Main results of the Council

The Council agreed on a text setting the security features and biometric identifiers to be used by the Member States in a uniform format of residence permit for third-country nationals. The text will now be prepared by the legal-linguistic working party with a view to its formal adoption by the Council once the remaining parliamentary scrutiny reservations have been lifted.

In addition, the Council agreed on the scope of this draft Framework Decision and on the data protection regime for transfer of data to third countries. The Council preparatory bodies will continue the examination of the rest of the text with a view to reaching an agreement as soon as possible.

Finally, the Council adopted a Regulation on public passenger transport services by rail and by road, approving all amendments voted by the European Parliament at second reading.

SOUTHERN MARITIME BORDERS - Council conclusions

TheCounciladoptedthefollowingconclusions:

"TheCouncil: a) RecallingtheneedtobuildonthemeasuresalreadytakentoreinforcetheEuropean Union'ssouthernmaritimebordersforthepurposeofmoreeffectivelycombatingillegal migrationandrespondingtothehumantragediesrelatedtoillegalmigrationbysea; b) RecallingtheConclusionsadoptedbytheCouncilonreinforcingthesouthernexternal maritimeborderson5/6October2006andwelcomingtheprogressmadeinimplementing keymeasuresidentifiedinthoseconclusions; c) RecallingthediscussioninCouncilonthesituationattheEuropeanUnion'ssouthern maritimeborderson12/13June,includingsuggestionsputforwardforthesharingof responsibilitiesincertaincircumstances,andnotingtheworkalreadybeingundertakenon thosesuggestionsandrelatedpossibilities;

NotingthatanysuchactionmustbewithintheframeworkoftheGlobalApproachtomigrationas adoptedbytheEuropeanCouncilandmustbefullyconsistentwithEuropeanandInternationallaw; inprincipleanysuchactionshouldbecapableofbeingappliedtoanyMemberStatefacingsimilar difficulties,althoughitisalsonecessarytoconsidertemporarysolutionsforparticularpressures facedbyindividualMemberStates; a) Recognisingthecontributioninternationalorganisationscanmakeinthatregard; b) Reaffirmingthatcooperationwiththirdcountriesisindispensableforsavinglivesand combatingillegalimmigrationbysea;

ADOPTSthefollowingConclusions:

A. RegardingimmediatestepsforthepurposeoffurtherreinforcingtheEU'ssouthern maritimeborders,theCouncil:

1. EncouragesMemberStates,inaspiritofsolidarityandsharedresponsibilities,to providesupport(e.g.onreturnoperations,receptionconditions,caseworking expertiseorvoluntarilyundertakingtotakeresponsibilityforpersonssuchasasylum seekers,refugees,beneficiariesofsubsidiaryprotectionand/orunaccompanied minors)onabilateralbasistoindividualMemberStatesfacingaparticularpressure exacerbatedbyfactorssuchastheirgeographicallocation,thedegreetowhich neighbouringthirdcountriesfulfiltheirinternationalobligationsonsearchand rescue,andthecurrentstatusofcooperationwiththosecountries.

2. CallsontheCommissionandtheMemberStatestofollowuponthecontacts recentlyinitiatedwiththirdcountrieswithaviewtolaunchingand/orreinforcing concretecooperationonbordercontrol,searchandrescueandreturn(including identificationanddocumentation);suchcooperationshouldfullyrespect internationallawandtherighttointernationalprotectionandtakeplacewithinthe frameworkoftheGlobalApproachtoMigration.

3. Underlinestheneedtopromoteclosecooperationwiththirdcountriesoforiginand transit,includingthosethirdcountriesidentifiedforthepurposeofprioritywork,in orderto:

– enhancetheircapacitytomanagetheirownborders;

– helpthemtofulfiltheirresponsibilitiesasregardssearchandrescue;

– fightorganisedcrimeinvolvedintraffickinginhumanbeingsandsmuggling ofhumanbeings;

– enhancetheircapacitytoprovideprotectiontothosewhoneedit;

– provideaneffectiveframeworkforreturnsincludingthroughreadmission agreements.

4. WelcomestheinitiativeofthePortuguesePresidencytostrengthenthedialoguewith allEuromediterraneanpartnersonimmigrationrelatedissuesontheoccasionofthe MinisterialEUROMEDmeetingtobeheldon18and19NovemberinPortugal.

5. EncouragesMemberStatestosharebestpracticesandexperiencesgainedthrough bilateralcooperationwiththirdcountries,andcallsforbettercoordinationand sharingofinformationwithregardtosupporttothirdcountriesprovidedatEuropean andnationallevelrespectively.

6. EncouragesMemberStatesandtheCommissiontoensurethatthenewfundsmade availableintheareasofborders,returnandasylum,aswellasthefundsnow availableforactioninthisareainthirdcountries,areexploitedtothefullforthe purposeofgivingaconcreteexpressiontotheprincipleofsolidaritythrougha targetedandcoordinatedapproach.

7. EncouragesMemberStates,theCommissionandFRONTEXtofurtherdevelop,in cooperationwithrelevantpartners,includingUNHCR,theIOMorother internationalorganisations,theintegratedapproachtobordercontroland surveillanceoperations,especiallyinhighriskareas,andthefightagainstillegal immigration,takingaccountofnotonlyinterceptionbutalsoprotectionneedsand repatriation,andwithduerespectofinternationallawandmigrants'rightsto dignifiedtreatmentandtoseekinternationalprotection.

8. InvitesMemberStatesandFRONTEXtoidentifyandimplementmeasuresofa longertermnatureconcerningmaritimepatrolsatthesouthernexternalborder, including:

– jointoperationsatalimitednumberofhighriskareas,identifiedinaccordance withFRONTEXriskanalyses;

– theEuropeanPatrolsNetwork,wherethepossibilityofexpandingjoint operationalareastothehighshouldbeexamined;

– thepromotionofparticipationofrelevantthirdcountriesinthosemeasures.

9. ConsidersthatFRONTEXshouldbeequippedwiththenecessaryresourcesandcalls onMemberStatestoprovidethenecessaryparticipation,includingwithtechnical means,tomakesuchmeasuresarealityin2008.

10. CallsforworktobetakenforwardurgentlyontheimplementationoftheCouncil Conclusionsof1213June2007ontheimprovementofthecooperationbetween MemberStates,theCommissionandFRONTEXinthefieldofreturn.Inparticular thefurtherdevelopmentofICONetasaninformationnetworkfortheMemberStates shouldbepromotedinordertoenableitssystematicuse.

11. RequestsMemberStatestoexplorepossibilitiesformutualsupportinmakingreturn operationsmoreeffective,includingbymakinguseofexistingbilateralagreements anddiplomaticchannelswiththirdcountriesconcernedwhereappropriateandto promotetheimplementationofthereadmissionobligationsunderArticle13ofthe Cotonouagreement.

12. CallsonMemberStatestomakemaximumuseofvoluntaryreturnprogrammesand ofexistingCommunityfundsforassistedvoluntaryreturns.

B. Forthepurposeoftakingworkforward,

13. InvitestheCommission,FRONTEXandMemberStatestocompleteasamatterof prioritytheanalysisofthelawoftheseaasrelevantforFRONTEXjointoperations, andrequeststheCommissiontoreportbacktotheCouncilbeforetheendoftheyear.

14. InvitestheCommissiontocontinueitsexaminationofthescopeforfurthermeasures toaddresstheparticularpressureswhichMemberStatesmaybefacedwithandthe suggestionsmadebyMaltatotheJusticeandHomeAffairsCouncilon1213June 2007andtoreportbacktoCouncilassoonaspossible.

15. InvitestheCommissionandMemberStates,intheframeworkofthedebatelaunched bytheGreenPaperontheCommonEuropeanAsylumSystem,topayparticular attentiontothedevelopmentofasylumexpertteamsatthepointsofarrivalandto exploresolutionstosupportMemberStatesinexceptionalsituationsduringwhich theirasylumsystemsandreceptioncapacitiesareunderparticularpressureandto reportbacktotheCouncil."

UNIFORM FORMAT FOR NON-EU NATIONALS' RESIDENCE PERMITS

TheCouncilagreedonatextsettingthesecurityfeaturesandbiometricidentifierstobeusedbythe MemberStatesinauniformformatofresidencepermitforthirdcountrynationals.

Thetextwillnowbepreparedbythelegallinguisticworkingpartywithaviewtoitsformal adoptionbytheCounciloncetheremainingparliamentaryscrutinyreservationshavebeenlifted.

Theuniformformatforresidencepermitswillincludeastoragemediumcontainingthefacialimage andtwofingerprintsimagesoftheholder,bothininteroperableformats.Thedatawillbesecured andstored,andtheintegrity,theauthenticityandtheconfidentialityofthedatawillbeguaranteed.

Thetechnicalspecificationsforthecaptureofbiometricidentifierswillbesetinaccordancewith thetechnicalrequirementsforpassportsissuedbyMemberStatestotheirnationals.

VISA WAIVER RECIPROCITY

TheCounciltooknoteoftheCommission'sthirdreportonvisawaiverreciprocity(12881/07) .

Inthereport,theCommissionconsidersthatthedialoguewiththirdcountriesunderthenew reciprocitymechanismhasproveneffective.SinceitsestablishmentinJune2005–inlittlemore thantwoyears–fullvisareciprocityhasbeenachievedorisonthewaytobeingachievedwitha numberofimportantthirdcountries.Thisisthecasealsodespiteanewchallengewiththe notificationsbyBulgariaandRomaniaoftheircasesofnonreciprocity.Forexample,NewZealand andMexicohaveabolishedvisarequirementsforBulgariaandRomaniainlessthansixmonths fromtheentryofthesetwoMemberStatesintheEU.TheCommissionhasalsoachieved significantprogressindialoguewith,whichisexpectedtotreatequallyallMemberStates' citizensstartingfrommid2008.Acomprehensivevisawaiveragreementshouldsoonbenegotiated withBrazil.

AsregardstheUSA,theadoptionofnewlegislationmodifyingtheVisaWaiverProgramme(VWP) shouldpavethewayforitsextensiontoallMemberStates.Nowthenewlegislationisadopted,its conditionsandthetimelinefortheirimplementationwillbecarefullyexamined.TheCommission reservestherighttoproposeretaliatorymeasuresifexpectedprogresstowardsfullvisareciprocity failstomaterialiseingoodtime.

Canadahadundertakentomakeitsvisareviewprocessmoretransparentandprovidemore informationonthethresholds.However,forthemoment,noprogresshasbeenachievedinlifting visarequirements.TheCommissionwouldproposethat,inordertodemonstrateitscommitmentto resolutionoftheissue,CanadabeurgedtoliftthevisarequirementforoneormoreEUMember Statesbytheendoftheyearandtoshowfurthertangibleprogresstowardsreciprocityinthefirst halfyearof2008.Failingsuchprogress,appropriatestepscouldbeconsideredagainstCanada.

TheCommissionwillreporttotheCouncilagainbefore30June2008.

ESTABLISHMENT OF AN EMERGENCY PRELIMINARY RULING PROCEDURE AT THE COURT OF JUSTICE

ThePresidentoftheCourtofJustice,MrVassiliosSkouris,presentedtotheCouncilarequestby theCourttoamenditsStatutewithaviewtoinstitutinganemergencypreliminaryrulingprocedure.

ThisamendmentwouldallowderogationsfromcertainprovisionsoftheProtocolontheStatuteof theCourtofJusticewithregardtotheproceduregoverningurgentreferencesforapreliminary rulinginspecifiedareas.

TheCouncilinstructeditspreparatorybodiestofurtherexaminethecontentofthisproposal.

MUTUAL RECOGNITION ON NON-CUSTODIAL DECISIONS AT PRE-TRIAL AND POST TRIAL STAGES

TheCouncildebatedaproposalforaFrameworkDecisionontheEuropeansupervisionorder,and tooknoteofaprogressreportinrespectofadraftFrameworkDecisionon"probation".

Thesetwodraftlegalinstrumentsaimatreinforcingtheapplicationoftheprincipleofmutual recognitioninthecommonareaoffreedom,securityandjustice.Bothinstrumentshaveastheir objectivetoallowpersonstocomplyintheirMemberStateofresidencewithanoncustodial supervisionorprobationmeasurewhichhasbeenimposedinanotherMemberState.

TheCommissionproposalontheEuropeanSupervisionOrder(ESO)addressesthepretrialphase. TheFrancoGermaninitiativeon"probation"addressestheposttrialphase.Whereasalotofwork hasalreadybeencarriedoutonthislatterinitiativewhichisreflectedintheProgressreportwork ontheproposalontheESOhasyetnotstarted.

Infact,thePresidencyconsidereditappropriatetohavefirstlyapolicydebateintheCouncilin respectofthisCommissionproposalandtorevisethetextaccordingly,beforestartingtheworkin theCouncilpreparatorybodies.

Followingthedebate,thePresidencydrewthefollowingconclusions:

AllMemberStatessupporttheobjectivesoftheCommissionproposal.However,many MemberStateshavedoubtsregardingthewayinwhichtheCommissionproposalis drafted.Theyfeelthatvariouspracticalaspectsoftheproposalshouldbereconsidered.A clearexampleofthisisthemechanismforreturningsuspectstotheissuingMemberState.

AlmostallMemberStatessupportthePresidency'sviewthatworkonthisproposalshould becarriedforward,butonthebasisofanew,completelyrevisedtext.Suchrevisionofthe textshouldadheretothefollowingprinciples:

– TheEuropeanSupervisionOrdershouldbebasedontheprincipleofmutual recognition;

– Specificfeaturesofthenationalsystemsofcriminaljusticeandcriminalprocedure asregardsthecriteriaandconditionsforissuingaEuropeanSupervisionOrder shouldberespectedasmuchaspossible;

– However,somelimitsshouldbesetonthediscretionoftheissuingMemberStateso astomakeforsimple,swiftandeffectivecooperationwithinMemberStates;

– Coherenceshouldbeensuredwiththeapproachtakeninotherinstrumentsof mutualrecognition,byestablishingflexiblerulesoncrossborderrecognitionand enforcementofaEuropeanSupervisionOrder.Furtherconsiderationshouldalsobe giventothemechanismforreturningsuspectstotheissuingMemberState.Inthis context,particularattentionshouldbepaidtothesolutionsusedinthedraft FrameworkDecisionon"probation";

– AlthoughtheCommissionproposalforaEuropeanSupervisionOrderistoacertain extentlinkedthedraftFrameworkDecisionon"probation",theworkonboth instrumentsshould,atleastforthetimebeing,bekeptseparate,astheyinvolve specifictechnicalaspects(relatingtothepretrialandposttrialphase)andareat differentstagesofthenegotiation.

Onthebasisoftheseprinciples,thePresidencywillmakearevisionofthetextoftheproposal,in consultationwithCommissionservices,andwillsubmittherevisedtexttotheCouncilpreparatory bodies.

OTHER ISSUES

– TheGerman,AustrianandDanishdelegationsreportedontherecentpoliceoperations againstterroristsnetworksintheirrespectivecountries.

– CommissionVicePresidentFrancoFrattinibriefedtheCouncilaboutthepossibilityof introducingaproposalregardingtheestablishmentofaPassengerNameRecord(PNR) SystemintheEU.

– TheSloveniandelegationreportedontheopeningofacommonvisaapplicationcentrein Podgoricaon5October2007.

Schengen Information System

TheMixedCommitteediscussedtheimplementationoftheSISone4allproject(extensionofthe currentSISItoincludethenewMemberStatesinthesystem)andtheprogressmadebythefuture SchengenStatestocomplywiththeSchengenacquis.

ThePresidencyinformedthatthetechnicalpartoftheSISone4ALLprojectisnowoperational, accordingtoschedule.Thismeansthatasof1September2007theCzechRepublic,Estonia,Latvia, Lithuania,Hungary,Malta,Poland,SloveniaandSlovakiaareabletousetheSchengenInformation System(SIS).Someofthecountriesconcernedhavealreadyannouncedhitsinthesystem.

TheMixedCommitteealsoagreedtoaninterimreportonSchengenevaluation.

Frontex

TheExecutiveDirectorofFrontex,MrLiaitanen,briefedthedelegationsonrecentdevelopments andplannedfutureactivitiesinrelationtojointoperationsundertheEuropeanPatrolsnetwork,the socalled"toolbox"(CRATECentralisedRecordofTechnicalEquipment)aswellasthe implementationoftheRapidBorderInterventionTeams(RABIT)Regulation.

Background

TheEuropeanAgencyfortheManagementofOperationalCooperationattheExternalBordersof theMemberStatesoftheEuropeanUnion(FRONTEX)wasestablishedbyCouncilRegulation (EC)2007/2004of26.10.2004inordertocoordinateandassistMemberStates'actioninthe surveillanceandcontroloftheexternalbordersoftheEU.

ThemaintasksofFRONTEX,assetoutinArticle2oftheaboveRegulation,areto:a)coordinate operationalcooperationbetweenMemberStatesinthefieldofmanagementofexternalborders;b) assistMemberStatesontrainingofnationalborderguards,includingtheestablishmentofcommon trainingstandards;c)carryoutriskanalyses;d)followuponthedevelopmentofresearchrelevant forthecontrolandsurveillanceofexternalborders;e)assistMemberStatesincircumstances requiringincreasedtechnicalandoperationalassistanceatexternalborders;f)provideMember Stateswiththenecessarysupportinorganisingjointreturnoperations.

TheAgencyofficiallybecameoperationalon1May2005,butinfactitsactivitiesbeganon3 October2005inWarsaw(Poland).Sincethen,FRONTEXhasgraduallydevelopeditsoperational capabilitiesandcarriedoutimportantinitiativesaimedatstrengtheningsecurityattheexternal bordersoftheEU,focussinginparticularoncombatingillegalmigration.

On24May2007,theEuropeanPatrolsNetwork(ENP)projectwaslaunchedtoensurethe coordinationofMemberStates'patrollingactivities.Thisnetworkshouldconstituteinthefuturean integralpartoftheEuropeanSurveillanceSystem.TheENP,initsfirststage,isbasedonasystem ofnationalcontactpointscoveringthecoastalareasoftheMediterraneanSeaandtheAtlantic identifiedbytheneighbouringMemberStates.Atalaterstagetherewillbeanappropriate organisationalstructure(NationalCoordinationCentres)andtheopenseawillalsobecovered. FRONTEXhasalreadycoordinatedsomejointoperationsundertheEuropeanPatrolsNetwork.

InaccordancewithArticle7ofRegulation(EC)2007/2004,FRONTEXhasestablishedtheso called"toolbox"theCentralisedRecordofAvailableTechnicalEquipment(CRATE)forthe controlandsurveillanceoftheexternalborders.Itconsistsofhelicopters,aircrafts,vessels,mobile radarunits,vehiclesandotherbordercontrolinstruments,whichMemberStates,onavoluntary basisanduponrequestofanotherMemberStateorfollowingthelaunchingofaFrontexjoint operation,arewillingtoputatdisposalforalimitedperiodoftime.

Regulation(EC)863/2007establishedamechanismforthecreationofRapidBorderIntervention Teams(RABIT).Theregulationwasadoptedon11July2007andenteredintoforceon20August 2007.TheimplementationoftheRABITRegulationrequiresthecreationofalistofnationalexperts tobedeployedinordertoproviderapidoperationalassistanceforatemporaryperiodtoa requestingMemberStatefacingasituationofurgentandexceptionalpressure,especiallythe arrivalsatpointsoftheexternalbordersoflargenumbersofthirdcountrynationalstryingtoenter theEuropeanUnionillegally.FRONTEX,whichisresponsiblefordrawingupthelistsofthe officersofthenationalborderguards,organisetheirtraining,determinethecompositionofthe teamsanddecideontheirdeployment,hasalreadystartedtheimplementationoftheRABIT RegulationandisplanningtocarryoutthefirstexerciseinPortugalinOctober/November2007.

Thepurposeofthislegislationistoensureahighlevelofprotectionofthebasicrightsand freedoms,andinparticulartheprivacy,ofindividuals,whileguaranteeingahighlevelofpublic safetywhenexchangingpersonaldata.

Aftermorethanayearandahalfofintensenegotiationsonthisproposal,thePresidencyproposeda narrowscopefortheFrameworkDecision,whichmeansthatthetextwillapplytothecrossborder exchangeofpersonaldataonly.Thisunderstandingwillalsoimplyanevaluationbythe Commissionofthedataprotectionsystem,includingthelimitationofthescope,threeyearsafter theFrameworkDecisionwillapplytoMemberStates.

Public passenger transport services

TheCounciladoptedaRegulationonpublicpassengertransportservicesbyrailandbyroad, approvingallamendmentsvotedbytheEuropeanParliamentatsecondreading(PECONS 3623/07,9500/07).Inthefirsthalfof2007,CouncilandParliamentachievedagreementonthese amendmentsafterintensenegotiations.

Thenewlegislativeframeworkforpublicserviceobligationswillreplacethesetofrulesthathas beeninforcesince1969withalastmodificationin1991.Intoday'smarketforpublicpassenger transportservices,operatorsarenolongerexclusivelynational,regionalorlocal.Instead,they operateonaEuropeanlevel.Anewsetofrulesisneededthattakesaccountofthisdeveloped marketforEuropeanpublictransportservices.

ThePublicServiceObligationsRegulationintroducestwonewelements.Firstly,theobligation that,inreturnforthedischargeofpublicserviceobligations,competentauthoritiesconcludepublic servicecontractswhentheygrantexclusiverightsand/orcompensationtotransportoperators. Propercontractualagreementsareimportantforprotectingrailwayundertakingsfrominsufficient compensation,especiallyinthelightoftheliberalisationofthemarketforinternationalrail passengerservicesby2010.Secondly,rulesaresetonhowpublicservicecontractsmustbe awarded.Inprinciple,publiccontractsshouldbethesubjectofcompetitivetenderingsocalled "regulatedcompetition".However,authoritiesareallowedtoawardcontractsdirectlyinfour specificcases:

– ifthetransportoperatorisaninternaloperator,thatisalegallydistinctentityoverwhich theauthorityexercisescontrolsimilartothatexercisedoveritsowndepartments;

– ifthecontractsareminordefinedinthresholdsforvalueortransportkilometres;higher thresholdsaresetinthecaseofsmallandmediumsizedenterprises;

– emergencysituations;

– heavyrailpassengerservices,including(sub)urbanrail.

Thenewlegislativeframeworkwillreducedistortionofcompetitionbyenhancingtransparencyand byestablishingnondiscriminatoryconditionsofcompetitionamongstoperators.Furthermore,by definingaclearregimeforgrantingexclusiverightsandcompensations,thenewlegislative frameworkprovideslegalcertaintytobothoperatorsandpublicauthoritiesinvolvedinpublic transport.

Otherimportantelementsoftheregulationconcern:

- scope - theregulationappliestopublicpassengertransportservicesbybusandbyrail.However, inaddition,MemberStatesmaychoosetoapplytheregulationtopublicpassengertransportby inlandwaterwaysandnationalseawaters;

- duration of contracts - thedurationofpublicservicecontractsmaynotexceed15yearsforrail andothertrackbasedmodes.However,thedurationofdirectlyawardedcontractsforheavyrailis notallowedtoexceed10years.Also,forcoachandbusservicesamaximumdurationof10yearsis provided.Undercertainconditions,thesedurationscanbeextendedby50%;

- transitional period and entry into force -theregulationwillenterintoforce2yearsafterits publicationintheOfficialJournaloftheEUand10yearsthereafter,publicservicecontractsbyrail andbyroadwillneedtobeawardedinaccordancewiththeregulation.

ENVIRONMENT

Floods

TheCounciladoptedadirectiveontheassessmentandmanagementoffloodrisks(PECONS 3618/07),acceptingalltheamendmentsproposedbytheEuropeanParliamentatsecondreading.

Floodsmaycausefatalities,displacementofpeople,damagetoagricultureandtheenvironment, severelycompromiseeconomicdevelopmentandundermineothereconomicactivities.Theyare naturalphenomenawhichcannotbeprevented.However,somehumanactivitiesandclimate changemaycontributetoanincreaseinthelikelihoodandadverseimpactsoffloodevents.Itis feasibleanddesirabletoreducetheriskofadverseconsequencesassociatedwithfloods.

Thepurposeofthedirectiveistoestablishaframeworkfortheassessmentandmanagementof floodrisks,aimingatthereductionoftheadverseconsequencesforhumanhealth,theenvironment, culturalheritageandeconomicactivityassociatedwithfloodsintheCommunity.

Initsstructurallines,thedirectiverespects,inparticular,thefollowingprinciples:

– ThroughouttheEUdifferenttypesoffloodsoccur,suchasriverfloods,flashfloods,urban floodsandfloodsfromtheseaincoastalareas.Thedamagecausedbyfloodeventsmay alsovaryacrossthecountriesandregionsoftheEU.Hence,objectivesregardingthe managementoffloodrisksshouldbedeterminedbytheMemberStatesthemselvesand shouldbebasedonlocalandregionalcircumstances.

– Inordertohaveavailableaneffectivetoolforinformation,aswellasavaluablebasisfor decisionsregardingfloodriskmanagement,itisnecessarytoestablishfloodhazardmaps andfloodriskmapsshowingthepotentialadverseconsequencesassociatedwithdifferent floodscenarios,includinginformationonpotentialsourcesofenvironmentalpollutionasa consequenceoffloods.Inthiscontext,MemberStatesshouldassessactivitiesthathavethe effectofincreasingfloodrisks.

– Withaviewtoavoidingtheadverseimpactsoffloods,itisappropriatetoprovideforflood riskmanagementplans.Thecausesandconsequencesoffloodeventsvaryacrossthe countriesandregionsoftheEU.Floodriskmanagementplansshouldthereforetakeinto accounttheparticularcharacteristicsoftheareastheycoverandprovidefortailored solutions.Inparticular,MemberStatesshouldrefrainfromengaginginactionswhich significantlyincreasetheriskoffloodinginotherMemberStates.
