I declare that my thesis consists of 98,700 words. 3 Abstract: This thesis examines qiaowu [Overseas Chinese affairs] policies during the PRC’s first decade, and it argues that the CCP-controlled party-state’s approach to the governance of the huaqiao [Overseas Chinese] and their affairs was fundamentally a political economy. This was at base, a function of perceived huaqiao economic utility, especially for what their remittances offered to China’s foreign reserves, and hence the party-state’s qiaowu approach was a political practice to secure that economic utility. -

Resolution of the Central People's Government Committee on the Convening of the National People's Congress and Local People's Congresses
Resolution of the Central People's Government Committee on the convening of the National People's Congress and local people's congresses January 14, 1953 The Common Program of the Chinese People's Political Consultative Conference stipulates: "The state power of the People's Republic of China belongs to the people. The organs through which the people exercise state power are the people's congresses and governments at all levels. The people's congresses at all levels are elected by the people by universal suffrage. The people’s congresses at all levels elect the people’s governments at all levels. When the people’s congresses at all levels are not in session, the people’s governments at all levels are the organs that exercise all levels of power. The highest organ of power in the country is the National People’s Congress. The government is the highest organ for the exercise of state power.” (Article 12) The Organic Law of the Central People’s Government of the People’s Republic of China stipulates: “The government of the People’s Republic of China is a government of the People’s Congress based on the principle of democratic centralism.” (Article 2) Three years ago, when the country was first established, many revolutionary work was still underway, the masses were not fully mobilized, and the conditions for convening the National People’s Congress were not mature enough. Therefore, in accordance with Article 13 of the Common Program, the Chinese People’s Political Consultative Conference The first plenary session implements the functions and powers of the National People's Congress, formulates the Organic Law of the Central People's Government of the People's Republic of China, elects and delegates the functions and powers of the Central People's Government of the People's Republic of China to exercise state power. -

CHINA CAN SAY “NO”: ANALYZING CHINA’S REJECTION OF THE SOUTH CHINA SEA ARBITRATION Toward A New Era of International Law with Chinese Characteristics Isaac B. Kardon* At least since the 2008 global financial crisis, the People’s Republic of China (“PRC”) has been feeling its oats on the world stage. After decades of “reform and opening” to ever-deeper integration into global affairs, China is now shaping the international system as much as that system is shaping China. The “engagement” thesis— variations on the idea that China’s sustained participation in interlocking Western-dominated institutions will produce a more liberal, compliant, and cooperative China (Economy and Oksenberg 1999, Kent 2007, Johnston 2008)—is all but historical artifact. Now equipped with ample experience and outsized capacity, China can give as well as they get on the global stage. Operating at impressive scale in economic, security, and diplomatic arenas, Chinese actors and organizations are now major players who drive the agenda. Deng Xiaoping’s dictum to never seek leadership (绝不 当头) is no longer operative as the Chinese Communist Party (CCP) publicly touts China’s role as a global leader with major ambitions.1 PRC diplomats are no longer so reticent and have announced *Isaac B. Liebman* INTRODUCTION Consider two recent defamation cases in Chinese courts. In 2004, Zhang Xide, a former county-level Communist Party boss, sued the authors of a best selling book, An Investigation into China's Peasants. The book exposed official malfeasance on Zhang's watch and the resultant peasant hardships. Zhang demanded an apology from the book's authors and publisher, excision of the offending chapter, 200,000 yuan (approximately U.S.$25,000)' for emotional damages, and a share of profits from sales of the book. HSIEH ABSTRACT This Article examines the evolution of international law as a professional and intellectual discipline in the Republic of China (ROC), which has governed Mainland China (1912–1949) and post-1949 Taiwan. The ROC’s centennial development fundamentally shaped modern China’s course of foreign relations and postwar global governance. The Article argues that statism, pragmatism, and idealism define the major features of the ROC’s approach to international law. These characteristics transformed the law of nations into universally valid normative claims and prompted modern China’s intellectual focus on the civilized nation concept. First, the Article analyzes the professionalization of the discipline of international law.
