Bioética e direitos dos animais é a linha editorial da Revista, e qualquer trabalho encaminhado para publicação deverá ser inédito no Brasil. 3. O trabalho deve ser enviado pelo correio eletrônico do autor para um dos correios eletrônicos a seguir: [email protected], [email protected], [email protected]. 4 O trabalho deverá ter no máximo 15 a 30 laudas no formato word (lim- ite que poderá ser superado apenas em casos excepcionais), A4, posição vertical, fonte: Times New Roman, corpo 12, justificado, parágrafo com espaçamento de 1,5, resumo com espaçamento simples, parágrafo 1,5 cm, margem superior e esquerda – 3cm, inferior e direita -2cm. 4. O trabalho deverá obrigatóriamente ter: título, nome e qualificação do autor (ou au- tores), resumo com um mínimo de 150 e máximo de 250 palavras, mínimo de 3 palavras-chave, abstract, keywords, sumário, introdução, conclusão e notas de fim de texto. 5. As citações devem obedecer a ABNT (NBR 10520/2002), as referências nu- méricas devem obedecer a NBR 6023/2000. 6. O processo de avaliação será em duas etapas: inicalmente será avaliada a sua adequação à linha editorial da Revista, seguida de uma avaliação du- plo-cega, por doutores de Direito que desconhecem os autores, da mesma forma que os autores desconhecem os avaliadores. Em caso de empate, o artigo será submetido a um terceiro avaliador ad hoc. 7. Como contrapartida pela licença de publicação dos trabalhos na Revista, o colaborador receberá 01 (um) exemplar do periódico em cujo número seu trabalho tenha sido publicado, não sendo prestada remuneração autoral. 8. Os trabalhos para publicação serão selecionados pelos coordenadores da Revista. Santa Catarina State Federal University Danielle Tetu Rodrigues | 287 Revista Dir Animal_14_book.indb 8 02/12/2013 00:23:29 E Estimados leitores, ao chegarmos ao final do ano de 2013, es- tamos concluindo o oitavo ano da Revista Brasileira de Direito Animal (Brazilian Animal Law Journal). Lembro que no ano de 2005, o promotor de justiça ambiental de Salvador (BA), Luciano Rocha Santana e eu tivemos a ideia de criar um periódico sobre direito animal no Brasil. Depois de várias reuniões e a inestimável colaboração de Thiago Pires de Oliveira, então estudante de direito da UFBA, acabamos por lançar o primeiro número da revista, que foi apresentada aos leitores pelo professor Tom Regan. Primeira revista do gênero em língua de origem latina, a RBDA foi lançada no Encontro da Sociedade Vegerariana Brasileira, mesmo evento em que evento foi criado o Instituto Abolicionista pelos Animais (IAA). Desde então muita coisa aconteceu, a revista foi assumindo cada vez mais o perfil acadêmico, acabando por se constituir em um veículo privilegiado de divulgação científica do Núcleo de Ensino, Pesquisa e Extensão em Direitos dos Animais, Meio Ambiente e Pós-humanismo (NIPEDA), grupo de pesqui- sa vinculado ao Programa de Pós-graduação em Direito da Universidade Federal da Bahia. Neste número 14, a RBDA terá a colaboração de dois arti- gos internacionais: o primeiro, denominado O FUTURO DO DIREITO ANIMAL: INDO ALÉM DE “ENSINAR O PAI NOSSO AO VIGÁRIO (The Future of Animal Law: Going Beyond Preaching to the Choir), é de autoria das professoras Megan A. Senatori, da Wisconsin University Law School, (EUA) e Pamela D. Frasch, da Lewis & Clark University, Oregon (EUA), anali- sa a introdução da disciplina direito animal nas faculdades de direito dos EUA. Assim, a partir de uma análise comparativa E | 9 Revista Dir Animal_14_book.indb 9 02/12/2013 00:23:29 com o direito ambiental, as autoras destacam a importância de se acionar as “alavancas” que podem promover o avanço da proteção animal, especialmente o apoio de pessoas credibiliza- das que não são integrantes do movimento animalista. Na seção sobre ÉTICA ANIMAL, Renata Duarte de Oliveira Freitas, estudante do Programa de Pós-graduação em Direito pela Universidade Federal do Rio Grande do Norte, apresen- ta o artigo ANIMAIS NÃO HUMANOS: OS NOVOS SUJEITOS DE DIREITO (Nonhuman Animals: The New Legal Subjects), que partindo da premissa de que a Constituição Federal reconhece a vida animal com um fim em si mesmo, defende a possibilidade de que animais não humanos sejam reconhecidos como sujeito de direito, independentemente do fato de serem ou não consi- derados “pessoa”.

This is evidenced by the rapid growth of journals on the question of the animal within the fields of the humanities and social sciences worldwide.1 Yet also outside the academy animals now seem to preoccupy the popular mindset more than ever before. In 2002, the Netherlands was the first country in the world where a political party was established (the so-called “Partij voor de Dieren” or PvdD: Party for the Animals) that focused predominantly on animal issues. Heated discussions about factory-farming, the related spread of diseases (BSE/Q Fever), hunting and fishing practices, the inbreeding of domestic animals, are now commonplace. Animals, as we tend to call a large range of incredibly diverse creatures, come to us in many different ways. We encounter them as our pets and on our plates, animation movies dominate the charts and artists in sometimes rather experimental genres engage in the question of the animal.2 Globally speaking, animals might be considered key players in the climate debate insofar as the alarming rate of extinction of certain species is often taken to be indicative of our feeble efforts at preserving what is commonly referred to as “nature.” At the same time, these rates serve, albeit indirectly, as a grim reminder of the possible end of human existence itself.

    The Ethics of the Meat Paradox Lars Ursin* The meat paradox—to like eating meat, but dislike killing and harming animals—confronts omnivores with a powerful contradiction between eating and caring for animals. The paradox, however, trades on a conflation of the illegitimacy of harming and killing animals. While harming animals is morally wrong, killing animals can be legitimate if done with minimal suffering and respect for the moral status of the animal. This moral status demands the ac- knowledgement of a certain justification for killing animals that makes modesty a virtue of the omnivore. The psychological problem with regard to killing animals can persist even if the moral tension is weakened, but only to a certain degree, since emotions and principles are interdependent in moral reasoning. Virtuous meat consumption demands a willingness to face the conflicting feelings involved in killing animals and to tolerate the resulting tension. INTRODUCTION Humans and animals interact in a number of ways and establish a diversity of relationships. Humans relate to animals as members of the family, as research objects in the laboratory, as guide dogs, trained animals in sports and shows, and still many other kinds of relations. In some of these relations, animals are edible beings. The relation between humans and animals that are eaten is a special one. Like animals sacrificed for research purposes, the animals we eat are killed by us. The acceptance and legitimacy of this killing is thus an essential part of eating animals. By eating animals, we enter into a very intimate relation with the animal. We eat parts of the animal and digest the parts, thus allowing these parts to be absorbed into our bodies.

Not only should we not buy and eat meat, but we should also not purchase fur coats, stoles, and hats, or leather shoes, belts, jackets, purses and wallets, furniture, car interiors, and other traditionally animal-based products for which there are readily available plant-based or synthetic alternatives. Francionef INTRODUCTION The topic of this symposium-Law and Life: Definitions and Decisionmaking-provides an excellent opportunity to address some of the comments made by Professor Cass R. Sunstein in his review of my book, Introduction to Animal Rights: Your Child or the Dog?1 A central argument in the book is that we cannot jus- tify treating nonhumans as our property and using them for our purposes irrespective of how "humanely" we do so. Sunstein, on the other hand, maintains that it is morally permissible to use animals for human purposes, including uses that cannot be re- garded as necessary, provided that we do not make animals suf- fer unduly in the process.

In this article I will present and outline Jahr’s bioethical programme with a special emphasis on Charles Darwin’s role in Jahr’s ethics. According to Jahr, useful and effi cient animal protection can only be practised well if we have enough knowledge of nature. Jahr refers to Darwin who revolutionised our view of life and of the relationship between the human being and the rest of living nature. In the fi rst introductory section I will shortly present Jahr’s overall perspective and his bioethical imperative. I will also give a very short sketch of today’s bioethics. In the second and third section I will outline Dar- win’s revolutionary theory and its application to the human being. I will also present some of the reactions of his contemporaries which refl ect Darwin’s achievement for our understanding of living nature. In the fourth section I will go back to Fritz Jahr and will present and discuss diff erent aspects of his approach in more detail. A fi nal quotation from Hans Jonas about the dialectical character of Darwinism will trenchantly highlight Darwin’s importance for Fritz Jahr’s ethics.

Nesse contexto, o artigo tem o objetivo de lançar uma proposta de princípios jurídicos, exclusivos e não-exclusivos (compartilhados com outros ramos jurídicos), para o Direito Animal, extraídos do ordenamento jurídico brasileiro, sobretudo do estrato constitucional, com o auxílio da teoria dos princípios de Humberto Ávila. Para tanto, enfrenta duas questões epistemológicas preliminares: a fixação da denominação e do conceito da disciplina jurídica estudada, que permitam bem identificar o objeto desse novo campo da enciclopédia jurídica. Direito Animal é a denominação proposta para fins de uniformização terminológica. O conceito para a disciplina leva em consideração o reconhecimento da sua autonomia em relação ao Direito Ambiental. Nesse particular, procede-se à desconstrução analítica do conceito proposto, para permitir a análise de seus elementos essenciais. Conforme se propõe, os princípios exclusivos ou típicos do Direito Animal são os seguintes: 1) princípio da dignidade animal; 2) princípio da universalidade; 3) princípio da primazia da liberdade natural e 4) princípio da educação animalista. Por sua vez, os princípios não-exclusivos ou compartilhados do Direito Animal têm uma listagem mais aberta, podendo ser indicados, ao menos, os seguintes: 1) princípio da precaução; 2) princípio da democracia participativa; 3) princípio do acesso à justiça e 4) princípio da proibição do retrocesso.
