History and Heritage serves as a country's identity and are inextricable from each other. Simply speaking, while 'history' concerns itself with the study of past events of humans; 'heritage' refers to the traditions and buildings inherited by us from the remote past. However, they are not as simple as it seems to be. The question on historical consciousness and subsequently the preservation of heritage, intangible or living, remains a critical issue. There has always remained a major gap between the historians or professional academics on one hand, and the general public on the other hand regarding the understanding of history and importance of heritage structures. This paper tends to examine the nature of laws passed in Indian history right from the Treasure Trove Act of 1878 till AMASR Amendment Bill of 2017 and its effects with respect to heritage management. It also analyses the sites of Sanchi, Bodh Gaya, and Bharhut Stupa in this context. Moreover, the need and role of the museums has to be considered. The truth lies in the fact that artefacts and traditions both display 'connected histories'; and that the workings of archaeology, history, and heritage studies together is responsible for the continuing dialogue between past, present, and future.

    journal of law, religion and state 5 (2017) 117-147 brill.com/jlrs Reexamining Secularism The Ayodhya Dispute and the Equal Treatment of Religions Geetanjali Srikantan* Assistant Professor of Global Legal History, Tilburg Law School [email protected] Abstract It is widely recognized that the secular Indian state unlike its Western counterpart does not follow the strict separation of religion and state, opting to intervene in the domain of religion by treating religions equally. This article examines how the concept of equal treatment of religions is applied in the legal domain by an intellectual history of the Ayodhya litigation and argues that the courts cannot treat religions equally due to the incompatible nature of the claims made by the parties i.e. the history of reli- gion claim of the Hindus vis-a-vis the property rights claim of the Muslims. Departing significantly from the current consensus about the litigation being characterized by defective legal interpretation and political influences, it further argues that the real le- gal challenge in resolving this dispute is addressing the theological frameworks within modern property law which are dependent on a set of normative inferences embed- ded in colonial discourse. * Acknowledgments: Versions of this paper have been presented at the symposium on “Unex- pected Sources of Law” held at the David Berg Foundation Institute for Law and History, Tel Aviv University, and the Conference on Religion and Equality held at Bar Ilan University.     The Marxist, XXVII 4, October–December 2011 KRISHNA MOHAN SHRIMALI Ram Sharan Sharma: The People’s Historian THE PERSONA Born in Bihar’s Barauni village (Begusarai district) on September 01, 1920, Professor Ram Sharan Sharma had his early education in a rural milieu. Later, he went to the Patna University to do his graduate and postgraduate studies. After a short stint of teaching in colleges of Arrah and Bhagalpur (1943-46), he joined the renowned Patna College as a Lecturer in 1946 and rose to become Professor and Head of the Department of History of the Patna University in 1958. He continued to hold that position till 1973, when the University of Delhi offered him professorship and headship of its history department. He retired from active service there in 1985. Though a widely travelled person, both in India and abroad, he never forgot his mula (roots) and actively worked for the upliftment of his village. He was particularly concerned about the need of educational facilities for all, and specially for the education of women. He was instrumental in inspiring the local people to create a library in the village. The peasant leaders of the National Movement such as Pandit Karyanand Sharma and Swami Sahajanand Saraswati and THE MARXIST progressive and irrepressible Mahapandit Rahul Sankrityayana had considerable formative influences on his persona. As a result, he became simplicity personified. Amongst the numerous Awards and Honours bestowed upon him, the Professor H.K.     Ram Janmabhoomi Vs Babri Masjid The dispute, as is well known, is that some Hindu organisations claimed that the mosque known as Babri Masjid in Ayodhya, a town in Faizabad district of Uttar Pradesh, was built by Mir Baqi, a general of Emperor Babar, in 1528 after demolishing a grand temple on the spot, that marked the birthplace of Lord Ram – the most important incarnation of Vishnu in the Hindu belief system. So, while the Hindus wanted to remove the mosque from the spot and build a Ram temple there, some Muslim organisations disputed the legitimacy of the Hindu claim. In the independent India, the matter has been in the courts since 1950. The mosque was destroyed on 06th December 1992 when a political rally developed into a riot involving 150,000 people. The report of Liberhan Commission, appointed on 16th December 1992 to investigate the demolition of Babri mosque, was tabled in the Indian parliament on 24th November 2009 and it has listed people responsible for the demolition of the mosque, indicting some very senior political figures of India. No doubt, the manner the disputed structure called Babri Mosque was demolished on 06th December 1992 was wrong. The organisers of the rally on the day had promised to the Union Government and gave an undertaking to the Supreme Court of India that the structure would not be harmed. After giving that undertaking, the act of demolishing the mosque, that too in front of the world television cameras, was unacceptable. It left the Muslim community in India with a feeling of a gross excess and insult, and it belittled the Indian State.

Political scientists and historians studying the mechanisms of contemporary armed conflict and dic- tatorship frequently but inattentively use the term to indicate a more or less pro- found change in time. But there are different ruptures with the past. Indeed, two contrasting types can be distinguished: transitional and iconoclastic breaks. The former are the hallmark of new or restored democracies, the latter of new or conso- lidated dictatorships. Transitional breaks have received much attention during the last decades; truth commissions and tribunals were devised as instruments to cope with the painful past before the break. Transitional breaks are organized by regimes which recently acquired power and are backed by large parts of civil society. They constitute an attempt to deal with the injustices of the immediately preceding pe- riod but usually leave the legacy of the more remote past intact. These tabulaIconoclastic rasa breaks are different. Some regimes or groups try to force not1 a par- tial but a complete break with the past and even to start from the year zero. breaks are meant to cleanse the entire past or as much of it as possible, and either to reach or regain some faraway golden age. They are the hallmark of totalitarian regimes, at least during certain phases in their life span, or of radical groups aspiring to totalitarian power.
