Such modifications have arisen over the course of the Examination and are provided in the Appendix at the end of this report. The majority have been proposed by the Council who specifically requested that I recommend any modifications necessary to enable them to adopt the Plan. The modifications cover a wide range of matters and include: • An increase in the minimum number of houses to be provided over the plan period, from 37,000 to at least 42,000 and revisions to their distribution; • A commitment to partially review the Core Strategy to enable an adequate development plan basis for decision making over the plan period to 2026; • A commitment to produce additional Development Plan Documents to ensure the effective delivery of necessary development. Such documents will include a Housing Sites Allocation DPD, a Gypsy and Traveller DPD based upon updated needs evidence and a Chippenham Site Allocation DPD; • The creation of two different affordable housing targets across the county to reflect development viability; • Clarification of the approach to be taken towards renewable energy to be consistent with national policy; • Clarity of the approach to be taken towards natural and heritage assets to be effective and consistent with national policy. - 3 - Wiltshire Core Strategy, Inspector’s Report December 2014 Introduction 1. This report contains my assessment of the Wiltshire Core Strategy (CS) in terms of Section 20(5) of the Planning & Compulsory Purchase Act 2004 (as amended). It considers first whether the Plan’s preparation has complied with the duty to co-operate, in recognition that there is no scope to remedy any failure in this regard. It then considers whether the Plan is sound and whether it is compliant with the legal requirements. The National Planning Policy Framework (the Framework, paragraph 182) makes clear that to be sound a Local Plan should be positively prepared; justified; effective and consistent with national policy. 2. The starting point for the examination is the assumption that the local authority has submitted what it considers to be a sound plan. The basis for my examination is the Wiltshire Core Strategy Pre-Submission Document (February 2012) published for consultation in February 2012. 3. Within the submission documentation, the Council identified a number of changes to be made to the Plan arising from the consultation1. Subsequently, further focussed consultation was undertaken to incorporate the schedules of proposed changes (including that affecting Core Policy 42), the publication of the Framework and the Planning Policy for Traveller’s Sites, changes made to the Sustainability Appraisal (SA) report and to clarify that the previous consultation had been an opportunity to comment upon the Pre Submission document as a whole. I have had regard to the consultation outcomes. 4. Subsequent to the Hearings of 2013, post hearing consultation and correspondence, the Council produced additional evidence2 and proposed further modifications to the submitted plan, this included updates to the SA and Habitats Regulation Assessment (HRA). Public consultation3 upon these matters was undertaken in April and May 2014 in conjunction with an opportunity to comment upon the implications of the publication of the government’s Planning Practice Guidance (PPG published March 2014). A further Hearing in relation to matters concerning Matter 4 was held on 30th September 2014. I have had regard to the resulting evidence, including all consultation comments, in its totality. 5. This report deals with the main modifications that are needed to make the CS sound and legally compliant and they are identified in bold in the report (MM). In accordance with section 20(7C) of the 2004 Act the Council requested that I should make any modifications needed to rectify matters that make the CS unsound/not legally compliant and thus incapable of being adopted. These main modifications, predominantly derived from the Council’s own proposals, are set out in the Appendix. 6. The main modifications that go to soundness have been subject to public consultation and, where necessary, SA. Section s20(5)(c) of the 2004 Act requires that I consider whether the Council complied with any duty imposed on them by section 33A of the 2004 Act in relation to the Plan’s preparation. 8. The Council’s Statement on the ‘Duty to Cooperate’4 sets out the principal activities undertaken in the preparation of the CS. It recognises that at the time when the ‘Duty’ was enacted the CS was at an advanced stage of preparation yet also indicates that the work of the Council has sought consistently to build meaningful partnerships with appropriate parties to deliver solutions to common strategic issues. Inevitably, this has necessitated working with a large number of adjacent and nearby local authorities5 which has provided due consideration of various matters, including those influenced by the proximity of key settlements such as Bath, Bristol and Swindon. These matters are discussed further below. I am mindful of the Statements of Common Ground6 which have been produced illustrating the nature of such work. Similarly, the Council has worked with other prescribed bodies, including Natural England, English Heritage, the Highways Agency and the Environment Agency, to ensure suitable dialogue and actions upon relevant areas of interest. The balance of evidence indicates that such partnership work is set to continue into the foreseeable future. 9. Indeed, the evidence must be considered in its totality. With due regard to SOCG/317, the Council’s actions are the product of the internal working relationships and processes between elected Members and Officers. As such, Officers of the Council maintain the position that Section 33A has been discharged in its entirety and that the Council Members had been informed that ‘steps taken to prepare the draft Core Strategy are considered to be compliant with legislative requirements’. Whilst the Council has detailed its working arrangements with prescribed bodies there is no single evidence source which baldly indicates how Section 33a)(6)(a) and (b) have been discharged. Nevertheless, there is considerable information indicating the nature of engagement between neighbouring authorities. This includes the Borough of Swindon, whereby Appendix 3 of DEM/408 indicated the relative stages of plan preparation between the two authorities and the scope for joint working if necessary upon a

The report then sets out the next steps toward submission, examination and adoption. 2.0 Background 2.1 When adopted, the Core Strategy will set the overall vision and planning policy framework for the town to 2026. It will set out what we want to achieve in different areas of the borough and how we will go about doing it. It will also provide the context for all subsequent Local Development Documents and their policies. When preparing this pivotal planning document the Council must maintain consistency with national and regional planning guidance and take into account the views of the community and stakeholders. 2.2 A significant amount of work to progress the Core Strategy has already been undertaken. In October 2007 the Council did prepare a Submission version of the Core Strategy. At that time, it was then expected that a public examination of the document would take place in early 2008.

    COLCHESTER CORE STRATEGY NOTES OF PRE EXAMINATION MEETING HELD ON WEDNESDAY 2 APRIL 2008 IN THE TOWN HALL, COLCHESTER 1 Introduction 1.1 The Inspector Mrs Jean Jones welcomed everybody to the meeting. She explained that she is a Chartered Town Planner and has been appointed by the Secretary of State for Communities and Local Government under Section 20 of the Planning & Compulsory Purchase Act 2004 to hold the examination into the soundness of the Colchester Core Strategy which forms part of the Colchester Local Development Framework. 1.2 She drew attention to the Guidance Notes for Participants, circulated previously, which covers much of the content of these notes. She confirmed that the “Examination” relates to the whole process from the time of submitting the Core Strategy document to the Secretary of State late last year to submitting the Inspector’s report to the Council later this year. She also confirmed that the hearing sessions of the Examination will commence at 10am on Tuesday 24 June 2008 at a different venue which will be notified when the agendas are sent out. 1.3 She introduced Mrs Andrea Copsey, who has been appointed as the Programme Officer for this examination. 1.4 The Council officers involved with the Core Strategy Examination introduced themselves. They are: Karen Syrett – Spatial Policy Manager Beverley McClean - Coast and Countryside Planner Paul Wilkinson - Transportation Policy Manager Laura Chase – Principal Planning Officer Martin Mason of Essex County Council Highways section was also introduced and it was indicated that his colleague Helen Ramsden would also be involved. The Council stated that consultants who had prepared certain parts of the evidence base may be asked to attend certain hearing sessions.

    Shepway Core Strategy Local Plan 2013 The Adoption of the Shepway Core Strategy: Minor Editing (September 2013) Introduction This note has been produced to maximise transparency in the preparation and formal adoption of the final Shepway Core Strategy. It is not a statutory or formal council document, and has been produced optionally to provide additional public information. The Shepway Core Strategy was found ’sound’ by the independent Planning Inspector, Michael Hetherington in June, following Examination of the document (which was published in July 2011). This means that it could proceed to formal ‘adoption’ and come into force as the new development plan for the district. 1 The Inspector’s Report was considered by Shepway’s Cabinet on 23 rd July 2013. This flagged up the intention to consider including minor alterations, additional to the Inspector’s modifications, to ensure the adopted plan was factually correct and up-to-date. The Core Strategy is adopted including the ‘Main Modifications’ that make up the appendix and annexe to the Inspector’s Report. These changes substitute most of the modifications put forward by the council following the five Examination hearing days in 2012, in place of parts of the 2011 Core Strategy document. Main modifications were necessary for the plan’s policies to meet the national tests of soundness.     PLANNING APPLICATIONS VALIDATION INFORMATION REQUIREMENTS CHECKLISTS & GUIDANCE December 2016 READING BOROUGH COUNCIL PLANNING APPLICATION VALIDATION INFORMATION REQUIREMENTS The Town and Country Planning (Development Management Procedure) (England) Order 2015 (DMPO 2015) sets out that for a planning application to be valid: • it should be submitted using the appropriate planning application form (1APP available from the Planning Portal websites. • the form should be completed on line, the correct fee paid and information provided to meet national information requirements, and • it should include additional information as required by the local planning authority and specified by the local planning authority on their local list of information erequirem nts. The DMPO 2015 requires local planning authorities to review their local lists, if they have them, at least every 2 years to ensure that the requirements remain robust and justified. In addition the Growth and Infrastructure Act 2013 makes clear that local planning authority information requirements must be reasonable by having regard to the nature and scale of the proposed development and the information required must be a material consideration in the determination of the application. Customers were asked to comment on the previous local list document and officers have reviewed it against changes in regulations and procedures. Most customers wanted the list simplified and suggested that typical examples or worked scenarios be given, which we have tried to do. The main change is that for householders we will no longer invalidate an application if Part 2 local list requirements are not met, although we will advise you if your site is in an area where a Bat survey might be needed.

    Local Development Framework Core Strategy Submission Document June 2006 Self Assessment of Soundness Introduction The Council has carried out this informal assessment in accordance with the advice contained in Development Plans Examination – A guide to the Process of Assessing the Soundness of Development Plan Documents published by the Planning Inspectorate in December 2005. It is being submitted alongside the Core Strategy document to show why Epsom and Ewell Borough Council considers this plan to be a sound development plan document. Procedural Tests Test 1: The Core Strategy has been prepared in accordance with the Local Development Scheme The timetable for the production of the Core Strategy is identified in the Council’s Local Development Scheme (LDS) which came into effect on the 15 April 2005 following approval by the Council and the Government Office for the South East. The Core Strategy has been approved by the Council at a meeting of its Strategy and Resources Committee on 27 June 2006. The LDS describes the role of the Core Strategy as the document that ‘sets out the vision, strategy and core policies for development, up to March 2016’. Following the publication of draft PPS3 (Housing), the response from GOSE, and the submission of the South East Plan (with an end date of 2026), it was proposed that the Core Strategy should cover the period up until 2022 (15 years from its anticipated adoption in September 2007). It was felt that this would help provide greater certainty and clarity, and provide a firm basis for the development of the remaining development plan documents, and the evolution of the Community Strategy.
