PRIVILEGED ATTORNEY-CLIENT COMMUNICATION EXECUTIVE SUMMARY SECOND AMENDED AND RESTATED LICENSE AGREEMENT (“SPIDER-MAN”) CREATIVE ISSUES This memo summarizes certain terms of the Second Amended and Restated License Agreement (“Spider-Man”) between SPE and Marvel, effective September 15, 2011 (the “Agreement”). 1. CHARACTERS AND OTHER CREATIVE ELEMENTS: a. Exclusive to SPE: . The “Spider-Man” character, “Peter Parker” and essentially all existing and future alternate versions, iterations, and alter egos of the “Spider- Man” character. All fictional characters, places structures, businesses, groups, or other entities or elements (collectively, “Creative Elements”) that are listed on the attached Schedule 6. All existing (as of 9/15/11) characters and other Creative Elements that are “Primarily Associated With” Spider-Man but were “Inadvertently Omitted” from Schedule 6. The Agreement contains detailed definitions of these terms, but they basically conform to common-sense meanings. If SPE and Marvel cannot agree as to whether a character or other creative element is Primarily Associated With Spider-Man and/or were Inadvertently Omitted, the matter will be determined by expedited arbitration. All newly created (after 9/15/11) characters and other Creative Elements that first appear in a work that is titled or branded with “Spider-Man” or in which “Spider-Man” is the main protagonist (but not including any team- up work featuring both Spider-Man and another major Marvel character that isn’t part of the Spider-Man Property). The origin story, secret identities, alter egos, powers, costumes, equipment, and other elements of, or associated with, Spider-Man and the other Creative Elements covered above. The story lines of individual Marvel comic books and other works in which Spider-Man or other characters granted to SPE appear, subject to Marvel confirming ownership.

A Small Death
MADELINE gagement. I could still bow but they did not know that my limbs were now more fragile. In fact, they did not know what CHAPTER 14 - they were asking, but I did. I wonder if they still use the trick of the curtain, the beams, and the dowager. I knew if I went there again I would never escape alive. A Small Death HAVE remarked that I was born in the central plains, compacted out of glacial dust and winter cold. I see ani- mal faces as readily as though I sat with my mother's one blighted gift in a Cro-Magnon cave. The religious forms of the present leave me unmoved. My eye is round, open, and undomesticated as an owl's in a primeval forest-a world that for me has never truly departed. The boy who watched the gold crosses of his childhood swept up by a man with a scythe would scarcely hope too much for what lay forward. In one of those golden Octobers that fell between the wars, I made a journey somewhere in southern Kansas. The friend who went with me was Claude Hibbard, a paleontologist who died only a year or so ago after an intense and devoted career given to the life of the past. Claude had got word of a farmer who had found an enormous long-horned bison skull in a ,gravel pit. The man had it hanging out in the weather under the eaves of his barn. The skull proved to be a beautiful example of one of the least-known bisons, the horns having the sweep of one's ex- tended arms.

The abbreviations used herein follow. The letter D, followed by a number, indicatesthat the character was mentioned in that issue of DRAGON® Magazine (issues #88 to #198). The letter P, followed by a number, indicates the given issue number of POLYHEDRON Newszine in which a character was mentioned (issues #18 to #61). Some products listed did not mention specific heroes or villains, but are included here to show the complete line of MARVEL SUPER HEROES game products. In cases where character entries occupy multiple pages, the page number given denotes the beginning page of the character entry. Note that this index ONLY includes characters published under the TSR "FASERIP" system; it does not include source material for the SAGA or any other subsequent incarnation of the Marvel RPG, or unpublished "vaporware" works in progress that were never commercially released, etc. This index also does not include various issues of the Marvel-Phile and other publications which do not include character information (for example, the various Ultimate Power Book addenda, Q&A, and the character indexes themselves) although some of those articles do include non- character stats (e.g., Marvel Universe technology, or real-world miltary generic stats). For some, it is any aspect of culture that is aimed at and appreciated by a large segment of a society. Some conceive of it as inherently unsophisticated, standing in opposition to higher forms of culture. Others consider it to be necessarily commercialized, and primarily existent to make money. Some have even referred to it as culture which reflects the genuine concerns and ideas of the general public. It is often associated with members of the lower classes, and its manifestations tend to be mass- produced. This collection specializes in items such as comic books, graphic novels, and science fiction, while also housing tabloid newspapers, cult magazines, realia, and more. Comic Books, 1964-current Pinpointing the precise origin of the comic book would prove a difficult task. Given the ambiguous definition of the medium (typically defined as a form of storytelling characterized by sequential images, often accompanied with text), precedents can be found throughout history. Examples of such include newspaper comic strips. However, the modern comic book is said to have begun in the United States in the early 1930s. From here, and especially following the success of Superman, first introduced in 1938, the medium has exploded in popularity and notable works have been published in Japan and Europe.
