INTRODUCTION The guidebook COMING HOME TO VIETNAM was commissioned by the British Embassy in Vietnam and developed in collaboration with the Centre for Training and Community Development (CTD). Aiming at supporting the successful rehabilitation and reintegration of Vietnamese returnees into the local community, it provides useful information on opportunities and services that Vietnamese returnees can access upon their return. Sponsored by the British Government, this guidebook was developed by CTD, with valuable inputs from the British Embassy in Vietnam. The guidebook includes, but is not limited to, useful information about the process of return and reintegration of Vietnamese returnees, through stages of pre-departure, on the way home, arrival in the hometown and resettlement in the local community. In addition, the guidebook introduces basic knowledge and understanding of safe and unsafe migration, risks of irregular migration (including human trafficking) as well as good tips for you, your families and your friends to enjoy positive migration experiences, both within and outside Vietnam. The guidebook will also be useful for Vietnamese returnees from different countries.

BEFORE RETURNING TO VIETNAM

1. Travel Document Application If you have a valid passport, you are advised to contact a UK Home Officer official at your prison, immigration removal centre, or authorised agency, to arrange your return to Vietnam. If your passport was lost or stolen, you are advised to apply for an Emergency Travel Documents (ETD). There are two options 1.1 Apply at the Vietnamese Embassy in the UK You shall contact the Vietnamese Embassy in the UK, at: 12-14 Victoria Road, London W8 5RD, United Kingdom, for application forms and relevant guidance on the procedures. Supporting documents: You will need a completed passport application form (ticking Travel Document field); Curriculum Vitae form; three 4cms x 6cms sized photographs (plain white background; full, straight face; no hat or sun glasses). And you will need one of the following documents determining your Vietnamese nationality: previous Vietnamese passport, or Vietnamese Identity Card. You should contact responsible officer at your prison, immigration removal centre, or authorised agency to request an ETD, and provide the following information for your application: - Full name, date of birth, address and telephone number in Vietnam; - Information on parents, brothers and sisters, and/or spouse in Vietnam. - Original or copied documents determining your Vietnamese origin, such as your ID card, household registration – household book, driver's license, expired passports, etc.

Once sufficient information is received, the UK Home Office will hand over your application to the British Embassy in for processing. You do not need to pay a fee. Timescales: maximum 30 days, if your application is sufficient. 2. Reintegration support programmes run by the British Government 2.1. Facilitated Return Scheme (FRS) FRS is a support programme provided by the UK Home Office, for those who have been convicted of a crime and have served a custodial sentence in the UK. Grant worth: Up to £1,500 if you are still serving your prison sentence; and up to £750 if you have already served your sentence. 4

2.2 Assisted Voluntary Return (AVR) AVR is a support program provided by Choices Organisation, including three programmes: - Voluntary Assisted Return and Reintegration Programme (VARRP): Up to £1,500 for those who sought, but failed to gain, asylum in the UK. - Assisted Voluntary Return for Irregular Migrants (AVRIM): Up to £1,000 for those who are illegal immigrants, without criminal records. (Failed asylum seekers are not eligible for this programme.) - Assisted Voluntary Return for Families and Children (AVRFC): Up to £2,500.

You should contact the responsible officer your prison, immigration removal centre or authorised agency for further information. If you apply under the FRS programme, the grant will be paid through a cash card. Up to £500 will be paid on departure and the rest will be settled upon your return to Vietnam, through the International Organisation of Migration (IOM). ON THE WAY HOME

Your flight from the UK to Vietnam will either land at Noi Bai International Airport in Hanoi, or Tan Son Nhat International Airport in Ho Chi Minh City. Public transportation (plane, train, taxi or bus) is available at the two to take you to your hometown. You will find below useful information that will assist you to have a safe journey to your hometown. 1. Useful information and required documents you will need before flights You should check your airline‟s baggage policy before packing. You need to know: - Baggage limitation: number of free bags, weight limitations, and restrictions (laptops, gold, cash, jewellery). - Weight and size limits, and restrictions for your carry-on luggage (no liquids over 100 ml, including shampoo, no knives or other sharp objects allowed). - Limitations on gold, cash (both VND and foreign currencies) and other valuable assets. - Other condition, policy and regulation.

If you fail to follow requirements, you may be requested to leave prohibited items at the security/custom check-point and spend time there for explanation. 2. After arrival - Immigration procedure: After leaving the plane, follow the instructions to find the immigration counter to complete procedure to enter Vietnam. - Baggage: Check which baggage line your bag will arrive. You will also find baggage collection information on an electronic board in the arrivals area. For any missing or damage luggage, please contact the airline representative, at the Customer Service Counter. - Your baggage tags may be verified against your baggage stub (usually attached to your boarding pass stub) at the arrival gates, by staff of your airlines.

3. From the Airport to your Hometown 3.1. Flight information - , Viet JetAir, and Jestar Pacific have flights connecting Noi Bai International Airport and Tan Son Nhat International Airport to each other, and to provincial airports such as Vinh Airport, Nghe An, Dong Hoi Airport, Quang Binh, and Phu Bai Airport, Hue. - For booking and reservation, you chose one of the following options: + Schedule and book your flight online on airlines‟ official website; or + Contact airlines‟ agents; or

RESETTLEMENT IN VIETNAM 1. Legal issues

1.1. Identity Card (ID Card) You should submit the following documents to the local authority where you registered your household book before leaving Vietnam - one-stop Administration Centre – to apply for an ID card: - Request form attached a passport sized photograph : if your ID card was lost or stolen, the form should be certified by local police; - Household Registration Book; - Travel Document/Passport if either ID card or Household Registration Book are not available; - Original ID card (if you want to renew); - ID card Form; - Photograph taken ID card issuing office

1.2 Birth Certificate

You should submit the below required documents to the District Department of Justice for obtaining a birth certificate for your children who were born abroad: - Birth Certificate Form; - Original birth certificate issued by the medical centre where the child was born. If the child was not born at a medical centre, the birth certificate will be replaced by the confirmation of a witness. In case, there have no witness, the one who submit the form should make an assurance on authentication of birth; - Your children's passports (if available); - A letter to guarantee that the child has not yet been issue for a birth certificate in a foreign country; - Household Registration Book or Confirmation of Temporary Residence; - Certificate of marriage of parents (if any); - Your ID card.

1.3 Registration of Temporary Residence

When you move from the place where you register your permanent residence to another to stay for a period of time, you shall obtain a temporary residence permit at the ward/ police offices within 30 days from the day of arrival. Supporting documents include: - Household Registration Form; - Written notification of changes in household registration and the number of household members with confirmation of consent by landlord or head of household; - ID card or certification form issued by police offices at the place where you have registered permanent residence.

Temporary residence book will be issued to you in 2 working days from the day of submission of a sufficient application.

1.4 Other legal issues and Legal Aid

Legal aid beneficiaries in accordance with the Vietnamese legislation include: - Poor people whose income beneath the poverty threshold in accordance with national regulation; - Homeless children under 16; - Children under 18, who are the detained, the accused, the defendant, or victims of rights violation - such as rights of children, sexual abused, labour abused etc. - People with disabilities, people with serious illness, HIV-infected people, agent orange affected people; - Victims of human trafficking (identified or being identified); - Women as victims of domestic violence; - Women as victims of labour exploitation or sexual abuse; - Women who are sued, the accused, and the defendant in pregnant period or have babies under 36-month old; - Ethnic minority people permanently residing in areas with exceptionally difficult social-economic conditions; - Migrant women; - Female workers who are terminated their labour contract illegally, deceived at workplace, mistreated in family life, or whose assets were taken illegally. Procedures of legal aid request: - Supporting document for the request includes: request form – obtaining from provincial or district Legal Aid Centre, certification proving the requester's eligibility for legal aid (Poor Household Books, Medical Insurance Certificates for poor household, paperwork determining the requester as targeted beneficiaries of assistance programmes, victims of trafficking etc.) as well as other documents needed for legal aid request. - You should submit relevant forms to provincial or district Legal Aid Centre.

Contact details of Legal Aid Centres in your area can be found at DIRECTORY OF SUPPORT SERVICES. In addition, you can access support from collaborators of state legal aid centres, District Office of Justice, legal counselling organisations of social-political organisations, social-political-professional organisations, social-professional organisations such as Women's Union, Farmer's Union, and the Youth Association.

2. Healthcare

2.1 Medical check-up and general healthcare

- You can visit the district or provincial general hospitals at your localities For a general check-up, - You can visit your respective provincial Dermatology hospital or Dermatology departments in provincial or district hospitals for special diagnosis and treatment of sexual transmitted infections - You can visit HIV counselling centres for your volunteer HIV test free-of-charge and with confidentiality, or visit the HIV/AIDS Control and Prevention Centre in each province for HIV test,

2.2 National Health Insurance

Free Health Insurance Scheme

- Beneficiaries: individuals who are under the government‟s poor or near-poor households categories; individuals who served the country as veterans or war invalids; people with disabilities; single senior citizens and senior citizens above 85 years old - If you or your relatives are eligible for the 100% free health insurance scheme, but have yet received it, you should contact the welfare officer of the people's committee at your commune to apply for it.

Voluntary Medical Insurance Scheme

The annual fee for Voluntary medical insurance is calculated as below:

Basic salary x 4.5% of monthly salary x 12 months

E.g: if the current state‟s basic salary is VND 1.150.000, the voluntary medical insurance that you pay would therefore be:

VND 1.150.000 x 4.5% x 12 = VND 621.000 per annum

Noted: according to the government regulations, basic salary is the lowest salary level that an employer can pay for their employees. Basic salary will be reviewed and adjusted by the Government from time to time to reflect the actual living costs

Health insurance benefits coverage

- Examination, treatment, rehabilitation, periodic medical check-up and medical expenses for birth - Examination for screening diseases and early diagnose of certain diseases - In-patient and out-patient treatment once deemed being diagnosed with a disease

Benefit levels

The bearer of the National Health Insurance Card is entitled to:

- 80% of in-patient and out-patient treatment expenses in the list of medicine, diagnose services and treatment stipulated by the Ministry of Health - 100% of examination and treatment expenses if the examination or treatment expense is lower than 15% of the basic salary and the examination or treatment are at a district hospital - 80% of advanced technology examination or treatment, or significant expense for one-off treatment, but not over 40 times of the basic salary (if the treatment is 180 days continuously) - 80% of 50 % of cancer treatment medicines and Immunosuppression medication for organ transplantation beside the name list (stipulated by the Ministry of Health) if the patient has joined the national health insurance scheme for 36 months continuously.

Procedure of purchasing the National Health Insurance

There are insurance agents and staff of the national insurance company available in each communes and districts to assist you when you purchase national insurance. When you want to purchase National insurance from your commune People's committee, you need to bring your Identification Card. If you have a temporary resident permit, you will need to obtain a certification from the local police at your commune/ward and your ID Card.

3. Marital and family support services

Should you have any problem related to marriage such as family disputes, domestic violence, divorce or child guardianship/custody, fixed assets and real estate disputes etc, you can look for assistance from the following authorities:

- Reconciliation Committee at your ward/commune - Public organisations at your locality such as commune/district/provincial including Farmer's Union, Ho Chi Minh Communist Youth Union and Vietnam Women's Union - Family and marital counselling centres

Free nation-wide counselling and helpline services:

- 1800-1567: child protection hotline run by the Ministry of Labour, War Invalids and Social Affairs - 1800-1769: Counselling hotline for family, marital issues and social work services run by Quang Ninh Social Work Centre - 1800-5454/53: Free psycho-counselling hotline (every Thursday morning) run by Centre for Social Work with Youths (Ho Chi Minh City‟s Youth Union)

4. Engagement with local organisations and service agencies

You should sign up for membership of local public organisations in your locality to secure your rights to access activities such as public education, vocational training and job placement, credit/loan access, counselling and other life-related issues.

To become a member of public organisations in your locality, you should contact the commune officers for instructions on membership registration. Key public organisations include:

- Vietnam Women's Union: representing the rights and entitlement to benefits for all Vietnamese women; promoting the advancement of women‟s development and gender equality. - Farmers' Union: protecting the rights and entitlements to benefits for farmers; organising consultancy and technical support services for farmers on agricultural production, business and life-related issues. - Ho Chi Minh Communist Youth Union: protecting the rights and entitlement to benefits for youths, from 16 to 30 years old. Participating in these public organisations and other community activities will help facilitate your personal development, interpersonal skills and social relationships, as well as access to social support when you are in need.

CAREER ORIENTATION AND ACCESS TO CREDIT/LOAN

1. Choose the right vocation

Upon your return to Vietnam, sometimes under the economic and reintegration pressures you may accept any work opportunity immediately instead of carefully considering the career path you should pursue and planning for a successful reintegration. Taking up seasonal jobs with low skill requirements will result in little pay and instability as you will have to change job frequently. Picking up and learning a vocation that matches your aptitude and personal circumstances will increase your chances of securing more gainful employment in the long-run.

What vocational tracks and work you can choose from?

There are plenty of jobs that you can learn and do. Some are listed below:

- Jobs that require patience and attention to details: Hairdresser, jewellery designer, electronic worker, cashier... - Jobs that require physical strengths: construction worker, turner, welder, driver... - Jobs that require both physical strengths and skilfulness: cook, baker, garment worker... - Jobs that require language and communication skills: receptionist, tour guide...

There are also jobs that can help you utilize your skills advantages and suit your personal circumstances in where you are, such as bee keeping, aquaculture, husbandry and farming.

How to choose a suitable vocational training course?

Before making any decision on the vocational training you want to pursue, you should take these suggested ideas into consideration:

- Prioritise vocations and local income generating opportunities. For example: handicraft jobs at traditional handicraft villages, garment workers in industrial zones - Vocational training entry requirements. For example: certain jobs require minimum secondary school completion before entering vocational training or the minimum height when taking hospitality training - Personal interests and strengths. For example: chef if you love cooking and can cook well; electronic worker if you are interested in electronic devices and technologies. - Vocational training schools and tuition fees. For example: available free-of- charge vocational training program versus training programs that charge an amount of tuition fee; apprenticeship or on-the-job training options - Course length: Elementary vocational training course will last from 3 to 12 months; intermediate course will last from 1 to 2 years (for high school graduate) and 3 to 4 years (for secondary school graduate). Alternatively, if students already have obtained a certificate in professional secondary school that is 15

recognised by the vocational training centre, the length of intermediate course will be reduced.

Vocational training programmes

Vocational Training and Job Creation Programme using State budget

All provinces are implementing national policies on vocational training and job creation for people in rural areas and other disadvantaged groups. There are government authorities and agencies providing free-of-charge career orientation, vocational training and job placement for their respective beneficiaries, including commune/town people's committees, departments and bureaus of Labour, War Invalids and Social Affairs, Farmers' Union, Youth Union and Women's Union in every provinces and cities. Additionally there are professional secondary or vocational training centres providing vocational counselling, vocational training and job placement. These programmes require fees.

List of vocational training and job creating programmes using national budget

National Program on Job Creation for Rural labour until 2020:

- Implementing Agency: People's Committee at commune/town levels - Beneficiaries: people in the labour age range (15 - 60 years old for male and 15 - 55 for female) under one of the following groups: people who served the country, poor household, ethnic minority groups, war invalids, people whose agricultural land was taken by the government - Provision of support: Short vocational training fee (elementary level below 3 months) with cost ranging from 2 to 3 million per person per course, depending on actual vocational strand and course length

National Program on Vocational Training and Job Creation for people whose agricultural land was taken by the government:

- Implementing Agency: Elementary vocational training program will be handled by the respective People's Committee at town/commune level. This intermediate vocational training programme will be handled by the respective bureau of Labour, War Invalids and Social Affairs at town/commune level. - Beneficiaries: individuals or family household - within the labour age range - whose agricultural land has been taken for other purposes by the government. - Provision of support: free vocational counselling and orientation, job placement, training fee provided for vocational training, Intermediate vocational training or college education. An individual who takes up overseas employment track will be supported with some pre-departure fees and access to credits with privileged interest rates from Vietnam Bank for Social Policies.

SAFE MIGRATION AND ELIMINATION OF HUMAN TRAFFICKING Migration for better opportunities to deal with difficulties of existing lives can be a good choice. However, either success or failure of your journey will depend on the way you migrate the risks. Some people who chose irregular migration face a number of serious risks such, including being trafficked for criminal, labour and sexual exploitation. They are threatened and forced to do things against their will, from cultivating drugs to prostitution. Prepare yourself well with the knowledge to recognise safe migration so you can avoid the risks of human trafficking. 1. Migration

Migration is the movement of a person, or a group of people, from one place to another - usually, from one country to another - for the purposes of job opportunities, study, marriage, family reunion, and others reasons. Migration can be categorised as safe migration and unsafe migration. Safe migration is generally means regular and legal migration. Migrants are well- informed before leaving. And they have genuine documents, issued by a competent authority, for the purpose of their entry to the other country. Unsafe migration means irregular migration, where migrants are provided with little or no necessary information before leaving. They may or may not be aware that the assistance they use to migrate is working outside the law. This invariably results in the migrant being vulnerable to the person organising the migration and very often leads to trafficking. Many irregular migrants believe they know the risks they are taking, but they end up to being trafficked. You can help prevent these risks and protect yourself during migration by leaving in safe ways.

2. Human Trafficking

What is human trafficking? “Trafficking in persons” means the recruitment, transportation, transfer, harbouring or receipt of persons, by means of the threat or use of force or other forms of coercion, of abduction, of fraud, of deception, of the abuse of power or of a position of vulnerability or of the giving or receiving of payments or benefits to achieve the consent of a person having control over another person, for the purpose of exploitation. Exploitation shall include, at a minimum, the exploitation of the prostitution of others or other forms of sexual exploitation, forced labour or services, slavery or practices similar to slavery, servitude or the removal of organs.

Anyone can be a victim of trafficking, both male and female, adults and children.

According to Vietnamese legislation, by committing human trafficking crime offenders are liable to be sentenced to between seven and twenty years of imprisonment. Human Trafficking Indicators People who have been trafficked may: - Be deprived of human rights such as the right to respect, the right to safety, or the right to free movement, etc.; - Be exploited for criminal, labour or sexual purposes, or other forms of exploitation; - Be deceived, forced or threatened; - Be subjected to insults, physical and mental abuse; - Not be in possession of their personal documents, be controlled or detained; - Live and work in harsh conditions that harm their health; - Have no labour contracts or jobs different from contracts; - Be forced to break the laws of the country they are in; - Receive little or no payment. Provision of assistance to victims of trafficking In accordance with the Decree No. 09/2013/NĐ-CP guiding the implementation of some articles under National Anti-Trafficking Law dated on 11 January 2013, victims of trafficking shall be entitled to receive basic needs support, travel cost, health care, psychological services, and grants for difficulties.

Residential programmes in shelters

Beneficiaries: - Vietnamese residents identified as victims of human trafficking; - Foreigners who have been trafficked to Vietnam; - Trafficked person in the process of being identified as victims in accordance with Article 24 and Article 25 under the National Anti-Trafficking Law; - Minors travelling with victims.

Support scheme includes: - Provision of food during the course of residence in shelters from the State Budget for no longer than 60 days. - Provision of clothes, personal items. Each victim shall receive two clothes, two sets of underwear, towels, sandals, toothbrush, toothpaste, soap, tampons (for female victims); - Provision of health care and recovery. Where victims with serious illness are referred to medical facilities, the cost of treatment shall be borne by victims or victim‟s families; - Provision of allowance for transportation and food during travelling time to victims going back to hometown. Fares of public transportation shall be applied.

Provision of vocational trainings and grants for difficulties In addition to aforementioned services, victims of trafficking are provided with education, vocational training and grants for difficulties. Victims of poor households are exempt from tuition and other education costs in line with existing legislation. Victims who have need of vocational training are supported once with apprentice costs. The amount of support for vocational training depends on vocational facilities. For victims from poor households, a grant for difficulties is provided upon their return to their community in accordance with regulations issued by Ministry of Finance and Ministry of Labour, Invalids and Social Affairs.
