GENDER NEUTRALITY AND THE DEFINITION OF RAPE: CHALLENGING THE LAW’S RESPONSE TO SEXUAL VIOLENCE AND NON-NORMATIVE BODIES ELISABETH MCDONALD* In 2005 the legislature of Aotearoa New Zealand chose for the second time, the first occurring in 1986, to retain the offence of rape as one of the ways in which the crime of sexual violation may be committed. The current definition of rape means that only those with a penis can be guilty of this offence, and only those with female genitalia can be a victim of such a crime. Despite use of the term in public vernacular being wider than the legal definition, little advocacy has been focussed on reforming this law, although those in the trans and intersex communities recognise their experiences are not reflected in the description of rape. In this piece I note the importance, and difficulty, of making visible within the legislative framework both the gendered nature of sexual offending as well as the vulnerabilities of those who have non-normative bodies. By considering the theory and critical analysis which informed the debates and law reform undertaken in other jurisdictions, I conclude that it is time to reconsider the actus reus of rape in Aotearoa New Zealand, with the aim of extending its scope so as to be responsive to all communities’ experiences of sexual violence. I INTRODUCTION Beginning with reform which took shape primarily in the mid-1970s, most common law jurisdictions have now adopted revised definitions of varying types of sexual offences. Early advocates for change were primarily concerned with the limited scope of the traditional crime of rape, including the requirement for force and the marital exemption.1 Feminists also agitated for * Professor, School of Law, University of Canterbury. -

He worked as a taxi driver in Kings Cross. Fred's mother, Marjorie, migrated to Australia from New Zealand and was of Scottish heritage. She worked as a waitress in Kings Cross. Both of Fred's parents are now deceased, and are buried in Christchurch, New Zealand. Fred has one brother (deceased), Jim who lived in Sydney, and two sisters, Marjory and Mary, who live in Christchurch, New Zealand. Fred married Elaine in 1958. Together, they had four children: o Stephen: Retired NSW Senior Police Constable, Driving school instructor. o Sharon: Social Worker. o Mark: State School Teacher, Previously secondary (17 years) now primary o David: Retired NSW Senior Police Constable (injured on duty). Council Ranger Sadly, Elaine passed away on the 17th October, 2011 from Cancer of the liver after 3 years of Chemotherapy and operations. Fred was remarried in December 2013 to Silvana Nero. August 08 Senate Submission: Academic Freedom ACADEMIC FREEDOM MAKE EDUCATION FAIR 13th August 2008 Committee Secretary Senate Education, Employment and Workplace Relations Committee Department of the Senate SUBMISSION TO SENATE INQUIRY INTO ACADEMIC FREEDOM The Young Liberal movement and the Australian Liberal Students Federation are gravely concerned about fairness in education. We welcome the opportunity to provide a submission into the inquiry into Academic Freedom, representing the voice of mainstream students across the country. Make Education Fair Campaign Bias at our high schools and university campuses has reached epidemic proportions. Many of our student members have approached us with numerous stories of this bias being expressed by teachers, reflected in the curriculum or in a hostile atmosphere for students who cannot freely express their views. We would like to ensure that all students continue to have the right to exercise freedom of thought and expression, without fear of reprisal or penalty. Over the past few months, the Make Education Fair campaign has actively sourced examples from students who have experienced bias on university campuses. The depth of academic bias uncovered by this campaign, most notably in the arts faculties of Australia’s major universities, is gravely disturbing and poses significant challenges for diversity within the education sector. Genders at Work: Exploring the role of workplace equality in preventing men’s violence against women Scott Holmes and Michael Flood Genders at Work: Exploring the role of workplace equality in preventing men’s violence against women 1 White Ribbon is the world’s largest movement of men and boys working to end men’s violence against women and girls, promote gender equity, healthy relationships and a new vision of masculinity. White Ribbon Australia, as part of this global movement, aims to create an Australian society in which all women can live in safety, free from violence and abuse. We are Australia’s only national, male-led violence prevention organisation. We work to examine the root causes of gender-based violence, challenge behaviours and create a cultural shift that leads us to a future without men’s violence against women. Through education, awareness-raising, preventative programs, partnerships and creative campaigns, we are highlighting the positive role men play in preventing men’s violence against women and inspiring them to be part of this social change. You may not see all of us unless we want you to, but we are there. Whether you choose to acknowledge our presence is another issue. Historical prejudices against minority groups and those who are 'different' still exist in many parts of the world and in many of our universities. There are significant cultural, religious, national and regional differences in how minority 'tribes' or 'groups' are identified and treated. There is a significant body of esearr ch discussing issues of homosexuality and discrimination against homosexuals. A simple search of the World Wide Web (WWW) will lead any interested person to thousands of pages and sites that discuss the discrimination. The research discusses many different aspects of same sex attraction and same sex practices. However, many of those who are in charge of our tertiary institutions systematically ignore this body of research. -

897 BOOK REVIEWS THE INCREDIBLE WOMAN: POWER AND SEXUAL POLITICS BY JOCELYNNE A SCUTT Sandra Petersson* Jocelynne A Scutt The Incredible Woman: Power and Sexual Politics (Artemis Publishing, Melbourne, 1997) (vol 1, 336 + xiv pages, $AUS34.95; vol 2, 354 + xvii pages, $AUS34.95). The Incredible Woman: Power and Sexual Politics is an anthology of scholarship by Jocelynne Scutt, Australian barrister and law reformer. While stated to cover 25 years of Scutt's activism, over three quarters of the articles are from the period 1990 to 1996, a fact that lends currency to the collection. The articles are arranged thematically under four headings. Volume One consists of "Part I — 'Judicial Wisdom', Patriarchal Power", a general examination of sexual politics in the legal system, and "Part II — Medicine, Power and the Politics of Health", a particular examination of sexual politics in the area of health law. Volume Two focuses on the wider equality issues of economics and power in "Part III — The Economic Politics of 'A Woman's Place'" and "Part IV — Power and the Woman". The cover of each volume bears the image of a diver, an athlete of visible strength captured in mid-flight. Behind her, there is a faint horizon that marks the division between air and water, the diver's twin media. An Examination of the Parliamentary Disqualification Provisions of the Commonwealth Constitution* John Kalokerinos THE PLACE OF SECTION 44 IN CONTEMPORARY AUSTRALIAN PARLIAMENTARY DEMOCRACY The right to choose political representatives is a fundamental right of the citizens of a democratic polity. Section 441 of the Commonwealth Constitution sets out the disqualification provisions for persons seeking to sit in the Senate or the House of Representatives in order to ensure that Australia’s parliamentarians have an undivided loyalty to Australia and to the Parliament. Using the 1890s Convention Debates, decisions of the Court of Disputed Returns, government reports, and academic commentary, this paper explores the purposes and justification for s 44, and its operation in the contemporary Australian context, to argue that reform is necessary. The paper reviews the latest developments in this dynamic area of the law, examining the most recent litigation, including the Hill2 decision. Particular consideration is given to Sykes v Cleary,3 where the High Court held that three of the candidates for election to the seat of Wills were ineligible, raising the question whether this rate of disqualification is extraordinary or simply demonstrative of the pressing need for reform of s 44. * This is an edited version of an Honours Thesis submitted for the Research Unit, Faculty of Law, the Australian National University, June 2000. 1 The full text of ss 44 and 45 is set out in the Appendix below. 2 Sue v Hill (1999) 163 ALR 648. 3 Sykes v Cleary (1992) 176 CLR 77.
