    Department of Veterans Affairs Office of Inspector General Healthcare Inspection Post-Operative Paralysis Overton Brooks VA Medical Center Shreveport, Louisiana Report No. 10-03462-190 June 8, 2011 VA Office of Inspector General Washington, DC 20420 To Report Suspected Wrongdoing in VA Programs and Operations: Telephone: 1-800-488-8244 E-Mail: [email protected] (Hotline Information: http://www.va.gov/oig/contacts/hotline.asp) Post-Operative Paralysis, Overton Brooks VA Medical Center, Shreveport, Louisiana Executive Summary The VA Office of Inspector General Office of Healthcare Inspections conducted an inspection to determine the validity of an allegation regarding post-operative paralysis at the Overton Brooks VA Medical Center (the medical center), Shreveport, LA. A complainant alleged that a patient could not move his lower extremities after the insertion of an epidural catheter (small hollow tube used to inject anesthetic between the spinal canal and spinal cord). The complainant believed that the catheter caused the patient’s paralysis. We did not substantiate the allegation. However, we found that the patient’s paralysis may have resulted from a prolonged period of hypotension (low blood pressure) in the intensive care unit (ICU). We concluded that the hypotension was poorly monitored and should have been treated more aggressively. During our review, we found that ICU nursing staff did not document required patient assessments. There was no documentation of the mean arterial pressures needed to adjust medications prescribed for low blood pressure, no documentation of the epidural catheter or of neurological assessments, and inconsistent documentation of verbal orders and administered medications. In addition, we found that the medical center’s system of reporting and evaluating adverse events needed improvement.

Oral argument is requested. To summarize the grounds for this Motion set forth in the accompanying Memorandum of Points and Authorities, the Board states as follows: 1. The actions of the Board are State actions that are immune from federal antitrust scrutiny under Cal. Retail Liquor Dealers Assn. v. Midcal Aluminum, Inc., 445 U.S. 97, 105-06 (1980). Louisiana law clearly articulates the intent to displace competition in the market for residential real estate appraisal fees by requiring enforcement of the obligation of Appraisal Management Companies (“AMCs”) to compensate residential appraisers at “customary and reasonable” (“C&R”) rates, and the State of Louisiana actively supervises the Board’s regulatory activities. 2. Under an Executive Order issued by the Governor of the State of Louisiana on July 11, 2017, the Board has repromulgated its C&R fee rule under newly-required active supervision of the Commissioner of Administration—who has authority to approve, reject, or modify the 1 PUBLIC Board-proposed regulation—in addition to supervision by oversight subcommittees of the Louisiana Senate and House Commerce Committees and the Governor. Through this active supervision, the State of Louisiana reaffirmed that the Board’s C&R fee regulation serves Louisiana’s policy of protecting the integrity of residential mortgage appraisals by requiring that AMCs pay customary and reasonable fees for such appraisals.

As you know, the energy industry is a major source of job creation in our country, providing employment to millions of our citizens and bolstering U.S. economic competitiveness. America was able to meet almost 90 percent of its energy needs last year—the most since March 1985—in large part because of increased domestic energy production. We take pride in the fact that domestic production largely powers America and increasingly other economies as well, helping to eradicate poverty and to provide political stability around the globe. Development of our resources has put more money in the pockets of working families and has helped the poor and elderly on fixed incomes, who can now more easily afford to run their air conditioning in the heat of the summer. For example, American natural gas production is reducing average retail electricity prices by 10 percent, saving households, on average, nearly $1,000 per year between 2012 and 2015. This significant accomplishment of increased U.S. energy independence, with its associated economic and health benefits, has been achieved largely by State policies—despite redundant and burdensome federal regulation. Your proposed rules for regulating greenhouse gas (GHG) emissions from existing power plants and redefining the Waters of the United States (WOTUS) would unnecessarily expand federal authority over the States in energy policymaking and risk undermining our success.
