Council From; STOP THE BORDER BLASTER [[email protected]] Sent: Friday, June 27,201410:31 AM To: Mayor & CouhCiI Cc: Huntington, Vicki; Findlay, Kerry-Lynne Subject: STOP THE BORPER BLASTER critiques MP's JUne 23 update to Mayor &Council Mayor & Council Municipality of DEll ta 4500 Clarence Taylor Crescent Delta, Be V4K 3E2 Re: STOP THE BORDER BLASTER crit:l.ques MP'S June Mayor & Council: I am concerned about Member of parliament Kerry-Lynne Findlay's KRPI update to Mayor and Council on JUne 23; so, for the following reasons, I repeat my request that Mayor and council insist that we get the cooperation from Canada, our national government, that we have every right to expect: . One, it's beyond me why our MP has declined to have Canada protest the S0,00e-watt KRPI AM transmitter planned for Point Roberts. There's no reason why our sovereign nation cannot file a protest on Delta's behalf in Washington De. Two, our MP's refusal to file an informal objection to KRPI's application for renewal of its broadcast licence also defies reason. Her doing so would support the informal objection and rebuttal filedwlth the Federal Communications Commission (FCC) by our American neighbours in Point Roberts WA. But, again, she has refused to do so: Why? Three, our MP is a lawyer who boasts of being a QC yet she failed to note that the AM transmission agreement between Canada and the States calls for mutual consideration of exceptional circumstances. The circumstance into which BBC Broadcasting Inc, owner of KRPI, has thrust Tsawwassen and the Tsawwassen First Nation as well as Point Roberts is most exceptional. Her ignoring this mutual consideration provision suggests that she does not have our interest at heart. Four, during her address to Council, she failed to express concern for the threat that this high-wattage AM transmitter poses to our property values) a callous refusal to acknowledge that a home is most Canadians' biggest asset. I Five, even after the previous speaker Armene Belless of Point Roberts revealed that KRPI's mitigation promise did not fix problems in Ferndale) our MP parroted KRPI's laughable promise to fix any problems that its harmful blanketing interference will cause here, suggesting again that she has KRPI's interests at heart, rather than ours. The inadequacy of mitigation is a subject that needs more space than I can be give it here; for now, it's enough to note that mitigation is fraught with legal, jurisdictional and technical pitfalls, shortcomings) and failures, So-called "mitigation" will be critiqued at length at a later date. Six, our MP also made light of the omissions and misrepresentations found in this radio station's filings with the FCC, suggesting that they might or might not be intentional when 1 any reasonable person or judge would deem them to be a pattern of dishonesty or wilful ignorance. Seven, our MP repeated her claim that the FCC knew of Tsawwassen when it granted BBC Broadcasting Inc a construction permit for Point Roberts, a claim that casts the FCC as an aider and abettor to an applicant who hid at le(ist 22,000 Canadians from the notice of FCC regulators. Since when did such an august American commission align itself with the dishonestl And since when did Americans begin harming and treating Canadians with the disdain that our MP Findlay's claim implies? And if she stands by this claim,; why isn't she standing up in every way she can against our being treated so shabbily? Eight, MP Findlay QC failed to point out that Canadians have every right to expect the FCC to regulate this proposed AM transmitter with the same concern for us as it would show for 22,ee0 Americans living under a proposed field of harmful blanketing interference of the strength that KRPI is proposing. There's no doubt that if Canadian leaders such as our MP Kerry-Lynne FindlayQC, Industry Canada Minister James Moore and Foreign Affairs Minister John Baird stood up to call this spade a spade; the FCC would acknowledge that BBC Broadcasting Inc won its permit slyly and dishonestly and thus rescind, annul or c(incel said permit. The Americans pride themselves on being a democracy that thrives on honest dealing and respect for universal human rights, so they would appreciate our Canadian leaders drawing their attention to this instance when an applicant to the FCC has used deceit to win a permit that will enable it to disregard our rights to fair and equal treatment, rights based on the fact that the FCC would never subject 22,000 Americans to the harmful blanketing interference that's in store for us. But our federal political representative, MPFindlay QC, declines to have Canada draw this deceit and disdain to the FCC's attention, causing Tsawwassenitesto ask: Is she the MP for us) or for KRPI AM Radio of Washington State, U.S.A? Mayor & Council, our MP's actions have failed us thus far, so I'm repeating my request that Delta insiSt that we get the national and international reprasentationto Washington DC from Industry Canada and Foreign Affairs that we need, deserve, and have every right to expect. If It does not affect you personally, it does affect Ms. Findlay's constituency, to whom she is accountable. We continue to ask, yet again, that you individually and severally take this issue to those responsible for erecting these towers, and pass on our concerns. Is there anyone who doesn't have a TV or cell phone these days, plus other electronic equipment which we don't own, who doesn't rely on these uninterrupted services? Even in the event of a major disaster, TV can be a valuable source of information. And especially those who operate Ham radios.
