Resolution Adopted at the 75th Annual General Meeting of the Malaysian Bar Held on 13 March 2021 Resolution Regarding the Emergency (Essential Powers) Ordinance 2021 WHEREAS: (1) In December 2019, cases of “viral pneumonia” were identified in Wuhan, People’s Republic of China (“China”), and subsequently reported to the World Health Organization (“WHO”).1 Shortly after, it was identified as a new type of coronavirus (novel coronavirus, nCoV) and later termed by WHO as “COVID-19”. (2) On 13 January 2020, the first case of COVID-19 in Thailand was reported.2 By 27 January 2020, 11 countries (excluding China) reported laboratory confirmed COVID-19 cases, including Malaysia.3 WHO declared the COVID-19 outbreak as a “Public Health Emergency of International Concern” on 30 January 2020.4 (3) In Malaysia, a Movement Control Order (“MCO”) was implemented on 18 March 2020 to 31 March 20205 following a steep rise in the number of cases. Probed under OSA, Muhyiddin hopes he won't share Rafizi's fate MalaysiaKini.com Nov 15 th , 2016 Kow Gah Chie & Zulaikha Zulkifli Former deputy prime minister Muhyiddin Yassin, who is being investigated under the Official Secrets Act (OSA), hopes he too will not get a jail sentence, as was handed to PKR's Pandan MP Rafizi Ramli. "While I sympathise with what happened to Rafizi. I hope I will not fall into the same situation," Muhyiddin said after spending two hours in Bukit Aman to record his statement. "This is because I do believe that when I speak in Parliament, I do have the right to speak and I do have immunity." He was asked if he was worried that he would end up like Rafizi, who was convicted and sentenced to 18 months' jail under the OSA for leaking Page 98 of the auditor-general's report on 1MDB. Muhyiddin is currently being investigated under Section 8 of the OSA and Section 4 of the Sedition Act for his budget debate on Oct 26, which touched on 1MDB. Meanwhile, Sepang MP Hanipa Maidin ( photo ) said there is nothing wrong for any parliamentarian in the Dewan Rakyat to touch on matters under the OSA. Hanipa said this is based on the fact that elected representatives are protected by parliamentary immunity, and as such they cannot be charged for speaking out in the House. He said action could only be taken against an MP who utters remarks deemed to be seditious. “The speech by Pagoh (Muhyiddin) has no seditious elements and if what he said had touched on any official secret under the Standing Orders, or on any official matter, (he) cannot be charged under the OSA. -

KENYATAAN MEDIA GPS Gabungan Parti Sarawak (GPS) menafikan sebarang kaitan dengan PKR yang diketuai oleh Datuk Seri Anwar Ibrahim. GPS masih kekal memberikan sokongan tidak berbelah bahagi kepada kerajaan Perikatan Nasional (PN) di bawah kepimpinan Perdana Menteri, YAB Tan Sri Dato’ Haji Muhyiddin Yassin. Parti GPS yang dianggotai oleh Parti Pesaka Bumiputera Bersatu (PBB), Parti Rakyat Bersatu Sarawak (SUPP), Parti Rakyat Sarawak (PRS) dan Parti Demokratik Progresif Sarawak (PDP) kekal berpegang teguh kepada prinsip perlunya sebuah kerajaan Persekutuan yang stabil demi kebaikan rakyat dan ekonomi negara. Tambahan pula ketika negara sedang berperang dengan penularan wabak Covid-19 dan fokus sepenuhnya ditumpukan dalam memulihkan ekonomi rakyat dan negara. Selaku Setiausaha Agung GPS dan PBB, saya ingin mengingatkan Datuk Seri Anwar agar menghentikan permainan politik tidak matang demi mencapai kepentingan dan cita-cita peribadi. Sebagai seorang ahli politik veteran dan berpengalaman, Datuk Seri Anwar seharusnya menghentikan sebarang cubaan untuk mewujudkan ketidakstabilan di dalam negara yang hanya akan memberi kesan buruk kepada rakyat dan ekonomi. Kepentingan rakyat dan negara pada ketika kita sedang menghadapi cabaran penularan wabak Covid-19 yang telah meragut ribuan nyawa di seluruh dunia, perlu diberi keutamaan. GPS sekali lagi menegaskan bahawa parti ini menolak sekerasnya PKR yang bersekutu dengan pihak tidak bertanggungjawab dan angkuh melemparkan tuduhan bahawa Negeri Sarawak akan bankrap di bawah kepimpinan GPS. Negeri Sarawak, yang diterajui oleh YAB Datuk Patinggi Abang Johari Abang Openg sebagai Ketua Menteri akan terus memberi sokongan penuh kepada Perdana Menteri YAB Tan Sri Dato’ Haji Dato’ Haji Muhyiddin Yassin dan Ketua Menteri Sarawak, YAB Datuk Patinggi Abang Johari Abang Openg dapat membawa banyak kebaikan kepada kerajaan Persekutuan dan Negeri Sarawak. -

Kemenangan yang berpihak kepada parti pembangkang Pakatan Harapan telah membuktikan bahawa gelombang perubahan politik dan proses pendemokrasian itu adalah tidak asing dan ianya mampu direalisasikan dan ianya bersifat inklusif dengan mengambil kira aspek yang merentasi masyarakat majmuk. However, the PH government, led by ex-premier Tun Dr Mahathir Mohamad, only lasted 22 months. Accordingly, the sudden collapse of the PH government drew many to offer their respective analyses. James Chin (2020) wrote one of them titled ‘Malaysia: The 2020 Putsch for Malay Islam Supremacy’. He argued that, amongst the many reasons attributable to its sudden collapse, one stood out – the position of Islam and Malay supremacy in Malaysia. Since Malaysia is predominantly a Malay-Muslim country, such a profound claim warrants a thorough response. Mekanisme Pengawalan Bahasa Kurang Sopan (Unparliamentary Language) di dalam Dewan Rakyat: Perspektif Perundangan The Control Mechanism of Unparliamentary Language in the Dewan Rakyat: A Legal Perspective Idzuafi Hadi Kamilan* and Muthanna Saari** Abstrak Kekerapan insiden penggunaan bahasa kurang sopan di Parlimen merupakan cabaran besar dalam memastikan kelakuan tertib khususnya semasa perbahasan di dalam Parlimen. Pernyataan seksis, perkataan kesat, serangan peribadi termasuk pernyataan merendah-rendahkan orang (condescending) adalah dianggap sebagai bahasa kurang sopan dalam Parlimen yang tidak seharusnya mempunyai tempat dalam mana- mana badan perundangan. Penulisan ini menelusuri insiden penggunaan bahasa kurang sopan yang tidak berkesudahan di Dewan Rakyat, Parlimen Malaysia meskipun pelbagai peraturan dan Petua Speaker telah dibuat terhadap penggunaan bahasa sedemikian. Peraturan Mesyuarat 36(4) Peraturan-peraturan Majlis Mesyuarat Dewan Rakyat merupakan pengawal utama terhadap kesalahan menggunakan bahasa kesat dan pernyataan seksis di dalam Dewan Rakyat. Usaha untuk mendisiplinkan ahli Parlimen berkenaan penggunaan bahasa kurang sopan melalui pelbagai pendekatan perundangan sedia ada dipercayai sudah tidak berkesan. Oleh itu, penulisan ini menganalisis bagaimana bahasa kurang sopan dikawal di badan perundangan negara lain, seterusnya mencadangkan mekanisme pengawalan yang lebih baik dalam mentadbir ketidak tertiban penggunaan bahasa kurang sopan di Dewan Rakyat. Malaysian Electoral Reform – Three Proposals A Report for the Southeast Asia Rules-Based Order Project Professor Benjamin Reilly School of Social Sciences University of Western Australia 35 Stirling Highway Perth WA 6009 AUSTRALIA Executive Summary This paper investigates three areas of potential reform to Malaysian elections: the status of the electoral management body, the process of boundary delimitation, and the type of electoral system used. It argues that Malaysia’s existing electoral arrangements are out of step with best practice globally in all three areas. Establishing a genuinely independent electoral management body is the first step in restoring confidence in the Malaysian model of democracy. Urgent reform is also needed to the way by which electoral boundaries are apportioned and delimited to both equalise the number of voters in each electorate and to ensure that constituencies are drawn without recourse to political considerations. A final recommendation is to consider changing the way votes and translated into seats, suggesting that Malaysia consider moving away from its current first-past-the-post system to alternative electoral systems which can more truly reflect the will of the electorate. Introduction Elections are a unique area of public governance, being large-scale national events which require substantial state capacity, fundamental rights of speech and association, rule of law, and sufficient infrastructure and security to allow all adult citizens to participate. Well-functioning electoral processes balance the demands of the public at large with the rights of individuals, and must exhibit an overriding concern for the greater public good, as opposed to the good of special interests. -
