work over the past semester keeping the connection with students. She thanked student government advisors Ray Gamba and Jennifer Keh for their guidance and counsel to the ASG, and she thanked and congratulated Debra Griffith for her strong support of students and her new appointment as Vice President of Student Services. The ASG looks forward to returning refreshed and ready to start the spring semester.

10.4 West Valley College Update (Stephanie Kashima) President Kashima congratulated President Kinman on her new position and looks forward to working with her in 2021. Everyone was invited to attend the Lifetime Achievement Award event this Friday honoring Paulette Boudreaux and Carolyn Nash for their pioneering work in the Success program they started decades ago supporting African American Students. The Success program evolved into the current Umoja program. Stephanie wished everyone a restful and rejuvenating holiday.

10.5 Mission College Update (Daniel Peck) President Peck thanked the Board for approving the hiring of Yuko Kawasaki, the dean of Nursing and Health Occupations. Yuko began her teaching career at Mission College. He thanks Marsha Oliver, Judith Berkeley and Brian Miller for stepping in to manage the program in the dean's absence. He expressed his gratitude for the support the Curriculum Committee and the Distance Ed. Committee has provided to our dedicated faculty, who have pulled it all together during nearly impossible circumstances. Thank you to our classified staff, and to the Classified Senate for the creation of caring spaces, which is a very welcome resource for candid conversations in a safe environment and for creating Pika Kucha, the impactful video that can be viewed on the HSI-STEM program YouTube feed. He invited the trustees to two events, the Kwanzaa celebration on Thursday at 5:00 p.m. and the College Holiday Zoom party on Friday at Noon. He also highlighted the award for $60,000 to Mission College as part of a consortium of businesses and colleges for an STEM student internship program. Mission is working with Cabrillo middle school students and their parents to illustrate how affordable college can be and that Mission college would be a good resource for them. He talked about Jennifer Eng, and student who won an award for her poster at the STEM conference for Minority students in physiology and pharmacology. Her poster illustrated research she did during her summer internship, working with faculty member Dr. See Chan, on deer antler supplements for relieving inflammation from osteoarthritis. Thank you to all the faculty and classified who supported this HSI-STEM internship program. Happy holidays and here's to a good break.

10.6 Chancellor's Report (Bradley Davis) Chancellor Davis thanked the District Community for its hard work in very challenging times. Thank you for everything you have done to support teaching and learning this year. He wanted everyone to take the time over the winter break to relax, rejuvenate and recover from a very difficult year. He also wanted to say how fortunate we are as a district. We have a board of trustees that has offered us such tremendous continuity and strength at a time when boards are turning over all over the district. We have empathetic and thoughtful administrators who enjoy working together. We have faculty who got it done in spite of incredible circumstances. He thanked classified staff who are clearly willing to do anything to support student success in the time of COVID. He was proud of the work we accomplished this year, and hopes we never see anything like this again. What hasn't killed us will make us stronger. He asked everyone to enjoy themselves over the holiday. Be safe, be healthy and thank you. Here's to a great 2021.

10.7 Trustee Comments Trustee Owens said that he knows West Valley College is in the process of drafting its Education and Facilities Master Plan (E&FMP), and he requested that the college make a presentation to the Board on this plan relatively soon. He would like to know what are the contemplated changes and what are the recommendations the college adopted and discarded, and why? What changes will come in three, five and ten years? President Kashima interjected that they were planning on making this presentation in the late spring when the E&FMP is completed.

WVC Student Trustee Hartman said that she knew right away that Dean Griffith was not an ordinary administrator when a student she was assisting was having an issue, and they stopped Debra on her way to catch a plane. Dean Griffith disregarded catching the plane and spent 20 minutes listening to the student to resolve the issue. She will be a great Vice President. Tisha also said in her time working with Trustee Kinman on this Board and then on the MTC Board, she recognized that Randi is a strong advocate for minority rights and serving the underserved population. Congratulations on your Presidency. 011 Trustee Fish said that in the beginning of her time as board president, she met with both Academic Senate Presidents Shepherd and Ehlers with very beneficial results, and she hopes that when it is safe to meet in person agian, that practice will resume.

Trustee Grey congratulated President Kinman and Vice President Kepner on their election. She said that the 2020 CCLC annual convention's recorded breakout sessions are now available on their website for viewing. She also said that the ACCJC presented a learning series on the future of education that was very interesting and heavily focused on DEI and new technologies, and she encouraged others to listen to the series. The Chancellor's office has set up a Diversity Equity and Inclusion site with learning resources and material for college districts to access. They also have a draft resolution for districts who want to formally declare their DEI commitment. It can be found by searching CCCCO DEI on the State Chancellor's website.

Trustee Kinman said she was reminded by Jack Lucas that the purpose of the Trustees comments was to report on how you had worked and advocated for the District as a Trustee. That being said, she appointed Trustee Lucas as our honorary ambassador-at-large, to freely attend the meetings we all wish we could join but cannot due to time constraints. President Kinman closed by wishing everyone time to decompress and rest during the holidays.

Funding Source/Fiscal Impact The General Fund is the major source for the cost of instruction, which pertains to the offering of approved courses. These costs are offset, to varying degrees, by apportionment received for credit-based instruction and other associated fees.

Reference(s) Curriculum development and recommendation is an ongoing activity overseen by the Academic Senate, and its subordinate Curriculum Committee, and the Office of Instruction as per District Policy 4020. It is integrated into the West Valley College Program Review process. It is emphasized in many sections of Standard II of the Accreditation Standards of the Accrediting Commission for Community and Junior Colleges. Likewise, it is regulated through Title 5 and WVMCCD District Policy 4020.

Background/Alternatives As per District policy, the curriculum changes to programs and courses described herein have been considered and recommended by the Curriculum Committee and the Articulation Officer. Each of the curriculum changes and the foregoing recommendations has been further reviewed by the Chief Instructional Officer, the College President, and the District Chancellor. The Office of Instruction further certifies that the programs and courses described herein satisfy all applicable requirements of Title 5 and have also been submitted to the Associated Students Government of West Valley College. Degrees developed in compliance with State-approved Transfer Model Curricula (TMC) pursuant to SB-1440 (Padilla, 2010) have already been approved by the District Chancellor acting as designee for the Board of Trustees, and are being presented here as information items.

Coordination Offerings have been coordinated between Mission College and West Valley College through a process of consultation.

Follow-up/Outcome Following Board approval of the curriculum changes, updates to catalogs and class schedules will be made, and campus marketing communications will reflect the changes, as appropriate. Reference(s) This item will provide the District with successful upgrades to the IPAM infrastructure and provide service and value for students, staff, and faculty. The equipment would be procured under Infoblox’s master agreement No.AR2472 for NASPO with participating addendum No. 7-17-70-40-05. The term of the contract is three years.

Background/Alternatives Infoblox will be responsible for procuring and installing a number of appliances and servers required to not only refresh aged current equipment but also deliver needed functionality. Infoblox provides core network functionality - without this, WVM systems and applications will not be able to connect to internal or external resources. The current Infoblox appliances will be end-of-life on February 15, 2021, and will no longer be supported.

Coordination The associate vice chancellor of information & educational technology and the associate vice chancellor of finance and administration have reviewed the contract.

Background/Alternatives John Burton Advocates for Youth has received funding from the Educational Credit Management Corporation (ECMC) Foundation Basic Needs Initiative to issue subgrants to community college campuses in California. These subgrants will be used to create new basic needs centers or to either expand or scale existing basic needs services. The goal of this investment is to enable individual campuses to serve students better, to inform efforts related to the effective scaling of this approach, and to highlight best practices. It also supports the development of mechanisms for reducing basic needs insecurity systemically, such as improving students' access to financial aid. This agreement will end June 30, 2022.

This work directly relates to supporting the basic needs of students, which was identified as a crucial part of the implementation of the adopted Mission College Equity Plan. This includes plans to develop a permanent home in the Mission College Campus Center for a Food Pantry distribution location.

Coordination Coordination for the JBAY grant will involve Mission College’s office of student equity & success, student activities, financial aid, vice president of student services, vice president of administrative services, and the district’s general services executive director.

Follow-up/Outcome On approval of the MOU, JBAY will provide a single payment of $15,000 in order to accomplish the activities outlined in the attached agreement.

092 Memorandum of Understanding (MOU)

Parties to MOU

This is a Memorandum of Understanding (MOU) between the Mission College (“Subgrantee”) located at 3000 Mission College Boulevard, Santa Clara, CA 95054 and John Burton Advocates for Youth (“JBAY”), located at 235 Montgomery, Suite 1142, San Francisco, CA 94104.

Purpose of MOU

John Burton Advocates for Youth has received funding from the ECMC Foundation Basic Needs Initiative to issue subgrants to community college campuses in California to create new basic needs centers or expand or scale existing basic needs work. The goal of this investment is to enable individual campuses to better serve students, inform efforts related to the effective scaling of this approach, highlight best practices and develop mechanisms for reducing basic needs insecurity systemically, such as by improving access to financial aid.

Payment

The Subgrantee will be provided a single payment of $15,000 in order to accomplish the activities outlined in this agreement. Payment will be issued within three weeks from the effective date of this MOU.

Duration of Agreement

This agreement takes effect upon execution by both parties and ends effective June 30, 2022. The Subgrantee agrees to return any unexpended funds to JBAY as of June 30, 2022.

Subgrantee’s Responsibilities

The Subgrantee agrees to complete the following activities:

 Complete the deliverables as described in the scope of work included as Attachment 1. Receipt of the grant is not conditional on the completion of these deliverables.  Engage with the JBAY technical assistance team to support implementation of the activities outlined in this MOU and other activities related to the provision of support for student basic needs as appropriate.  Conduct an evaluation of financial aid policies in collaboration with JBAY and consider possible adjustments to existing policies to maximize access to financial aid for students experiencing basic needs insecurity.

093  Work with Education Northwest to develop a protocol for data sharing in order to support the evaluation of the ECMC Basic Needs initiative. Any data sharing shall be governed by a separate agreement between the Subgrantee and Education Northwest and shall be implemented in accordance with any existing federal, state or local laws or regulations and in accordance with existing Subgrantee policies (See attachment 2 for details).  Maintain records of receipts and expenditure made in connection with the grant.  Provide an interim report by November 1, 2021 and a final report no later than June 30, 2022. The report shall include a brief narrative description of activities performed and a financial report of how the funds were expended.  Subgrantee undertands that these Grant funds have been and may be used only for such purposes outlined in the MOU and that no substantial variances will be made from these purposes without JBAY’s prior approval in writing.

JBAY Responsibilities

JBAY agrees to the following:  Provide payment to Subgrantee per the terms outlined in this agreement.  Provide technical assistance to the Subgrantee to complete the deliverable items set forth in this MOU.

Miscellaneous Provisions

Assignment: This MOU shall not be assigned to a third party without the express written consent of the Organization.

Independent contractor: Subgrantee is deemed at all times to be an independent contractor and shall be wholly responsible for the manner in which they perform the services required of them by the terms of this MOU. Nothing contained herein shall be construed as creating the relationship of employer and employee between the Organization and the Subgrantee.

Indemnification: Subgrantee shall defend, indemnify, and hold the Organization, its officers, employees, and agents harmless from and against any and all liability, loss, expense (including reasonable attorney’s fees), or claims for injury or damages arising out of the performance of this MOU.

Amendment: Either party may request changes to this MOU. Any changes, modifications, revisions or amendments to this MOU which are mutually agreed upon by and between the parties to this MOU shall be incorporated in writing, and effective when executed and signed by all parties to this MOU.

Severability: If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable.

094 Termination: Each Party shall have the right to terminate the Memorandum of Understanding without cause by giving 10-days written notice to the other Party at any time. If the Memorandum of Understanding is terminated by either Party, steps shall be taken to ensure that the termination does not affect any prior obligation, project or activity already in progress. If the Memorandum of Understanding is terminated by either Party the Subgrantee is responsible for returning the balance of unspent funds to JBAY.

097 Attachment 2 – Data Sharing Request

John Burton Advocates for Youth (JBAY) is one of seven grantees funded by the ECMC Foundation focused on the research, development, and scaling of basic needs initiatives (BNIs). The ECMC Foundation has also contracted Education Northwest, a nonprofit in Portland, Oregon, to conduct an external evaluation of grantees’ initiatives. The overall goals of the evaluation are to contribute to the fields of postsecondary education and philanthropy and to help identify how organizations and institutions can support BNIs to serve postsecondary students across the country.

If you are selected to receive the JBAY basic needs center grant, your institution has the opportunity to be included in this external evaluation. Your participation in the external evaluation is voluntary and will not impact your receipt of seed grant funds from JBAY. Participation in the evaluation may inform improvements to your basic needs initiatives (see details below).

Evaluation participation. One part of the Education Northwest evaluation will examine student access to basic needs services and the relationships between access and student outcomes. To participate in this part of the evaluation, we would ask that you collect the following student-level data elements from students who access your basic needs center during the 2020/21 and 2021/22 academic years.1

Example of requested student-level data elements Student ID We will use the Student ID to uniquely identify students and merge records with student-level demographic and academic data requested from your institution’s Institutional Research office. Date(s) student accessed basic needs We will use these data to identify who center accesses the basic needs centers. Service(s) provided to student We will use these data to identify what services students are receiving.

Education Northwest would also work with your Institutional Research office to establish a data sharing agreement with your institution to collect student-level

Students who do not provide consent must still be eligible to access the basic needs center and receive services. A formal data sharing agreement would be established between Education Northwest and your institution to ensure data sharing is executed in a secure manner that is compliant with FERPA and any other relevant considerations.

098 academic and demographic data for all students who attend during the 2020/21 and 2021/22 academic years.

Use of data. Data from your institution will be combined with data from other institutions across all grantees. Education Northwest will conduct analyses to examine characteristics of students accessing basic needs services/resources and the relationship between access and several short-term, student-level outcomes. Results will not be reported by individual institution in deliverables. Results will be shared publicly in reports, delivered to the ECMC Foundation in 2022 and 2023.

Potential benefits to your institution. Education Northwest may be able to provide you an internal data memo with results for your college detailing characteristics of your college’s students who are accessing basic needs services and the relationship between access and student retention and academic performance. This memo may be used to inform program improvements and share information about and advocate for your program with external stakeholders.

Funding Source/Fiscal Impact There is no fiscal impact to the District.

Reference(s) Contributions required to be paid by a CalSTRS member are picked up for the sole purpose of deferring taxes as authorized by Section 414(h)(2) of the Internal Revenue Code of 1986 (26 U.S.C.A. Sec 414(h)(2)) and Section 17501 of the Revenue and Taxation Code. West Valley-Mission Community College District is both fiscally accountable and fiscally independent as defined in Sections 85266 and 85266.5 of the Education Code.

Background/Alternatives WVMCCD is currently reporting the contributions for its participants to CalSTRS through the Santa Clara County Office of Education (SCCOE), which combines the WVMCCD report with all of the other dependent school districts in Santa Clara County and submits the entire group of school districts to CalSTRS.

The District would prefer to report its CalSTRS participants’ contributions independently from the SCCOE, which will allow the District direct communication and control of its information with CalSTRS. Direct reporting will also provide more time for the audit of records prior to being submitted to CalSTRS.

West Valley-Mission Community College District will be responsible for submitting all contribution data and remitting all contributions on and after the effective date of becoming a direct report.

Significant Events Since the go-live of the Banner HR Module in 2016, the District transitioned all payroll processes from the SCCOE to the District. The District began reporting directly to CalPERS on April 25, 2019.

The process to report directly to CalSTRS requires numerous steps including submitting an application, having satisfactorily passed a CalSTRS audit, five consecutive fiscal years with unqualified financial audit opinions, maintaining good standing with the Accrediting Commission for Community and Junior Colleges (ACCJC) for five consecutive fiscal years, and full compliance with the file layouts specified in Division 3 of Title 5 of the California Code of Regulations. These items were completed in November 2019, at which time the State Board of Governors approved WVMCCD’s fiscal independence.

Coordination This report was prepared by the executive director of financial services and reviewed by the associate vice chancellor of finance and administration.

Follow-up/Outcome Upon Board approval, the executive director of financial services will forward Resolution 21011901 to the SCCOE to notify it of WVMCCD’s intent to report directly to CalSTRS.

103 RESOLUTION NUMBER 21011901 OF THE GOVERNING BOARD OF THE WEST VALLEY-MISSION COMMUNITY COLLEGE DISTRICT to Report Directly to California State Teachers’ Retirement System Effective July 1, 2021

Employers who report contribution data and remittance directly to the California State Teachers’ Retirement System (CalSTRS) are required to comply with California Education Code sections 23000-23010 and are subject to penalties as outlined in Title 4, Division 3, Chapter 1, Article 15.1 of the California Code of Regulations.

WHEREAS, the West Valley-Mission Community College District (hereinafter “District”) desires to become a direct report source that reports Defined Benefit Plan contributions and remittance directly to CalSTRS; and

WHEREAS, the CalSTRS Executive Officer of Benefits and Services has authorized the District to report directly to CalSTRS; and

WHEREAS, if at any time, CalSTRS terminates the District as a direct reporter, the Santa Clara County Office of Education (hereinafter “County Office of Education”) will immediately resume reporting contribution data and remittance for the District to CalSTRS.

NOW, THEREFORE, BE IT RESOLVED that the District does hereby:

1. Elect to be a CalSTRS Direct Report Source as of July 1, 2021. 2. Agree to: a. Comply with Education Code Sections 23000-23010; b. Reference(s) California Penal Code § 933(c) requires that a governing body of the particular public agency or department which has been the subject of a Grand Jury final report shall respond within 90 days to the Presiding Judge of the Superior Court on the findings and recommendations pertaining to matters under the control of the governing body. California Penal Code § 933.05 contains guidelines for responses to Grand Jury findings and recommendations.

Background/Alternatives California law requires that the District respond to the Civil Grand Jury Report to indicate one of the following to each of the three findings contained in the report:

1) Agree 2) Disagree wholly or partially with an explanation of the reasons therefore.

Staff recommends that the District agree with each of the three findings.

California law further requires that the District respond to the Civil Grand Jury Report to indicate one of the following to each of the three recommendations contained in the report:

1) The recommendation has been implemented, with a summary regarding the implemented action; 2) The recommendation has not yet been implemented, but will be implemented in the future, with a time frame for implementation; 3) The recommendation requires further analysis; or 4) The recommendation will not be implemented because it is not warranted or is not reasonable, with an explanation therefore.

Honorable Judge Zayner,

The West Valley-Mission Community College District received the Santa Clara County Civil Grand Jury report, dated October 26, 2020, concerning police reports during the period of November 15, 2014, to November 15, 2019. This letter is the response of the District to the findings and recommendations contained in the report.

Finding 1 Because police reports are not being completed, submitted, and reviewed by management in a timely manner, the District Police Department has a large backlog of incomplete reports. This backlog undermines confidence in the District Police Department.

District Response to Finding 1

Agree.

The District fully agrees with the Civil Grand Jury about the importance of completing, submitting, and reviewing reports in a timely manner, and agrees that there were some deficiencies in this area during the period reviewed by the Civil Grand Jury.

However, the District would note that the percentage of reports identified as incomplete comprised approximately eight percent (8%) of 1004 reports generated during the review period. Further, the

107 District Police Department has already addressed existing deficiencies in this area and put in place measures to ensure that these deficiencies do not reoccur. The District continues to have full confidence in the District Police Department.

Recommendation 1 The District Police Department should prioritize police report completion and supervisory review. The District Police Department should assign specific staff to manage the reporting process on an ongoing basis. This recommendation should be implemented by May 2021.

District Response to Recommendation 1

The recommendation has been implemented.

On March 12, 2020, the District Police Department updated policy regarding report preparation, completion, submission, and review, and specific staff members have since been assigned to manage and oversee these processes on an ongoing basis. Since implementation of the new policy, the department has continued to reinforce the high priority of these processes with staff.

To further ensure that the District Police Department is utilizing the best possible policies and practices in this area, the District has contracted with PRI Management Group, a police records management consulting firm, to review current operations and to provide recommendations for further improvement. This review is scheduled to be completed in March 2021.

Finding 2 Police officers rely on ARMS software to perform vital recordkeeping of police reports. The Civil Grand Jury found that ARMS software is not regularly evaluated for effectiveness. Additionally, training is insufficient for new and existing police officers.

District Response to Finding 2 Agree.

Recommendation 2

108 All staff should be trained or retrained on all aspects of ARMS or ARMS Mobile in use, including any software upgrades, as the upgrades are installed and implemented. Management should ensure that ARMS software is meeting the department’s needs and that substantive training takes place. Training sessions should be an ongoing activity that should be implemented by May 2021.

District Response to Recommendation 2

The recommendation has been implemented.

The District Police Department has committed to ensuring that ARMS training will be provided on an on-going basis moving forward. In February 2020, the department entered a contract with the product vendor for ARMS to provide training for all personnel that work with ARMS, including all sworn personnel and all records management staff. A District Police Department employee has also been assigned as an ARMS system administrator to work with ARMS support on system upgrades and implementation, and to ensure that system upgrades that require additional staff training are brought to the attention of police management.

To ensure that the ARMS system is meeting the needs of the District Police Department, the District has contracted with PRI Management Group, a police records management consulting firm, to evaluate the ARMS system. This review is scheduled to be completed in March 2021.

Finding 3 The Civil Grand Jury found that the District Police Department procedures manual related to incident reporting is outdated and does not sufficiently support department personnel in executing their incident reporting and supervisory review duties.

Recommendation 3

109 The District Police Department should update the procedures manual related to incident reporting. The department should initiate this review by January 2021, with subsequent actions scheduled for completion by May 2021.

The District would also like to take this opportunity to respectfully clarify an inconsistency in the Civil Grand Jury’s timeline as identified on page 8 of their report. In the “Report Status and Stagnation” section of the report, the Civil Grand Jury indicates that on October 18, 2019, they sent a request to “District Police Department Administration” for a list of all open police report cases that were produced in the last five years. The report further states that the police department responded with the requested report on November 18, 2019, and that the Civil Grand Jury subsequently asked the police department to expand the report to include any cases whose status was changed between October 18, 2019, and November 18, 2019, which the police department did. The Civil Grand Jury’s report goes on to note that a significant number of case statuses were changed between October 18, 2019, and November 18, 2019, which implies that this was done with knowledge of the Grand Jury’s investigation.

The District would like to clarify that the first correspondence received from the Civil Grand Jury by the District, which was the request for the initial five- year report, was in fact dated November 15, 2019, not October 18, 2019. This letter was received by Vice Chancellor Maduli on November 15, 2019, and shared with Chief Rolen later that day. Information about the Civil Grand Jury’s investigation was not shared with other senior police staff until Monday November 18, 2019. It is important for the District to clarify this discrepancy as all case status changes made prior to November 18, 2019,

110 were made as part of normal operations, and were made with no knowledge of the Civil Grand Jury’s investigation.

The 2021 Board President was elected under Item 3.4. 3.7 Presentations/Recognitions: ESSP - Mission College Non-Credit Community Health Worker Program, Presented by Nursing Faculty Ann Cowels and Julia Barba, Community Health Partnership 123 There is a growing need for Community Health Workers (CHW) who serve as liaisons for the low-income residents of Santa Clara and San Mateo Counties and their local health care clinics programs and services. Some of the Community Health Partner (CHP) clinics include Gardner Health Services, Ravenswood Family Health Network, Northeast Medical Services, School Health Centers of Santa Clara County, Peninsula Health Care Connection, Marmonte Community Clinics, Planned Parenthood, and the Indian Health Center of Santa Clara Valley.

In response to that need, Ann Cowel and Julie Barba used Mission College's credit CHW programto develop a three course, non-credit CHW program with externships at the clinic partners. The courses could be accomplished in 12 weeks (162 hours), when students would earn their certificate of completion. The CHW acts as the link between communities and health care services, with strong focus on low-income individuals with chronic conditions, mental illnesses and substance abuse. CHWs worked with medical doctors, nurses and mental health care professionals and provided outreach, care management and coordination, home-based support, health promotion and coaching, and navigation of the health care system for their clients while acting as community/cultural liaison. During spring and summer 2020, Julia Barba and Ann Cowels determined the course content, lectures, activities, class materials and externship guidelines and secured six externship sites for the first student cohort.

Santa Clara County Supervisor Susan Ellenberg championed this pilot CHW accelerated program and recommended they receive a one-time $85,000 grant, which was granted by the SCC Board of Supervisors. The one-year project included: • Curriculum Development • Identification of Student Cohort • Established Agreements with Participating Community Health Center Sites • Implementation of Curriculum & Successful Completion of Student Cohort • Placement of Students at Community Health Centers to Complete Internship • Evaluation and Tracking • Plan for program sustainability and supports for completing students in collaboration with local health care providers and potential CHW employers

Twenty-one students participated in the first cohort comprised of community health center staff and Mission College students. The three courses included: 1) Introduction to Community Health Worker, 2) Introduction to Chronic Disease Management, and 3) Externship for Community Health Workers. Student Melanie Zamora talked about her externship at Mayview Health Center, which is part of Ravenswood Family Health Network. The Primary Care Access Program where she was working increased enrollment through outreach and designed bilingual educational materials that improved access to medical health services for the uninsured and undocumented population in our community. Her externship outcomes included the following: Personal Development: strengthen listening and communication skills, strengthen technical and artistic skills, and strengthen leadership and team work skills. Professional Development: Obtained information about health coverage options for uninsured and undocumented patients, screened and referred patients for PCAP, successfully enrolled about 30 uninsured patients in PCAP, and created an educational brochure in English and Spanish.

The program was a big success, with all 21 students in the cohort on track to completion. After the presentation, members of the Board spoke highly of this program and hoped that it could continue and expand. President Peck said that Mission college is committed to continuing this program, and as a non-credit program, the funding for the instructors was covered by the state.

8.3 2019-2020 DISTRICT AUDIT REPORT - Recommendation: The Board of Trustees accept the 2019-2020 District Audit Report. Motion to approve the 2019-2020 District Audit Report.

AVC Chim thanked the auditors and her fiscal team leader Linda Wilczewski and the auditor John Dominguez for their work over a weekend to complete this audit ahead of schedule. CWDL auditor John Dominguez talked about the process and commended the District on having complete and accurate records. Highlights included giving an unmodified statement, which is the best review possible. He also mentioned the wise foresight in establishing the pension stabilization trust fund, with a balance of 18.7 million, to protect against unforeseen increases in the district's contribution to CalPERS and CalSTRS pension funds. The audit identified one minor finding with no fiscal impact regarding the program's state compliance. Auditors expect this compliance issue to be addressed easily by the District. Overall, they were very pleased with the content and timeliness of the audit's completion.

3.9 Report of the Audit and Budget Oversight Committee (ABOC) ABOC chair Robert Owens reported that they met last week and recommended approval of 5.8 Financial Statements and Budget Adjustments, 5.9 2020-21 CCFS 311 First Quarter Financial Reports and the District Audit Report. He will have a comment about item 5.9 on the consent agenda.

3.10 Report of the Legislative and Policy Oversight Committee (LPOC) LPOC chair Anne Kepner reported that they met on October 28, where they were joined by Evan Low, who provided an overview of recently passed legislation affecting community colleges and projected legislation to watch during the upcoming sessions. LPOC reviewed Board Policy Chapters 4 & 5, which were on this agenda for their first reading. The committee recommended that the District join ACCT to access their programs resources and participate in higher education discussions at the national level. Thanks to Trustee Grey, a legislative analyst from CCLC will join LPOC's next meeting in either November or December and will provide insights regarding legislation that the League intends to pursue next year.

Trustee Owens called attention to the net change in fund balances when more funds were spent than revenue earned in the unrestricted general fund, the parking fund and the child development fund. The unrestricted general fund deficit is largely due to COVID-19 and the extended property tax deadlines, and the college had no students or community members on campus generating revenue by utilizing the services of the Child Development Center and paying for parking passes for parking lots.

Chancellor Davis acknowledged the two curriculum committees and especially the chairs, Carla Breidenbach and Paulette Boudreaux, for their extensive work in approving hundreds of courses for online instruction. President Kashima will contact Student Trustee Tisha Hartman with the plans for the WVC Learning Resource Center renovations.

10. Information Reports and Items for Future Board Consideration

Information: 10.1 Academic Senate Update (Aram Shepherd) (Gretchen Ehlers) MC AS President Shepard thanked the curriculum committee for their excellent work and for departments who forwarded the requests for new faculty hiring, which the Academic Senate will review at their next meeting. Department chairs are working on their program reviews while all faculty are busy with grading. Both he and Gretchen attended the online Fall Plenary, which focused on inclusion, diversity, equity and anti-racism.

WVC AS President Ehlers recognized Curriculum Chair, Paulette Boudreaux, our Curriculum Committee members and our faculty for successfully completing, editing and approving over 500 Distance Education addenda in about 2 1/2 months. This has been a monumental task.

She thanked the Land Corp for supporting the Open Educational Resources (OER) program. The faculty who were awarded grants through this program last year made presentations at Senate meetings. So far, the Senate heard presentations from Laura Plunkett in Math and Nils Michals from English. Both of these faculty are developing resources to encourage other faculty in their departments to adopt OER resources for their students. Today, we had one presentation from Cynthia Reiss, who wrote an OER Art History text on the Venice Biennale that she is now using in her class; and another from Heidi Weber who developed videos and created a YouTube channel for students in the Pilates Instructor certificate program. This funding has helped faculty in different fields develop and use OER free resources for the students in their classes. This week, the senate would distribute the applications for new OER faculty grants.

On October 13th, the Senate endorsed the college's Anti-Racism and Inclusion Action Plan, and they are now accepting applications from faculty to work on our Curriculum Review Working Group lead by DESP Coordinator Cheryl Miller.

Three of WVC senators attended the ASCCC Fall Plenary last Thursday through Saturday. The most important resolution was to implement a California Community College Ethnic Studies graduation requirement by Fall 2021, and the WVC Senate is busy preparing for this to happen.

Information: 10.2 Classified Senate Update (Ana Lobato) (Kristal DeLaCruz) WVC CS President Lobato said that there were so many initiatives underway, and the classified staff are participating and providing input for many of them. On October 14, the Senate approved the Anti-Racist Guiding Principles, and she thanked VPSS Debra Griffith, Dr. Ajani Byrd and Cheryl Miller for their leadership and guidance. The Senate looked forward to sincere conversations and doing the work supporting the guiding principles. Caring Campus Liaisons Vida Sabouri and Michelle Francis led a group of 16 participants focused on implementing principles 4 and 8 that actively discussed strategies to reach equitable outcomes. At their next senate meeting, 2020-2025 E&FMP consultants CBT will ask for input from the senators and discuss the results of their campus wide survey. She recognized Senate VP Shamiran Badal who took the initiative to create a workshop for ESL students to ensure their input was reflected in the survey and was a clear demonstration of true student-centered leadership.

MC CS President Kristal DeLaCruz reported that Secretary Amanda Marshall and her team, released the second edition of the Senate's classified newsletter on October 12, with the third edition coming out on November 15. At their October 15 Senate meeting, they endorsed both the Guided Pathways new structure and the Call to Action Plan. She encouraged classified to submit interest and become involved in this important equity work. VP Danielle Ramirez-King led 21 classified employees through the last Caring Campus training, where they determined a plan that will be presented to college administrators. The plan identified four areas of focus: improvements to traditional and virtual workspaces, increased student services and connecting students more with the college.

128 On October 28, they held the Halloween costume themed Trick or Treat Meet, which was open to all faculty staff and administrators. She thanked the faculty, college deans, President Peck and Chancellor Davis for attending and the organizers Mario Flores and Danielle Ramirez-King. One of the Senate's goals is to create safe and brave spaces for dialog, so they collaborated with the Office of Student Equity and Success to create a series called Creating Spaces, and the kick-off will be November 17. Thank you to Mario Flores, Vianey Topete, Lusyna Narvaez, and Kendall Harrison for organizing the series. The Senate has started Mission Buddies, pairing new employees with seasoned staff buddies during onboarding. This program was coordinated by Monica Sian and Nusyna Narvaez, and the Mission Buddies Takeover meeting is planned for the December 3, introducing the new staff and their buddies to the classified senate and ts role and activities for Mission's classified professionals.

Information, Procedural: 10.3 Student Senate Update (Maddy Mandarelli) (Alondra Martinez-Medina) MC ASG President Martinez-Medina welcomed Joshua Gerrill as the secretary and Gerald Lingard as a new senator, and she thanked the parliamentarians for their efforts as they planned to welcome more ASG members soon. They held their virtual Halloween event in October. Saturday, December 19, will be a drive- in cinema event for the students and their families to enjoy.

WVC ASG President Maddy Mandarelli appointed many new senators, reaching a record high in numbers of senators for this year including at the state level. Student Senates' General Assembly is March 26-28, and all senates will go to vote on various resolutions proposed by Student Seantes in Region 4. The Club Activities Board (CAB) hosted a pumpkin carving contest with winners receiving $50 Viking Bookstore gift cards. ASG held an Election Day Debate for 25 students had the opportunity to debate propositions currently on the November 3 ballot.

Information: 10.4 West Valley College Update (Stephanie Kashima) Thanks to the entire curriculum committee, chair Paulette Boudreaux, the office of academic affairs, and department chairs for moving hundreds to courses through to approval. An amazing amount of work was done exceptionally well. WVC officially unveiled the Anti-Racist and Inclusion Action Plan, and she thanked Trustee Grey for attending. Next steps include training the volunteers for the work that will start in January 2021. She thanked Debra Griffith for being the architect of this plan and for the unanimous support of the plan by the Student, Academic and Classified Senates. The college recently concluded the interviews for the new Vice President of Student Services and will conclude the interviews for the new Vice President of Administrative Services the following week. Congratulations and happy birthday to Joe McDevitt, who was approved tonight as the new interim Dean of Student Services. Also, thank you to Dean Renee Paquier for serving as the interim Dean of the Cilker School until a new dean can be hired, which is in addition to her duties as the Dean of the Che School of Professional Studies. WVC hosted a Puente event, Noche de Familia, with 20 families participating in the event organized by Joe Bucher, Andrew Soler, and Leslie Saito-Liu. Congratulations to all administrators for approval of their contract extensions, and especially to Daniel Peck who has been a personal friend and valued advisor to President Kashima.

Information: 10.5 Mission College Update (Daniel Peck) President Peck reported Mission's "Be The Change" lettering is finally completed. Mission's recent equity and social justice events included: USF's Teacher Education professor, Dr. Patrick Camangian discussed the FilipineX experience in honor of Filipino American Month inf October. Discussions of the book How to be an Anti-Racist by Ibram X. Kendi, Community Conversations with our students, and Mission released its Call to Action Plan and looks forward to working on its implementation.

He thanked the curriculum committee, chair Carla Breidenbach, faculty and the DE committee team. Online instruction improvement trainings continued with over 75 faculty who participated. Mission's spring schedule was released. The District released the new assessment tracking tools for COVID-19 in preparation for our safe return to campus, hopefully by next fall. Mission and Kaiser launched the winter drive-up flu shot free service for students and the local community. The baseball team practiced on the new turf field.

On November 14, the Career Technical articulation event to build relationships between high school and adult school teachers and CTE faculty, and high school counselors with Mission counselors. Congratulations to Trustee Kepner for her engaging virtual Mission Community Fund event, and he was grateful for the $5,000 grant in support of Mission's student emergency fund. Thank you for extending the contract of administrators. They are the liaisons between staff and faculty, while completing the administrative work behind the scenes. Thank you to the Board for renewing his contract. He also appreciated Chancellor Davis for putting Mission College first, like no other past Chancellor has done. Our faculty, staff, administrators and students noticed the difference. Thank you to Dr. Martin for her work on our successful Accreditation, and he is proud to be longest-serving President for Mission College. He ended by honoring the service of Veterans in our community, including the students, staff, Foundation Board members, and administrators who have served our country in the military. Happy 245th birthday to the U.S. Marine Corps. 129 Information: 10.6 Chancellor's Report (Bradley Davis) Chancellor Davis appreciated the voters who reelected our trustees Robert Owens, Karl Watanabe, Adrienne Grey, and Randi Kinman. He remarked that the District had a solid foundation in our Board, and thanked them for their continued service. Other friends of our district were reelected as well, like Kathy Watanabe, Dave Cortese, Ana Eshoo and Evan Low. On the national level, we now have in the White House as a beacon of hope for many of our students and our country. His fellow Syracuse University Law School Alumnus Joesph Biden will be our new President. Thank you to everyone who voted. Our LPOC committee has done some very important work, as evident by the board policy items on this agenda.

The West Valley Public Access channel content included an interview he did with the Saratoga Area Senior Center, and he thanked Tyler Taylor for the opportunity to discuss the benefits to our community from both West Valley and Mission Colleges. He has unofficially been appointed as the Bay Area representative for community college athletics tasked with finding a pathway to safely and thoughtfully return to competition in the spring under Sarah Cody's guidelines. CHW student Melanie Zamora in the presentation today has been on the frontline assisting low-income community members with chronic health challenges, and she was a wonderful example of how our college programs serve our communities. Finally, he thanked everyone who contributed to this weighty agenda.

Information: 10.7 Trustee Comments Trustee Lucas sent his Kudos to both curriculum committees and their chairs for their hard work. Paulette Boudreaux's book, Mulberry, made the quarterfinals of the Silicon Valley Reading Advisory Board's community reading selections. He hoped she is working on another book.

Trustee Kinman said this election was the most brutal she has been through to date. Seeing this community reach out and support one another, connecting over crucial conversations, and holding special speaking events that she wishes she had the time to attend filled her heart with gratitude and soothed her soul. The voters are sending the husband of a community college instructor to the White House as our next President, which is the best outcome of this recent election.

Trustee Grey reported that CCCT was working with community colleges throughout the state on identifying best practices in diversity, equity and inclusion (DEI) professional development and providing a road map for colleges to pursue their DEI work. She was proud to say that both west Valley and Mission were well down the path in integration of this essential DEI work into our institutions. She expressed her disappointment that Proposition 16 did not pass, allowing us to reverse the inability to use race and ethnicity in hiring, scholarships, college admission, etc. She planned to attend the canvas series on anti-racism by Reverend Jamie Washington, but needed her "G" number to sign up (Employee or Student ID). She was also gathering these types of webinars to use on statewide level. On Thursday night, 7:00-8:30 p.m. CCLC hosted Part 1 of the series on Courageous Governance with conversations, breakout room discussions and exercises to familiarize and give thought to diversity, equity and inclusion terms and concepts. All trustees should have received the invitation from the League to attend. It was important that our members around the state are familiar with DEI terms, as they will be asked to assess how their colleges are proceeding in their DEI work. Thank you to Mission College for partnering with Kaiser to provide flu shots to students, staff, faculty and member of the local community-she got hers.

Student Trustee Hartman acknowledged VPSS Debra Griffith for her involvement and availability to students at all hours, and continued to be impressed by her service to and concern about WVC students as she continues to provide over-the-top assistance. She really enjoyed Mission College's Community Health Worker program presentation and would like to see it expand in the future. She also was happy to see that the Board approved a board policy that provides showers to the homeless population.

Board President Fish thanked everyone for their contributions to items on this agenda. It is clear a lot of talent and time went into the curriculum, student instruction, and information that was shared at this meeting.
