1 INTRODUCTION

1.1 The Scheme 1.1.1 Etive Ecology Ltd was commissioned by Lleweni Parc Ltd. in December 2017 to undertake an ecological appraisal of a plot of land at The Glyn, Lleweni Parc, Denbigh. The site is centred on National Grid Reference SJ 0800 6899.

1.1.2 The application site boundary primarily comprises a grassland field surrounded by scattered trees and woodland, with a small water‐course flowing through it. The site is set within the grounds of Lleweni Parc, with arable land to the south, a gliding airfield to the north and the Afon Clwyd to the east.

1.1.3 The proposed scheme is for the layout and siting of 24 lodges with associated vehicular access, individual parking spaces and sewage treatment works.

1.2 Scope of this Report 1.2.1 The site assessment is based on the Guidelines for Preliminary Ecological Appraisal (Chartered Institute of Ecology and Environmental Management, 2017).

1.2.2 The aim of the assessment is to obtain data on existing ecological conditions, and to conduct a preliminary assessment of the likely significance of ecological impacts on the proposed development site. To achieve this, the following steps were taken:

 The desk study area and field survey area (including the ‘zone of influence’ of the scheme) have been identified  A desk study has been undertaken, including the purchase of biological records from the Local Records Centre (Cofnod)  Baseline information on the site and surrounding area has been recorded through an ‘extended Phase 1 survey’, including a Phase 1 habitat survey (JNCC 2010) and consideration of notable and/or protected habitats and species  The ecological features present within the survey area have been evaluated, where possible (IEEM, 2006)  Invasive plant and animal species (such as those listed on Schedule 9 of the Wildlife & Countryside Act [WCA]) have been identified  Potential constraints to the proposed development have been identified  Recommendations for further survey have been made  Mitigation recommendations have been provided based on current information.

1.2.3 The Phase 1 Habitat Map of the survey area is in Appendix A with target notes used to link features of note to the report text. Photographs taken during the survey are presented in Appendix B.

2 METHODOLOGY

2.1 Desk Study 2.1.1 A desk study was undertaken to identify any nature conservation sites and/or any relevant protected or notable species records within 1km of the site.

2.1.2 The following sources of information were utilized:

 MAGIC website (http://www.magic.gov.uk/MagicMap.aspx)  Biodiversity Partnership (https://www.biodiversitywales.org.uk/)  Natural Resources Wales website (https://naturalresources.wales/)

2.1.3 A data search enquiry to the North Wales Environmental Information Service (Cofnod) was made, for all designated nature conservation sites and all protected and/or notable species within 1km of the centre of the site. 2.2 Extended Phase 1 Habitat Survey 2.2.1 The site visit was made on 18th December 2017.

2.2.2 The survey comprised an extended Phase 1 Habitat Survey. This survey method follows the habitat assessment and classification procedure outlined by the Handbook for Phase 1 Habitat Survey (JNCC, 2010), whereby all habitats are identified, described and mapped using a standard classification.

2.2.3 The extended component of the survey is developed from the methodology described in Guidelines for Baseline Ecological Assessment (IEA, 1995). All habitats and features within the survey area are assessed for their potential to support legally protected or notable species (nationally or locally).

2.2.4 These species include:

 Amphibians: ponds within 250m of the site were considered for their suitability to support a range of amphibians, including great crested newts (GCN).  Reptiles: the site was assessed for suitable habitats including rough grassland, allotments, brownfield sites and habitat edges in general which would provide cover, basking and foraging habitat for reptile species.  Otters: watercourses within 100m of the site were checked for signs of otter and assessed for their suitability to support the species.  Water voles: watercourses on site were checked for signs of water vole presence and assessed for their potential to support the species.  Bats: all trees and structures on site were assessed as to their suitability to support roosting bats at any point during the year. Trees and structures were then categorised for their potential to support roosting bats as per the Bat Surveys for Professional Ecologists – Good Practice Guidelines (Collins, J., 2016).  Birds: the site was assessed for suitable habitats for nesting birds, including habitats suitable for ground‐nesting species.  Badgers: all habitats within 30m of the site were surveyed where possible to identify the presence of any setts or signs of badger activity.

 Invasive plant species: this assessment does not constitute a full Schedule 9 species survey. The potential for any Schedule 9 species was assessed and any species that were encountered were mapped and noted.

2.3 Assessment of Ecological Value 2.3.1 The value and sensitivity of ecological features was determined based on the guidance given in Guidelines on Ecological Impact Assessment (CIEEM, 2016). Individual ecological receptors (habitats and species that could be affected by the development) were assigned levels of importance for nature conservation in one of the following categories:

• International / European • National / UK • Metropolitan / County • Local, or • within the immediate zone of influence or site only.

2.3.2 For a given receptor, determination of value includes consideration of the size, secondary or supporting value/function, conservation status and quality of the species or feature.

2.4 Limitations 2.4.1 The Phase 1 Habitat survey was undertaken outside of the recommended survey season. However, previous survey of the site was undertaken in June 2011 by the same surveyor, to inform a previous planning application for a similar footprint. Therefore, the surveyor is aware of the botanical composition of the site from 2011 and, such is the nature of the site, its current land‐use and its recent management, it is unlikely that any significant or rare species of flora are present.

2.4.2 Access was permitted to all land within the application site boundary. All surrounding land was either accessible or fully visible to the surveyor.

2.4.3 There are considered to be no significant limitations to the undertaking or accuracy of the Extended Phase 1 Habitat survey.

3 RESULTS

3.1 Desk Study

Designated Sites 3.1.1 There are no statutory sites for nature conservation located within 1km of the site. 3.1.2 There are two Local Wildlife Site (LWS) located within 1km of the site;

 The Belt; located 400m to the west of the site and designated due to its broadleaved woodland habitat which forms a continuous block of 8.4ha. This habitat is considered likely to qualify as UK Priority Habitat and as ancient woodland.  Ty‐coch and Afon Clwyd Woods; located 800m to the north of the site. The sites comprise of broadleaved woodland on the banks of the with a diverse age structure and ancient woodland flora. There is also an area of neutral grassland occurring on a bank to the south of the site. Round‐leaved crowfoot also occurs in the river and the sandy bank of the river meander has the potential for nesting Sand Martin and Kingfisher. 3.1.3 There are a total of 14 blocks of ancient woodland located within 1km of the site. These include The Belt, sections of Big Wood 400m to the south of the site, Coed Nant Lleweni 175m to the north and a number of sites on the opposite side of the Afon Clwyd. These sites comprise a mix of semi‐natural, plantation and restored ancient woodland.

Species Records 3.1.4 A summary of the protected and notable species records provided by Cofnod is given below. Full details of biological records returned from the search are given in Appendix C.

Environment (Wales) Act 3.1.5 The Environment (Wales) Act 2016 replaces the Natural Environment and Rural Communities (NERC) Act 2006. The legislation change still places a duty of care for all public bodies to ‘seek to maintain and enhance biodiversity’. This is commonly referred to as the ‘Biodiversity duty’. 3.1.6 The Section 7 list under the new Act has been produced to identify those habitats and species of Principal Importance in Wales. The following relevant habitats and species are found on this list:

3.2 Phase 1 Habitat Survey 3.2.1 The walkover survey was undertaken by Russell Grey (BSc, CEnv, MCIEEM). The survey was undertaken on a cold winter day, with no constraints to the survey of the site itself. Access beyond the site boundary was permitted as it is within the same ownership as the applicant.

3.2.2 The site is located 2km to the northeast of Denbigh, within the grounds of Lleweni Parc. The application site comprises a 0.8ha area composed of improved grassland, recently‐felled conifer woodland, scattered broadleaved trees and a minor water‐course. The site is surrounded by a mix of woodland, grassland and arable farmland. There are no ponds within the planning application boundary and four located within 250m of the site.

Habitats 3.2.3 A total of 10 habitats/features were identified within, or immediately adjacent to, the site boundary. These habitats are mapped in Figure 1 (Appendix A), shown in the site photographs (Appendix B) and summarised below;

3.2.4 The site is accessed via an rough vehicle track in its northern boundary (Target Note 1). The northern boundary of the site is marked by a line of scattered broadleaved trees; mature Lombardy poplars of a uniform age and to a height of ~20m. Upon entering the site, there are two scattered conifer trees either side of the track; Scots pines to a height of ~15m. From here, the site comprises improved grassland (Target Note 2) which slopes downwards towards a small water‐course which runs east‐west through the centre of the site (Target Note 3). The water‐course is lined by rank tall ruderal vegetation such as common nettle, hogweed and willowherb.

3.2.5 The southwest portion of the site comprises an area of recently‐felled conifer woodland (Target Note 4). This area comprises bare ground and the clearance works appear to have been undertaken within a matter of months prior to the site visit, with stacks of logs still present along the southern boundary. The southern boundary is comprised of a simple stock‐proof fence‐line with an edging of rank grasses and tall ruderals. Continuing along the southern edge of the site, the bare ground gives way to rank improved grassland (Target Note 5). Here, on the opposite side of the water‐course, there are three semi‐mature silver birch trees (Target Note 6), one mature oak tree (Target Note 7) and one mature ash tree (Target Note 8). All of these trees appear to be in a good condition, with some ivy growing on the ash tree. The southwest corner of the site is marked by an overgrown mound of earth (Target Note 9).

3.2.6 The site is surrounded by semi‐natural broadleaved woodland to the west (Target Note 10) and improved grassland pasture of the gliding club airfield to the north (Target Note 11). To the east is plantation conifer woodland (Target Note 12) through which the minor water‐course flows and enters into the nearby Afon Clwyd. To the south is arable land (Target Note 14) which was bare plough at the time of survey.

3.3 Protected Species 3.3.1 The following text describes the suitability of the site to support various legally protected species, including any direct observations made during the site survey.

Amphibians 3.3.2 There are no ponds located within the application site boundary but there are four ponds located within 250m of the site. Of these ponds, only two were visited during the site survey to consider their suitability to support breeding amphibians and GCN in particular.

3.3.3 The closest pond to the site is a large angling pond located 25m to the southeast (Pond 1). This pond is located within the floodplain of the Afon Clwyd and as such is frequently inundated during flood events, meaning that it is populated with fish. The pond also covers a large footprint and has limited marginal vegetation cover. The Habitat Suitability Index (HSI) for the pond is calculated to be 0.53 – considered to be below average quality breeding habitat for GCN.

3.3.4 The next closest pond to the site is located 120m to the west of the site (Pond 2), within the woodland belt adjacent to the site. The pond is formed by the collection of land drainage, held back by a sluice gate to form an amenity feature within the Lleweni Parc land. The pond is a permanent feature, with no fish likely to be present and is not over‐shaded by trees, however there was limited aquatic vegetation. The HSI score for the pond is 0.72 – considered to be good quality habitat.

3.3.5 The other two ponds within 250m of the site are located 210m to the southwest (Pond 3) and 230m to the northwest (Pond 4). Pond 3 is located within a clearing of Coed Lleweni and is of a size and shape to suggest it is used as an angling pond, which would make it wholly unsuitable to support GCN due to the high density of coarse fish. Pond 4 is located within a woodland block and appears to be un‐managed and therefore surrounded by dense tree cover. These conditions are unlikely to be suitable for GCN due to the absence of marginal/submerged vegetation, the low dissolved oxygen levels and poor water quality that arise from over‐shading and large volumes of organic input (leaf litter). It is therefore considered that both Ponds 3 and 4 offer below average quality habitat for GCN.

3.3.6 The application site was found to comprise of semi‐natural habitats of low value to amphibians during their terrestrial phase. The improved grassland and recently‐felled woodland offer little in the way of foraging or sheltering value to amphibians. The tall ruderal vegetation that edges the water‐course and the southern boundary are of greater potential value but cover such as small area as to be insignificant. The earth mound located in the southeast corner of the site also holds some potential as a refugia for amphibians. However, the woodland habitats that border the site to the east and west are more likely to be of value as they offer good shelter, refugia and over‐wintering potential.

3.3.7 There are no records of any amphibians within 1km of the site. However, this is most likely a reflection of a lack of survey effort rather than an absence of amphibians. Based on the composition of the site and the surrounding habitats, amphibians are considered to be likely absent from the development footprint but potentially present in the local area.

Badgers 3.3.8 The application site offers potential foraging opportunities for badgers across the grassland and along the site boundaries; woodland edge and tall ruderal vegetation. There are however, no suitable sett‐building locations within the site boundary. No evidence of any badger activity was noted within the site boundary, including setts, footprints or foraging evidence.

3.3.9 Habitats surrounding the site are considered to be of higher value to badgers than the site itself. The lush improved grassland pasture to the north of the site is likely to be a foraging resource for invertebrates at certain times of the year. Likewise, the arable land to the south is also likely to be a valuable foraging resource whilst under crop. The woodland to the east and west offers good shelter and cover for badgers, is suitable for sett locations, and also offers foraging opportunities. A large sett complex was identified in the conifer plantation to the east of the site (Target Note 12), comprising 10‐15 holes with large spoil mounds and clear pathways linking each hole. Fresh evidence of badgers was limited to some footprints outside two of the holes, where the spoil heaps included fresh earth, although this is likely to reflect low badger activity over the winter period. This sett is therefore considered to be active and occupied, but it is not possible to confirm its size or status at this time of year.

3.3.10 The nearest specific badger record is a sett located 316m to the southwest of the site, whilst there is also another sett located 661m to the south of the site. The Clwyd Badger Group also holds records for setts in land to the northwest and northeast of the site. It is therefore concluded that badgers are present within 30m of the development footprint.

Bats Bat Roost Potential

3.3.11 There are no buildings found within the application site. Therefore there are no artificial structures present which could support roosting bats.

3.3.12 There are four trees present within the application site boundary. These trees are described below and assessed as to their Bat Roost Potential (BRP1):

 Tree 1; a mature silver birch located on the north side of the water‐course. The tree has a diameter at breast height of circa 300mm and is to a height of circa 15m. The tree was found to be in excellent condition, with its trunk intact and lacking in any natural defects or features suitable for roosting bats to use. The tree is therefore assessed to be of Negligible BRP.

Medium = tree or structure with one or more potential roost sites that could be used by bats but unlikely to support a roost of high conservation status. Low = tree or structure with one or more potential roost sites that could be used by individual bats opportunistically, but are not suitable to be used on a regular basis by larger numbers of bats. Negligible = negligible features likely to be used by roosting bats (Collins, J., 2016).  Tree 2; a mature silver birch tree located on the north side of the water‐course and immediately to the east of Tree 1. The tree has a diameter at breast height of circa 280mm and is to a height of circa 15m. Similar to Tree 1, Tree 2 was found to be in excellent condition, with no potential roosting features identified from the ground. The BRP is therefore assessed to be Negligible.  Tree 3; a mature oak tree located ~5m to the southeast of Tree 2. The tree is of significant size, age and stature, with a diameter at breast height of circa 750mm and a height of circa 25m. The tree has numerous defects and features with the potential to support roosting bats, including holes at 3m and 5m, and splits in a number of damaged upper limbs. These features have the potential to support a variety of species of bat but not in significant numbers, therefore the BRP is assessed to be Medium.  Tree 4; a mature ash tree located ~10m to the east of Tree 3. The tree is of significant size, age and stature, with a diameter at breast height of circa 650mm and a height of circa 20m. The tree has numerous defects and features with the potential to support roosting bats, including a hole at 4m, a vertical fissure leading to a trunk cavity at 4m and moderate ivy coverage to 6m height. These features have the potential to support various species of bat and in potentially high numbers, therefore the BRP is assessed to be High.

Foraging / Commuting Value

3.3.13 The grassland within the application site is assessed to be of low value to foraging bats, due to the species‐poor composition, poor structure and relatively low abundance of invertebrates that this habitat would support. However, the boundary features – hedgerows, occasional trees, tall ruderals and woodland edge – offer much higher value foraging and commuting habitats for bats. Likewise, the small water‐course that flows through the site is also likely to be used as both a foraging and commuting corridor. The surrounding landscape is of high value for bats, comprising large woodland blocks, riparian corridors, hedgerows and tree.

Inspection

3.3.14 As part of the site survey, the mature oak and mature ash trees (Trees 3 and 4) were inspected from the ground up using binoculars and with the use of ladders and an endoscope to inspect potential roosting features to a height of ~4m. As described in 3.3.12, there are numerous features on either tree with the potential to support roosting bats. However, all of those at or below 4m height were inspected and no bats or any evidence of bat usage such as droppings or staining, could be found. Likewise, the features located above 4m were inspected from the ground but no evidence such as staining or scratch marks could be seen. It is therefore concluded that these features are unoccupied and that no roosting bats are currently present.

Birds 3.3.15 The main grassland body of the site offers negligible value as a nesting resource for birds, being too heavily disturbed and homogenous in structure. The grassland is likely to be a foraging resource outside of the breeding season, with seeds and terrestrial invertebrates available for foraging birds. There is still nesting potential associated with the site however, associated with the tall ruderal vegetation alongside the water‐course and around the southern boundary, and also within Trees 3 and 4. Bird activity at the time of survey was limited to occasional common / widespread species such as goldfinch, coal tit and wren. Reptiles 3.3.16 The main body of the site is assessed to be of negligible value to reptiles due to the homogenous grassland structure and the relatively high level of disturbance associated with the surrounding agricultural land use. There is also negligible value associated with the closed canopy woodland to the east and west of the site.

3.3.17 There are no records for any species of reptiles within 1km of the site. In summary, reptiles are considered to be absent from the development footprint and also likely absent from the surrounding area.

Riparian Mammals 3.3.18 A minor water‐course flows through the application site, from west to east. The water‐course originates from farmland to the west of the A543 and collects additional drainage before it flows through the site and outfalls into the Afon Clwyd. The main river is located just 100m to the east of the site. The minor water‐course is not more than 1m wide and had a water depth of ~50cm at the time of survey. The banks were dominated by bare earth in the western portion of the site but had a component of rank grasses at the eastern end. The water‐course was searched for evidence of any otter or water vole activity; no such evidence could be found along its length through the site. However, a mink raft was noted in the water‐course next to Tree 3 and it is therefore assumed that this species has been recorded locally.

3.3.19 The land within the site boundary is not considered to offer any suitable habitat to support a place of shelter for otter, as it is comprised of open and unprotected land. However, the adjacent woodland blocks are somewhat more suitable for a place of shelter, although again, no evidence of such was found.

3.3.20 There are numerous records of otter on the Afon Clwyd, from 1993 up to 2015; the nearest of which is ~600m to the north of the site. There is only one record for water vole within 1km of the site, dating back from 1974. It is concluded that both water vole and otter are likely absent from the application site but that otters are present within habitat ~100m from the site.

3.4 Notable Species 3.4.1 The application site and immediately surrounding land has no potential to support any additional notable species listed on Section 7 of the Environment (Wales) Act.

3.4.2 No nationally rare or locally important species of flora were identified during the site visit. None are anticipated as being likely to be present owing to the current amenity use, and previous forestry use of part, of the site.

3.5 Invasive Species 3.5.1 Himalayan balsam, a non‐native invasive species (NNIS) of flora listed on Schedule 9 of the Wildlife and Countryside Act 1981 (as amended), was found to be present in land surrounding Pond 1, approximately 20m to the southeast of the site.

3.6 Key Ecological Receptors 3.6.1 The findings of the extended Phase 1 Habitat Survey indicate that there are a number of key ecological receptors for the site;

 Badgers – there is a large sett complex located 5‐10m to the east of the site; Local Value.  Bats – there is Medium – High BRP associated with two mature trees located within the site boundary. There is also foraging and commuting value associated with the water‐course and ‘edge’ habitats; at least Local Value.  Birds – breeding bird potential associated with the tall ruderal vegetation and mature trees; Local Value.  Otter – the species is known to be present locally and using habitat approximately 100m to the east of the site; Local Value.  NNIS – Himalayan balsam present ~20m to the east of the site. The scale at which this species could pose an adverse impact is Local.

3.6.2 The protected species / ecological receptors not bullet‐pointed above are considered to be of less than local value.

4 DISCUSSION

4.1 Proposed Development 4.1.1 The proposed scheme is to construct 24 lodges on the site, with associated vehicle access, parking and sewage treatment plant (STP). The proposed site layout is provided as part of the planning application documents.

4.1.2 The development will require provision of an improved access track through the adjacent field to the north, and improvements to the existing site entrance in the northern boundary. However, the scheme will retain the existing water‐course and all four of the mature broadleaved trees in the eastern end of the site (Trees 1 – 4).

4.1.3 The proposed construction works will take approximately 6 months to complete.

4.2 Likely Impacts

Badgers 4.2.1 The construction phase of the proposed scheme is likely to result in disturbance to the badger sett located 5‐10m to the east of the site. This disturbance is likely to be of a magnitude sufficient to disturb individual badgers, with noise and vibration associated with the installation of lodges, STP and site road within 30m of the sett. However, it is unlikely that the works would cause any structural damage to the sett, as the works are of a relatively small scale and short duration.

4.2.2 The development of the site also represents a loss of foraging habitat for badgers (0.8ha) and will increase the level of disturbance to surrounding habitat that is also used by foraging badgers. These impacts will be permanent but should be considered within the context of the surrounding land, which comprises an extensive area of suitable habitat which badgers utilise for foraging. Therefore, the anticipated impacts on badgers are considered to be minor at the local scale, without mitigation.

Bats 4.2.3 Trees 1 – 4 will be retained and protected as part of the proposed development. Therefore there should be no direct impacts on any roosting bats as a result. However, the construction phase of the scheme may pose disturbance impacts on any bats roosting within Tree 3 or 4. Construction activity is anticipated to take place within 5m of these trees and would therefore be of a magnitude with the potential to displace bats from these trees.

4.2.4 The scheme will also result in the permanent loss of 0.6ha of improved grassland considered to be of low foraging value to bats. There will also be potential losses to the quality and functionality of the boundary features and ‘edge’ habitats, and therefore indirect impacts on foraging and commuting bats through the introduction of disturbance from human activities and artificial lighting. Therefore the anticipated impacts on bats, prior to mitigation, are considered to be major at the local scale.

Birds 4.2.5 The proposed scheme will result in the permanent loss of grassland habitat of negligible nesting value, but of potential foraging value outside of the breeding season. The scheme

will also result in a significant increase in disturbance to retained semi‐natural habitats which are likely to be used by nesting birds, i.e. tall ruderal vegetation and broadleaved trees. The construction of the scheme also poses the risk of harming/disturbing active nests and young birds if works commence during the nesting period. Therefore the anticipated impacts on nesting birds prior to mitigation, is assessed to be minor at the local scale.

Otters 4.2.6 Otters are acknowledged to be present within the Afon Clwyd located approximately 100m to the east of the site. However, there are no suitable habitats present within the site boundary for otters to use as a place of shelter and no evidence was found that otters currently use the site. Therefore no direct impacts on otters are anticipated, but there may be low level disturbance posed to otters during the construction phase of the scheme, as a result of the noise, vibration and human activity associated with this phase. There will also be disturbance impacts associated with the occupation of the site post‐development. Therefore, the likely impact on otter prior to mitigation, is considered to be minor at the local scale.

NNIS 4.2.7 The proposed construction works associated with the development pose a minor risk of causing Himalayan balsam to spread both on‐site and off‐site as a result of vehicle movements, the localised breaking of ground and any minor earth‐working. This could pose an adverse impact on the ecological features of the site and of the surrounding area. However, it is noted that the closest Himalayan balsam is 20m to the southeast of the site and is currently kept under control by the landowner. No development activity will take place within the area of balsam and therefore the anticipated impact is both low risk and minor in scale.

4.3 Recommendations

Badgers 4.3.1 It is recommended that a Badger Development License is obtained from Natural Resources Wales (NRW) prior to the commencement of any works on site. This license should be sought to allow the likely disturbance of badgers associated with the nearby sett for the duration of constriction activities within 30m. It is not anticipated that the sett will need to be closed, but rather that works are timed to take place during the least sensitive time of year for badgers (July to November inclusive) and that other mitigation measures are also implemented to minimise the scale of disturbance. These mitigation measures should include the installation of heras fencing (or similar) along the eastern edge of the site and the use of an acoustic barrier to reduce noise impacts. Measures such as the covering of trenches and the safe storage of all materials and machinery overnight will also be required, to reduce the risk of harm to badgers.

4.3.2 In order to manage the level of daytime disturbance on the badger sett, by people and dogs, it is recommended that the area of woodland within which the sett is located, is protected using natural barriers (log piles, brash, scrub planting). This will ensure that the sett can remain relatively undisturbed and that the woodland can continue to offer core foraging habitat for badgers.

4.3.3 Provided the above mitigation measures are implemented, the anticipated impact on badgers is assessed to be a minor adverse at the local scale.

Bats 4.3.4 To ensure that Trees 3 and 4 remain suitable for roosting bats, and that the site as a whole remains suitable for foraging/commuting bats, it will be necessary for the site to remain as dark as possible during the period from dusk to dawn. This should be achieved by a strict lighting scheme for the development, which details the use of low lux lighting only and no elevated lighting columns of any description.

4.3.5 To compensate for the disturbance posed by the scheme on bats, it is recommended that artificial bat boxes are installed onto two trees within woodland adjacent to the east and west. The boxes should be installed at a height of at least 4m and should face broadly to the south. A Vincent Pro Bat Box or similar would be appropriate.

4.3.6 Provided the above mitigation measures are implemented in full, the anticipated impact on roosting, foraging and commuting bats is assessed to be a minor adverse at the local scale.

Birds 4.3.7 To avoid impacts to active nests, nesting birds and eggs or young birds, it is recommended that all vegetation clearance is undertaken outside of the nesting bird season, taken as March to August inclusive. If the works commence within this period, they must be preceded by a nest check undertaken by an experienced ecologist. Only once the area has been confirmed clear of nesting birds can such works be undertaken within the nesting season.

4.3.8 To compensate for the disturbance and habitat loss caused by the scheme, it is recommended that four bird boxes are installed on trees within the adjacent woodland to the east and west. The boxes should be installed at a minimum height of 4m and should be suitably sheltered from the elements but warmed by the summer sun. Timber boxes with a mix of entrance hole sizes would be appropriate.

4.3.9 Provided the above mitigation measures are implemented, the anticipated impact of the scheme on nesting birds is assessed to be minor at the local scale.

Otter 4.3.10 It is recommended that daily pre‐start checks are undertaken of the working area to ensure that there are no otters or evidence of otters present on site. Where evidence of otter activity is found (or any other mammal activity), then an ecologist should be called for advice.

4.3.11 Provided the above mitigation measures are implemented, the impact on otter is assessed to be minor adverse at the local scale.

NNIS 4.3.12 It is recommended that no construction within 20m of any Himalayan balsam. It is also recommended that measures to manage the existing areas of balsam continue.

4.3.13 Provided the above measures are implemented, the impact posed by Himalayan balsam to ecological receptors is assessed to be minor.

5 CONCLUSION

5.1 Etive Ecology Ltd was commissioned by Lleweni Parc Ltd to undertake an ecological appraisal of a plot of land at The Glyn, Denbigh. The site is proposed for the siting of 24 lodges with associated access and other facilities.

5.2 The assessment comprised an extended Phase 1 Habitat survey, a desk study, a summary of likely impacts on the ecological value of the site and recommendations for any further survey and/or enhancing the ecological value of the site post‐development.

5.3 A desktop data search identified two non‐statutory nature conservation sites and fourteen blocks of ancient woodland within 1km of the development footprint. Protected species records obtained for within 1km of the site included a large number of bird species, an unknown bat, otter, badger, water vole and Himalayan balsam. None of these records related specifically to the proposed development footprint.

5.4 The site comprises an area of grassland within a woodland belt, surrounded by arable land to the south and grassland to the north. The site covers an area of 0.8ha and a minor water‐course flows through it from west to east. There are no ponds within the site boundary and four ponds within 250m. The Afon Clwyd is located 100m to the east.

5.5 The site is dominated by grassland of low ecological value. The surrounding woodland and the minor water‐course, are of more notable value. There are four mature broadleaved trees within the site boundary, two of which have bat roost potential. An active badger sett was identified 5‐10m to the east of the site; likely to be a main sett. The site also has the potential to support foraging/commuting bats and nesting birds. Himalayan balsam is present in adjacent land and otter are known to be present along the Afon Clwyd.

5.6 The proposed development is to construct 24 lodges on site. The scheme will require the improvement of the existing vehicle access track through the grassland in the north and the upgrading of the existing access into the site. The scheme will also include the construction/installation of a sewage treatment plant in the southeast corner of the field. All trees on site, as well as the water‐course, will be retained and protected during construction works. The potential impacts associated with the scheme include the permanent loss of 0.6ha of grassland habitat, disturbance on badgers, bats, birds and otter during construction works and disturbance on badgers, bats, birds and otter during the operational phase.

5.7 It is recommended that a Development License in obtained in relation to the badger sett and likely disturbance associated during the construction phase. Additionally, the badger sett should be protected from disturbance post‐construction. Vegetation clearance should be undertaken outside of the bird nesting season. Reasonable avoidance measures should be implemented during construction to avoid impacts on badgers, otters and the potential spread of Himalayan balsam. Post‐development, bat and bird boxes should be installed into the adjacent woodland areas to provide compensatory enhancement.

5.8 In conclusion, the application site has been found to comprise a number of ecologically valuable features and the potential to support a number of legally protected and/or notable species. There are a number of ecological impacts identified, however, with the implementation of appropriate mitigation measures these impacts are not considered to be more than minor at the local scale.
