BACKGROUND 1.1 Planning legislation entitles applicants to the right of appeal to Scottish Ministers in various circumstances. This right is most commonly exercised where the Council a) refuses an application b) grants an application subject to conditions c) fails to give notice of determination of an application within 2 months d) serves a notice under its enforcement powers. 1.2 Appeal decisions are of special interest to the Council as they represent an independent appraisal of Council decisions and may impact on policy. Of particular importance are those that are sustained (Scottish Ministers support the appellant rather than the Council). These may lead to amendment of policy. Those that are dismissed (Scottish Ministers support the Council rather than the appellant) affirm the validity of policy. As part of the City Plan Monitoring process, a detailed report on appeals was considered by the Development & Regeneration Committee on 20 October 2005. This highlighted particular appeal decisions impacting on policy which is being addressed in City Plan 2. It is intended that this annual review continues. 1.3 In addition to the annual report presenting a full review of a year’s appeal decisions, a need has been identified to advise members of the outcome of appeals on a more immediate basis – as soon as appeal decisions are received. This will provide members and other interested parties a more complete understanding of the final outcome of any decisions on applications that may have been taken, and allow members the opportunity to consider whether any further action, such as challenge by the Council of the appeal decision at the Court of Session, should be taken. 1.4 It is proposed that reports on the outcome of appeals be submitted to Committee when decision letters are received from Scottish Ministers. For dismissed appeals, where no further action by the Council is likely, a summary report on a monthly basis will be presented to Committee, unless there are particular decisions which need to be brought to the attention of Committee. Where appeals are sustained, or part sustained, it is proposed to report these individually, whenever received. 2. APPEAL DECISIONS 2.1 It is intended that new reporting procedure be established as soon as possible. In the interim, it is considered that it would be of assistance to members to note the outcome of appeal decisions received for the first half of this year. These are included as Appendix 1 to this report. 2.1 Table 1 below summarises the outcomes. Therefore, some of the planning appeals determined this year will relate to decisions that were taken last year. Nevertheless, to give an indication of the level of appeal activity, it is useful to advise members that approximately 1630 planning applications have been determined since the start of the year. This means that only 2.7% of planning decisions were appealed, and in only 1% of cases was the Council’s decision successfully challenged. 3. This leaflet tells you what this means for you and your local area between now and 2020. It sets out what local people told us their priorities were and what we plan to do in your community over the next five years. This leaflet covers the communities of Pollokshaws, Eastwood, Mansewood, Auldhouse, Shawlands and Crossmyloof. What you told us In developing this plan we engaged with tenants on their priorities during our customer conversations. We heard feedback on the need to continue to invest in our homes and communities, particularly for tenants who have not had external improvements due to sharing blocks with owners. Some tenants raised concerns about their neighbourhood, for example people wrongly believe there are higher levels of anti-social behavior. Other issues included the diverse range of people moving into areas/blocks since the new allocation policy was introduced. This was particularly the case for blocks which included many older people – for example the Cartcraigs multi and at Hillpark. This has been highlighted in our action plan. Better homes, better lives Other themes included environmental issues, soundproofing, repairs and maintenance, fuel poverty, rent levels and house sizes - particularly in Hillpark. Again, these issues have been prioritised in our action plan. Potential tenants told us during Housing Options interviews their priorities when deciding where they wanted to live included: • the condition of the house • safety and security • a clean and tidy environment • what the neighbourhood is like • the school catchment area and transport links • local connection to the area.

Background and Context 1.1 After decades of depopulation in areas across the city the population of Glasgow is growing again. Over the next decade the primary age population is predicted to rise between 13 and 18%. 1.2 The Southside of the city has over recent years benefitted from significant housing developments and the resulting increase in demand for primary school places. This increase is set to continue and will result in some imbalance between current capacity and forecast demand for primary school places unless changes to catchment areas are implemented.

CATCHMENT AREA – ALISTAIR HENDERSON Alistair Henderson had attended to talk about the catchment area and the consultation paper leading up to these changes. He apologised for the delay in feedback and left a copy of the report for our information. The report looked at the falling school roles within Holmlea, Simshill and Merrylee primary schools and the issue of refurbishment of these schools to bring them in line with current legislation, eg Disability Discrimination Act. The conclusion of the report was that Homlea and Simshill were to close and a new build for Merrylee was to take place at Friarton Road. As Merrylee was in the Hillpark Learning Community and Holmlea and Simshill within King's Park New Learning Community, the delineation of catchment areas became an issue. Alistair explained that after this consultation a Scottish Government consultation took place, which effectively meant that any future consultation proposed would cost around £20,000 per consultation. Therefore to propose changes to the catchment area to take account of the loss of feeder schools for King's Park alone would be too costly.

These include health visiting, health improvement, district nursing, speech and language therapy, physiotherapy, podiatry, nutrition and dietetic services, mental health, addictions and learning disability services. As well as this, we host a range of specialist services including: Specialist Children’s Services, Homeless Services and The Sandyford. We are part of NHS Greater Glasgow & Clyde and provide services for 584,000 people - the entire population living within the area defined by the LocalAuthority boundary of Glasgow City Council. Within our boundary, we have: 154 GP practices 136 dental practices 186 pharmacies 85 optometry practices (opticians) The CHP has more than 3,000 staff working for it and is split into three sectors which are aligned to local social work and community planning boundaries.

    King’s Park Secondary School Standards and Quality Report for Session 2009-10 1 About our King’s Park Secondary School, is a six-year non-denominational secondary school in King’s school Park Learning Community, in the South East Education Area of Glasgow. We work closely with our partner primary schools in Croftfoot, King’s Park and Mount Florida. Toryglen Primary School (partnered with Stonelaw High School, South Lanarkshire) is also part of King’s Park Learning Community. Following the closure of Holmlea and Simshill Primary Schools, and rezoning in 2005, pupils living in our catchment area who currently attend Merrylee Primary School retain the right to transfer to King’s Park Secondary without a placing request until 2012. King’s Park Secondary Parent Council are preparing a request for this right to be extended without limit of time, because the catchment area is geographically unusual, eg King’s Park Secondary School actually sits within the catchment area of Hillpark Secondary School. Approximately 13% of the pupils come from ethnic minority backgrounds. This percentage has been increasing steadily. Where necessary the pupils receive support from the teacher of English as an Additional Language. Three pupils are working at Langside College towards a qualification in English to Speakers of Other Languages (ESOL). The roll was 935 in September 2009 and is projected to be approximately 900 in September 2010. The roll is expected to continue falling until 2012, when the effect of the closure of Holmlea and Simshill Primary Schools will have worked its way from S1 to S6. In session 2009-10 the teaching complement was 67.8 fte including probationer teachers, plus an allocation for EAL, Alternatives to Exclusion and instrumental instructors.
