Johnson Lawson Kenton Richardson Ramone DELAWARE STATE SENATE 149th GENERAL ASSEMBLY JUNE 12, 2018 SENATE BILL NO. 235 AN ACT MAKING APPROPRIATIONS FOR THE EXPENSE OF THE STATE GOVERNMENT FOR THE FISCAL YEAR ENDING JUNE 30, 2019; SPECIFYING CERTAIN PROCEDURES, CONDITIONS AND LIMITATIONS FOR THE EXPENDITURE OF SUCH FUNDS; AND AMENDING CERTAIN PERTINENT STATUTORY PROVISIONS BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE: 1 Section 1. The several amounts named in this Act, or such part thereof as may be necessary and essential to the 2 proper conduct of the business of the agencies named herein, during the fiscal year ending June 30, 2018 2019, are hereby 3 appropriated and authorized to be paid out of the Treasury of the State by the respective departments and divisions of State 4 Government, and other specified spending agencies, subject to the limitations of this Act and to the provisions of Title 29, 5 Part VI, Delaware Code, as amended or qualified by this Act, all other provisions of the Delaware Code notwithstanding. 6 All parts or portions of the several sums appropriated by this Act which, on the last day of June 2018 2019, shall not have 7 been paid out of the State Treasury, shall revert to the General Fund; provided, however, that no funds shall revert which 8 are encumbered pursuant to 29 Del. Inasmuch as there was no opinion of the court, as a court, the reporter refers the reader to the opinions of the judges for an explanation of the statutes and the goints in which they conffilcted..with the Constitution aifd laws of the United tates. THESE were kindred cases, and were. argued together. They were both brought up to this court by writs of. error issued un- der the twenty-fifth section of the Judiciary Act; the case of Smith v. Turner being brought from the Court for the Trial of Impeachments and Correction of Errors of the State of New' York, and the case of Norris v. The City of Boston from, the Supreme Judicial Court of Massachusetts. The opinions of. the justices of this court connect the two casds so closely, that the same course will be pursued in reporting them which was adopted in the License Cases.

He feels, and ever will feel, that he has received an incurable wound from that sword which he, in com- mon with his fellow citizens, had put into the hands of the magistracy for their protection. ” The case made in the court below was one appealing very strongly to the reason of that tribunal to grant a new trial. It was certainly from no fault of the court before which the defendant was tried that the trial resulted in a conviction. A number of unfortunate circumstances concurred in presenting him before the jury substantially without defence, and yet standing thus unaided and unshielded before them, there was evident hesitation with the jury in convicting him of the crime of murder. There is every reason to believe that on another trial the crime laid to his charge will, if not excused, be greatly mitigated. I think it is eminently due to this comparative stranger to us and our institutions-this “ waif, ” as he has been appropriately called, cast upon our shores from LL the central flowery kingdom “- that he should have one more opportunity to show the extenuations of his offence, even if he cannot suc- ceed in wholly purging himself of crime.
