Complainant alleges the Oakland Chief of Police and the Captain of Internal Affairs failed to investigate Internal Affairs in the past to properly investigate the of Mr. Waajid Bey; the attempted murder of Mr. John Bey; the business failure of Your Black Muslim Bakery due to by IV; and to look into and expose alleged police failures, missteps, omissions, and chain of command racism and prejudices against the Your Black Muslim Bakery.

Rationale for administrative closure – The CPRB staff recommends administrative closure of this complaint on the basis a hearing would not facilitate the fact-finding process and that no good cause has been shown for further action.

Case No. 13-1103, Cheryl Lynn Luckett a. Public Comment b. Staff Report c. Discussion d. Action

Complainant alleges that an Oakland police officer threw her to the ground, put handcuffs on her, and sent her to John George Hospital for being “in his face,” as she was trying to explain to the officer a threat on her life by a tenant in her home.

Rationale for administrative closure – The investigation reveals that the acts which provided the basis for the complaint occurred, however, the acts were justified, lawful and/or proper. The CPRB staff recommends administrative closure of this complaint on the basis a hearing would not facilitate the fact-finding process and that no good cause has been shown for further action.

2. Service Complaint – No Manual of Rules Violation

Case No. 13-1153, Sofia Han a. Public Comment b. Staff Report c. Discussion d. Action

Complainant alleges that the Oakland police have failed to adequately respond to repeated calls regarding the burglary and of her home.

Rationale for administrative closure – This allegation is a service complaint, because the complainant is complaining about the level of service or lack thereof being provided by Oakland Police, and not about specific police misconduct which rises to the level of a Manual of Rules violation. The CPRB staff recommends administrative closure of this complaint on the basis a hearing would not facilitate the fact-finding process and that no good cause has been shown for further action.

3. No Jurisdiction

Case No. 13-1147, Broderick Huggins, Sr. a. Public Comment b. Staff Report c. Discussion d. Action

Complainant alleges that his son was shot and killed by Alameda County Sherriff’s Department officers during their patrol at San Leandro Boulevard and 34th Avenue. Complainant alleges that after making numerous requests, he and his family have not received police reports related to the incident. Complainant alleged that his son was shot over thirteen times and he did not believe that deadly force was necessary. Complainant also alleged that no one from the law enforcement community has contacted his family to discuss his son’s death.

Rationale for administrative closure – The CPRB investigator explained to Mr. Huggins that the CPRB only has jurisdiction over sworn officers of the Oakland Police Department. Oakland police officers were not directly involved in the incident. The CPRB investigator also told Mr. Huggins to re-new his requests for Public Records through the Oakland Police Department and Alameda County Sheriff’s Office so that police reports could be released to him when the investigation was concluded. Additionally, the CPRB investigator provided the contact information to the Alameda County Sheriff’s Office where Mr. Huggins could file a complaint against the Alameda County Sheriff’s Office personnel. The CPRB staff recommends administrative closure this complaint on the basis a hearing would not facilitate the fact-finding process and that no good cause has been shown for further action.

As representatives of the community, our goal is to improve police services to the community by increasing understanding between community members and police officers.
