"' . .... WHEREAS, the AGREEMENT requires renewal of the lease on the date of the initial assignment. Attached to the initial assignment as Exhibit B is a copy of the renewal lease agreement issued to THE PROFIT GROUP on MA Y 1 ,1998 covering the property described as Lot G-3 B.R.A. WHEREAS, STEVE HOUGHTON , our current Lessee, has agreed to assign said lease to HOUGHTON PK. LTD. , hereinafter called Assignee. NOW THEREFORE, said Lessee hereby assigns said lease to Assignee above named in consideration of a sum of one ($1.00) dollar and other valuable consideration, the receipt of all of which is hereby acknowledged by Lessee. Assignee hereby acknowledges that he has read the lease mentioned above (Exhibit B) and the NOTICE OF RESTRICTIONS AND CONDITIONS, and a copy of the associated photograph booklet which have been supplied by The Ranch on Possum Kingdom, L.P., and are being attached hereto as Exhibits C and D, respectively. Assignee hereby acknowledges that he has read the lease mentioned above (Exhibit B) and that he is familiar with the rules and regulations of Lessor applicable to such lease and hereby accepts said assignment subject to all of the terms and provisions of said lease and subject to said rules and regulations, and said Assignee assumes all obligations imposed by said lease, rules and regulations. THE WATER LEVEL IN POSSUM KINGDOM LAKE WILL NOT BE CONSTANT. THIS IS A WATER CONSERVATION AND HYDROELECTRIC POWER PROJECT, AND, WHILE IT IS THE DESIRE OF THE BRAZOS RIVER AUTHORITY TO KEEP THE LAKE AS FULL AS POSSIBLE, THE LEVEL OF THE WATER WILL VARY, DEPENDING ON THE AMOUNT OF WATER USED FROM THE LAKE, EVAPORATION RATES, AMOUNTS OF RAINFALL AND RUNOFF IN THE BRAZOS BASIN UPSTREAM, AND OTHER FACTORS. ("Developer") that I am aware of and have been fully informed of the facts set out below. I further acknowledge that I have received a copy of this Notice of Restrictions and Conditions. The facts of which I acknowledge awareness are the following: (a) I recognize that the items set forth below are not a complete list of the restrictions relating to My Lot and that additional covenants, conditions and restrictions with which I must comply are contained in that certain Declaration of Covenants, Conditions, and Restrictions for the Ranch on Possum Kingdom (the Declaration"), which has been recorded by Developer in Volume 944, Page 405 of the Official Public Records of Palo Pinto County, Texas. I acknowledge receipt of a copy of the Declaration and that the provision thereof may be enforced by Authority as well as by Developer. (b) My Lot is subject to restrictions on use imposed in my lease (if My Lot or part of it is leased from Authority), which may be enforced by Authority. (c) I have been furnished with a -plat of My Lot, a copy of which is attached and copy of which has been furnished to Authority.
