Statement of Facts:

The premises concerned is located in an R-1 5 Residential District and delineated as Lot Number 134 on Assessors Plat Number 29.

Notice Provision and Hearing:

In accordance with the provisions of the General Laws, the Zoning By-laws and the Rules of the Board, the Clerk of the Board notified the public and other parties in interest of a public hearing to be held on the application in the Town Hall on May 21, 2019, by causing a notice thereof to be published on April 24, 2019 and May 1,2019, in Chronicle, a of general circulation in the Town of North Attleboro and by mailing a copy of the notice on April 24, 2019, to all persons owning real estate, in accordance with Massachusetts General Laws, Chapter 40A, Section II, as shown by the most recent Assessor’s Map. A copy of the notice is appended hereto. Notice was also filed with the Town Clerk’s office in accordance with the provisions of Chapter 39 of the General Laws. 2

Pursuant to the advertisement and notice, the Board held a public hearing on said application on May 21,2019. Prior to the hearing members of the Board inspected the premises in question. At the hearing application was read into . The applicant, Peter Lewis, was in attendance. He expressed that there were other properties within the neighborhood with similar front yard setbacks. There were no parties in attendance speaking in favor of or in opposition to this application.

Decision of the Board:

By unanimous consent of the five members of the Board hereinafter listed, each and all voted in favor of granting the variance to allow the applicant to construct the front porch as shown on the submitted plans with the following condition:

1. The porch shall be no closer than 27 feet to the front yard lot line.

Basis for the Board’s Decision:

In the opinion of the Board the applicant has met the criteria for the granting of the Variance. There are other homes in the vicinity with similar setbacks and in the Board’s opinion, the use will not cause substantial detriment to the public good nor impair the purposes or intent of the by-law. This Board hereby certifies that a copy of this decision and all plans referred to therein have been filed with the Planning Board and Town Clerk of North Attleborough. Appeal of this decision, if any, shall be made pursuant to Section 17 of Chapter 40A of the Massachusetts General Laws and shall be filed within twenty days after the date of filing this decision with the said Town Clerk.

The Inspector of Buildings shall not issue a permit until the applicant submits certification from the Bristol County Registrar of Deeds pursuant to Section 11 of Chapter 40A of Massachusetts General Laws that this Decision has been recorded.

Application of Greater Attleboro Area Council for Children, Incorporated for Variances

Greater Attleboro Area Council for Children, Incorporated (hereinafter called the “applicant”) hereby applies to the North Attleborough Zoning Board of Appeal (“Board”) for the following relief pertaining to the property located at 0 John L. Dietsch Boulevard, North Attleborough, Massachusetts and more particularly described as North Attleborough Assessors’ Map No. 34, Lots No. 718 and 719 (hereinafter called the “Property”).

1. A variance from the provisions of Section IV.A INTENSTITY SCHEDULE A of the North Attleborough Zoning By-law (hereinafter called the “By-law”) which requires a lot within the 1-60 zoning district have a minimum lot width of not less than 200 feet to enable the applicant’s Property to have a minimum lot width of not less than 120 feet resulting in a variance of 80 feet.

2. A variance from the provisions of Section VI.A.3 of the By-law that requires accessory off-street parking spaces be 10’ x 20’ to enable the applicant to have 61 accessory off-street parking spaces measuring 9’ x 18’.

3. A variance from the provisions of Section VI.A. 1, SCHEDULE C. OFF-STREET PARKING REGULATIONS that requires a community facility have one off- street parking space per each 400 square feet of gross floor space to allow for a total of6l off-street parking spaces instead of the 69 spaces required.

As grounds in support hereof the applicant states as follows.

The Property is located within the 1-60 zoning district. Attached hereto as Exhibit B is a plan entitled “GREATER ATTLEBORO AREA COUNCIL COMMUNITY FACILTY” (hereinafter called the “Site Plan”) that depicts the applicant’s proposed development of a 27, 560 square feet, two story building to house the applicant’s community facilities. The applicant plans to use the building for the following activities:

1. The Hebronville Food Bank. The food bank operates three days per week (Mondays from 10:00 A.M to noon, Wednesdays from 3:00 P.M. to 5:00 P.M. and Thursdays from 5:00 P.M. to 8:00 P.M.).

2. A clothing distribution facility for people residing in shelters operated by one or more local charitable organizations. All of the clothing available is free and there are no sales of any clothing. This clothing facility operates one day per month from 10:00 A.M. to 11:30 A.M. On that same day the clothing dispensary is open for donations from 9:00 A.M. to 10:00 A.M.

3 3. The WIC Program which is a program for women’s, infants’ and children’s nutrition. This program operates four days per week (Mondays from 9:00 A.M. to 4:30 P.M., Tuesdays from 11:00 A.M. to 6:30 P.M, and Thursdays and Fridays from 9:00 A.M. to 4:30 P.M.

4. American Credit Counselling Services. This agency provides free credit and financial counselling services for low income individuals that are receiving support from philanthropic organizations, such as Christmas is for Kids. This program operates Monday through Friday from 10:00 A.M. to 6:00 AM. and has not more than three employees on the premises at any given time.

The applicant falls within the ambit of the Dover Amendment which allows the building commissioner and zoning enforcement officer for the Town of North Attleboro to determine whether any density regulations (such as bulk and height of structures, yard sizes, lot area, setbacks, open space, parking and building coverage requirements) shown on the applicant’s Site Plan comply with the By-law and/or whether any deviation therefrom is reasonable under the circumstances. The Dover Amendment as set forth in G.L. c. 40A, § 3 provides that the applicant’s educational purposes may be subject to reasonable regulations concerning density requirements.

By letter dated December 20, 2019 from Russ Wheeler, the Town’s building commissioner and zoning enforcement officer, a copy of which is attached hereto as Exhibit C, Mr. Wheeler determined that (i) the applicant’s 22.9 feet and 10.4 feet side yard setbacks as shown on the site plan are reasonable and would not require variances from the Board; and (ii) that reasonable buffer zone requirements may be achieved by the installation of a 6 feet stockade fence with suitable privacy plantings along the westerly and northerly boundaries of the Property. Given these determinations the applicants seeks no setback or buffer zone relief.

The applicant now seeks relief from the Board from the off-street parking requirements as directed by Mr. Wheeler, and the applicable lot width requirements of the By-law, all as set forth above.

The applicant further asserts that its request for variances set forth herein may be granted by the Board for the following reasons.

a) Conditions and circumstances are unique to the Property, structure or building and do not apply to the neighboring lands, structures or buildings in the same district.

b) Strict application of the provisions of the By-law would deprive the applicant and owner of reasonable use of the lot, structure or building in a manner equivalent to the use permitted to be made by other owners of their neighborhood lands, structures or buildings in the same district.

4 c) The unique conditions and circumstances are not the result of actions of the applicant taken subsequent to the adoption of the By-law.

d) Relief, if approved, will not cause substantial detriment to the public good or impair the purposes and intent of the By-law.

e) Relief, if approved, will not constitute a grant of special privilege inconsistent with the limitations upon other properties in the district.

Based on the foregoing and evidence to be submitted by the applicant during the public hearing on the instant application the applicant respectfhlly requests that the Board grant the variances requested herein.

Dear Mr. Manoogian:

In response to your email inquiry on November 13, 2019, pertaining to your clients proposed project at the above referenced address located in North Attleborough, MA, please note the following.

As indicated in your correspondence dated 5/14/1 9, Greater Attleboro flea Council for Children, Inc. is categorized as a not-for-profit Massachusetts corporation, organized for educational and charitable purposes. In accordance with the North Attleborough Zoning By-Laws, Section V-Use Regulations, Schedule B, Community Facilities, 2., this would be an allowed use in all zoning districts. Furthermore, the Building Inspector/Zoning Enforcement Officer may make reasonable allowances concerning density requirements under the provisions of M.G.L. Section 3 (Dover Amendment).

According to the preliminary site plan provided, it appears that setback relief would be required, due to the proposed location of the structure and the unusual shape of the lot As indicated on the plan, the north and westerly sides of the parcel do not provide sufficient area for the 35’ buffer required under Section IV.B.6 of the Town’s Zoning Regulations. ,4Jso, the parking spaces as shown on the proposed plan do not conform to the Town’s current Parking Regulations, which require that accessory off-street parking spaces be no less than 10’ x 20’ in size.

Upon the completion of my review of the materials provided, I offer the following recommendations:

1. As previously stated, the shape of the lot makes it difficult to conform to the 25 ft. side yard setback requirement for properties within this 160 Zoning District Therefore, it is my opinion that an exemption from the Town’s Intensity Regulations would apply under the provisions of M.G.L. Section 3 (Dover Amendment). 2. The Parking Plan (02.0) shows in excess of the amount of parking spaces required for the proposed building. However, the dimensions of the spaces do not conform to the Town’s current Parking Regulations, which require a minimum size of 10’x20’. Therefore, I suggest that either the parking plan be modified to conform to the current Parking Regulations, or that the applicant(s) seek the applicable Zoning Board relief. 3. Due to the close proximity of the neighboring residential properties, I recommend the installation of a 6 ft. stockade fence with suitable privacy plantings along the westerly and northerly boundaries, to provide a buffer.

Lastly, I would like to emphasize that a determination as to whether the proposed project meets the criteria for exemption under the Dover Amendment has been given careful consideration. However, the burden of proof that the local requirements are unreasonable as applied to this proposed project, is ultimately the applicant(s) responsibility.

Section 3 SUBJECTS WHICH ZONING MAY NOT REGULATE; EXEMPTIONS; PUBLIC HEARINGS; TEMPORARY MANUFACTURED HOME RESIDENCES

Section 3. No zoning ordinance or by-law shall regulate or restrict the use of materials, or methods of construction of structures regulated by the state building code, nor shall any such ordinance or by-law prohibit, unreasonably regulate, or require a special permit for the use of land for the primary purpose of commercial agricuiture, aquaculture, silviculture, horticulture, floriculture or viticulture, nor prohibit, unreasonably regulate or require a special permit for the use, expansion, reconstruction or construction of structures thereon for the primary purpose of commercial agriculture, aquaculture, s ilviculture, horticulture, floriculture or viticulture, including those facilities for the sale of produce, wine and dairy products, provided that either during the months of June, July, August and September of each year or during the harvest season of the primary crop raised on land of the owner or lessee,

25 per cent of such products for sale, based on either gross sales dollars or volume, have been produced by the owner or lessee of the land on which the facility is located, or at least 25 per cent of such products for sale, based on either gross annual sales or annual volume, have been produced by the owner or lessee of the land on which the facility is located and at least an additional 50 per cent of such products for sale, based upon either gross annual sales or annual volume, have been produced in Massachusetts on land other than that on which the facility is located, used for the primary purpose of commercial agriculture, aquaculture, silviculture, horticulture, floriculture or viticulture, whether by the owner or lessee of the land on which the facility is located or by another, except that all such activities may be limited to parcels of 5 acres or more or to parcels 2 acres or more if the sale of products produced from the agriculture, aquaculture, silviculture, horticulture, floriculture or viticulture use on the parcel annually generates at least $1,000 per acre based on gross sales dollars in

For such purposes, land divided by a public or private way or a waterway shall be construed as 1 parcel. No zoning ordinance or by-law shall exempt land or structures from flood plain or wetlands regulations established pursuant to the General Laws. For the purposes of this section, the term “agriculture” shall be as defined in section 1A of chapter 128, and the term horticulture shall include the growing and keeping of nursery stock and the sale thereof; provided,

however, that the terms agriculture, aquaculture, floriculture and horticulture shall not include the growing, cultivation, distribution or dispensation of marijuana as defined in section 2 of chapter 369 of the acts of 2012, marihuana as defined in section 1 of chapter 94C or marijuana or marihuana as defined in section 1 of chapter 94G; and provided further, that nothing in this section shall preclude a municipality from establishing zoning by-laws or ordinances which allow commercial marijuana growing and cultivation on land used for commercial agriculture, aquaculture, floriculture, or horticulture. Said nursery stock shall be considered to be produced by the owner or lessee of the land if it is nourished, maintained and managed while on the premises. No zoning ordinance or by-law shall regulate or restrict the interior area of a single family residential building nor shall any such ordinance or by-law prohibit, regulate or restrict the use of land or structures for religious purposes or for educational purposes on land owned or leased by the commonwealth or any of its agencies, subdivisions or bodies politic or by a religious sect or denomination, or by a nonprofit educational corporation; provided, however, that such land or structures may be subject to reasonable regulations concerning the bulk and height of structures and determining yard sizes, lot area, setbacks, open space, parking and building coverage requirements. Lands or structures used, or to be used by a public service corporation may be exempted in particular respects from the operation of a zoning ordinance or by-law if, upon petition of the corporation, the

department of telecommunications and cable or the department of public utilities shall, afier notice given pursuant to section eleven and public hearing in the town or city, determine the exemptions required and find that the present or proposed use of the land or structure is reasonably necessary for the convenience or welfare of the public; provided however, that if lands or structures used or to be used by a public service corporation are located in more than one municipality such lands or structures may be exempted in particular respects from the operation of any zoning ordinance or by-law if, upon petition of the corporation, the department of telecommunications and cable or the department of public utilities shall afier notice to all affected communities and public hearing in one of said municipalities, determine the exemptions required and find that the present or proposed use of the land or structure is reasonably necessary for the convenience or welfare of the public. For the purpose of this section, the petition of a public service corporation relating to siting of a communications or cable television facility shall be filed with the department of telecommunications and cable. All other petitions shall be filed with the department of public utilities. No zoning ordinance or bylaw in any city or town shall prohibit, or require a special permit for, the use of land or structures, or the expansion of existing structures, for the primary, accessory or incidental purpose of operating a child care facility; provided, however, that such land or structures may be subject to reasonable regulations concerning the bulk and height of structures and

determining yard sizes, lot area, setbacks, open space, parking and building coverage requirements. As used in this paragraph, the term “child care facility” shall mean a child care center or a school-aged child care program, as defined in section 1A of chapter 15D. Notwithstanding any general or special law to the contrary, local land use and health and safety laws, regulations, practices, ordinances, by-laws and decisions of a city or town shall not discriminate against a disabled person. Imposition of health and safety laws or land-use requirements on congregate living arrangements among non-related persons with disabilities that are not imposed on families and groups of similar size or other unrelated persons shall constitute discrimination. The provisions of this paragraph shall apply to every city or town, including, but not limited to the city of and the city of Cambridge. Family child care home and large family child care home, as defined in section 1A of chapter 15D, shall be an allowable use unless a city or town prohibits or specifically regulates such use in its zoning ordinances or by-laws. No provision of a zoning ordinance or by-law shall be valid which sets apart districts by any boundary line which may be changed without adoption of an amendment to the zoning ordinance or by law.

No zoning ordinance or by-law shall prohibit the owner and occupier of a residence which has been destroyed by fire or other natural holocaust from placing a manufactured home on the site of such residence and residing in such home for a period not to exceed twelve months while the residence is being rebuilt. Any such manufactured home shall be subject to the provisions of the state sanitary code. No dimensional lot requirement of a zoning ordinance or by-law, including but not limited to, set back, front yard, side yard, rear yard and open space shall apply to handicapped access ramps on private property used solely for the purpose of facilitating ingress or egress of a physically handicapped person, as defined in section thirteen A of chapter twenty-two. No zoning ordinance or by-law shall prohibit or unreasonably regulate the installation of solar energy systems or the building of structures that facilitate the collection of solar energy, except where necessary to protect the public health, safety or welfare. No zoning ordinance or by-law shall prohibit the construction or use of an antenna structure by a federally licensed amateur radio operator. Zoning ordinances and by-laws may reasonably regulate the location and height of such antenna structures for the purposes of health, safety, or aesthetics; provided, however, that such ordinances and by-laws reasonably allow for sufficient height of such antenna structures so as to effectively accommodate amateur radio communications by federally licensed amateur radio

Grounds for appeal:

We are appealing the failure of the North Attleboro Building Departmenfs response to the letter dated September lQ~, 2019: demanding a written response within 14 days of the said letter to uphold penalties related to Decision 2470 dated February 27, 2008 for 196 Commonwealth Aye, and Lot 68B both of North Attleboro, MA 02760 by the Zoning Board of Appeals.

Mr. Ohaid (current owner of 196 Commonwealth Ave and Lot 688 referenced above) is in direct

violation of these zoning terms set forth on February 27. 2008 - Decision 2470. After repeated attempts by us alerting the appropriate town departments of these violations, the North Attleboro Building Department has failed to enforce terms set forth by the Zoning board. We have requested formally Mr. Obaid be fined for these infracttons daily pursuant to terms set forth in the original decision until Mr. Obaid complete the work necessary to satisfy the terms. To our knowledge, Mr. Obaid was never fined for the extreme delay in Decision ~3: fencing constructed on the North & East portions of the lot which was finally completed October/November 2019 Additionally, Decision #5 has never been completed to maintain 50% of the beech trees along Simmons Ci lot line. Lastly. we asked that we are formally notified in writing the reasons for refUsing to enforce the request for ordinance.

Dear Mr. Wheeler:

We are writing with reference to the property located at 196 Commonwealth Avenue/Lot 68B Simmons Court, North Attleboro, Massachusetts owned by Wathek Obaid and specifically with reference to the Zoning Board of Appeals Decision No. 2470 dated February 27, 2008 (Exhibit “AZ). We are also attaching to this letter copies of each of the following:

(i) April 10, 2019 Action Needed Report we previously filed with the Building Department (Exhibit ff~;

(ii) April 17, 2019 correspondence you have sent to the current owner, Wathek Obaid (Exhibit “C”); and

(iii) July 16, 2019 correspondence you have sent to the current owner, Wathek Obaid (Exhibit “D”).

By this letter, we are formally requesting and renewing our request that you enforce the February 27, 2008 ZBA Decision since it is apparent from the attached Exhibits that Mr. Obaid does not believe he is required to abide by the specific terms of the February 27, 2008 ZBA Decision. For example, your 4/12/19 notes on the Action Needed Report (Exhibit “B”) state, among other things “Fence To Be Installed”, yet to date Mr. Obaid has failed to do so.

We are requesting that Mr. Obaid (1) be assessed a penalty of $300 per day for violating the Decision until such time as he is in fill compliance with the Decision, (2) that he install the fence running “along the entire North & East portions of the Lot that border Simmons Court” within 14 days from receipt of this letter, (3) that a determination of the number of maple and beech trees which existed on the premises as of February 27, 2008 and as of the date of this letter be made within 14 days from receipt of this letter, and (4) that Mr. Obaid be ordered to comply with the ZBA Decision requiring that “at least fifty percent of the maple trees and fifty percent of the beech trees shall be preserved on Lot 68B along the Simmons Court lot line.” Mr. Obaid should be ordered to plant the necessary trees on the premises on or before November 1, 2019.

Pursuant to Mass. General Laws Chapter 40A, Section 7, we are requesting you take this requested action and if you decline to do so, notif~j us in writing and the reasons therefore within 14 days from the date of this letter.

Section 7. The inspector of buildings, bui[ding commissioner or local inspector, or if there are none, in a town, the board of selectmen, or person or board designated by local ordinance or by law, shall be charged with the enforcement of the zoning ordinance or by-law and shall withhold a permit for the construction, alteration or moving of any building or structure if the building or structure as constructed, altered or moved would be in violation of any zoning ordinance or by-law; and no permit or license shall be granted for a new use of a building, structure or land which use would be in violation of any zoning ordinance or by-law. If the officer or board charged with enforcement of zoning ordinances or by-laws is requested in writing to enforce such

ordinances or by-laws against any person allegedly in violation of the same and such officer or board declines to act, he shall noti~’, in writing, the party requesting such enforcement of any action or refusal to act, and the reasons therefor, within fourteen days of receipt of such request. No local zoning by-law or ordinance shall assess a penalty of more than $300 per violation; provided, however, that nothing in this section shall be construed to prohibit local zoning by-laws or ordinances from providing that each day the violation continues shall constitute a separate offense. Thank you, I’ve attached the form for Cheryl. Yes you are correct, only 2 trees have been planted to date. The fence also was not installed until Late Oct/early Nov which was well past the 2 week response time.

I do want to be clear though the legality of this is that the town has not provided a response back within 14 days of written request to questions related to upholding zoning enforcement of a decision from 2008. Im not totally understanding why we have to send out notices to abutters of the properties as our lawyer did not say this needed to be done. We will do what is needed but I don’t want there to be conifision when we do in fact attend the meeting (and have our request denied because it wasn’t filed correctly).

Ok so I’m clear, the tree’s not being planted is the current issue because the fence appears to be in. Correct me if I’m wrong as I don’t want to misrepresent the 2 issue. When I draft the legal ad I need to be extremely clear as to what you are appealing.

As far as requesting the abutters list. You need to reach out to the Assessors office for that. I have cc’d Cheryl Smith on this email. She can help you with the list, please correspond directly with her on that.

Lastly you can just mail in a check payable to the town for the 75.00 and I will let you know what the other amounts will be for the mailing and advertising once I know.

Thank you for your response. Understood and hope everyone is remaining healthy. The website said you are still open for business virtually so I wanted to formally request via email. Keep me posted on the decisions regarding the meetings.

In reference to why, if you remember last fall we spoke and drafted a letter dated Sept 19, 2019 formally requesting a written response within 14 days from the building department pursuant to mass general law chapter 40A section 7. I’ve included all of the details in my original request along with the letters as exhibits.

I am attaching a picture taken today as proof that Mr. Obaid has not planted any but 2 trees to date. The fence was also not completed in the allotted timeframe.

Please provide a list of abutters as well as instructions to alert them, and also pay the $75 electronically.

A couple things if you want to file the appeal officially. Can you give me the very specific items that you believe have not been implemented or adhered too and whatever back up information you may have to prove that position (ie. pictures etc).

There will be a fee of $75.00 application fee, plus the cost of advertising and mailing to all abutting parties of interest. You will need to request a list of abutters to submit with the application.

The deadline for the april meeting is Wednesday the 25~’~.

The meeting opened at 6:30 and the Clerk of the Board Michelle DiRenzo polled the virtual meeting attendees to confirm that all members and applicants were in attendance. All voting members were in attendance Mrs. DiRenzo explained where how the meeting would run, how votes would be taken and where the viewing audience could view the documents and plans being discussed.

Chairman, Russell Baumann welcomed Landis Hershey and Bruce Wessel as new members of the Board.
