Federalists and Republicans 1789–1816 Why It Matters In the first government under the Constitution, important new institutions included the cabinet, a system of federal courts, and a national bank. Political parties gradually developed from the different views of citizens in the Northeast, West, and South. The new government faced special challenges in foreign affairs, including the War of 1812 with Great Britain. The Impact Today During this period, fundamental policies of American government came into being. • Politicians set important precedents for the national government and for relations between the federal and state governments. PRESIDENT-SHOPPING FOR A NEW SCALIA: THE ILLEGITIMACY OF “MCCONNELL MAJORITIES” IN SUPREME COURT DECISION-MAKING J. Stephen Clark* WASHINGTON, June 29—By the slimmest of margins, the Supreme Court today ended its decades of protecting abortion rights and overruled Roe v. Wade,1 the 1973 decision that established abortion as a constitutional right.2 The breaking news one day in June 2019 is the demise of Roe v. Wade. By a vote of 5-4, the Supreme Court has overruled the precedent and left the protection of abortion rights to the sole discretion of lawmakers. There had been no majority for such a decision until President Trump had the chance to make two appointments to the Court. One of those appointees wrote the majority opinion. Perhaps fittingly, the author of the opinion was the successor to the late Justice Antonin Scalia, who strove for this goal more vigorously than any member of the Court since 1973. Of course, every supporter of abortion rights realizes that the Trump appointee now sits on the High Court only because President Obama’s nominee for the same seat was ignored by the Senate for eleven months. The overruling of Roe is directly traceable to that stonewalling and its mastermind—the majority leader, Senator Mitch McConnell of Kentucky. Why should supporters of abortion rights accept the legitimacy of a Court decision handed down by a bare majority that owes its fifth vote to Mitch McConnell’s Supreme Court Justice? CHAPTER ONE American Federalism: More Than Two Centuries of Political Tension efore one explores the components and particulars of the BConnecticut polity, it is important to first discuss the features of American federalism, as well as the ongoing tension between federal and state authority throughout the course of American history. This general overview should demonstrate the centrality of state governments within the context of the American federal system, and why this work has special relevance in the twenty-first century. One of the bedrock principles of the United States Constitution is that the power of government should be limited and restrained. Heavily influenced by the writings of classical liberal philosophers, most notably the English philosopher John Locke (1632-1704), the Founding Fathers devised an ingenious constitutional system in which power would never be concentrated in one branch or one level of government.1 Limited government was viewed as a prerequisite to individual liberty and more generally the preservation of the newly- formed republic. The Founding Fathers’ deep belief in a system of limited government is clearly reflected in the principle known as federalism. Drafted during a swelteringly hot summer in Philadelphia more than two hundred years ago, the Constitution of the United States established a governing system in which power would be divided between two levels of government, national and state. The principle of federalism is among the several distinguishing features of the American constitutional framework. 2 AMERICAN FEDERALISM Federalism and Divided Power The Constitution, written in response to the failure of the Articles of Confederation (1781-88), provides the national govern- ment with both enumerated and implied powers. -

A collection of approximately 3600 plus lithograph illustrations collected and curated over a 25 year period by an advanced collector and baseball historian. Boston Book Fair 2019 – Part 1 2 [email protected] Wild and wonderful ! The imagery is eye catching in many ways. About two thirds of the collection is advertising graphics with the remainder being 19th and early 20th sheet music. The history of printing][ graphic arts and historically significant images were considerations when building the collection. The advertising ephemera is 90% American with international exemplary. The 19th C sheet music is predominantly from 1859-1879 and 60% American and 30% British. Although predominantly lithograph, there are some earlier engraved pieces included in the collection. Condition is very good to excellent. The imagery is striking and finest to outrageous and formidable. Topic by design, 40% of the collection is comprised of the primary categories of Tobacco, Social History, Sports, Fantasy and Food and Wine. That said the materials cross many categories. From the 19th C sheet music category with selections such as Civil War era Home Run Quick Step or the Live Oak Polka to Barnum’s National Poultry Show Polka and The Rainbow Temperance Song, the subject matter is varied and historically notable. -

Key Concepts 3.1 — British attempts to assert tighter control over its North American colonies and the colonial resolve to pursue self-government led to a colonial independence movement and the Revolutionary War. I. The competition among the British, French, and American Indians for economic and political advantage in North America culminated in the Seven Years’ War (the French and Indian War), in which Britain defeated France and allied American Indians. II. The desire of many colonists to assert ideals of self-government in the face of renewed British imperial efforts led to a colonial independence movement and war with Britain. 3.2 — The American Revolution’s democratic and republican ideals inspired new experiments with different forms of government. I. The ideals that inspired the revolutionary cause reflected new beliefs about politics, religion, and society that had been developing over the course of the 18th century. II. After declaring independence, American political leaders created new constitutions and declarations of rights that articulated the role of the state and federal governments while protecting individual liberties and limiting both centralized power and excessive popular influence. III. To this end, we have found that identity—or, more precisely, how people define themselves—is a powerful predictor of behavior. This is an outgrowth of using demographics in social sciences as proxies for a wider range of socio-cultural beliefs. Since people have many different ways of characterizing themselves in different circumstances, contexts, or times, researchers have traditionally relied on context-specific identifiers. For instance, someone may behave like a parent at home but an employee at work. However, one particular type of identity—political partisanship—has become the lens for many Americans in how they relate to the world around them. This has problematic implications, not just for government, but for civil society and the economy, as party identification has an increasingly zero-sum logic of “with us or against us.” Political partisanship is not a new phenomenon. Abstract: Henry Larcom (1777 – 1862) and his only child, Fanny/Fannie/Francis1 Larcom (1807-1883), are the focal point of this Larcom Family Collection although it also includes many items relating to their spouses, ancestors, and descendants. Collection Creator: Quincy Sewall Abbot Provenance: The collection was donated to by Quincy Sewall Abbot in 2018. Conservation/Processor's Note: 52% of the listed documents are duplicates composed through independent research by QSA. Most of the primary sources in this collection are in good condition except for a few items that have been previously water-damaged or torn. Smaller items are in acid free envelopes due to the delicate status of the item and to prevent any further damage. PRICE Following Justice Kennedy’s retirement and the bitter fight over Justice Kavanaugh’s confirmation, increasingly polarized views about constitutional law in general, and specific constitutional cases in particular, threaten to undermine courts’ legitimacy, degrade their institutional capacity, and weaken public support for important civil liberties. To help mitigate these risks, this Essay proposes that judges subscribe to an ethos of “symmetric constitutionalism.” Within the limits of controlling considerations of text, structure, history, precedent, and practice, courts in our polarized era should lean towards outcomes, doctrines, and rationales that confer valuable protections across both sides of the nation’s major political divides, and away from those that frame constitutional law as a matter of zero-sum competition between competing partisan visions. -
