1. INTRODUCTION 1.1. PROJECT OBJECTIVES: The Rural Energy Project No. 2 (RE2) aims at facilitating the Vietnamese Government to launch poverty elimination campaign in rural areas by providing key infrastructures such as power, accessibility to public services to improve life and production and business performance. The RE2- the expansion shall continue supporting the Vietnamese Government to: - Develop a rural electrification strategy, specially focusing on power supply to mountainous and remote areas. - Rehabilitate, upgrade and expand the rural power system to satisfy power supply demand for the future socio-economic development. - Improve power supply reliability, reduce loss on power, and improve performance for production and business activities. - Re-consolidate the rural power grid system to improve reliability and power quality to be provided, including reduction of power loss due to technical or non-technical failure. - Expand 35kv and 22kv medium voltage grids to be able to supply additional power to households.

1.2. THE RURAL ENEGY II – ADDITIONAL FINACING – PHASE 3- THANH HOA PROVINCE

The Rural EnegyII project - Additional Financing - phase 3- Thanh Hoa Province is proposed to invest in rehabilitating, upgrading and expanding the local's power system, improving quality of power supply in rural areas of 190 communes of 20 districts covered by the project area, namely: districts of: districts of Ba Thuoc, Cam Thuy, Vinh Loc, Yen Dinh, Ngoc Lac, Thuong Xuan, Tho Xuan, Trieu Son, Hau Loc, Nga Son, Hoang Hoa, Ha Trung, Thach Thanh, Dong Son, Quang Xuong, Tinh Gia, Nong Cong, Thieu Hoa, Nhu Thanh and Nhu Xuan. - Thanh Hoa province Implementation of the Project aims to achieve following targets: + Overload resistance of the area + Meeting power demands in the current as well as in the future + Ensuring reliability in power supply and improving electric quality + Improvement of electric grid capacity + Conformity with Electric Development Planning of Thanh Hoa province period 2005 to 2010 with consideration beyond 2015 + Contribution to social economic development and expanding power business. The Sub-project includes 03 components. namely: Medium voltage (35kV, 22kV) transmission lines: New construction 169,017 km medium voltage transmission line: In which:  Medium voltage 35kV transmission line : 90,504 km.  Medium voltage 22kV transmission line: 78,513 km.

2. PROJECT DESCRIPTION 2.1. BRIEF DESCRIPTION ON NATURAL AND SOCIAL CONDITIONS OF THANH HOA PROVINCES Thanh Hoa is one province of the Northern Central Vietnam, 150km far from the capital . Thanh Hoa has 27 administration entities under provincial and city rank, in which Thanh Hoa City is considered as Economic-politic-cultural –social Center of the province. Project is invested for construction in the locality of 79 communes under 17 districts and 01 city, Thanh Hoa province. The entire area is affected by the tropical monsoon climate with two distinct seasons: - In hot season: very sunny and rainy. On the days having ’wind the temperature can up to 40-41oC. - In cold season: the northeast monsoon usually occurs, less rain; in the beginning of season it usually dry season. The lowest temperature in some days may down to 5-6oC. - The average rainfall is about 1600 - 2300mm/year, rainfall is concentrated from May to October according to lunar calendar. Relative Humidity is from 85% - 87%. Although Thanh Hoa is coastal delta province, but it is surrounded by dense network of rivers and the mountains, therefore Thanh Hoa’s terrain is divided into three regions: the midland and mountainous areas, plains and coastal areas. The project region consists of delta and midland communes. Topography, geology is relatively simple, convenient for transportation of materials and equipment to construction sites by trucks and manual vehicles. Terrain is flat advange for construction of tranformers, wire-lines as well as future operation management. The projected communes are not located in protected zones. Population: Population of Thanh Hoa province has 3.4 million people, the average density is 306persons/km2 including 7 ethnics mainly: Kinh, Muong, Thai, Tho, Dao, Mong, Kho Mu. In project area there are only 13 communes under 07 districts where ethnic minorities live, inluding: Muong, Thai and Dao. Preliminary investigation results showed that 79 projected communes are farming communes with area of agricultural land accounts for about 49% - 60% of natural land area, mainly for planting rice, in addition to land groups suitable for development of food crops, forest trees, industrial crops, fruit trees and marine aquaculture. In recent years with economic restructuring policy, increasing proportion of industry and services, forming specialized region for growing industrial trees, the economy of province have made profound changes: - Growing rate is stability: 11%/year. - Agriculture: average rice yield of whole year reached 54.7 quital/ha. Besides breeding also developed towards form of farm combination with garden-hill economy. - Forestry: mostly is breakwater artificial forest and artificial forests for timber such as eucalyptus, acacia ... - Industry - handicraft: it focus on development of traditional trades such as blacksmithing, jewelry, construction materials production, sedge products, building and repairing boats ... and introduces number of additional new carriers such as embroidery for export, knitting, weaved, sericulture production, production of food mushrooms, material fungi. - Fishery: thanks to long coastline, interlaced river system (Ma, Chu River, Hoang River, and Nhon river ...) fish and shrimp yards with large reserves facilitate to fishing and marine aquaculture development

- Tourism: having potential for tourism development. Tourism activities, festivals are evenfully organized,… Tourism development not only contributes significantly to the State budget but also facilitates to development of other support services such as transport, post and telecommunications. Together with the economy, infrastructure system is also progressive, in which: - Transport: Development in both roadway, railway, waterways, such as North-South railway line, the Highway, national road system (1A, 45, 47 ...) and river networks facilitate the traffic through north and south. Inter-village, inter-district road systems are gradually upgraded and concreted. - Education: High illiteracy rate: 93%. The high school was built with multi-storey and durability. - Electric and water facilities: 100% of communes have had national grid. Rivers Network directly serves water for domestic and irrigation. - Health: In principle national health programs are well implemented. Basic network of medical facilities are developing and strengthening, expansion of medical services to all classes of people. - Housing status of DPs in the project areas can be evaluated as follows: Mainly are four-class houses. They are permanent brick wall, tile or iron roof, paved cement/flower-brick floors, usually they do not have a toilet inside, this type of house accounts for about 55%. In addition, in project area there are many unqualified for four-class ones, representing about 15%.

2.3. PRE-CONSTRUCTION AND WHILE-CONSTRUCTION ACTIVITIES AS SPECIFIED IN THE IMPLEMENTATION PROCEDURES

- Site clearance method Site clearance covers mainly cutting trees off and clearing structures situated in pylon foundations, trees with height of over 4m and buildings available in the route. - Buildings in the route not affected should not be cleared. - Trees at pylon foundation positions are mainly crops (rice, maize, potato, and cassava). Communal People’s Committees and district People’s Committees in the project area agree to implement compensation and site clearance as stipulated to ensure power construction and erection. If it is fallen in the harvest season of farmers, it is required to calculate to compensate trees on land for farmers in accordance with the average productivity. Trees with height of over 4m available in the route may be cut down before wiring. - Compensation is undertaken by power companies. Therefore, PCs of 05 provinces should complete the land recovery procedures and grand land for construction so that site can be handed over to builders. - Camp construction: In order to ensure the storage of materials, plants and equipment and houses for workers, a temporary camp construction project is launched in each commune, including: + Indoor storage for cement, equipment, electrical materials and accessories: 30m2 x 1 commune = 30m2. + Outdoor storage with fence to protect transformers, medium voltage conductors, construction tools, beam, bracket and backstays: 10m2 x 01 commune = 100m2. + Temporary buildings for workers during construction: 50m2 x 1 commune = 50m2. + Indoor warehouse and temporary buildings are made from bamboo frame with fiberboard, its roofs are covered with fiberboard and roofing felt. Transporting materials and equipment to the site Different types of equipment and materials such as: Conductors and insulators are bought in Hanoi and transported by trucks to the route center of each project component (site storage). Goods are transported from Hanoi to the site storage as follows:

+ Protection switchgear, insulators and cables with small packing, scattered goods shall be transported to the site by trucks and manually unloaded. + Conductors with bulk quantity shall be transported to the site by the less than 5 ton trucks and 5 ton cranes. + Centrifugal concrete pylon bought in the area or Hanoi shall be transported to the site by KMAT 7.5 ton truck, each shipment delivers 6 pylon sections, loaded by 5 ton cranes. Pylons are piled at the ending route and scattered transported to the site by combining the manual and mechanical method. + Other materials such as beam, backstay, accessories, etc from Hanoi shall be transported to the site by the 5-ton trucks and manually unloaded. + Cement bought in districts is transported by the 5-ton trucks and manually unloaded. + Sand and stone bought at the project’s district, 20km distance, shall be transported by the 5-ton dump trucks and manually unloaded. 2.4. 3. LEGAL FRAMEWORK ON THE PROJECT’S ENVIRONMENT IMPACT ASSESSMENT 3.1. LAWS AND REGULATIONS OF VIETNAM The Vietnamese Government promulgates some laws and regulations on environmental protection. Such documents include: - Legislation of the Socialist Republic of Vietnam (April 1992) specifies that the State-own enterprises, governmental agencies, cooperatives and national defense bodies must be responsible for fulfilling policies on environmental protection to ensure the proper use of natural resources and environmental protection. - Law on Environmental Protection approved by the National Assembly on 29th November 2005 and valid since 1st July 2006, superseding Law on Environmental Protection in 1993 which prescribes responsibilities of the central, locality, individuals and organizations in environment degrading prevention and protection and implements specific environmental protection functions. - Law on Forest Protection (1992) specifies on managing, protecting, developing and exploiting forest and preventing cutting trees downs and deforestation. - Law on Protection of People's Health (11th July 1989): Rights and obligations of residents in health protection, guiding principles on health protection, sanitation education in people; conduct the standby measures; rehabilitate and clean living environment; ensure labor sanitation standards, food and foodstuff hygiene. - Decree No. 80/2006/ND-CP dated 9th August 2005 of the Government of Vietnam on detail regulations and guidance on implementing some articles of revised Law on Environment in 2005. - Decree No 21/2008/ND-CP dated 28th February 2008 of the Government on amending and supplementing some articles of Decree No. 80/2006/ND-CP dated 9th August 2006. - Decree No. 81/2006/ND-CP dated 9th August 2006 of the Government on sanctioning of administrative violations in the field of environmental protection. - Decree No. 106/2005/ND-CP dated 17th August 2005 of the Government on detailing and guiding the implementation of a number of articles of the electricity Law on Protection of safety of high-voltage power grid works (amending and supplementing Decree No. 54/1999/ND-CP). - Decree No. 52/1999/ND-CP: Regulations on managing construction investment with amendments on environmental issues in construction management. ENVIRONMENT IMPACT ASSESSMENT 4.1. DETERMINATION OF THE PROJECT’S POTENTIAL IMPACTS The Project shall pay an essential role in electrification and poverty elimination program in 190 communes of 20 districts in Thanh Hoa province. The Project also facilitates the industrialization and modernization policy promulgated by the Government and offers best opportunities for general socio-economic development to poor areas. When distribution wirelines are constructed, local persons tend to move to live near such wirelines. Local People’s Committee shall prepare a specific plan to support the regional development. Such plans include road, residential areas, industrial and agricultural development, etc. Such district/commune or province shall divert the development as sketched in these plans. In addition to noticeable positive impacts, variety of adverse impacts may be posted on environment and local socio-economics. By using the Checklist of Environmental Test Data and Background Environment List as guided in the Guidelines, the environmental protection measures are applied for the Rural Energy Project No. 2. 4.1.2. Temporarily and permanently occupied land

The occupied land area of 190 communes, 20 districts of Thanh Hoa province is 1,659,254 m2 and 27,002m2 of temporarily and permanently occupied agricultural and forestry land, respectively. On average, the permanently occupied land area per commune is approximately 160m2 and the temporarily occupied land area is about 520m2. Therefore, it is possible to recognize the negligible impact of land occupancy by both MV wirelines and transformer station. (Please, see at table 4.1.2)

4.1.3. Impacts on affected households The survey unveiled that the Project would affect three main groups of people, including farmers (majority, accounting for over 90% of total affected groups of people), trading and service groups and public servant groups in management agencies, companies and factories. Among these three groups, subsistence and income of farmer and business groups would be affected because a part of production land is recovered or business is suspended during construction. Whereas, the public servant group is free from this impact. Among households affected in terms of land, no household is required to resettle. The Project also affects 574 households (2,245 persons). In which there are 63 households (109 persons)of ethnic minorities such as Muong, Tay, and Thai. However, such impact is evaluated as negligible and temporary due to strict requirements on selecting route direction and technical solutions of the Project to minimize recovery of land, property, trees and crops of local persons.

5. COMMUNITY CONSULTATION AND INFORMATION DISCLOSURE During preparing the Project (2010), following works were conducted: Activity 1: Understand and discuss with the local authority about wiring position Activity 2: Make a survey and statistics about impacts Activity 3: Organize meetings with affected households After finishing survey, the Consultant must notify the local persons and affected communes about the project’s activities. Public notice form should be applied. 6. Public news release during project preparation through community consultancy meeting and mass media.  Claim and compensation mechanism  Claims and questions relating to any aspects of RP, including determination of unit price and quantity of lost assets shall be solved in accordance with following steps: Step 1: If any person claims about any issue of the resettlement and life recovery program, he may present directly or submit a written claim to authority persons of the commune. The CPC shall settle such questions within 15 working days since the claim is received. Step 2: If claimer is not satisfied with decisions in Step 1, his claim may be submitted to district People’s Committee or CRC within 15 working days since the date of receiving the decision in step 1. The DPC or CRC shall make decision within 15 working days since the date of receiving the claim. Step 3: If the claimer is still dissatisfied with decision of the district authority, he may lodge the appeal to the PPC or the district CRC within 15 working days since the date of receiving decision of DPC or district CRC. Within 15 working days, PPC or PCRC shall decide such claim. Step 4: If he is still dissatisfied with decision released by the provincial authority, he may file the appeal to the district court within 15 working days since the date of receiving decision made by PPC or PCRC.  DPs are completely exempted from administrative and legal fees and charges.  Monitoring and evaluation system  Power companies and concerned PMUs work closely with corresponding DPCs/CPCs at the management units and independent supervision unit to launch regular monitoring of Compensation and Resettlement Plan Performance. recorded in the quarterly report to submit EVN, power companies and concerned provincial power companies.  Internal inspection and monitoring include: - Verifying that basic information about DPs, evaluating lost or damaged assets, compensations, benefits of resettlement and life recovery are conducted in accordance with the regulations of the corresponding Policy Framework and RP. - Monitoring that RP is conducted as designed and approved. - Determining that financial resources to implement RP are provided to PMUs in due date with full quantity to fufill the objectives; Such resources are properly used by PMUs as prescribed in RP. - Archiving all claims and questions and ensuring that such claims are solved as scheduled.  Independent supervision: Independent units or independent consultancy units employed by PCs under EVN shall conduct regular monitoring and external evaluation in addition to RP performance. Recommendations  Construction activities near the hospital must be limited with working hours from 07:00 to 11:00 in the morning and from 14:00- 17:00 in the afternoon.
