Guidelines

• An application for a Beach Permit must be made at least 30 days before the first day it is intended to operate • FULLY completed application forms only will be accepted • No permit will be issued unless the applicant submits evidence of a Public Liability Insurance Policy indemnifying Cork County Council from any liability caused by the applicant’s actions with at least €6.5m cover. • The submission of an application does not guarantee the issuing of a permit. • Additional information may be sought by Cork County Council

Conditions:

• A permit is subject to the requirements and provisions of Cork County Council (Regulation and Control of Certain Beaches) Bye-laws 2011 or any amending or substituting bye-laws.

• The activities covered by a permit shall be limited to those specified within the permit application.

• The activities covered by a permit shall only be undertaken at the locations specified.

• The permit holder(s) shall ensure that appropriate waste management and litter control measures are put in place and shall ensure that no environmental damage results from the activities.

• At no time is the activity to interfere with or encroach on swimming zones

• Chequered flags must be used to demarcate the area of beach in use for the activity

• The permit holder(s) shall obtain and hold valid and up to date public liability and employer insurances to cover the activities taking place.

• If the activity is water based the permit holder (s)should be a member of the Irish Surfing Association/Kayaking Association or other body recognised by the Council. The activity shall be conducted in accordance with the conditions of the granted permit and in accordance with the standards issued by Irish Water Safety, Irish Surfing Association and /or other body recognised by the Council to issue such standards.

• The permit holder(s) must ensure that there is emergency vehicle access at all times. In the event that the permit holder is causing excessive parking which is leading to accessibility problems for emergency vehicles, they will be removed immediately.

• The permit holder(s) shall have in place safety and emergency response procedures in the event of an accident resulting in the activities permitted.

• The granting of a permit does not relieve the permit holder(s) from responsibility or liability in respect of any criminal, unlawful, illegal or negligent act or omission for which they may be sued or charged.

• The granting of a permit shall in no way be deemed to implicate or involve Cork County Council, it’s officers or employees in any liability or responsibility in respect of any criminal, unlawful, illegal, wrongful or negligent act or omission done by any person(s) to whom such permission is granted or by their servants or agents.

• The permit holder(s) shall pay a fee of €50.00 to Cork County Council on approval of the application.

• Permits are issued on seasonal basis only.

• Cork County Council reserves the right to revoke a permit during the season.
