Our next meeting Oct. 4th and we will be having food for all who attend the meeting so save the date we would like to see you there. Chapter Meeting September 6, 2012 Fraternal Order of Eagles 7:30 p.m. By: Terri L. Ryals

President: Jim Hoffman called meeting to order at 7:40 p.m. followed by the Pledge of Alliance and Moment of Silence for our lost brothers and sisters. George, our Chapter Chaplin gave prayer prior to starting the meeting. Jim thanked all the new members that came to the meet- ing. Talked about run, party and October 6th party at the Daytona Rehab Center. Jim also informed chapter members that George is stepping down as Safety Director and will be turning it over to Mike Knezevich after tonight. VP: Frank Roush spoke about the run and that we are getting a flyer together for it with all the stops that we will be making. Secretary: Terri Ryals stated that last month’s minutes were printed in the newsletter and we mailed paper copies for those who do not have a computer. Also requested that any member that has changed their e-mail address or gotten a new one please make sure that it is put on the sign in sheet and will forward them to Ken. I receive the e-mail addresses. Motion made to accept minutes as printed. Motion passed. Treasurer: John Banta read the treasury report regarding the Chapter finances. Spoke about getting a debit card for nightly deposits to be made. Membership: 4 renewals; 18 new members. Welcomed the new members that are here. Products: Terri has some products with limited sizes left. They have been reduced the prices on the products that we have in stock. Men’s short sleeve, tanks and sleeveless will be $8.00, long sleeve will be $10.00. The ladies merchandise is all $8.00 for any of the shirts. Legislative: John spoke about the up and coming elections and his report is in the newsletter. Also, John asked if anyone has received any feedback from the Senate or House of Representatives. He has not received any feedback. Newsletter: Kathy Holland absent, but the newsletter was sent out to everyone with e-mail addresses and printed copies are also at the front table. PR Communications: Ken Holland absent however, Steve has spoken with him and he stated that when he gets back into town he is going to be busy getting out and getting new advertisers. Ken also stated that he and Kathy will be back for the next meeting. Safety: George Green is no longer going to be able to do this so he handed it over to Mike Knezevich. Stated how the certification will have to be done and get the certified instructors that we have to help. The basic instruction manual approximately 25 pages (has 5 complete packages with him), also informed us about how the DVD is now showing both scenarios with a pause between both so that you can turn off the device and continue with the presentation and then start again. Stated that he had about 5 individuals that were interested and said that they should make a hot sheet and get together with Mike and the certified instructors and set up some classes. Asked Mike to stand up and stated he will be taking over. He will still be our Chaplin and will be at the meetings. Sgt. At Arms: Mr. Terry was absent State Reps: No State Meeting this month, next one is October 12th, 13th, 14th, 2012, “Spooks ‘N Scoots. Webmaster: Kathy Holland is absent, however welcomes anyone who would like to help out or even take over. Web site has not been updat- ed due to state having problems with the programs to update everyone’s websites. No chapter has updated for several months. Old Business: Showed the members the original chapter charter and Articles of Incorporation papers showing that we started in 1980. New Business: Run scheduled for November 17th, Saturday starts at Eagles and ends at Eagles, flyer being put together. October 6th party for members from the Daytona Rehab Center for what we did for them at Christmas. State Meeting Spooks ‘N Scoots October 12th, 13th, 14th down in Hillsborough County. September 29th Vintage Chapter Run and September 30th Peace River Chapter Run. Good of Order: Our Chaplin led us out with a prayer. 50/50: Dennis Snyder Meeting adjourned: 8:43 p.m.

Legislative Report September 11, 2012 John Banta Out of date as soon as I write it Go on to the ABATE of Florida Website www.abateflorida.com, Click on the Legislative Information Center (LIC) and subscribe to email list. You will get the latest legislative news and press releases. Some things hap- pen very quickly and need our action. State Legislative Trustee Darrin Brooks has an additional email list and sends out info on a wide assortment of legislative issues. Elections 2012 ABATE of Florida cannot endorse any candidate, but our lobbyist, Doc Reichenbach, can and we will print his recommendations. The following link is for state wide offices http://election.dos.state.fl.us/candidate As we meet the candidates, we need to educate them about ABATE. Tell them what we are all about. We are for legisla- tion for safer roads and maintaining funding for safety and awareness programs THESE ARE OUR NATIONAL ISSUES Motorcycle Only Checkpoints Currently, H.R. 904 would prohibit the Secretary of Transportation from providing grants or any funds to states or local gov- ernments to be used for any program to create motorcycle-only checkpoints. These checkpoints are discriminatory, intrusive and have very little to do with safety. Some states have passed legislation that prohibits accepting these grants. There has been a lawsuit filed in Ney York. The only other state to accept this grant was Georgia. Sandy Adams signed on as a spon- sor but was defeated in the primary Mandates to force states to pass Mandatory motorcycle Helmet laws Historically, the Highway bill has been used to implement nationwide mandatory helmet laws. Due to the hard work of the citizen lobbyist motorcyclists of this country, that's not the case in 2012 on the reauthorization of surface transportation pro- grams through fiscal 2014. There was never any official talk of attaching a helmet law on this bill. The last time Congress passed a highway bill, Sen. Lautenberg (D-NJ) offered an amendment on the floor of the Senate, just prior to passage. That amendment was defeated 68-29. The Florida DHSMV chart on fatalities per accidents, between helmeted riders and non- helmeted riders, is the best information we can provide that show helmets do not make that much of a difference. The 2010 Florida fatality/accident ratios are: helmeted motorcyclists 4.0%; un-helmeted motorcyclist 4.5%. That helmet does not make that much of a difference.

US House of Representatives District 7 SW Volusia and Seminole County REP, Jason Kendall DEM District 6 Volusia, Flagler, St. Johns and part of Putnam Ron DeSantis REP, Heather Beaven DEM Here is an email I received in September 2010, when Heather Beaven was running against John Mica Hi John, Thanks for the email. I talked with Heather about this issue and she strongly believes this (and many others) should be a state issue and be addressed state by state. She would support a measure to keep it that way. She does not believe mandatory helmet laws should be a federal priority or a federal issue. Your facts are very interesting and we will continue to follow and look into them as well. Heather actually just completed the American Motorcyclist Association survey so we hope that you will look for those results as well once they are pub- lished. Your point about education and awareness rings very true and I hope you will find a friend in Heather as a candidate and a future Congresswoman. Let me know if this adequately addresses your concern or if you have any other information or issues. Thanks and I hope Heather can earn your support and your vote. THESE ARE OUR STATE ISSUES No Mandatory Motorcycle Helmet Laws ABATE is much more than fighting helmet laws, but the conversation always ends up with this issue.

E15 Ethanol; Repeal the Florida Renewable Fuel Standard Act The federal EPA is allowing (mandating) to have 15% ethanol gasoline to be introduced to the market. It is anyone’s guess as to how that will affect the availability of E10. We all want cleaner air, less Middle East dependence and expansion of new markets. However, my 1985 Harley Davidson requires more maintenance because of ethanol. The instructions to my new lawn mower specifically state no gas over 10% ethanol. Ethanol makes engines run hotter, which is not good for air cool engines. Ethanol also will gum up carburetors. The American Motorcycle Association expressed concern about same hose “blender” pumps. The EPA response was to require a minimum purchase of 4 gallons which is not workable for many bikes with small gas tanks. Locally, non-ethanol gas can be only available at Daytona Gas and Grill and at boat marinas, hardly a solution. It was interesting to find in my cross-county trip this year that non-ethanol gas was available in many corn producing states, like South Dakota. We might have to ask Congress for action. During the Florida 2012 legislative session, we tried to be proactive to this situation but session ended before SB238; HB4013 could get out of committee SB238, HB4013 (THESE ARE OLD FLORIDA BILLS) These bills would have removed the requirement that all gasoline offered for sale in this state include a percentage of etha- nol, subject to specified exemptions, waivers, suspensions, extensions, enforcement, and reporting. Even if lawmakers re- peal the requirement, however, it is unclear how much effect the change would have. Rep. Costello co-sponsored the House bill. This was one of the results of us going to Tallahassee mid-session. The House bill died in the State Affairs committee. The Senate bill passed the Senate Communications, Energy and Public Utilities committee, with Senator Lynn voting yes. However, when it was sent to the Senate Commerce and Tourism committee, Senator Lynn temporarily postponed it, where it died.

Stiffer Penalties for those who cause an accident resulting in death There should be an infraction that law enforcement can write that is in between failure to yield and vehicular homicide. There is a stiffer penalty already, but we want it strengthen. I track the local motorcycle accident fatalities. One reason is to make sure the media does not exaggerate when discussing previous rally deaths. There has been an increased in mo- torcycle only accidents. And finally I monitor to see if the current stiffer penalties are being applied. The newspaper account is no substitute for what goes on in court. And sometimes, for reasons not available to an unre- lated person, charges are never filed and therefore does not appear on Diane Matousak, Volusia County Clerk of the Court’s website (which is one the best websites in this state). It is the courts that determine if someone is guilty since they presumably have the true facts. The Bikeweek 2012 accidents are still in the courts. Hers one from Bikeweek 2011: From the News-Journal. On March 3, 2011 in Deland, Timothy Ackley 18, drove into the path of John Henshaw 68, and killed him. Ackley was charged with running a stop sign, $166, and was also fined an additional $840 and his license was suspended for a year. Judge Feigenbaum did not have levied the Florida Statue 318.14 (5) fine of $1000 because he with- held adjudication. We still need to strengthen the stiffer penalties since Timothy Ackley was since charge, on Jan. 15, 2012 of driving with a suspended license. Monitoring DHSMV on motorcycle safety awareness programs Money for motorcycle safety is provided by additional fees that only motorcyclists pay on registrations. For five years we had a formal arrangement, with the State of Florida on how that funding was spent, however Gov. Scott vetoed that in the budget because he felt that such an arrangement, with an outside not for profit corporation, should not be in the budget.

Legislation to prohibit texting while driving Our chapter members, that go to our meetings, are supportive of such legislation. I personally have some reservations on how much the State of Florida should legislate driving distractions. However, texting is the worst. Cell phone issues have never been on ABATE of Florida, Inc. official legislative agenda. We need to be aware that our lobbyist, Doc Reichen- bach, can only be at one committee hearing at the time.

Florida House Volusia County has been divided into: District 24 Flagler, Southern St. Johns and Ormond by the Sea & NW Volusia Travis Hutson REP, Milissa Holland DEM This is what I sent: I am interested on your position on issues that affect me as a motorcyclist since I am in District 24. How do you feel about the current Florida motorcycle helmet law? The DHSMV fatality/ accident ratios show very little difference be- tween helmeted and non-helmeted accident victims. Last session I supported HB4013 which would repeal the Florida Renewable Fuel Standard Act which states that all gas sold at gas stations have ethanol. The federal EPA is mandating the introduction of E15 and older bikes and small engines have enough problems with E10. Motorcyclists have been lobby- ing for stiffer penalties for those who cause an accident resulting in death. We need a statue that is in between failure to yield and vehicular homicide. Careless driving can result in jail, so should killing someone for poor driving.
