The tenure of SEIAA/SEAC’s in the State of ended on 16th

March 2020. The MoEF&CC informed to the Maharashtra SEIAA by an e-mail stating that, the tenure of SEIAA, Maharashtra has been extended up to

16.06.2020 In view of above communication and present pandemic situation of

COVID-19, Maharashtra SEIAA directed SEAC-2 to appraise the proposals by using information technology facilities. Hence, SEAC-2 initiated to appraise the proposal received by the SEIAA through Videoconferencing technology on Cisco

WebEx platform from 8th,9th & 10th June , 2020.

Following members of SEAC-2 were present for videoconference.

Deliberation:- The project proposal was discussed on the basis of presentation made and

documents submitted by the proponent. All issues related to environment,

including air, water, land, soil, ecology and biodiversity and social aspects were

discussed. Committee noted that the project is under 8a (B2) category of EIA

Notification, 2006. Consolidated statements, synopsis of compliances, form 1, 1A,

presentation & plans submitted are taken on the record.

During discussion following points emerged:

1. PP to ensure that STP to be kept open minimum upto 40%.

2. PP to adopt following segregation & treatment method for the sewage

generated from the residential complex.

A) Grey water :- The waste water emanating from bathroom, kitchen sinks,

wash basins, showers, dish washers should be collected separately and

treated on site ,suitably to a level for reuse for flushing of toilets in

be collected separately and conveyed through sewer to the nodal STP for

treatment and reuse for central garden, gardening etc.

3. PP to adopt water conservation measures by providing Low Flow Devices

(LFD) as plumbing fixtures.

4. PP to obtain Tree NOC from tree authority.

5. PP to submit legible contour map along with ground Monitoring results as

per protocol.

6. PP to ensure that the energy savings from renewable sources shall be

minimum 5.03 %.

7. PP to follow the methodology adopted by Metro rail in respect of study of

vibrations due to the metro rail in Mumbai.

8. No Occupation Certificate (OC) to be granted to the project unless the

proposed Nodal STP at Kharghar is commissioned and put into Operation.

9. During presentation it is mentioned that plot is out of CRZ area. PP to

submit the layout superimposing it on approved CZMP .

10. PP to convert 25% of car parking into two wheeler parking as per Socieo

Economic survey carried out.

11. PP to provide thick Miawaki Plantation all along the perimeter of the plot.

12. PP to calculate the reduction in potable water consumption due to provision

of Grey water treatment plant at site. The same shall be implemented.

13. PP to add ground water survey report in the EIA by taking samples from

existing nearby dug wells/bore wells. If these are not available then PP to

arrange to make samples available by digging at site.

14. The PP to get NOC from competent authority with reference to

creek flamingo sanctuary if the project site falls within 10 Km radius from

the said sanctuary boundary, if applicable. The planning authority to

After deliberation, Committee decided to recommend the proposal for

Environmental Clearance to SEIAA, subject to compliance of above point

During discussion following points emerged:

1. As the area of plot mentioned in the application is only 13840.227 sqm

which is actually not a separate plot but part of a big chunk of plot on

3. PP to adopt water conservation measures by providing Low Flow Devices

(LFD) as plumbing fixtures.

4. PP to ensure that the energy savings from renewable sources shall be 5 %.

5. As presented PP to use fly ash, Crushed sand instead of natural sand for

construction.

6. PP to obtain Tree NOC from Competent authority.

7. PP to submit an affidavit that no nalla is passing through the plot

8. PP to abide with conditions of all Government authorities.

9. The PP to get NOC from competent authority with reference to Thane

creek flamingo sanctuary if the project site falls within 10 Km radius from

the said sanctuary boundary, if applicable. The planning authority to ensure

fulfilment of this condition before granting Commencement Certificates.

10. PP to submit CER prescribed by MoEF&CC circular dated 1.5.2018 relevant

to the area and people around the project. The specific activities to be

undertaken under CER to be carried out in consultation with Municipal

Corporation or collector or Environment Department.

Decision:-

In view of above discussion and subject to compliance of above points, the proposal is recommended to SEIAA for grant of Environmental Clearance.

After discussion, Committee approved the ToR with following observations & additions, which is valid upto 09/06/2023. EIA will be apprised as & when submitted. 3. PP to submit structural stability report from local body as the construction

is being carried for 7 floors instead of G+4, earlier sanctioned, on the same

Plinth..

4. PP to submit copy of earlier layout super imposing the new layout in

comparison with RG area and other amenities.

5. PP to adopt water conservation measures by providing Low Flow Devices

(LFD) as plumbing fixtures.

6. PP to submit socioeconomic study along with behavior pattern of the

proposed occupiers of the flats and develop a protocol for sustainable

operation of Environment Infrastructure.

7. PP to submit specific DMP , if the STP operation fails what are the

measures proposed .

8. PP to integrate EMP with all attributes of Environment.

9. PP to carry out Detailed Geo-Hydrological Study to ascertain the

usefulness of rain water harvesting with Technical details.

10. PP to ensure ECBC norms are complied.

11. PP to submit & upload wind analysis, shadow analysis, traffic analysis, light

and ventilation analysis and measures to reduce heat island effect.

meter area all around the proposed project. PP to also study contour of the

whole catchment and of the plot area and design the storm water network

accordingly.

13. PP to ensure that the Nallah which is flowing W-N-S in the plot is neither

diverted nor covered and that its natural flow is maintained. It may be

suitably widened, delisted or deepened as per remarks of the planning

authority.

14. PP to submit the design & cross section of STPs indicating minimum 40%

area open to sky for adequate ventilation.

15. PP to submit the detailed EMS system to be followed in the proposed

project. The system should be divided in two parts , during construction &

after construction, as mentioned during the meeting.

16. As agreed during presentation a separate report on sustainable

maintenance of Environment infrastructure , along with budgetary

provisions made and to be transferred to the housing societies for

further period 10 years after formation of housing Societies , to be

included in the report.

17. PP to verify the distance of project site from Flamingo Sanctuary, . PP to

submit & upload the same.

18. PP to submit report with emphasis on migrant labours, transit

accommodation, in situ arrangement for labours with PHC /Dispensary.

the said sanctuary boundary, if applicable. The planning authority to ensure

fulfilment of this condition before granting Commencement Certificates.

Proposal was earlier considered in 131st meeting of SEAC-2. SEAC pointed out that,

1. The land CTS no A589 on, which present project is proposed NDZ in

current DP, UD while draft notification 06-08-2019 proposed to change

the reservation from NDZ to residential zone excepting reservation for

cemetery in this plot, PP is not supposed to take any construction activity

till the final notification is published by UD converting land from NDZ to

residential zone.

2. PP to clarify what is the plot area of 589(A)-plot. The area as per proposal

and as per U.D Notification does not tally. It is therefore not becoming

clear as to for how much plot area, the EC is to be granted.

3. PP to ensure that project should be net zero discharge.

4. The nalla flowing through plot not to be closed by cement slab nor it should

be diverted. PP to ensure that crossing over nalla should be of box culvert.

PP to provide 6 mtr road alongside nalla for maintenance and upkeep of

nallah.

5. PP to submit the nalla remark received by vide letter date 17-08-2019.

6. Committee noted that, nalla drawing shown in PPT is not matching with nalla

remark drawing received from MCGM, PP to submit actual layout matching

the nallah flow as per actual on the spot.

7. PP to ensure that E-waste disposal should be as per E-waste management

rule 2016.

8. PP to submit the copy of HRC NoC. Minutes of the 134rd meeting of the State Level Expert Appraisal Committee-2 (MMR & th th th Konkan Division) held on 8 ,9 & 10 June , 2020. 9. PP to submit the CFO NoC.

10. Civil aviation NOC for proposed helipad on top of building as well as point of

height of building.

Deliberation:- The PP along with Consultant presented the compliance of above points during meeting. The project proposal was discussed on the basis of presentation made and documents submitted by the proponent. All issues related to environment, including air, water, land, soil, ecology and biodiversity and social aspects were discussed. Committee noted that the project is under 8a (B2) category of EIA Notification, 2006. Consolidated statements, synopsis of compliances, form 1, 1A, presentation & plans submitted are taken on the record.

During discussion following points emerged:

1. PP submitted the compliance of above points.

2. PP submitted nalla remarks dated 17.10 2019 however mentioned that they

have approached MCGM for Revised Nalla remark on 07th may 2020 which

is awaited.

3. The Committee during earlier appraisal of the Project had pointed out that

the Nallah passing through the plot is neither to be diverted nor closed

except that crossing over the Nallah may be through box culverts of

sufficient strength and that the PP was to provide clear driveway along the

Nallah for its maintenance and upkeep. The MCGM has also not given any

Nalla remarks granting permission for diverting/closing of Nallah. The

project therefore cannot be considered as proposed.

Decision:-

In view of above discussion the proposal is deferred and will be considered after compliance of above points.
