    NCAA SANCTIONS: ASSIGNING BLAME WHERE IT BELONGS Maureen A. Weston* Abstract: Success in a major intercollegiate athletic program, particularly a National Collegiate Athletic Association (NCAA) Division I national championship, can translate into millions of dollars and immense pride for the players, coaches, alumni, fans, and university. It can also be a de- terminative factor in a highly recruited high school student-athlete’s pro- gram selection decision. In this intensely competitive environment, temp- tations to cheat, exploit, or circumvent the rules lurk, not only for agents, but also for institutional personnel, certain student-athletes, boosters, and even parents. Acting on behalf of over 1200 member institutions, the NCAA regulates and enforces rules of amateurism in college. In recent cases involving high-profile student-athletes and programs found to have engaged in cheating and major infractions of NCAA rules on amateurism, agents, and extra-benefits to players, the NCAA imposed stringent sanc- tions, including bans on postseason competition, against member institu- tions and the offending athletic programs. This Article analyzes the effec- tiveness of these sanctions on the offending programs, actual wrongdoers, and student-athletes most impacted by sanctions. The Article asserts that the sanctions’ reach is both overly limited and overly broad. NCAA sanc- tion powers are narrow in that they extend only to member institutions, not to individual coaches, players, agents, boosters, or other involved in- dividuals. The sanctions are broad in that they negatively impact current student-athletes, who are restricted in their ability to transfer without penalty. The Article makes proposals for holding coaches and institutions financially accountable for infractions, while protecting uninvolved stu- dent-athletes.

The Indians have savored both high marks and high attendance for Victory Field ever since. One feature of life for the Indians has been the tendency for people to stay awhile, from the front office to the grandstand. FITT† ABSTRACT The recent resolution of the Andrew Oliver case may mark the death throes of the NCAA’s no-agent rule, prohibiting college athletes from retaining agents in professional contract negotiations, and perhaps the traditional paradigm of amateurism in sport. In light of the trial court’s ruling, as well as continuing calls for the revocation of the NCAA’s tax-exempt status, the time is ripe for a reexamination of amateurism and the law. This Note argues that the NCAA has developed a complicated web of largely unenforceable rules and regulations that are unnecessary to maintain tax-exempt status in light of the regulatory environment. This Note examines the antitrust, labor, and tax consequences of changing definitions of amateurism. Focusing on the Internal Revenue Service interpretations of amateurism, this Note concludes that a less restrictive amateurism regime would still achieve many of the legal benefits sought by the NCAA. This analysis has broader implications for tax policy and the culture of sport. Calling for a shift to a “new amateurism,” this Note contributes a novel redefinition of amateurism that reflects the current environment of intercollegiate sport. Modern amateurism should recognize the profit motive of the student-athlete. Under a less restrictive NCAA rule-making regime, the remaining rules are enforceable and fair. For this reason, they often command large sums of money prior to ever stepping on a major league baseball field, as teams annually pay large bonuses to the most talented players drafted in Major League Baseball’s (“MLB”) amateur draft. Combined, the thirty MLB teams awarded $228,009,050 in signing bonuses to 2011 draftees.1 The most talented individuals—the first-round draftees—received on average $2,653,375 per player in 2011.2 Both numbers set records for spending, as did the $8 million bonus given to the number one overall pick, Gerrit Cole.3 These sums of money are not given for performance but are given simply as an incentive to sign with the team.
