OPPOSER, SPLIETHOFF BEVRACHTINGSKANTOOR B.V.'S MOTION FOR ORDER RESUMING PROCEEDINGS AND TO SHOW CAUSE AND INCORPORATED MEMORANDUM OF LAW

Opposer, SPLIETHOFF BEVRACHTINGSKANTOOR B.V., by and through undersigned counsel, pursuant to the Trademark Board's September 9, 2020 Order and TBMP § 510.03(b), hereby moves the Trademark Board to enter an Order resuming proceedings herein and to show cause why a default judgment should not be entered against Applicant, and in support respectfully

states as follows:

On August 10, 2020, Applicant's then-counsel filed a request to withdraw as Applicant's

counsel of record in this proceeding.

On September 9, 2020, the Board issued an Order granting the foregoing request and allowing Applicant until thirty days from the date of the order to appoint new counsel, or to file a paper stating that Applicant chooses to represent itself. 88 TTABVUE at 1. The Order suspended proceedings and provided that if "Applicant files no response, the Board may issue an order to show cause why default judgment should not be entered against Applicant based on Applicant's apparent loss of interest in the proceeding." 88 TTABVUE at 1 - 2.

Applicant received notice of the September 9, 2020 Order. The Order stated that it was sent

to Applicant at the address provided in the August 10, 2020 motion to withdraw. 88 TTABVUE

at 2. In addition, on September 10, 2020, counsel for Opposer also served Applicant, by email and

by U.S. Certified Mail, Return Receipt Requested, with a copy of the Order. See 89 TTABVUE

and Composite Exhibit "A" hereto.

Applicant has failed to respond to the Board's September 9, 2020 Order within the time

period established therein. As such, Opposer respectfully requests, in accordance with the terms

of the foregoing Order, that the Board enter an Order that proceedings are resumed and to show

cause why a default judgment should not be entered against Applicant.

WHEREFORE, Opposer prays that the Trademark Board enter an Order resuming this

proceeding and to show cause why a default judgment should not be entered against Applicant, and for such other and further relief as is just and proper.
