MAORI LAND IN HAURAKI Philip Hart Te Aroha Mining District Working Papers No. 12 2016 Historical Research Unit Faculty of Arts & Social Sciences The University of Waikato Private Bag 3105 Hamilton, New Zealand ISSN: 2463-6266 © 2016 Philip Hart Contact: [email protected] 1 MAORI LAND IN HAURAKI Abstract: Imagining the Hauraki Peninsula to contain payable goldfields and knowing that land to the south of Thames had great agricultural potential, Pakeha were determined to acquire it, and were frustrated by what was considered to be ‘Maori intransigence’. For their part, Maori landowners were justifiably concerned about losing their land, and hindered and delayed opening it to settlement for as long as possible. A major difficulty for officials seeking to acquire land was how to determine boundaries between different blocks and how to identify the true owners when there were rival claims put forward by hapu and individuals. Land purchase agents used a variety of means to get blocks through the land court and then to individualize the title, notably the controversial ‘raihana’ policy, which benefited some landowners at the expense of others. The expensive legal process involved often forced those who had proved their ownership to sell land to pay for their success, a success which resulted in grantees treating the land as their personal property rather than tribal property. Some Pakeha as well as many Maori protested at the unfair process; even James Mackay, the most effective practitioner of raihana, came to lament his success and its consequences for the younger generation of Maori (he blamed the system, not himself). -

Council Agenda - 26-08-20 Page 99 Project Number: 2-69411.00 Hauraki Rail Trail Enhancement Strategy • Identify and develop local township recreational loop opportunities to encourage short trips and wider regional loop routes for longer excursions. • Promote facilities that will make the Trail more comfortable for a range of users (e.g. rest areas, lookout points able to accommodate stops without blocking the trail, shelters that provide protection from the elements, drinking water sources); • Develop rest area, picnic and other leisure facilities to help the Trail achieve its full potential in terms of environmental, economic, and public health benefits; • Promote the design of physical elements that give the network and each of the five Sections a distinct identity through context sensitive design; • Utilise sculptural art, digital platforms, interpretive signage and planting to reflect each section’s own specific visual identity; • Develop a design suite of coordinated physical elements, materials, finishes and colours that are compatible with the surrounding landscape context; • Ensure physical design elements and objects relate to one another and the scale of their setting; • Ensure amenity areas co-locate a set of facilities (such as toilets and seats and shelters), interpretive information, and signage; • Consider the placement of emergency collection points (e.g. by helicopter or vehicle) and identify these for users and emergency services; and • Ensure design elements are simple, timeless, easily replicated, and minimise visual clutter. The design of signage and furniture should be standardised and installed as a consistent design suite across the Trail network. Small design modifications and tweaks can be made to the suite for each Section using unique graphics on signage, different colours, patterns and motifs that identifies the unique character for individual Sections along the Trail. -

Hauraki District Plan September 2014 6.2 INDIGENOUS BIODIVERSITY AND SIGNIFICANT NATURAL AREAS 6.2.1 BACKGROUND (1) PART 2 RESOURCE MANAGEMENT ACT 1991 (RMA) (a) The RMA has a key role in managing our indigenous biological diversity. Almost all forms of resource use affect indigenous biodiversity, and biodiversity is recognised in the Act in many ways. Part 2 of the Act places a responsibility on the Council to recognise and provide for the general protection of indigenous vegetation and habitats of indigenous fauna. (b) Section 5(2)(b) of the Act refers to safeguarding the life-supporting capacity of ecosystems. Section 6(c) places a responsibility on Council to protect areas of significant indigenous vegetation and significant habitats of indigenous fauna as a matter of “national importance”. Section 7 also requires Council to have particular regard to the maintenance and enhancement of amenity values (Section 7(c)) and the intrinsic value of ecosystems (Section 7(d)). The definition of “Intrinsic Values” in the Act includes values derived from biological and genetic diversity and the essential characteristics that determine an ecosystem’s integrity, form, functioning and resilience. These characteristics are also integral to the life-supporting capacity of ecosystems identified in Section 5(2)(b). In addition, it is understood that some areas of indigenous biodiversity have cultural values of importance to tangata whenua, and through the protection of indigenous biodiversity for ecosystem reasons, such protection can also assist Council in carrying out its responsibilities under Section 8 of the Act. (c) Section 31 of the Act provides that it is the function of territorial authorities to control the effects of the use of land for the maintenance of indigenous biological diversity. -

Burns1 1School of Biological Sciences, The University of Auckland, Private Bag 92019, Auckland, New Zealand *Author for correspondence (Email: [email protected]) Published online: 13 January 2021 Abstract: Tree fern trunks provide establishment surfaces and habitat for a range of plant taxa including many understorey shrubs and canopy trees. The importance of these habitats for augmenting forest biodiversity and woody plant regeneration processes has been the subject of conjecture but has not been robustly assessed. We undertook a latitudinal study of the woody epiphytes and hemiepiphytes of two species of tree ferns (Cyathea smithii, Dicksonia squarrosa) at seven sites throughout New Zealand to determine (1) compositional variation with survey area, host identity, and tree fern size, and (2) the frequency of woody epiphyte and hemiepiphyte occurrence, in particular that of mature individuals. We recorded 3441 individuals of 61 species of woody epiphyte and hemiepiphyte on 700 tree ferns across the seven survey areas. All were facultative or accidental, with many species only ever recorded as seedlings. Epiphyte composition varied latitudinally in response to regional species pools; only two species occurred as woody epiphytes at every survey area: Coprosma grandifolia and Schefflera digitata. Five woody epiphyte species exhibited an apparent host preference to one of the two tree fern species surveyed, and trunk diameter and height were strong predictors of woody epiphyte and hemiepiphyte richness and diversity. -

Most of the 600 species (in seven families and 13 genera) are arbo- rescent, but considerable morphological variability exists, spanning the giant scaly tree ferns (Cyatheaceae), the low, erect plants (Plagiogy- riaceae), and the diminutive endemics of the Guayana Highlands (Hymenophyllopsidaceae). In this study, we investigate phylogenetic relationships within tree ferns based on analyses of four protein-coding, plastid loci (atpA, atpB, rbcL, and rps4). Our results reveal four well-supported clades, with genera of Dicksoniaceae (sensu Kubitzki, 1990) interspersed among them: (A) (Loxomataceae, (Culcita, Pla- giogyriaceae)), (B) (Calochlaena, (Dicksonia, Lophosoriaceae)), (C) Cibotium, and (D) Cyatheaceae, with Hymenophyllopsidaceae nested within. How these four groups are related to one other, to Thyrsopteris, or to Metaxyaceae is weakly supported. Our results show that Dicksoniaceae and Cyatheaceae, as currently recognised, are not monophyletic and new circumscriptions for these families are needed. © 2006 Elsevier Inc.
