Introduction

The 12 month period from 1 st August 2011 to 31 st July 2012 covered by this report was a busy one with the normal highs and lows that make up a successful academic year.

Our students continue to excel both in terms of LLB performance with 22% securing overall Firsts but also with several successes in national mooting competitions, further details below. At postgraduate level we had the first Diploma Awards Ceremony since the repatriation of the Diploma and continue to be the leading provider in Scotland. Lord Gill presented the awards and delivered the charge to the students. In the autumn the LLM Graduation was marked by the award of an honorary LLD to Judge Bruno Simma, then a judge at the International Court of Justice in The Hague. Furthermore, two new LLM Programmes, Intellectual Property and the Digital Economy and International Law and Security , were launched in September.

In terms of academic events the year was marked by the 25 th James Wood Lecture delivered in the autumn by Baroness Brenda Hale, Justice of the Supreme Court, and the first Andrew Dewar Gibb Lecture delivered in the spring by Lady Hazel Cosgrove. A number of other lectures, seminars and workshops were organised bringing to the University of and to the School of Law academics, practitioners and judges from the UK and abroad.

As evidenced by the list of publications annexed to the Report, academic staff have been productive publishing seventeen books and a significant number of articles in leading national and international journals. The work of colleagues in the School has been recognised nationally and internationally by either election to prestigious bodies or awards for outstanding contributions to innovative teaching programmes.

The internationalisation of the School of Law continues with several new academic appointments coming from European Universities. For our undergraduate students the School participated in Summer Schools organised in Italy and The Netherlands. We have also been active in recruiting non-UK students. The recruitment activities have focussed on Germany, Norway, China and Brazil. Several agreements have been signed with non-UK Schools of Law primarily facilitating mobility of undergraduate and postgraduate students. The School has continued to welcome foreign visitors who are accommodated in the School for periods ranging from a month to a year.

The highlight of the year in terms of a significant appointment was the recruitment of a distinguished academic to the Regius Chair in Law which has been vacant of a number of years. James Chalmers, an expert in Criminal Law, and formerly from the University of , was appointed to a Chair of Law and nominated to the Scottish Executive as the University’s candidate for the Regius Chair. The appointment enables the School to initiate in January 2013, the tercentenary celebrations of the establishment of the Regius Chair. During the following 12 months, a number of events will be organised to focus attention on the School’s excellent scholarship in terms of research and teaching as well as the achievements of its alumni. The celebrations will be launched on Thursday 17 January 2013 with the inaugural lecture of Professor James Chalmers, Regius Chair in Law.

4 Staffing

As we have come to expect the year was marked by a number of staff departures and arrivals.

Outgoing :

• Antonios Tzanakopoulos - left in September 2011 to take up a temporary post as a lecturer at University College London. He has now been appointed to a permanent post at the University of Oxford (but remaining on a 0.2% contract at Glasgow).

• Dr Aileen McHarg left in March 2012 to take up a Chair in Public Law at the University of Strathclyde.

• Professor Scott Veitch resigned as from June 2012 to remain as the Paul K C Chung Professor in Jurisprudence at the University of Hong Kong , a post he has occupied since 2010 after taking a period of leave of absence from the .

• Professor Nicholas Tsagourias left in August 2012 to take up a post as Professor of International Security at the University of Sheffield.

We wish them all success in their new endeavours.

Incoming:

Professor James Chalmers has taken up the Regius Chair of Law. He was previously at the

Dr Marco Goldoni from the University of Antwerp, has taken up a Lectureship in Legal Theory.

Mr Thomas Heraghty has taken up the post of Assessment Administrator

Dr Irini Papincolopulu has taken up a lectureship in International Law. She has just completed a period of two years at the University of Oxford as a Marie Curie Fellow.

Professor Emilios Christodoulidis has been elected member of the Executive Committee (representing the UK for a period of 4 years) of the International Association of Social and Legal Philosophy (IVR). Currently celebrating its centenary, the IVR is the main international association for legal philosophy. The Association numbers over 30 national branches and its bi-annual conferences are attended, on average, by 800-900 scholars.

Professor Lorne Crerar has been appointed for a term of 3 years as the Chair of the Highlands and Islands Enterprise (HIE). He has been a member of the HIE board since April 2008 and is also chair of the HIE Risk and Assurance Committee.

Professor Mark Godfrey , (then Senior Lecturer in ) was appointed Editor of The Journal of Legal History as from November 2011. The Journal was established in 1980 and is dedicated to publication on the sources and development of the common law, both in the British Isles and overseas, on the history of the laws of Ireland, Scotland, and Wales, and on Roman Law and the European legal tradition. It is the leading European journal in the field published in English.

Professor Jim Murdoch, Professor of Public Law at the University of Glasgow has been awarded the Pro Merito medal of the Council of Europe. The medal is the highest distinction granted by the Secretary General to individuals or organisations in recognition of their commitment to the Council of Europe’s values and work. The medal was presented to Jim for his work in human rights education and, in particular, the Human Rights Project, now in its 20th year.

Professor Christian Tams has successfully become a member of the Royal Society of Edinburgh Young Academy of Scotland for an initial term of 3 years. The Society has nominated 68 members who were selected from over 300 applicants. The Young Academy was launched at a ceremony in November 2011 in Edinburgh.

Dr Antonios Tzanakopoulos has won the Georges Tenékidès Prize for best doctoral thesis in international law and international relations in the biennium 2009-10. The prize is awarded by the Hellenic Society of International Law and International Relations.

Honorary degrees

Judge Bruno Simma from the International Court in The Hague was awarded an Honorary Degree at the postgraduate graduation in December 2011.

Undergraduate Student News

English Speaking Union Essex Court Chambers National Mooting Competition

Katherine Docherty, Francesca Ruddy, HRH Prince Philip

In June 2011, after seven months of moot rounds against universities throughout the country, two final year students, Katherine Docherty and Francesca Ruddy were delighted to win the Final of the English Speaking Union (ESU)/Essex Court Chambers National Mooting Competition, held in the Royal Courts of Justice in London. Beating opponents from the and BPP Law School (London) they mooted on Equity in front of a three-judge bench.

This is the first time in the prestigious competition’s 40 year history that the coveted silver mace has come to Glasgow. The students each received a cash prize and a cheque for the School of Law. After being congratulated in the Scottish Parliament and by prominent legal figures such as Lord Bonomy, Lord Gill and Lady Smith, they were invited to the ESU prize-giving ceremony at Buckingham Palace in November and were honoured to receive an award from Prince Phillip, Duke of Edinburgh.

OUP-BPP Mooting Competition

Katherine Docherty and Bobby Lindsay won the Oxford University Press - BPP National Mooting Competition for 2011-2012, held at the BPP Law School in Holborn, London. Katy and Bobby were one of four teams in the final, having started out competing as one of 58 UK universities in the competition. This is the second time in a decade that Glasgow has won this UK-wide mooting competition (previously won for Glasgow by Raymond Baudon and Louise Beattie in 2003).

Placements

We continue to be effective in our activity outwith the school facilitating approximately 50 student placements with several key firms and organisations including: Citizens’ Advice Bureau, Airdrie In-Court Advice Service, Govan Law Centre, Witness Service (Victim Support). Law students are also invited to apply for placements sourced by Club 21, normally at city law firms. The Employability team is monitoring the links and the optimum number of “placement partners” in order to realise the best fit of placements to number of interested students. The placements are very popular as they add a positive dimension to the student’s CV and we are continue to seek placement partners to add to our portfolio.

Postgraduate Student News

Diploma students were once again very successful in the Client Consultation Competition and the two students, Andrew Gow and Rachel McKay, who won the internal heats, represented the University at the Scottish finals in Dundee and again for Scotland in the international competition in Dublin.

For the first time, Diploma students took part in the Scottish Negotiation competition, which was held in Aberdeen. Pamela Sealey and Jane Farnsworth won the national event and went onto represent Scotland in the international finals in Belfast.

Andreas Jauch, a postgraduate student studying for an LLM in Intellectual Property and the Digital Economy (IPDE programme), benefitted from a summer 2012 internship with the IP team at the Glasgow Office of Pinsent Masons. In 2012-13 a boutique Scottish IP law firm – Cloch Solicitors – will also be offering one student on the IPDE programme a two-week summer internship working in the field of IP law.

In March 2012, a group of students from the International Law/International Law & Security LLM programmes organised a trip to The Hague, where they visited various institutions such as the International Criminal Court (ICC), the International Criminal Tribunal for the former Yugoslavia (ICTY) and the International Court of Justice (ICJ).

9 Scottish Competition Law Forum 2012

In May 2012, the University of Glasgow hosted the Scottish Competition Law Forum 2012 student debate. Teams were made up of 2-4 members following undergraduate or postgraduate studies with some element of competition law. The University of Glasgow was represented in the debate (on the topic This house believes no cartel can be justified ) by two teams of students. Members of the winning team consisting of Lindsay Morison, Rachel Malloch, Martin Langvik and Paul Silviu who are all students taking postgraduate courses in competition law, were invited to spend a day with one of the Scottish competition law practitioner firms, Pinsent Masons. The judge hearing the debates was Dr Philip Marsden, Director of the Competition Law Forum and Senior Research Fellow of the British Institute of International and Comparative law.

Continuing Professional Legal Education We have continued to revise and develop the portfolio of courses that we offer to legal professionals so that they remain innovative and dynamic. As from May 2012 the School commenced the delivery of Trainee/Continuing Professional Development (TCPD) courses. The School organised and delivered 26 courses specifically designed for the legal and other professions. The School is now offering courses approved by the Law Society of Scotland (LSS) not only for TCPD and Continuing Professional Development (CPD) but also offers the opportunity to choose courses which will lead to an LLM in Contemporary Law and Practice. In this manner trainees and solicitors are able to meet the professional requirements of the LSS as well as the academic standards for an award of a postgraduate degree. The autumn/winter programme of courses, which offers 55 different sessions, is due to commence in September 2012.

Our courses are delivered by expert academics or Diploma tutors who are practitioners and trained in teaching skills. It is a key objective of the School to become the provider in Scotland not only of the best qualified law practitioners but also to be recognised as a centre of excellence for the provision of courses for law trainees, legal practitioners and other professionals

Internationalisation

The School of Law’s international profile reflects its continuing successes in attracting overseas students, sending undergraduate students abroad, and in developing staff collaboration in postgraduate recruitment, teaching and research.

The results of the International Student Barometer for 2011 indicated the University of Glasgow is rated 1st in the UK for international student satisfaction: in Law, more than 90% of the international students in the School of Law report satisfaction with their learning experience at Glasgow, while an impressive 99% of international students report themselves as being satisfied with the expert lecturers in the School of Law.

Developing links: International visits and collaborations

In October, a group of 10 senior law students from the University of Sarajevo visited the School on a two- week study programme. This was part of a programme involving Glasgow, Hamburg (Bucherius) and Virginia Law Schools following a series of intensive classes which were delivered in Sarajevo earlier this year. The lectures were delivered by academics and practising lawyers, including Professor Ian Forrester. The focus of the programme is public law and European law. Funding comes from a range of European government and private charities.

The ‘Globalisation and Legal Theory’ doctoral programme is a collaboration between the Universities of Antwerp, Glasgow, Kiel and Tilburg . Erasmus Mundus, with eight students, three of who will be supervised in Glasgow and a full 'intensive training programme' has been devised for its first year, including a week- long seminar in November in Glasgow with the participation of all students and teaching staff. The objective for this programme is to secure Erasmus Mundus Action 1B funding in due course. It a unique experiment at PhD level and we have been approached by Bologna who wish to participate in the partnership . One particular feature of the programme is that it involves regular exchange between PhD students and staff across the four participating universities through co-supervision, annual doctoral colloquia and joint seminar series.

The Law School has developed an integrated programme targeted at the US graduate market. The integrated programme permits graduates to enrol on the 2-year accelerated LLB degree followed by 1 year LLM and thus graduating with 3 years of Law studies. The School of Law intends to seek recognition of this integrated degree from the New York Bar Association which would enable the graduates to receive credit for relevant courses taken at Glasgow.

11 The joint programme will offer a fee discount for the combined integrated programme. The combination of professional accreditation with a Masters level qualification is unusual and has considerable potential, especially if promoted to partner institutions in the US.

In January a delegation from the University of Xi'an Jiaotong (XJTU) visited the University with specific interest in exploring possibilities for their law students to study at the School of Law. An agreement has been signed enabling their postgraduate students to come to the School for one year LLM study, sandwiched between their 2 and 3 year masters programme. Agreements have also been signed with two leading Chinese Law Schools with the intention of facilitating Chinese students coming to the University of Glasgow to study for one of our LLM programmes.

Following a visit by Professor Greaves to Brazil in April, an agreement is being entered into with the University of Sao Paulo (USP) for student exchange. Another agreement is being finalised with Pontificia Universidade Catlolica de Sao Paulo (PUC) to enable PUC students to join the Glasgow LLM and then to complete their LLB at PUC with credit awarded by PUC for the Glasgow LLM.

In May 2012 the Law School hosted a visit by academic and administrative staff from the Faculty of Law, University of Oslo . While undergraduate collaboration already occurs through the Erasmus/Study Abroad programme, the visit highlighted areas of potential collaboration at postgraduate level. In the short-term some form of collaboration with regard to PG research, such as a joint PGR conference, seems feasible.

12 In July 2012, Prof Victoria Marich, for the St Petersburg University of Management and Economics (SPbUME ) returned to Glasgow to follow up on the signing of a Memorandum of Understanding, earlier in the year, by signing a Study Abroad agreement for undergraduates from the 11 campuses that cover the length and breadth of the Russian Federation. While here she met with staff from the School of Law, School of Education and the Adam Smith Business School to discuss the possibilities of joint research, 1+1 PGT arrangements and staff development for SPbUME academic staff. The College of Social Sciences looks forward to working with SPbUME in the future.

A team of five students and Professor Jim Murdoch were invited by the Council of Europe to teach a human rights course at the European Humanities University (EHU) in Vilnius, a university funded by Western governments and donors for law students from Belarus. The intensive one week course focused on the fundamentals of human rights law and the process of taking a case to Strasbourg. This is the third time Glasgow students have taught this course in Lithuania and continues a productive partnership between the school of law and EHU.

A number of recent graduates and Diploma students have been involved in the creation of human rights teaching materials for the Council of Europe. In November the team took part in a symposium in Strasbourg on freedom of expression in the classroom. In April the team were part of a working group in Lucerne alongside education students from Swiss and Croatian Universities. The ongoing project is currently being tested in Scottish schools and a conference will be held in Glasgow in January 2013.This Symposium is the first of a series of annual events organised within the life-cycle of the project “Learning the key principles and the functioning of the European system of protection of human rights” (2010-2014) on different topics of interest for educators and lawyers, education policy makers as well as law students and teachers. The

13 Symposium addressed the broad topic of promoting freedom of expression, not only in the classroom (in respect of senior students in secondary level education) and in the education context but also more generally in helping spread awareness of and respect for the standards and values expressed in the case law of the European Court of Human Rights and other standard-setting bodies of the Council of Europe. Internationalisation within the curriculum

21 students - including UG students , LLM by Research students and MSC students of European Politics and Law took part in a Study Visit to Brussels in December 2011. The group was sponsored by David Martin MEP and visited, in addition to the European Parliament, the European Commission (Competition Directorate), Council of the EU, White and Case LLP, Join Law Societies Brussels Office, Scottish Government EU Office and Scotland Europa.

The ‘study abroad’ programme for level 3 students saw a further increase in participation: some 55% of all level 3 students on the Honours programme now spend all or part of their year abroad.

Calgari Summer School Ten undergraduate students and four members of staff took part in the first ERAMUS Intensive programme- funded summer school in Sardinia, Italy in July. This involved a collaboration between Cagliari (Italy); Juan Carlos (Spain); Marburg (Germany) and Glasgow.

Nijmegen Summer School For the first time this year three of our second year students were invited to participate in the annual University of Nijmegen Summer School on European and Comparative Competition Law. Chosen on the basis of their student record in related subjects, on their interest in pursuing further studies in competition law and on their wish to participate as evidenced by a short written essay, Fraser Grier, Michelle Korman and Claire Martin represented the School of Law. The three students worked with students from forty other European Universities and participated enthusiastically in the traditional Moot Court Competition which concludes the Summer School. The organisers reported to us that 'after a fairly brilliant performance, the students from the Glasgow School of Law emerged triumphant, beating the team from Munster in an action-packed final'. The University of Nijmegen very generously covered the costs of the fees of the students, their accommodation and their travel and the School would like to record its thanks to our partner University for this support and particularly to Dr Henri De Waele who is a now an annual visitor to the School where he is part of the teaching team of the second year EU Law course. Dr De Waele facilitated the involvement of the Glasgow students and we look forward to hosting him again in January 2013.

Awards and Funding

Throughout the year, several members of the School staff have secured funding for research work, seminars and events:

• Dr R G Anderson and Mr J MacLeod have been awarded the sum of £4,062 by the Modern Law Review for research on Private Law in Multilingual Jurisdictions . The event, which forms part of the Scottish Association of Comparative Law's programme, took place in June 2012 with visiting speakers from Jersey, Quebec, South Africa and Switzerland.

• Prof R Deazley (PI) has received an amount of £15,000 from the Engineering & Physical Sciences Research Council for ISG - EPSRC: CREATe Startup Activities.

• Dr J Finlay has been awarded a Fellowship worth £46,601 by the Arts and Humanities Research Council for research on Legal Practice in Eighteenth-century Scotland .

• Dr A M Godfrey has received an award from the Gerda Henkel Foundation for the sum of 36,900 euros jointly with Professor Remco van Rhee of the University of Maastricht to conduct a three- year collaborative research project on The Comparative History of Central Courts in Europe and the Americas . The project will focus on the period 1400 and 1700, tracing the origins and jurisdiction of European and American central courts and tribunals, and how they became accepted and embedded within the existing structures of jurisdiction and courts.

• Dr A M Godfrey has been awarded the sum of £23,062 from the Johan Wolfgang Goethe - Universitat, for research on Extrajudicial and Judicial Conflict Resolution in Early Modern Scotland.

• Dr Jane Mair (Glasgow) with Prof Fran Wasoff (Edinburgh) have been awarded (c£74,000) from the ESRC small grants fund for a project entitled All Settled? Private ordering in Scots family law with a

start date of 1 April 2012.

Professor Ronan Deazley led a consortium of 7 Universities to secure the establishment of an Centre for Creative, Regulation, Enterprise and Technology (CREATe) funded by the Arts and Humanities Research Council to a total of £5m .

The School has been successful in securing the following doctorial scholarships for postgraduate students: Paul Scott, Gregor Clunie and Paul McClelland from the Modern Law Review.

18 Postgraduate Research Community

PG Colloquium

Organised by the postgraduate students in the School of Law, in association with the Centre for Law and Cosmopolitan Values at the University of Antwerp, the conference on the 6-8 June 2012 featured keynote speakers including Judge Sanji Monageng Attorney-Judge at the International Criminal Court at The Hague. While the main emphasis has in the past been legal theory a very conscious effort has been made to broaden the scope with this year the theme was 'International Justice'.

The School’s PhD programme continues to attract candidates of extremely high calibre from around the world. Five candidates completed their programmes successfully in the year 2011-12, and were awarded the degree of PhD. Twelve new candidates were admitted for the coming academic year, one of whom was awarded an Adam Smith Scholarship from the College of Social Sciences. Our candidates are supported financially in attending conferences and events where they have the opportunity to present their research, or which are important to their research. In June we hosted the annual Glasgow/Antwerp/Helskinki PhD Colloquium. This event is run by and for PhD candidates, and attended too by academic staff. In addition to the three partner institutions candidates from as far afield as New York and West Africa attended the event. A number of our PhD candidates past and present have been successful in finding academic posts over the year, including, through open and transparent recruitment processes at the School of Law.
