The settlement comprises a locale of residential development of varying forms and styles i.e. traditional cottage forms and more modern housing i.e. bungalows and two storey houses. The site is located to the north of the settlement of Kilhallon which is a large hamlet of now over 45 houses. The application site lies to the west of an accessway off the lane known locally as Billy Lane. This accessway serves at least 6 other residential properties. This locale has been recognised as being part of the fabric of a built-up area by the planning authority. In this area there are various types of housing represented mainly as detached residential properties. Interspersed in the location there are cottages and former agricultural buildings, some now residential. This locale has a residential character that completes development at Kilhallon and the site application site is approached by Billy Lane and a subsequent private driveway to the main house (Quilletts Barn). The site is not within a designated landscape setting and The Saints Way a bridleway adjoins the site to the east (beyond an established boundary hedge). The site lies within the Parish of Par/Tywardreath. The image below shows the pattern of development within part of the settlement of Kilhallon. There is sufficient space at the application site to accommodate the proposed development. 2.1 Site Investigations 2.1.1 Contamination The Council confirm that this is a site that doesn’t lie in an area that is contaminated. We also consider that the land uses have been sensitive and therefore consider that the level of risk for developing this site with a single annexe unit will be negligible. In regard to consultation the applicant has communicated with his nearest neighbour at No 4 Kilhallon and we have been advised that no negative comments in respect of the siting of the annexe/holiday accommodation have been received. Situ8 Planning Consultancy Ltd Oravia House, Trevarthian Road, St Austell, Cornwall, PL25 4BH 01726 67591 [email protected] www.situ8.co.uk Page 7 of 20 Proposed Residential/holiday Annexe Quilletts Barn 4.Proposed Development 4.1 Introduction The application seeks planning permission for the construction of a single storey, one bedroom annexe/holiday unit that would provide a level of independence for the applicant’s father who now requires some support in his older years and this proposal provides the applicant with a solution. The accommodation has a modest kitchen area, shower room/wc/lounge area and bedroom. The building is to be sited to the west boundary adjacent to No 4 Kilhallon. All windows have been carefully sited so as to ensure privacy for the applicants’ father ,the applicant and the adjoining neighbour. 4.2 Access, Layout and Design The access to the proposed access would be the same access that is used for access to the main house, and to the outbuilding, which already has an access way that leads from the house. Access from the road to the house is safe, with good visibility in both directions. The proposed annexe will be a stand-alone structure within the curtilage of Quilletts Barn and is located close to the host dwelling. The development will be finished with muted colours and in keeping with the modest, rural appearance of the site. As is the case at Quilletts Barn the garden area will be shared by the applicants for amenity purposes, with it being of such a size that is entirely suitable and there is no requirement or desire to provide a separate garden area for the proposed annexe. Externally, the proposed development is oriented towards the house, where it would be within sight of the host dwelling. All accommodation is arranged over a single level to ensure easy access between rooms for the applicant’s father and future users. We draw your attention to the submitted plans for more details. Situ8 Planning Consultancy Ltd Oravia House, Trevarthian Road, St Austell, Cornwall, PL25 4BH 01726 67591 [email protected] www.situ8.co.uk Page 9 of 20 Proposed Residential/holiday Annexe Quilletts Barn 5.Relevant Planning Policy & Guidance 5.1 Introduction Under Section 38(6) of the Planning and Compulsory Purchase Act 2004, decisions on applications for planning permission and appeals must be taken in accordance with the development plan, unless there are material considerations that indicate otherwise. The National Planning Policy Framework (NPPF) was originally introduced in 2012 and stressed the importance of having a planning system that is genuinely plan-led. The NPPF was most recently revised in February 2019 however maintained the emphasis that planning applications should be determined in accordance with the development plan, with the purpose of the planning system being to contribute to the achievement of sustainable development. At the heart of the Framework, so that sustainable development is pursued in a positive way, is a presumption in favour of sustainable development. In Cornwall the development plan comprises the Cornwall Local Plan 2010-2030, including 'saved' policies from the adopted Local Plans which include Minerals Local Plans. The site lies within Par/Tywardreath Parish, for which there is currently no adopted neighbourhood plan that would otherwise require consideration. The proposed scheme has been considered against the following guidance and specific policies and is considered to be in conformity with these policies and guidance. Our view accords with Paragraph 8 where the development meets the criteria of Sustainable Development’s three dimensions, those being economic, social and environmental objectives. These objectives are interdependent and need to be pursued in mutually supportive ways, so that opportunities can be taken to
