BEFORE THE FEDERAL ELECTION COMMISSION In the Matter of) Philip Baker) MUR 621(78) Thurman Hamlin) William Taylor) George Tolhurst) Jack Watson) GENERAL COUNSEL'S REPORT Background On June 12, 1978, the Disclosure Division referred to the office of General Counsel the Kentucky candidates and committees which were published on May 20, 1978 as 10 Day Pre Primary Report non-filers. These reports were due on May 13, 1978. Reason to believe notices were sent on May 15, 1978 and reasonable cause to believe notices were sent on May 17, 1978. None of the candidates won the election. Evidence Philip Baker filed his 10 Day Pre Primary Report on May 22, 1978 which showed aggregate receipts and expenditures totalling $1615; however, no reports have been filed by the Baker for Congress Committee. Mr. Baker received 3.4% of the votes. Neither Thurman Hamlin nor his campaign committee filed a 10 Day Pre-Primary Report. Mr. Hamlin did send in a letter in March which stated that he had not received any contributions nor had he made any expenditures. Mr. liamlli received the reason to believe and reasonable cause to believe notices for both himself and his committee. Mr. Thurman Hamlin received 21.7% of the vote. -2- The William Taylor for U.S. Senate Committee filed on May 15, 1978 before publication. The aggregate receipts and expenditures totalled $1314. The candidate filed his report on May 22, 1978 which showed no receipts or expenditures. Mr. Taylor received 7.4% of the vote. George Tolhurst waived reporting on April 24, 1978. His committee filed the 10 Day Pre-Primary Report on May 24, 1978. The aggregate receipts and expenditures together equaled $23. 5.9% of the vote went to Mr. Tolhurst. Jack Watson, who received 11.2% of the vote, filed his report on May 16, 1978. On May 22, 1978, his campaign committee filed its reports. Mr. Watson received and expended $10,250. His committee received no contributions nor did it make any expenditures. Analysis None of the candidates had aggregate receipts or expenditures totaling more than $25,000. Also, none of the candidates received 30% of the vote. Recommendation It is recommended that no further action be taken at this time against Philip Baker, Thurman Hamlin, William Taylor, George Tolhurst, Jack Watson or their committees.
