i 0 NOTICE OF RESTRICTIONS AND CONDITIONS

As purchasers or lessees of the lots platted as Lot G3 B.R.A., Block G, the Ranch on Possum Kingdom, a subdivision of which plat is recorded in Volume 7, Pages 90-98 of the Plat Records of Palo Pinto, County, Texas, ("My Lot"), I (whether one or more persons) acknowledge to Brazos River Authority ("Authority") and to The Ranch on Possum Kingdom, LP. ("Developer") that I am aware of and have been fully informed of the facts set out below. I further acknowledge that I have received a copy of this Notice of Restrictions and Conditions. The facts of which I acknowledge awareness are the following: (a) I recognize that the items set forth below are not a complete list of the restrictions relating to My Lot and that additional covenants, conditions and restrictions with which I must comply are contained in that certain Declaration of Covenants, Conditions, and Restrictions for the Ranch on Possum Kingdom (the Declaration"), which has been recorded by Developer in Volume 944, Page 405 of the Official Public Records of Palo Pinto County, Texas. I acknowledge receipt of a copy of the Declaration and that the provision thereof may be enforced by Authority as well as by Developer. (b) My Lot is subject to restrictions on use imposed in my lease (if My Lot or part of it is leased from Authority), which may be enforced by Authority. (c) I have been furnished with a -plat of My Lot, a copy of which is attached and copy of which has been furnished to Authority. The plat shows a building setback line. No building, garage, gazebo, fence, patio, railing, or construction or improvement of any kind except as noted in the following sentence shall be placed or erected on My Lot within the area between the setback line and Possum Kingdom Lake and no part of any such facilities shall extend into such area. Nor shall any cutting of trees of any kind be permitted in such area without written permission of Authority. Such written permission shall not be granted within 50 feet (25 feet for Lots in Block F) of the shoreline. Trimming of trees, brush clearing, landscape planting and natural rock walkways may be allowed in this area, but only with specific written permission from Authority. (d) No boathouse, dock or any installation supporting boating activity, will be permitted by Authority to be placed on the waters of Possum Kingdom Lake adjoining My Lot or on My Lot within 50 feet (25 feet for Lots in block F) of Possum Kingdom Lake (this provision is not applicable to Lots Numbered 1-11 in Block F of The Ranch on Possum Kingdom). If My Lot is in Block F, a permit from Authority shall be required for any dock serving it. (e) I understand and acknowledge that the principal purpose of Possum Kingdom Lake is water supply and not recreation; Possum Kingdom Lake is not a constant level lake; the elevation of its surface will vary from time to time with rainfall, water supply

Notice of Restrictions and Conditions - Page 1 requirements and hydropower generation needs; at times, it may fall substantially below the 1,000 Foot Contour, so that areas of the Lake bottom which are normally covered with water will be exposed and the exposed area between My Lot and the Lake will be substantially larger that if the Lake were full. The area below the l,OOO-Foot Contour is not a part of My Lot and will not be under my control when not inundated. (f) Possum Kingdom Lake is a licensed project of the Federal Energy Regulatory Commission; the license under which Authority operates the lake has required Authority to file with and obtain approval by Federal Energy Regulatory Commission of a recreation plan; the license and recreation plan impose restrictions on the land owned by Authority around the Lake, which includes a part of My Lot leased from Authority. (g) A license or permit from Authority is required for any septic tank facilities to be located or to be installed on My Lot. (h) The areas between Lots Numbered 1-9 in Block D, and 2-18 in Block I of The Ranch on Possum Kingdom and the 1,000 Foot Contour are owned by Authority and designated as public use areas in the recreation plan referred to above. Authority will not prohibit use of such areas by the general public. I will have no power to exclude the general public on such areas. Authority does have existing regulations, which prohibit overnight camping, the making of fires and the operation of motor vehicles in these public use areas. These regulations are subject to change by Authority's Board of Directors. No removal of brush or trimming, cutting or other destruction of trees in such areas will be permitted, except that Authority may, but shall not be required, to accomplish removal, trimming or cutting to maintain the present appearance of such areas if the owners of any of the lots adjoining this area so request and agree and make arrangements satisfactory to Authority to pay the expense of such work. No such removal, trimming or cutting by anyone other than Authority or a party employed by Authority therefor will be permitted. (i) I have been furnished with a booklet, copy of which I have signed for delivery to Authority. The booklet contains photographs of the shoreline of Possum Kingdom Lake in the vicinity of The Ranch of Possum Kingdom. I understand that the purpose of the booklet is to depict the general appearance of property which front on or is visible from Lake which the restrictions, setback lines and requirements set forth in my lease, my deed and/or this notice are designed to avoid and the general appearance which they are designed to maintain. (j) I understand that my lease from Authority provides that if I cut down or otherwise destroy any tree located on land owned by Authority adjacent to Possum Kingdom Lake in the vicinity of The Ranch on Possum Kingdom in violation of my lease, of any provision of the contract between the Authority and The Ranch on Possum Kingdom, LP relating to inclusion of Authority-owned land in the area platted as The Ranch on Possum Kingdom or any regulation of Authority, Authority, may, on written demand, require me to replace and nurture to maturity a substitute tree of the same species in the same general vicinity of the tree cut down or destroyed. (k) I understand that the Authority has adopted regulations applying to conduct on property owned by it, including the land on which Possum Kingdom Lake is located and land owned by it in the vicini ty of Possum Kingdom Lake. I also understand that such regulations will apply to me while on the Lake and also which on Authority-owned land, even if such land is leased to me. (1) Authority will be notified of and may have a representative present at and participate in all meetings of any homeowners, property owners or lessees' association created in connection with the implementation of Developer's plans for development of The Ranch on Possum Kingdom.

Pages 90 through 98, of the Plat Records of Palo Pinto, County, Texas, ("My Lot"), I (whether one or more persons) acknowledge to Brazos River Authority ("Authority") and to The Ranch on Possum Kingdom, LP. ("Developer") that I am aware of and have been fully informed of the facts set out below. I further acknowledge that have received a copy of this Notice of Restrictions and Conditions. The facts of which I acknowledge awareness are the following:

(a) I recognize that the items set forth below are not a complete list of the restrictions relating to My Lot and that additional covenants, conditions and restrictions with which must comply are contained in that certain Declaration of Covenants, Conditions, and Restrictions for the Ranch on Possum Kingdom (the Declaration"), which has been recorded by Developer in Volume 944, Page 405 of the Deed Records of Palo Pinto County, Texas. acknowledge receipt of a copy of the Declaration and that the provision thereof may be enforced by Authority as well as by Developer.

(b) My Lot is subject to restrictions on use imposed in my lease (if My Lot or part of it is leased from Authority), which may be enforced by Authority.

(c) I have been furnished with a plat of My Lot, a copy of which is attached and copy of which has been furnished to Authority. The plat shows a building setback line. No building, garage, gazebo, fence, patio, railing, or construction or improvement of any kind except as noted in the following sentence shall be placed or erected on My Lot within the area between the setback line and Possum Kingdom Lake and no part of any such facilities shall extend into such area. Nor shall any cutting of trees of any kind be permitted in such area without written permission of Authority. Such written permission shall not be granted within 50 feet (25 feet for Lots in Block F) of the shoreline. Trimming of trees, brush clearing, landscape planting and natural rock walkways may be allowed in this area, but only with specific written permission from Authority.

(d) No boathouse, dock or any installation supporting boating activity, will be permitted by Authority to be placed on the waters of Possum Kingdom Lake adjoining My Lot or on My Lot within 50 feet (25 feet for Lots in Block F) of Possum Kingdom Lake (this provision is not applicable to Lots Numbered 1-11 in Block F of The Ranch on Possum Kingdom). If My Lot is in Block F, a permit from Authority shall be required for any dock serving it.

(e) I understand and acknowledge that the principal purpose of Possum Kingdom Lake is water supply and notrecreation; Possum Kingdom Lake is not a constant level lake; the elevation of its surface will vary from time to time with rainfall, water supply requirements and hydropower generation needs; at times, it may fall substantially below the 1,000 Foot Contour, so that areas of the Lake bottom which are normally covered with water will be exposed and the exposed area between My Lot and the Lake will be substantially larger than if the Lake were full. The area below the 1,000- Foot Contour is not a part of My Lot and will not be under my control when not inundated.

Notice of Restrictions and Conditions Page 1 of 3 Pages (t) Possum Kingdom Lake is a licensed project of the Federal Energy Regulatory Commission; the license under which Authority operates the Lake has required Authority to fIle with and obtain approval by Federal Energy Regulatory Commission of a recreation plan; the license and recreation plan impose restrictions on the land owned by Authority around the Lake, which includes a part of My Lot leased from Authority.

(g) A license or permit from Authority is required for any septic tank facilities to be located or to be installed on My Lot.

(h) The areas between Lots Numbered I - 9 in Block D, and 2 -18 in Block I of The Ranch , on Possum Kingdom and the 1,000 Foot Contour are owned .by Authority and designated as public use areas in the recreation plan referred to above. Authority will not prohibit use of such areas by the general public will have no power to exclude the general public on such areas. Authority does have existing regulations, which prohibit overnight camping, the making of fires and the operation of motor vehicles in these public use areas. These regulations are subject to change by Authority's Board of Directors. No removal of brush or trimming, cutting or other destruction of trees in such areas will be permitted, except that Authority may, but shall not be required, to accomplish removal, trimming or cutting to maintain the present appearance if such areas if the owners of any of the lots adjoining this area so request and agree and make arrangements satisfactory to Authonty to pay the expense of such work. No such removal, trimming or cutting by anyone other than Authority or a party employed by Authority therefor will be permitted.

(i) I have been furnished with a booklet, a copy of which I have signed for delivery to Authority. The booklet contains photographs of the shoreline of Possum Kingdom Lake in the vicinity of The Ranch on Possum Kingdom. I understand that the purpose of the booklet is to depict the general appearance of property which front on or is visible from Lake which the restrictions, setback lines and requirements set forth in my lease, my deed and/or this notice are designed to avoid and the general appearance which they are designed to maintain.

G) I understand that my lease from Authority provides that if I cut down or otherwise destroy any tree located on land owned by Authority adjacent to Possum Kingdom Lake in the vicinity of The Ranch on Possum Kingdom in violation of my lease, of any provision of the contract between the Authority and The Ranch on Possum Kingdom, LP relating to inclusion of Authority-owned land in the area platted as The Ranch on Possum Kingdom or any regulation of Authority, Authority, may, on written demand, require me to replace and nurture to maturity a substitute tree of the same species in the same general vicinity of the tree cut down or destroyed.

(k) I understand that the Authority has adopted regulations applying to conduct on property owned by it, including the land on which Possum Kingdom Lake is located and land owned by it in the vicinity of Possum Kingdom Lake. I also understand that such regulations will apply to me while on the Lake and also which on Authority-owned land, even if such land is leased to me.
