– having regard to the Protocol on the implementation of the Fisheries Partnership Agreement between the Democratic Republic of São Tomé and Príncipe and the European Community (12202/2019),

– having regard to the request for consent submitted by the Council in accordance with Article 43, Article 218(6), second subparagraph, point (a)(v), and Article 218(7) of the Treaty on the Functioning of the European Union (C9-0001/2020),

Introduction The European Union (EU) has signed a number of Fisheries Partnership Agreements (FPAs) and Protocols with non-EU countries. Through the FPAs, the EU gives financial and technical support in exchange for fishing rights for surplus stocks in the country's exclusive economic zone (EEZ), in a legally regulated environment. These agreements also focus on resource conservation and environmental sustainability, ensuring that all EU vessels are subject to the same rules of control and transparency, and supporting the partner country’s own sustainable fishery policy. At the same time, a clause concerning respect for human rights has been included in all protocols to fisheries agreements. The Fisheries Partnership Agreement between the Democratic Republic of São Tomé and Príncipe and the European Community entered into force on 29 August 2011 and has since been renewed automatically. The last Protocol to the Fisheries Agreement between the two parties, which entered into force on 23 May 2014, expired on 22 May 2018. The Commission conducted negotiations with the Government of the Democratic Republic of São Tomé and Príncipe (hereinafter ‘São Tomé and Príncipe’) with a view to concluding a new Protocol to the Agreement. Following these negotiations, a new Protocol was initialled on 17 April 2019. The Protocol covers a period of five years from the date of its provisional application, i.e. from the date of its signature.

Content of the Protocol In accordance with the priorities of the Fisheries Policy reform, the new Protocol provides fishing opportunities for Union vessels in São Tomé and Príncipe waters, on the basis of the best available scientific advice and following the recommendations of the International Commission for the Conservation of Atlantic Tunas (ICCAT). This new Protocol takes into account the results of an evaluation of the previous Protocol (2014-2018) and of a forward- looking assessment of whether a new Protocol should be concluded1.The Protocol will also enable the European Union and São Tomé and Príncipe to work more closely on promoting sound exploitation of fisheries resources in São Tomé and Príncipe waters and to support efforts by São Tomé and Príncipe to develop its fisheries sector, in the interests of both parties. Fishing opportunities The Protocol provides for fishing opportunities in the following categories: 28 freezer tuna seiners (16 for Spain and 12 for France) and 6 surface longlines (5 for Spain and one licence for Portugal). Financial contribution The EU's annual financial contribution amounts to €840,000, based on: - A reference tonnage of 8,000 tonnes per year, for which an access related amount has been

Fisheries in São Tomé and Príncipe The fisheries sector is one of the growth drivers in São Tomé-et-Príncipe. The fishing sector in São Tomé-et-Príncipe is exclusively artisanal and exploits coastal and highly migratory resources. Domestic catches have recently been assessed as being in excess of 12,000 tonnes, including 3,300 tonnes of tuna species. All catches supply the domestic market in the absence of exports. The artisanal fleet has developed over the past few years with increased landings and a shift from subsistence to a more commercial approach. São Tomé-et-Príncipe grants access to non-EU foreign tuna vessels in addition to EU vessels. Over the last few years, São Tomé-et-Príncipe authorities concluded protocols with entities representing tuna purse seiners for approximately 15 vessels. These protocols, shared by the Authorities with the evaluators, include terms of payment different from those for EU vessels, monitoring modalities aligned with those applicable to EU vessels, and clauses supporting employment of São Tomé-et-Príncipe nationals on board the vessels. The administration in charge of fisheries in São Tomé and Príncipe disposes only of national financial means and depends highly on external aid in order to develop its fisheries governance and comply with international standards. A partnership with the EU is important for the country to improve its fisheries management and the fight against Illegal, unreported and unregulated (IUU) fishing.

Conclusion and recommendations In 2017, the Commission carried out an ex-post evaluation of the current Protocol to the Fisheries Partnership Agreement with São Tomé and Príncipe, along with an ex-ante evaluation of a possible renewal of the Protocol.2 The evaluation report concluded that the Union’s tuna fishing sector has a strong interest in fishing in São Tomé and Príncipe and that a renewal of the Protocol would help strengthen monitoring, control and surveillance and contribute to improved governance of the fisheries in the region. The importance of the EEZ in the Gulf of Guinea contributes to the relevance of the envisaged new Protocol, both for the Union’s tuna fishing sector and for the partner country. This is an important agreement providing an opportunity for the EU to enhance ocean governance in the region, complementing actions in the framework of ICCAT, as there are no other fisheries partnership agreements in the area south of the Gulf of Guinea, a very important fishing zone (Equatorial Guinea, Gabon, and Angola). The fight against IUU fishing is a priority for the EU (see regulation 1005/20083). In this regard, the Union should substantially enhance its action against IUU fishing and improve

RR\1197221EN.docx 7/19 PE643.145v02-00 EN compliance with the rules of the common fisheries policy by ensuring proper control of fishing activities of EU vessels and other fleets operating in the waters of São Tomé and Príncipe. In that respect, the presence of observers on board from São Tomé and Príncipe national authorities could be enhanced. (Contribution to the economic and social development). The authorities of São Tomé and Príncipe should promote the implementation of EU rules on shark finning by foreign fleets4. There is a need to obtain a stable framework of access to fisheries resources in the area for EU vessels in order to invest in regional fisheries strategies in the long term. Additionally, EU vessels need access rights accompanied by a robust legal instrument providing legal clarity over the rights and obligations of parties involved (vessels and coastal state). Following the Court of auditor's analysis on the FPAs5, the rapporteur would like to highlight the observations from the Court and to stress the importance of reliable information on fish stock and catch data in order to respect the principles and objectives covering the CFP and the FPAs and in order to draw robust conclusions regarding the evaluation of the FPAs. Finally, the rapporteur stresses that Parliament must, at every stage, be kept fully and immediately informed about procedures related to the Protocol. An annual report should be submitted to Parliament and the Council on the outcome of the multiannual sectoral programme referred to in Article 4 of the Protocol, and on compliance with catch reporting requirements

These agreements also focus on resource conservation and environmental sustainability, ensuring that all EU vessels are subject to the same rules of control and transparency, and supporting the partner country’s own sustainable fishery policy. At the same time, a clause concerning respect for human rights has been included in all protocols to fisheries agreements. The Fisheries Partnership Agreement between the Democratic Republic of São Tomé and Príncipe (DR-STP) and the European Community entered into force on 29 August 20111 and has since been renewed automatically. The last Protocol to the Fisheries Agreement between the two parties, which entered into force on 23 May 2014, expired on 22 May 2018. The Commission conducted negotiations with the Government of the DR-STP and with a view to concluding a new Protocol to the existing Fisheries Partnership Agreement. Following these negotiations, a new Protocol was initialled on 17 April 2019. The Protocol covers a period of five years from the date of its provisional application, i.e. from the date on which it is signed. Fishing opportunities The Protocol provides for fishing opportunities in the following categories: 28 freezer tuna seiners (16 for Spain and 12 for France) and 6 surface longlines (5 for Spain and one licence for Portugal). Fisheries in the DR-STP The fisheries sector is one of the growth drivers in the DR-STP. The fishing sector in São Tomé-et-Príncipe is exclusively artisanal and exploits coastal and highly migratory resources. Latest amassments of domestic catches is in excess of 12,000 tonnes, including 3,300 tonnes of tuna species. All catches supply the domestic market in the absence of exports. The artisanal fleet has developed over the past few years with increased landings and a shift from subsistence to a more commercial approach. The DR-STP grants access to non-EU foreign tuna vessels in addition to EU vessels. Over the last few years, the DR-STP authorities concluded protocols with entities representing tuna purse seiners for approximately 15 vessels. These protocols, shared by the Authorities with the evaluators, include terms of payment different from those for EU vessels, monitoring modalities aligned with those applicable to EU vessels, and clauses supporting employment of the DR-STP nationals on board the vessels. Given the considerable economic, social and environmental challenges facing the DR-STP, the Rapporteur considers that this Protocol and the entire EU financial contribution should support the following priorities: - promoting: a sustainable economy, with particular attention to small-scale local fisheries; the modernisation of port infrastructure, especially in regard to the treatment and safe disposal of highly pollutant agents such as but not limited to, engine-oil; and equal treatment of all working in the fishery-chain with a special regard to vulnerable groups. - improving knowledge of this ocean region and scientific cooperation, particularly by enabling local- and EU-scientists to travel on board vessels operating in this area; that also means having a precise knowledge of the cumulative impact of the various fisheries agreements concluded by the DR-STP with third countries on the state of fisheries resources in this oceanic region, in order to ensure that the fishing industry can further develop in a sustainable manner and that marine life is not harmed by over-exploitation; - stepping up monitoring, control and enforcement of applicable laws to eradicate IUU fishing; in this regard, close coordination with all other support programmes in this field should be facilitated; - transparency in the use of the EU’s financial contribution shall be attained through the use of all applicable EU rules as well as the IMF’s Fiscal Transparency Code (FTC), in order to ensure maximised benefits for the population of the DR-STP as well as the ecosystem and marine life of the Region. The rapporteur hopes that the new protocol may have the potential to encourage responsible and sustainable legal use of fisheries resources, provided maximised benefits and ensue a high degree of fiscal transparency in regard to the use of EU funds. ******

SHORT JUSTIFICATION

The Fisheries Partnership Agreement between the Democratic Republic of São Tomé and Príncipe and the European Community1 entered into force on 29 August 20112 and has since been renewed automatically. The previous Protocol to the Agreement, which entered into force on 23 May 2014, expired on 22 May 2018. On the basis of the relevant negotiating directives, the Commission conducted negotiations with the Government of the Democratic Republic of São Tomé and Príncipe with a view to concluding a new Protocol to the Agreement. Following these negotiations, a new Protocol was initialled on 17 April 2019. The Protocol covers a period of five years. It provides fishing opportunities for Union vessels in São Tomé and Príncipe waters, on the basis of the best available scientific advice and following the recommendations of the International Commission for the Conservation of Atlantic Tunas (ICCAT). This new Protocol takes into account the results of an evaluation of the previous Protocol (2014-2018) and of a forward-looking assessment of whether a new Protocol should be concluded. Both were carried out by external experts. The Protocol will also enable the European Union and São Tomé and Príncipe to work more closely on promoting sound exploitation of fisheries resources in São Tomé and Príncipe waters and to support efforts by São Tomé and Príncipe to develop its fisheries sector, in the interests of both parties. The Protocol provides for fishing opportunities in the following categories: - 28 freezer tuna seiners, - 6 surface longliners. The negotiation of a new protocol to the Fisheries Partnership Agreement with São Tomé and Príncipe forms part of the Union’s external action in relation to countries in the African, Caribbean and Pacific (ACP) Group of States and takes into account, in particular, Union objectives on respecting democratic principles and human rights.

PE643.145v02-00 14/19 RR\1197221EN.docx EN The annual financial contribution from the European Union is EUR 840 000, based on: a) a reference tonnage of 8 000 tonnes per year, for which an amount linked to access has been set at EUR 400 000 per year for the entire duration of the Protocol. b) support for the development of São Tomé and Príncipe’s sectoral fisheries policy amounting to EUR 440 000 per year for the entire duration of the Protocol. This support meets the objectives of São Tomé and Príncipe’s national policy on the sustainable management of its continental and maritime fishery resources for the entire duration of the Protocol. The annual amount for commitment and payment appropriations is established during the annual budgetary procedure, including for the reserve line for protocols not having entered into force at the beginning of the year3. The Commission would be authorised to approve, on behalf of the Union, the amendments to the Protocol to be adopted by the Joint Committee set up under the Partnership Agreement.

The Committee on Budgets calls on the Committee on Fisheries, as the committee responsible, to recommend that Parliament give its consent to the draft Council decision on the conclusion of the Protocol on the implementation of the Fisheries Partnership Agreement between the Democratic Republic of São Tomé and Principe and the European Community.
