INTERPRETING THE QUR’AN AND THE CONSTITUTION: SIMILARITIES IN THE USE OF TEXT, TRADITION, AND REASON IN ISLAMIC AND AMERICAN JURISPRUDENCE Asifa Quraishi* INTRODUCTION Can interpreting the Qur’an be anything like interpreting the Constitution? These documents are usually seen to represent overwhelming opposites in our global legal and cultural landscapes. How, after all, can there be any room for comparison between a legal system founded on revelation and one based on a man-made document? What this premise overlooks, however, is that the nature of the founding legal text tells only the beginning of the story. With some comparative study of the legal cultures that formed around the Qur’an and the Constitution, a few common themes start to emerge, and ultimately it turns out that there may be as much the same as is different between the jurisprudence of Islam and the United States. Though set against very different cultures and legal institutions, jurists within Islamic law have engaged in debates over legal interpretation that bear a striking resemblance to debates in the world of American constitutional theory.1 We will here set these debates next to * Assistant Professor, University of Wisconsin Law School. In the first chapter I deal with the fixed punishments or Mal hududrl; four punishments are discussed: the punishments for theft, armed robbery, adultery and slanderous allegations of unchastity. The other two punishments which are usually classified as "hudud11, i.e. the punishments for wine-drinking and apostasy are dealt with in the second chapter. The idea that they are not punishments of "hudud11 is fully ex- plained. Neither of these two punishments was fixed in definite terms in the Qurfan or the Sunna? therefore the traditional classification of both of then cannot be accepted. -

Pemikiran Ibnu Sahnun Tentang Belajar Mengajar Al-Qur’an 193 PEMIKIRAN IBNU SAHNUN TENTANG BELAJAR MENGAJAR AL-QUR’AN Ahmad Ubaedi Fathuddin* Abstract: Ibn Sahnun was the first Islamic leaders in which his thoughts was concentrated in the areas of education, especially teaching the Qur’an to early childhood. The highlighting of Sahnun’s was based on the notion that the Qur’an is the source of knowledge, and learning at an early age would be so attached and rooted in the child. Through Adab al-Mu’allimin, it is known that the thought of Ibn Sahnun seemed complete and programmed well, especially for the classical era in which only a few leaders who pursued the field of education. And of those concepts can be found some things that are still relevant for today, especially about the emphasis on methods of reading, memorizing and understanding in studying the Qur’an, as apparent in the method of iqra ¸ qira’ati, and amtsilati, and the permissibility of a Qur’an teacher to receive, take or set wages from his students Kata kunci: Ibnu Sahnun, belajar-mengajar, al-Qur’an. PENDAHULUAN Perkembangan pendidikan Islam jika ditinjau dari sejarahnya, terkesan terlambat pertumbuhan dan perkembangannya dibanding dengan disiplin ilmu- ilmu keislaman lainnya seperti fiqih, ilmu kalam, tafsir, hadits, dan sebagainya. Metode yang digunakan adalah kualitatif, sedangkan analisis data yang digunakan adalah content analysis yakni sebagai sebuah upaya menganalisis substansi pemikiran maqāşid al- sharīah, kemudian dikorelasikan dengan konteks kehidupan masyarakat sekarang. Hasil penelitian menunjukkan bahwa teori maqāşid al-sharīah yang digagas oleh Imam al-Syatibi telah menghadirkan shariah dalam wajahnya yang elastis. Maqāşid al-sharīah telah mentransformasikan teori-teori shariah ke dalam nilai-nilai kemanusiaan universal, seperti kemaslahatan, keadilan dan kesetaraan dalam kehidupan umat Islam. Hal ini setidaknya bisa dilihat dalam dua hal: pertama, maqāşid al-sharīah sebagai metode pengembangan hukum Islam. Pengembangan teori-teori maqashid al-shariah mengilhami filsafat hukum Islam dan menjadi pangkal berpikir serta analisis yang pokok untuk pengembangan pemikiran hukum Islam pada era globalisasi dan perubahan sosial sekarang ini. The Search for Knowledge: Andalusi Scholars and Their Travels to the Islamic East
THE SEARCH FOR KNOWLEDGE: ANDALUSI SCHOLARS AND THEIR TRAVELS TO THE ISLAMIC EAST María Luisa Ávila Escuela de Estudios Árabes, CSIC Granada In Andalusi biographical dictionaries, the portrait of the individual scholar follows a pre-established outline, centered upon his place of birth, the names of his masters and disciples, the places he visited during his “period of formation” and his career and, eventually, his positions in the administration. Information about his personal attitudes or family ties is nearly always absent in these sources, mainly interested as they were, in the position of scholars as transmitters of knowledge. For Andalusi scholars, traveling to the Islamic East was an essential step in their period of formation, at least during the first centuries of the history of al-Andalus. Biographers, then, dutifully recorded the names of Eastern masters and places visited by scholars during these journeys to the East, coupled also with the pilgrimage to Mecca. This kind of biographical information offers a prosopographical material of outstanding interest, the analysis of which sheds a welcome light on the formative years and study patterns of Andalusi scholars. On this occasion I will restrict the analysis to the oldest of Andalusi biographical dictionaries, that of Ibn Harith al-Khushani, known as Akhbar al-fuqaha, wa-l-muhaddithin,1 a basic source for the study of intellectual life in al-Andalus during the ninth and tenth centuries.2 Through the study of the prosopographical material in this dictionary I intend to establish, first, the age at which scholars began their period of formation; second, when the travel to the East (the rihla) was usually undertaken, and, finally, how long these scholars stayed in the East. -

e-ISSN 2289-6023 International Journal of Islamic Thought ISSN 2232-1314 Vol. 13: (June) 2018 2018 2018 May Arabic, Grammar, and Teaching: An Islamic Historical Perspective April NADIA SELIM1 Accepted: 17 11 Received: ABSTRACT Motivated by the need to rethink Islamic education and Arabic teaching in Western Islamic schools (Ramadan 2004), this article seeks to present an analytical exploration of Islamic educational thought on the purpose of Arabic grammar and its place in Arabic language teaching. The article will review the rise of Arabic grammar and thought surrounding its instruction to understand whether one of the most prevalent approaches to teaching Muslim children Arabic as a foreign or second language today, the Grammar-Translation Method (GTM), is part of the Islamic educational tradition. The GTM, which is not suited to the promotion of childhood literacy or language acquisition and leaves many children disengaged and with stilted rudimentary literacy, is often conflated with the rich philological tradition of the Islamic civilization. However, was nahw [grammar] meant to be the core component of Muslim childhood learning experiences in the way that it is today, or has the GTM method supplanted Islamic civilizational thought on teaching language? This article seeks to answer this question and will do so by reviewing the purpose of the Arabic language in the Islamic civilization, the rise of Arabic grammar and thought surrounding education and Arabic instruction. Keywords: Arabic language, Islamic education, grammar, nahw, Grammar-Translation Method The 19th-century European Grammar-Translation Method (GTM) lacks theoretical foundation (Richards & Rodgers 2001) and ignores the communicative aspects of language learning (Patel & Jain 2008) in favor of rote memorization, grammatical drills, and translation from the target language into the local language. -

(signature) ......................................................................................... 1 ABSTRACT This research studies the theology of those Wahhabis who have now named themselves Salafis. For the purpose of the study, they are referred to as the ‘Wahhabis-self-named- Salafis’ (WSNS). The thesis starts with the observation that the WSNS are usually studied from a political perspective, much less frequently a theological one. Recent research has identified that the theological background of all the different factions of the WSNS is one and the same. This is true for the WSNS who advocate a peaceful way to achieve their goals, as well as those who do not. This thesis aims to explore some of the theological issues that unify these factions. This research demonstrates that, because the WSNS are opposed to the very concept of interpretation of the Qur’an and the hadith, especially when these texts deal with important theological issues such as the Attributes of God, they have developed a vision of Islamic history which is entirely different from the one which had traditionally been accepted by most Muslim scholars and Western academics.
