This paper attempts to address challenges endure and its prospects through this doctrine of option in realizing it in today immense transaction. Furthermore, there are some exam- ple cases in the real practice which before and after the practicing of Khiyar Al-`Ayb in the stipulated contract terms and condition. Khiyar Al-`Ayb adalah salah satu komponen yang menitikberatkan suatu pilihan/opsi karena adanya kerusakan/cacat dan pembeli tidak berkewajiban sebagaimana tertera pada kontrak dimana kerusakan tersebut dapat merugikan atau menindas mereka. Amendment of the outsourcing act in the field of construction On March 13, an amendment was introduced to Royal Decree 1109/2007 of August 24, which develops Act 32/2006 of October 18 regarding outsourcing activities in the field of construction (hereinafter the “Act”). The abovementioned Act aims to improve the working conditions in the construction industry and to ensure the occupational health and safety of construction workers. It is applicable to the outsourcing contracts signed to conduct construction work. Besides this, Royal Decree 1109/2007 of August 24 establishes the guidelines for the development and enforcement of the Act in four fields: i) Registry of Accredited Companies, ii) Outsourcing Book, iii) rules for calculating the percentages of permanent workers established by Law and iv) simplification of documentary requirements for construction works in the legal system. One of the major innovations introduced by Royal Decree 1109/2007 is the creation of the Registry of Accredited Companies. It is compulsory for all companies that claim to be contracted or subcontracted to carry out construction works to be registered in this Registry, said registration being valid for a three year period.

Certain internal legal documents important for the history of Romania will be also introduced. The first document presented at the beginning of this research will be the Decree no. 3631 regarding the validation of the Unification of Basarabia, Bukovina and Transylvania with Romania, on 24th of December 1918. One of the last treaties will be The Treaty of Accession 2005 which is an agreement between the member states of European Union and Bulgaria and Romania, which entered into force on 1 January 2007. Between the two documents, almost 100 years of history are comprised. The main method of research used in drafting this study is the content analysis – simple or comparative, as the case may be – approached in a manner specific to the research in the field of social-human sciences, respectively in the field of legal sciences and history. Therefore, this analysis is mainly qualitative (broadly speaking) and less quantitative, a few statistic aspects being however emphasized where they are naturally completing the analysis of some qualitative aspects.

    THE CIVIL CODE OF THE ISLAMIC REPUBLIC OF IRAN Preamble On the publication Effects and Execution of Laws in General Article I - The Islamic Consultative Assembly’s enactments and the results of the referendum, having gone through legal procedures will be notified to the president of the Republic. The President shall within five days sign them and notify them to executors, and issue instruction to have them published, and the Official Gazette shall be required to publish them within 72 hours after notification thereof. Note: In case of the President’s refusal to sign or notify an enactment within the time period referred to in this Article, the Official Gazette shall be required to publish it within 72 hours on the order of the Chairman of the Islamic Consultative Assembly. Article 2 - The legislative enactments come into force throughout (lie country fifteen days after their publication, unless a specific arrangement has been prescribed in the given legislation itself to the timing of its enforcement Article 3 - The text of laws must be published in the Official Gazette Article 4 - A law shall be effective only as from the date of its coming into force, and shall not be retrospective unless special provisions to this effect have been laid down in its text Article 5 - All inhabitants of Iran, whether of Iranian or of foreign nationality, shall he subject to the laws of Iran except in cases which the law has excepted.
